Minutes 07-08-86MINUTES OF THE PLANNING & ZONING BOARD MEETING HELD IN COUNCIL CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA TUESDAY, JULY 8, 1986 AT 7:30 P.M. He introduced the members of the Board, Planning Staff and Recording Secretary. He recognized the-presence in the audience of Vice Mayor Carl Zimmerman, Councilman Ezell Hester, Councilwoman Dee Zibelli, City Manager Peter Cheney, and Owen Anderson, Executive Vice President of the Greater Boynton Beach Chamber of Commerce. READING AND APPROVAL OF MINUTES Minutes of May 21, 1986 Mrs. Huckle referred to Page 14 at the middle of the fourth paragraph where she was speaking ahd referred to the sentence that there have been no comPlaints so far about the owners renting out docks. She advised this is not correct about there being no complaints because she and her husband have complained to the city. Mr. Ryder moved to approved the minutes as corrected, seconded by Mr. Pagliarulo. Motion carried 7-0. Minutes of May 27, 1986 Mrs. Huckle moved to approve the minutes as submitted, seconded by Mr. Wandelt. Motion carried 7-0. Minutes of June 4, 1986 Mr. Ryder moved for adoption of the minutes of June 4, seconded by Mrs. Huckle. Motion carried 7-0. - 1 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACB, FLORIDA JULY 8, 1986 Minutes of June 5, 1986 Mrs. Buckle moved that the minutes be approved as submitted, seconded by Mr. Ryder. Motion carried 7-0. Minut_es of June 10, 1986 Mr. deLong referred to the next to the last paragraph on Page 2 where Mr. Cannon distributed a compilation of all the com- ments generated by the Board during workshop sessions on the Evaluation and Appraisal Report and corrected that all the comments were not included. Be subsequently had discussions with Mr. Annunziato and two items were missed. He suggests that it be changed to "most" of the comments. Mrs. Buckle moved to accept the minutes of June 10 with the corrections, seconded by Mr. Ryder. Motion carried 7-0. Minutes of June 16, 1986 Mr. Ryder moved to adopt the minutes of June 16 as prepared, seconded by Mrs. Buckle. Motion carried 7-0. ANNOUNCEMENTS Mr. Wandelt announced that he would not be present at the August 12 meeting, as he will be away on vacation. OLD BUSINESS Confirmation of list of proposed changes to the Evaluation and Appraisal Report and transmittal of the list and report to City Council Mr. Annunziato stated it was implied by the Board's action that the plan and recommendations were being forwarded to the City Council, although no formal motion was taken. However, two items were brought to his attention by Mr. deLong, one was a public hearing comment and the other a comment made by Mr deLong at the workshop meeting. ' Rezoning Request for Property East of N.E. 7th Street and South of N.E. 10th Avenue Mr. Annunziato continued that the public hearing item was a request by a property owner of land located east of N.E. 7th Street and south of N.E. 10th Avenue for that area to be - 2 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 placed into a high density residential category. It is the staff's opinion this request is somewhat premature and the effects of that request should be evaluated. We do not think it is appropriate for a change for one property owner without evaluating the impact to the single family homes in the area. Mr. deLong, referred to this being surrounded by high density and Mr. Annunziato disagreed and explained. Mrs. Huckle added that she looked at the area and it is not near being encroached by high density. Mr. deLong referred to there being existing multi-family in this area and Mr. Annunziato informed him that has probably been there for twenty years or more. Mr. deLong referred to there being local retail below there and Mr. Cannon replied it is CBD and explained the zoning of the adjacent parcels. Mr. deLong moved to grant this request and zone the property R-3, seconded by Mr. Pagliarulo. Vice Chairman Winter clarified that it would be a change from R-lA to R-3. Motion denied 5-2 with Mr. deLong and Mr. Pagliarulo voting in favor. Rezoninq Request for Old Dixie Hi~hwa~ Mr. Annunziato stated the second item concerned a recommen- dation worked out with Palm Beach County for the properties between Old Dixie Highway and U. S. 1. There is an old single family subdivision on the bend of Old Dixie Highway. The recommendation was to have retail/commercial along U. S. 1 and general commercial to the south with the residential area remaining. The county supported that recommendation. It was discussed at the workshop meetings that perhaps the property owners may receive some relief with putting the residential properties in a commercial category. Mr. deLong added that this is the area with some real dilapi- dated, rundown homes. He understood that Mr. Annunziato was going to rezone the whole area to C-4. He told about the com- mercial businesses in this area. His opinion is if we don't relieve the home owners with a chance to recoup any values, that it is a disservice to them. He feels those houses and mobile homes should be zoned C-4. He thinks we have the obli- gation to those private property owners to give them the opportunity to sell their property as commercial property. Mr. Annunziato stated the Planning Department would not recom- mend that the residential areas be placed into a commercial category. Piecemeal development of small lots does not work - 3 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 commercially. The houses would deteriorate quickly. He agrees there are some dilapidated houses, but he saw some signs of investment with houses getting new roofs, being painted, etc. He thinks improvements can be made with code enforcement. There was further discussion about the C-4 zoning uses south of this area and Mr. Annunziato concluded that he did not think the county would accept a commercial zoning for the residential property. Mr. deLong suggested finding out and stressed home rule. Mr. Annunziato continued that an attempt to redevelop commer- cially seldom works without unified control. There are approximately 80 residential properties in question. The potential for successful commercial redevelopment is negli- gible. Mr. deLong disagreed and pointed out that two or three lots run from Federal to Dixie Highway. Mr. Annunziato informed him the single family lots are 50 x 100 feet. Mr. Wandelt asked how many people requested this zoning change and Mr. deLong replied that none did at the meetings, but we are making a change there and should consider this. Mrs. Huckle referred to none of this residential property being in the city and Mr. Annunziato agreed that it is not, with the exception of the trailer park further south. Mrs. Huckle clarified that the suggestion was to make the recommendation that if and when this comes into the city, it will be zoned commercial and Mr. deLong agreed. Vice Chairman Winter commented that he thinks it would be a disservice to the residents to change it without hearing from them. Mr. deLong moved to table this and contact the residents to see how they feel. Mr. Winter asked how this would affect the Comprehensive Plan and Mr. Annunziato replied that it becomes a legal question whether the plan has been forwarded to the City Council. Mrs. Huckle suggested considering this at another time after having the chance to study it. Mr. deLong remarked that properties are rezoned all the time and many times, people don't realize it is rezoned until later. Mr. ~eLong made a motion that if the commercial codification is going to prevail that the entire area including the resi- dential be rezoned to commercial Motion died for lack of a second. ' - 4 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 Review of Changes to the Evaluation & Appraisal Report. Mr. deLong referred to (2) Monitoring of Development Regulations on Page 1 and stated he wanted to be sure the major problems of performance do not become construed to mean this city will come into the position to approve workmanship or materials. Workmanship cannot be monitored. Also, he doesn't intend that the Building Department is going to be taken out of checking building and construction regulations by the city staff. Mr. Annunziato advised this is language which the Board passed on in motion form. Mr. deLong made a motion to reconsider. Mr. deLong continued that the Building Department conducts an ongoing inspection system and this is redundant. He questions whether we are taking anything away from the Building Department or duplicating their efforts. He does not want additional payroll to be considered to have a staff go out and duplicate the effort or look at workmanship or material. Mr. Schultz referred to the recommendation stating the City should "begin" to regularly and systematically monitor the performance of all of its land development regulations and clarified that the Building Department has been active for many years. Does this mean to organize a separate department to monitor the Building Department? Mr. Annunziato explained how the city staff monitors different sets of regulations. He clarified that this is suggesting there be a systematic approach to evaluating the land development regulations that the City is involved in. Mr. Schultz pointed out this refers to the building codes and not land development, which is under the Building Department. He added that problems with the building code are handled once a month by the B.O.A.F. meetings. Mr. Annunziato agreed, but explained that the Building Department does not review all land development regu- lations. Further comments were made about the implication of this paragraph and Mr. Schultz told about the Building Department dOing an outstanding job. Mr. Ryder clarified that it was not implying they are not doing their job and Mr deLong disagreed. · Mr. deLong made a motion to reconsider, seconded by Mr. Schultz. Mr. Wandelt questioned what was being reconsidered and Mr. Schultz replied to reword this to put the authority within the Building Department for building construction. Mr. - 5 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 Ryder commented that was unnecessary. Motion failed 4-3 with Mr. Pagliarulo, Mr. deLong and Mr. Schultz voting in favor. R-2 and R-3 Building Setbacks Mr. deLong referred to the setback being greater for R-3 zoning as sometimes the building is three or four stories and stated he didn't believe that made sense. Why do we encourage development of duplexes on R-3 lots when this City needs affordable housing? He does not see any problem with reducing the setback from 40 feet to 25 feet for R-3 zoning. Mr. Annunziato replied that if there was going to be this amendment, it would be a zoning ordinance amendment and not the Comprehensive Plan. He explained how there are different ways to deal with height such as a sliding scale. It has been the pattern around Boynton Beach to go to 40 feet front and rear setbacks which have not presented a problem. Mrs. Huckle added if there were more than one or two of the same type of buildings in the same area, it would be congested without ade- quate setbacks and Mr. Annunziato agreed and added that generally people park in front of multi-family buildings, there has not been a problem, so Mr. deLong referred to a 100 ft. deep lot being zoned R-3 and how it would be difficult to meet the setbacks. He concluded that this should be discussed as a zoning code amendment. D_~ Care Centers Mrs. Huckle referred to our requirements for day care centers being according to state law and Mr. Annunziato agreed. Mrs. Huckle pointed out that it did not state that in the paragraph on Page 4. Mr. Annunziato suggested that it be amended to read day care centers will be permitted consistent to state law and Mrs. Huckle agreed. Mrs. Huckle moved to amend Item 11 on Page 4 and Mr. Annunziato advised this could be done without a motion. Mrs. Huckle referred to a motion being made in the previous minutes which have not been received and Vice Chairman Winter suggested reconsidering and making the change. Mrs. Huckle moved7-0. to reconsider, seconded by Mr. Ryder. Motion carried Mrs. Huckle moved to change the verbiage to reflect that day care centers shall be allowed in single family zoning districts in accordance with state law. Mr. deLong seconded and the motion carried 7-0. - 6 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA Page of Credits JULY 8, 1986 Mrs. Huckle requested that Marty Trauger be listed as Chairman on the Page of Credits. Expanded C-2 Zoning District Mr. deLong stated in regard to Page 5, the expanded C-2 zoning district uses are to be submitted to the Planning & Zoning Board and Mr. Annunziato agreed. M-1 Zoning Uses Mr. deLong referred to certain businesses being allowed to open retail outlets in M-1 zoning and questioned if it was being discriminatory by not allowing a food processing company to open a restaurant. Mr. Annunziato informed him when the M-1 regulations were redrafted, the permitted uses were expanded. Retail use was not permitted. Every industrial use was considered to evaluate the impacts and specific business requirements. He explained how the retail uses referred to are essentially like warehouses, but a restaurant is substan- tially different than a warehouse with different land use characteristics. It can be considered if the Board desires. Mr. deLong suggested possibly considering a light industrial classification. Motion to Transmit List & Report Mr. Wandelt moved to confirm the Board's previous action as amended by the language in the day care centers and transmit to the City Council. Mr. Ryder seconded and the motion carried 6-1 with Mr. Schultz dissenting. SITE PLAN PROJECT NAME: AGENT: OWNER: LOCATION: DESCRIPTION. Boynton Square Shopping Center Edward Duggan, HSW Investments Harold S. Wenal, Trustee Congress Avenue at Old Boynton Road, southeast corner Request for site plan approval to construct a 178,760 square foot shopping center including a super- market, a home improvement store and 4 outlots on 15.22 acres - 7 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 Mr. Golden informed the Board this item was before the Board at the June meeting. The Planning Department recommended it be tabled as a result of the quantity of staff comments. The applicant has revised the site plan incorporating most of the staff comments. Mr. Golden explained the location and pointed out the number of driveways on Old Boynton Road has been reduced. He explained the parking lot modifications and gave a brief description of the architecture and design. He referred to a landscaping tree management plan being presented and told about other landscaping proposed for screening. The Technical Review Board recommends approval subject to staff comments. Mr. Ed Duggan came forward and Mrs. Huckle asked if another name for the center had been considered. Mr. Duggan advised they are in the process of addressing a new name. Mr. Ryder asked if there were any problems with the staff comments and Mr. Duggan replied there were none. Mr. Schultz questioned how staff comment #3 from the Planning Director would be taken care of and Mr. Duggan informed him the parapet wall would be extended high enough to conceal the air conditioner. Mr. deLong made a motion subject to staff comments that we approve this site plan as submitted by the applicant. Mr. Ryder seconded. Under discussion, Mr. Pagliarulo referred to questioning the double turn exiting and Mrs. Huckle informed him that was addressed in the presentation with two going out and7-0. agreement was reached at the last meeting. Motion carried NEW BUSINESS PUBLIC HEARINGS ANNEXATION PROJECT NAME: AGENT: OWNER: LOCATION: DESCRIPTION: City of Boynton Beach Public Rights-of-Way Annexation City of Boynton Beach Palm Beach County See attached Municipal annexation of public rights-of-way located in unincorpor- ated areas adjacent to city limits - 8 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA Mr JULY 8, 1986 by' Annunziato informed the Board thi is a request submitted .staff to annex public rights-of-wa~ adjacent to the City. Mr Cannon pointed out the rights-of-way while Mr. Annunziato described the sections of Gulfstream Boulevard, Federal Highway, Hypoluxo Road, and Winchester Park Boulevard. He added that these fill up holes in the right-of-way system. He pointed out there are costs to the City identified in terms of landscaping and police enforcement, but it is recommended these rights-of-way be annexed because it reduces the con- fusion associated with police enforcement. Mrs. Huckle questioned Mr. Shelhamer,s comments stating only Winchester Park Boulevard would be the City,s responsibility and Mr. Annunziato explained the county and state would be liable for maintenance of certain roads even though they are located in the City. Vice Chairman Winter received no response when asking if anyone wished to speak in favor or against this application. He then declared the public hearing closed. Mr. Ryder moved to approve this proposed annexation of the various public rights-of-way, seconded by Mr. Wandelt. Under discussion, Mrs. Huckle stated that she very much respects all the Technical Review Board recommendations, but she personally has trouble with all the expense going to be involved, especially with comment No. 2 from the Police Department. Mr. Annunziato agreed there is no question there is cost associated, but in this instance it appears the Police Department is responding in any case and the expense is already there. Mrs. Buckle referred to the landscaping and maintenance of the medians being expensive and asked if there was a way to have these areas and not put much money into it and Mr. Annunziato replied the landscaping could be omitted, but that would be a budgetary decision. Motion carried 7-0. CONDITIONAL USE PROJECT NAME: AGENT: OWNER: Girtman Day Care Center Douglas R. Root, A.I.A. Slattery and Root Architects Eroyn and Blanche Girtman, Trustees - 9 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 LOCATION: DESCRIPTION: Seacrest Boulevard at N.E. 5th Ave., northeast and southeast corners Request for Conditional Use approval to construct a 4,400 square foot day care center to serve a maximum of 89 children on .71 acres Mr. Golden explained the location and pointed out that addi- tional parking will be provided on a separate parcel. A maximum of 89 children can be accommodated based on state requirements. He advised this is zoned R-2 and currently is vacant and told about the surrounding land uses and zonings. He told about the structure of the proposed building and outdoor recreation area. In regard to standards for eva- luating conditional uses, the project conforms to the stan- dards listed. Mr. Golden then explained the parking lot layout and how adjustments were made to relocate the dumpster, preserve the Pine Trees, and make access revisions. Mr. Golden referred to the Comprehensive Plan policies and explained how this was in conformance with it being private development of a vacant lot. He read a stipulation from the E & A Report in reference to day care centers. Mr. Golden concluded that the Planning Department recommends this proposed use would be compatible with the surrounding neighborhood and is consistent with the Comprehensive Plan. Approval is recommended subject to staff comments and recommendations. Mr. deLong questioned the number of parking spaces and Mr. Golden pointed out the location of a total of 22 parking spaces. Mr. deLong asked if there was a square footage requirement per child and Mr. Golden referred to there being state guidelines and Mr. Root added that 35 square feet in interior and 75 square feet in outside activity area per child is required. Mr. Douglas Root introduced Mrs. Blanche Girtman and Mrs. Angela Girtman and told about their experience and qualifi- cations for running this facility. Mr. Annunziato read the staff comments. Mrs. Blanche Girtman replied that she has read these comments and has no objections. - 10 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 Vice Chairman Winter ascertained nobody wished to speak in favor of or in opposition to this application and then declared the public hearing closed. Mr. Ryder moved that the Board approve the conditional use of the Girtman Day Care Center with staff comments, seconded by Mr. Schultz. Under discussion, Mrs. Huckle congratulated Mrs. Girtman for this marvelous concept and much needed facility. She is aware of Mrs. Girtman's qualifications and is sure this will be a fine addition and great service to the City. Mrs. Blanche Girtman came forward and stated she is deeply appre- ciative and thanked the Board for considering this. She advised she has been working with children for 44.64 years of her life. In retirement, she cannot get away from it and it is her dream of her life to open such a school. Motion carried 7-0. SUBDIVISIONS PRELIMINARY PLAT PROJECT NAME: Rollingwood AGENT: Patricia F. East side of Congress Avenue, south of Hypoluxo Road Request for site plan approval to construct 102 multi-family dwelling units plus landscaping at Plat 3B and 3C of the Boynton Lakes Planned Unit Development - 11 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 Mr. Golden explained the location. He advised the townhouses proposed are identical to the previous plats with the only difference having the front yard setback reduced from 25 feet to 20 feet to allow for the flexibility for screen porches. With regard to utilities, both plats are platted and bonded for adequate utilities. The Technical Review Board recom- mends approval subject to staff comments. Mrs. Huckle asked if these would be rental units and Mr. Jeff Hopper, Vice President of Lennar Homes, informed her they would be fee simple units, the same as the other units in Boynton Lakes. Mrs. Huckle questioned the price range and Mr. Hopper replied they would be from $62 000 to $70,000 depending upon location. ' Mr. Annunziato read the staff comments and Mr. Hopper replied there would be no problems. Mr. deLong made a motion that this application be approved subject to staff comments, seconded by Mr. Pagliarulo. Motion carried 7-0. PROJECT NAME: AGENT: OWNER: LOCATION: DESCRIPTION: Meadows 300 PUD Tract G - (Club Meadows Phase III) Jeff H. Iravani, P.E. Wilshire Corporation West side of Congress Avenue, South of Hypoluxo Road Request for site plan approval to construct 170 multi-family dwelling units plus landscaping at Tract G of the Meadows 300 Planned Unit Development Mr. Golden explained the location, showed the elevation and explained the materials. He pointed out the access to this tract. He added that adequate utilities are available to service this development; however, the Utilities and Planning Departments are requiring additional easements to be dedicated to serve the property to the north. The Technical Review Board recommends approval subject to staff comments. - 12 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 Mr. Iravani stated that he is in complete agreement with the staff comments. Mrs. Huckle referred to the comment from the Chief Plan Reviewer about the end units not showing 750 sq. feet living area and Mr. Iravani informed her that he met with Mr. Donovan and they do have the 750 square feet. Mr. Schultz questioned the type of construction and Mr. Iravani informed him it will be Type V, CBS. Mrs. Huckle referred to these being rental units and Mr Iravani agreed they would be. ' Mr. Ryder moved to approve this site plan for the Meadows 300 PUD Tract G, subject to staff comments. Mrs. ~uckle seconded and the motion carried 7-0. PROJECT NAME: AGENT: OWNER: LOCATION: DESCRIPTION: Seagate Service Center Thomas E. Brandt Thomas E. Brandt George A. Von Essen Approximately 200 feet east of the Thor Drive dead-end, south of the L.W.D.D. L-29 Canal Request for site plan approval to construct a 43,180 square foot com- puter disc-drive repair facility on 4.42 acres Mr. Annunziato requested this to be deleted until the next meeting. SITE PLAN MODIFICATIONS PROJECT NAME: AGENT: OWNER: LOCATION: DESCRIPTION: The Grove Shopping Center Goldenholz-Fischer Architects and Planners, P.A. Grove Partners Limited c/o Coastal Resources Development Corporation Federal Highway at Old Dixie Highway, west side Request for approval of an amended site plan to allow for an expansion of the previously approved shopping center, including an 11,431 square foot (877 seat) cinema, a 23,100 square foot junior department store and a change in parking lot layout and design. The applicant is also requesting approval of a shared parking allocation. - 13 - MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 Mr. Golden informed the Board the modifications were to add a cinema in place of some general retail and a junior department store in the northwest corner to replace the drug store. The result is an overall increase of 4,138 square feet. There is also a request for a shared parking alloca- tion for the cinema. The Planning Department recommends the shared parking allocation be approved, as the applicant has provided evidence for shared parking and a 10% buffer. A revised traffic analysis was submitted and no additional improvements are recommended. The applicant has also substantially redesigned the shopping center which is an improvement over the p~evious design. He then showed an overlay and ~ing of the proposed shopping center and and construction. The Techical Review Board recommends of this site plan modification including the sh~ parking allocation subject to staff comments. Mr. Ryder suggested having an approach to the shopping center in line with the angle on Dixie Highway. After giving this consideration, Mr. Annunziato clarified the suggestion was a continuous right-hand lane. He recommends this be left to the discretion of Palm Beach County and the Department of Transportation. Further comments were made expressing possible agreement to this suggestion. Mr. Bob McIntire, Goldenholz-Fischer Architects & Planners, came forward. Vice Chairman Winter asked if he read the staff comments and Mr. McIntire replied affirmatively and added that he didn't see any problems at all in complying with any of them. Mr. Ryder asked if he had any comment about the suggested approach from the north and Mr. McIntire replied that he thinks it will wOrk and will present it to D.O.T. Mr. Schultz referred to the Planning Director,s recommen- dation in reference to cooler locations and questioned the method being used to screen the noise and Mr. McIntire explained there would be a parapet continuous all the way around the roof to screen the air conditioning units and if the perimeter fence is not sufficient for the ground - 14- MINUTES - PLANNING & ZONING BOARD BOYNTON BEACH, FLORIDA JULY 8, 1986 coolers, they will be screened with a masonry block wall. Mr. Schultz suggested that a noise screen be considered. Vice Chairman Winter questioned whether the width of the rear service drive was sufficient and Mr. McIntire explained that it is one way and wider at the corners and the Fire Department expected no problems for a fire truck. Vice Chairman Winter referred to it being a long distance to be one way and Mr. McIntire replied that Winn-Dixie has approved, but the loading docks were adjusted for the semi- trucks. I discussed the changes with the landscape architect 'a~d felt it would be advis- able to show how any of the proposed ch~'nges would affect trees as outlined in the plan. An addendum would be submitted to the plan showing the trees affected. The newly installed landscaping would also be affected and should be addressed on the landscape plan. The tree management plan will remain i.ntact and reflect the ~approved changes. / Also, there should be a 2½ foot landscape strip behind the Junior Department Store. Ail landscaped areas should be protected in the parking area with a six inch non-mountable curb.
