Chairman Ryder called the meeting to order at 7:30 P. M.,
welcomed everyone, and introduced the Members of the Board,
Mr. Annunziato, Mr. Cannon, Mr. Golden, and the Recording
Secretary. He recognized the presence in the audience of
Councilman James R. Warnke. Chairman Ryder commented that
the Board had competition tonight from the Boynton Beach
Mall, which was having its opening. The City Council, City
Staff, and the Board Members had been invited to attend.

Mr. Annunziato explained that there are two problems with the
street n~ames. They are flower names and some are difficult to
pronounce. The real problem is that some of them are duplicated
in other areas of the City and County.
It was Mr. Kiviniemi's understanding, that these names were
previously approved. A representative of Boynton West
Corporation entered the room, and Mr. Kiviniemi said the question
should be referred to him. Mr. Kiviniemi stated that they want
to keep the flower names.
Mr. Annunziato suggested that they keep the flower names and
change the names of those that are difficult to pronounce and
those which are duplicates of existing streets. The man
from Boynton West Corporation indicated that was all right.
Mr. deLong moved, seconded by Mr. Pagliarulo, to approve the
preliminary7-0. plat, subject to staff comments. Motion carried

Mr. Annunziato advised that staff recommended this item be
tabled in order for the applicant to provide a traffic analysis
with respect to entry and exit from the site. He drew
attention to his Memorandum of October 2, 1985 and said the
applicant concurred with the recommendation.
Chairman Ryder said there was concern here about access on
Boynton Beach Boulevard. Apparently, the recommendation was
for one way going eastward. It appeared to him to. be so
close to the on ramp going south on 1-95 that it would pose a
problem. Mr'~Annunziato agreed that it was part of the
problem. The second problem is westward bound traffic. There
are only two lanes of through traffic ~there, and. there is~ a
median cut which he believed served 7th Street. It did not
look like there was an opportunity for a left turn lane west-
bound. Mr. Annunziato said the Department of Transportation is
preparing to make some median modifications in this area in the
future, so he suggested that the applicant have his traffic
expert take a look at what DOT is planning and the turning move-
ments in the area to arrive at some conclusions that will allow
for a safer, site.

As the building was initially approved on the west side, there
was the potential for a drive-thru window for a bank. Mr.
Annunziato said they have not signed up any banks for any
leases a~ apparentl~ do not intend to so the area where the
drive-thru'was supposed to be is now to be just a parking lot.
Mr. Annunziato talked to the applicant this afternoon and
asked if he had any concerns about the project. The applicant
told him he was aware of the staff comments and was going to
accept them.
Mr. deLong moved that the site plan modification be approved,
subject to staff comments from the Planning Department. Mr.
Winter seconded the motion, and the motion carried 7-0.

Mr. Annunziato told the Members the applicant is proposing to
construct an access road from the southwest corner of his
property westward to Congress Avenue. This would be south of

Mr. deLong asked how many feet it would be from the intersection.
Mr. Annunziato estimated it would be about 300 feet.
John F. Wheeler, Engineer, Caulfield & Wheeler, Inc., 2290 N. W.
2nd Avenue, Suite 3, Boca Raton, Florida 33431, appeared as
Agent and explained to Chairman Ryder that this was an ease-
ment that was granted when the property was purchased by his
client. There was discussion about the construction.
Mr. Wheeler agreed with all of the staff comments but with
reference to the comment from the Planning Department asking
that they dedicate an additional ten feet of right-of-way for
Congress Avenue, he said they do not actually own the property.
Unfortunately, this was the first time he saw this in the
comments, and they had not addressed that. He did not know
what the owners would do. Mr. Annunziato suggested that they
arrive at a conclusion between now and next Tuesday, October 15,
and let his office know. If there is a problem, it can be
addressed before the Council meeting. If it is impossible,
and their lawyers and the City lawyers think it canno~ occur,
maybe it cannot be addressed before the Council meeting.

If it is something that can happen, Mr. Annunziato said it should
happen, because C°ngress'Avenuewill.berecons~cted in this area
within a year._
Mr. Annunziato showed Mrs. Huckle that the additional 10 feet
will be where the driveway intersects with Congress Avenue and
said the westerly ten feet of it will be right-of-way for
Congress Avenue. He explained that they have an easement right
to the property, and the applicant was saying he did not have
fee title but an easement right. If the applicant can work out
the easement agreements with Lindsley Lumber between now and
next Tuesday, October 15, they can dedicate the right-of-way.
Mr. Arthur C. Caruana, 2400 S. W. 19th Avenue, Cedarwood Villas,
stated he is a resident immediately adjacent to where the road
will be built. The rear of his home and seven others face this.
Mr. Caruana informed Chairman Ryder it is 40 feet away from his
house.and is immediately on the lot line.
Mr. Caruana was speaking for himself but told Mr. deLong he had
conversations about this particular problem with the seven other
homeowners. He wanted it to be made a matter of public record
that the group, as a whole, .is very suspicious of this builder
who started construction on the road before any permits were
issued. The builder basically created a nuisance in the area
with heavy machinery, dirt that was created and trees that
were torn down. ,
Mr. Caruana was here to determine what the purpose of the road
would be now and in the future and the construction sequence
of the road. He understood a. six foot high masonry wall would
be constructed. Mr. Caruana asked if the road would be used
temporarily for construction purposes to bring construction
material, trucks, etc. into the property.
Chairman Ryder asked if you could clear a site without a per-
mit as long as you do not fill it. Both Mr. Annunziato and
Mr. Wheeler answered, "No." Mr. Whseler said the contractor
had cleared it without approval, was ultimately red tagged,
and contacted them to try and make it legal. Apparently, the
contractor had assumed the access road had been approved
previously.
Mr. Annunziato said there is a real desire on the part of the
neighbors to have the wall in place as a means to protect them
before the road construction commences. Mr. Caruana concurred
that this was one of their desires. Mr. Annunziato advised
that it was in the purview of the Board to make that recommenda-
tion to the City Council and said it would offer some protection
to the property owners to the south. Mr. deLong could see the
wisdom of doing that but said he certainly would not require
that it be finished until they are through with the road
construction. Mr. Annunziato agreed.

Mr. Caruana said they were interested in seeing that the road
is not used for construction purposes. When they originally
started clearing the site, trucks were going back and forth
through the road. If the Board gives them permission to put
the road through, Mr. Caruana said they will start using it
immediately as an access to the construction site to bring
equipment, trucks, and materials through there. He did not
think they would have any argument about the road being used
for the new building, parking purposes, etc. but d~d not want
their site to face on the construction of the building.
Mr. Wheeler informed the Members that they have started the
footings for the wall on the east side of the property along
the canal, so he assumed they would just keep going with the
wall all the way to Congress.
As everything would be coming from Woolbright now, Chairman
Ryder though~ apparently, there would be no problem. Mr.
Wheeler imagined they would come in off of Woolbright. He
imagined the parking lot and road would be done at one time.
Mr. Annunziato suggested that the applicant be required to
use the Woolbright Road entrance for his construction equipment
except in the instance of the construction of the road itself,
which would have construction equipment on it. He thought
the Board could also recommend that to the Council.
Mr. Wandelt complained that heavy equipment is parked in
front of the Sun Bank and sometimes interferes with the
customers. Other than that, they are getting along fine and
he said he understands. ,
Mr. Wheeler was worried about saying no construction traffic
can use Congress Avenue and was not sure that some sub-
contractor might have to come in that way. Mr. Caruana did not
want to open the door to having construction traffic come
through that road before it is finished for the purpose of
putting up the building because everybody will try to use it.
They have already experienced damaged floors and tile from
throughvibrations there, in the houses as a result of heavy equipment going

it. Mr. Caruana wondered if that meant their maintenance would
have to come on his side to cut the grass. Mr. Annunziato
answered that they would come out of their side and have two
feet to cut their grass on their property. Mr. Caruana asked
if it would be possible for Cedarwood Villas to maintain it
rather than having an outside party come in. Mr. Annunziato

advised that was something they would have to work out with the
owner of the property, but the owner would probably love to
have them maintain that two feet.
Mr. deLong moved to approve the site plan modification, subject
to staff comments~.and with the recommendations that the wall be
in place prior to the road construction and that, when possible,
construction equipment use Woolbright Road. Mr. Pagliarulo
seconded the motion, and the motion carried 7-0.
Several months ago, Mr. deLong was apprehensive about Boynton
Beach becoming the "Wall City of Jerulsalem." He referred to
all of the six foot walls going up and thought they should
consider alternative methods like natural barriers for the
aesthetic values. The only place where Mr. Annunziato knew
the Code offered an alternative was in the C-1 cat~egory, which
allows the substitution of a hedge for a wall. The Ordinance
has been in effect since 1976 and was the desire of the City
Council, although it may be something this Council may want to
reconsider. Mr. Gregory asked what mechanism they could use to
theget minutes." it to the City Council. Mr. Annunziato answered, "Through
Chairman Ryder and Mr. Wandelt brought up the matter of natural
barriers sometimes not being maintained.

2. Project Name: Catalina Club - Commercial Development

Mr. Annunziato informed the Members that Staff recommended this
be approved. Ira A. Martin, Project Engineer, R. Sheremeta
Associates, Consulting Engineers, 101 S. E. 6th Avenue, Suite F,
Delray Beach, Florida 33444, said Mr. Thomas McMurrian of Ocean
Properties was to be here to represent Walboyn.
Mr. Annunzia~o determined Mr. Martin was aware of the staff
comments from the Engineering Department and called attention

to the third comment contained in the Memorandum from Tom Clark,
City Engineer, dated September 30, 1985. The comment recommended
only one connection to the private access road. Mr. Annunziato
added that at the time, this was a matter of zoning. It was
agreed uDon by the Council that there would be no more than five
or eight connections, which was many more than what Mr. Clark
was recommending. Mr. Annunziato did not know how Mr.. Clark's
recommendation fitted into that scheme of things.
Mr. Annunziato clarified for Mr. deLong that Mr. Clark was
recommending that there be fewer connections than the applicant
was requesting. At the time of zoning, Mr. Annunziato believed
this was the subject of a variance, and he thought the applicant
was given no more than eight connections, but it was substantially
more than what Mr. Clark was recommending and more than the plan
provided for.
Given the fact that they had a Council policy in this matter,
Mr. Annunziato was not sure What the Board could do with Mr.
Clark's comment. Chairman Ryder recalled this was a matter of
rezoning, and he recollected that the Planning and Zoning Board
recommended denial of rezon±ng from residential to commercial.
The Council subsequently approved it. Chairman Ryder still did
not like it and thought it was a mistake.
Because a Council policy was in place, Mr. Annunziato recommended
that' the Board go with the Council policy unless told otherwise
by the Council. He recommended that the Board approve it with
the suggestion that the third comment of Mr. Clark's memo be
deleted because it was not applicable in this instance.
Mr. Annunziato was not downgrading the quality of Mr. Clark's
comment because he thought Mr. Clark was right but, at this
point, it was not an issue:. He informed Mr. deLong that the
issue was that the number of connections to this accessway
drive was determined by the Council at the time of zoning and
it exceeded one. '
Mr. deLong pointed out that they have a major commercial project
there with a convention center and a hotel, and he did not think
they should "buck" the Council. His observation was contrary
to Chairman Ryder's as he thought there was tremendous encourage-
ment for residential in an area that was basically conducive
for commercial development.
Mr. Cannon informed Mr. Gregory that designated as commercial
are about another four million square feet of retail space in
the City and he believed about an equal amount of office space.
Chairman Ryder's point was that whe~ you are considering rezoning
residential to commercial, something is happening to the
Comprehensive Land Use Plan, and he explained.

Mr. deLong arqued that this was the pattern they established on
Congress Avenue, and the pattern has existed. It seemed to
him the Council had made a commitment and he felt they should
either make a commitment, stay with it, and solve the problem,
or should not make a commitment to begin with.
Mr. Gregory thought the area certainly needed what these
people were ~lanning and thought the Council, in their wisdom,
saw fit to allow more than one connection.
Mr. Gregory moved that the master plan be approved, subject to
staff comments, and with the third paragraph stricken from Mr.
Clark's Memorandum of September 30, 1985. Mr. Pagliarulo
seconded the motion, and the motion carried 6-1 with Chairman
Ryder voting against the motion.

Mr. Wandelt asked if they could not go ahead and approve it,
subject to staff comments. Mr. Annunziato thought they could.
He knew the applicant was aware of the comments because he
spoke to him about them on Friday, October 4, 1985, although
he could not understand why he was not here tonight.
It seemed to Chairman Ryder that they could do the internal
treatment of the parking area internally. This discussion
occurred at the Technical Review Board meeting, and Mr.
Annunziato said it was his decision that the applicant could
accomplish what the variance would provide on site by just
having less building, but the Technical Review Board felt the
circulation was enhanced with the three driveways.
Since there was a problem, Chairman Ryder suggested this be
thepostponed, staff comments. Mr. Winter asked why they could not go ahead with
As it was a public hearing, Mr. Annunziato read the staff
comments into the record and said the Technical Review Board
recommended approval of the variance request, subject to the
comments.
Chairman Ryder asked if anyone wished to speak in favor or in
opposition to the request, and there was no response. THE
PUBLIC HEARING WAS CLOSED.
Mr. Annunziato called attention to the site plan and told the
Members they are long east/west oriented warehouses with doors
on the north and south sides of each building. The distance
between the street and the front of the buildings is the
drainage easement. The drainage easement can be bridged for
driveways, and the applicant desires to do this. Instead of
having two driveways, which is the limit imposed by the park-
ing regulations, the applicant is requesting three driveways,
which would give some enhanced circulation to the center core.
That and probablY the lack of traffic was probably enough for
the TRB to recommend that it be approved They have 315 feet
of frontage. -
Chairman Ryder thought they could do without the center drive-
way by internal movement. As they come in, they could provide
for it. Mr. Annunziato asked if Chairman Ryder was suggesting

that instead of having the westerly 30 or 35 feet of building,
that they put a driveway there. Chairman Ryder was not
suggesting anything, but it appeared to him that they ought to
be able to manage with two driveways.
Mr. Wandelt asked what would be involved if theyl moved the
buildings. Chairman Ryder said they could do that or they
could have the turning movements.
If the Board desired not to approve the variance, Mr. AnnunZiato
recommended that a north/south driveway be provided adjacent to
the easterly side of the drainage easement to give circulation
around all of the buildings and to connect all three drives.
Mr. Cannon showed on, the overlay where the driveway would be.
Chairman Ryder noted that they would have that access
internally rather than having to use the street for that kind
of movement.
Mr. Gregory commented that it might not be cost feasible on
the project, and the Members did not know what was involved.
Considering where the site is located, Mrs. Huckle saw no
problem with three drives. Chairman Ryder said if the Members
wanted to give the applicant a chance to be heard, they cOuld
still table the matter.
Mr. Annunziato informed Mr. Wandelt that the distance of the
drainage easement north and south is 315 feet. Mr. Wandelt
meant the'~di~tance between the drives. Mr. Annunziato
estimated it was about 200 feet, more or less. He told Mr.
deLong he did not make that north/south road recommendation
because there was no need for it in the recommendation to
approve by the TRB.
Mr. Pagliarulo moved to approve the parking lot variance,
subject to staff recommendations. Mr. deLong seconded the
motion~ ~ .... ~
Mr. Annunziato clarified that the motion was to approve the
parking lot variance as requested, based on the. TRB
recommendations.
A vote was taken on the motion, and the motion carried 6-1.
Chairman Ryder voted against the motion.

Mr. Annunziato said Staff recommended that the site plan be
approved subject to the staff comments from the Building, Fire,
Engineering, Utilities, Police, PUblic Works, and Planning
Departments and the Urban Forester.
Mr. Pagliarulo moved to approve the site plan seconded by Mr.
deLong. Motion carried 7-0. '
