Chairman Ryder called the meeting to order at 7:30 P. M.,
introduced the Members of the Board, Mr. Annunziato, Mr.
Cannon, Mr. Golden, and the Recording Secretary. He
requested that Mr. Schultz take Mr. Wandelt's place on the
Board. Chairman Ryder acknowledged the presence in the
audience of Councilman Ezell Hester; Councilman Carl
Zimmerman; Councilman James R. Warnke; Peter L. Cheney, City
Manager; Owen A. Anderson, Executive Vice President, Greater
Boynton Beach Chamber of Commerce; Kipp Friedman, Boynton
Beach News Journal; and Rebecca Theim, Sun Sentinel.
MINUTES OF JUNE 11, 1985
Mr. deLong called attention to the 3rd paragraph of page
23, which referred to "Plat closure" and said the last
sentence should be changed to read: "The point from where
you start and your bearings and dimensions as you go around
is supposed to get back within 1/100th of a foot closure
from the point of beginning."
Vice Chairman Trauger moved to accept the minutes as
corrected, seconded by Mr. deLong. Motion carried 7-0.
ANNOUNCEMENTS
Mr. Annunziato announced that last week the case of JCF
vs. the City of Boynton Beach was finally litigated. This
was a zoning lawsuit which evolved at the time of the
adoption of the zoning map, following the implementation
of the Comprehensive Plan. Mr. Annunziato added that it
involved Parcel D in the 10th Section of Leisureville
(Southwest corner of Woolbright Road and the E-4 Canal).
After five years, it is finally in litigation.

Mr. Cannon indicated the location of the property on the over-
lay and commented that the City limits are rather irregular in
the vicinity. He referred the Members to the memorandum from
Carmen S. Annunziato, Planning Director, dated June 5, 1985,
and said the Planning Department's finding was that the
existing land use is predominantly heavy commercial along Old
Dixie Highway and predominantly retail and office along U. S.
1. The parcel is presently being used for a concrete
contractor. Two buildings are on the site, and the applicant
intends to convert the parcel to an office and storage,
using the vacant area for storage of his concrete mixing
truck's.
In the Planning Department's analysis of the rezoning, they
brought up the possibility that the existing C-3 zoning on
Old Dixie Highway is not the correct zoning, as it does not
conform with the intent of a C-3 zoning district. In their
eyes, the issue that remains is to determine what the correct
zoning on Old Dixie Highway is. The two zoning districts
which are allowed for more intensive use are C-4 and M-l, as
explained in Mr. Annunziato's memo.
Mr. Cannon looked at both the C-4 and M-1 districts.
Presently in the City's C-4 zoning district, which mainly
includes North U. S. 1 north of the CBD district and also
along N. E. 3rd Street, it is hard to tell the difference
between the zoning districts because there are so many grand-
fathered uses in the C-4 zoning district, which include many

contractors. If you go out in the field and look at typical
wholeSale operations and compare them to typical contractors~'
storage yards or a typical manufacturer which has storage,
the distinction between a C-4 and M-1 zoning district becomes
more clear.
It was the opinion of the Planning Department that C-4 zoning
would be justified at this location. However, because o~
the problems with outdoor storage, odor, and such, it would
not he a good location for M-1 zoning primarily because it
would conflict with the surrounding land uses. It was the
Planning Department's finding that M-1 zoning would have a
negative impact on the surrounding land uses. Therefore,
C-4 is the appropriate zoning for this location.
Mr. Pagliarulo noticed in Mr. Annunziato's memo that there
are about 260 acres of vacant M-1 zoned property in the City.
He asked if the Planning Department came up with any figures
on how much C-4 is vacant and available at the moment, since
the recommendation was for this to go to C-4. Chairman Ryder
did not think the Board was going to do that, and he
advised that the question was whether they should go from C-3
to M-1.
Mr. Cannon knew there were very little C-4 properties and
imagined there were not more than three or four acres of C-4
zoned property in the City l~imits. Mr. deLong added that
they are extremely scarce.
Mr. Frank Spada, 123 S. W. 13th Avenue, Boynton Beach, said
they were located in Boynton Beach for 2-1/2 years on a
parcel of property that was zoned C-3. They looked for
another location because they had outgrown their location.
Since they were in .C-3 zoning for 2,1/2 years, Mr. Spada
said they bought this property and had it rezoned to C-3
because they had been parking their trucks where they had
been.
Mr. Spada told the Members they went in for a permit for
fencing and found out they did not'belong there. At that
time, they were told they could try to upgrade it to an
M-1. Mr. Spada stated that they were told M-1 was the zoning
they needed to park their trucks.
Chairman Ryder asked what Mr. Spada's operations consist of.
Mr. Spada answered that it is a concrete company and they
do decorative concrete work, cobble stones, etc. They also
do a lot of Department of Transportation work. Mr. Spada
informed Chairman Ryder that they have pickup trucks and
flat-beds. Their equipment is there too.

Mr. Spada informed Chairman Ryder that they do not batch any
concrete whatsoever. The only thing they use their yard for
is to park trucks at night. They pick up their materials at
other concrete plants. Their trucks supply the materials
for their jobs, but Mr. Spada said they pick the materials
up at plants like Rinker and deliver it to them. Chairman
Ryder asked, "You don't stock any sand, stone, or cement?"
Mr. Spada replied that they do not stock any material on
the property whatsoever.
Mr. Spada stated that they want the City to allow them to
put a nice concrete lot in there. They submitted some
plans, and the City approved the office area. Mr. Spada
said they were before a Board a couple of weeks ago, and
the plan was okayed for them to pave the front. They have
to locate some trees. Some property in the rear is theirs.
Chairman Ryder questioned whether Mr. Spada was talking
about picking up raw materials or concrete. Mr. Spada
answered that he was talking about the mixed concrete. All
trucks are out of the yard every morning by 7:00 A. M.
Between 4:30 and 5:00 P. M. every evening, the trucks come
back and are parked for the night. There is no truck
traffic and no going in and out of the place during the day.
Mr. Spada meets his brothers there every morning about
6:00 A. M.; they get everybody out, and Mr. Spada locks the
gates. ~r. Spada goes back about 4:30 P.. M. or 5:00 P. M.
That is what they did at the other location for 2-1/2 years.
Mr. Spada told Mr. Pagliarulo they have four concrete mixers,
and the rest of the trucks are pickup trucks and flat-beds.
Mr. Pagliarulo asked if the trucks are serviced, washed, and
polished. Mr. Spada replied that nothing is done in the
yard.
Mr. Spada informed Chairman Ryder that they have four transit
mix trucks, but they are just housed on the property. He
confirmed Chairman Ryder's statement that they go to the
yards, get the materials, and use their mixing trucks. About
five years ago, Mr. Spada said the suppliers could not give
them the supplies when they needed them. They met with the
suppliers and were told if they would buy their own concrete
trucks and take them to the yards of the suppliers, the
suppliers would load the trucks. That way they have
concrete on their jobs on time. Chairman Ryder asked if Mr.
Spada understood mixing concrete in the City limits is not
permitted. Mr. Spada understood that and emphasized that
they are not asking to mix concrete or to make any dust.
Mr. Spada stated that they finally got their plan approved
so they can put decorative concrete in front of their place,

pave it out, keep it nice and clean, and plant trees or what-
ever the City wants them to do. Reference was made by
Chairman Ryder and Vice Chairman Trauger~to Rinker, who
had been in the City and had to go because of 1-95.
Mr. deLong did not see anything on the application where Mr.
Spada would be mixing concrete. The application said Mr.
Spada would have his business office and store his concrete
trucks and equipment. Mr. deLong asked Mr. Spada how long
he has been in this location. Mr. Spada answered, "Three
months."
Mr. Spada explained that they moved out of Boynton Beach
to Lake Ida Road. The City of Delray Beach rezoned where
they were to reSidential, and they were in a commercial zone,
so they had to leave. Mr. Spada told Mr. deLong they have
owned this property for more than a year and moved in three
months ago.
Mr. deLong asked if they found out they did not have the
proper zoning when they went to get a permit to construct a
fence. Mr. Spada replied that they had a permit to remodel
the building that is on the property to an office, which
they are doing. He stressed that they have the property and
just want to park their trucks. Mr. Spada goes up and down
through the City and has four~ ~cks par~on side streets.
Chairman Ryder pointed out that the Board had to consider
whether M-1 was proper in this instance. It was not only
confined to what Mr. Spada's enterprise means and what it
does. If this would go to M-1 and Mr. Spada decided to go
somewhere else, Chairman Ryder called attention to the fact
someone else could come in. This is a permissive use in
M-l, and Chairman Ryder said they were talking about
introducing an M-1 into an area which is now Commercial and
Residential for one particular owner.
Mr. Annunziato advised that this was an annexation that
occurred about 2-1/2 years ago when the applicant was Mrs.
Grummons. The area remains as one of the greater problem
areas which will be in the City. The City has pushed
strongly for retail commercial land uses on U. S. 1. In
fact, they have gone so far as to refuse service to mini-
warehouses, who then went to the County and sought relief
in the form of a variance to the Health Codes and were
denied the opportunity to construct a well and septic tank
system. The County and the City recognize that this area
has problems, as does the City of Delray Beach. They have
had several meetings to discuss this. It is their intention
that along U. S. t, the useage should be C-3. Mr.
Annunziato said this has been the City's position, and it
has been reflected in the land uses that have been constructed
and in the water and utility agreements which have been signed.

Mr. Annunziato continued that the question then is, "How do
you treat the Dixie Highway frontage?" They did some
preliminary analyses. It appears that C-3 is not the proper
zoning, but it is not the kind of thing that should be done
piecemeal. As part of the update of the City's Comprehensive
Plan, Mr. Annunziato said they agreed to do a more definitive
land use analysis and offer recommendations for future land
use of this area in the City's plan. The County recognized
this is more of a local issue and not a County issue.
Mr. Annunziato suspected that the land use would end up being
General Commercial because some of the uses there are General
Commercial. The zoning would likely be C-4 to accommodate
some of those uses.
With M-l, Mr. Annunziato said there would be severe current
and future land use problems. The current problems would
be they interface with the residential properties to the
west, and future problems would be they interface with the
community commercial, which would be zoned along U. S. 1.
In that light, there was no question that M-1 zoning was
improper in this location.
When Mrs. Grummons annexed the property, Mr. Annunziato said
she was told very specifically that a contractor's yard
would not be a permitted use. He recalled that he was the
person that told Mrs. Grummons it could not be used as a
contractor's yard because he did not foresee any M-1 zoning
in the future.
Mr. deLong brought out that there is a bag company right
next door to this and asked what they are doing manufacturing
bags there. Mr. Annunziato replied that they are legal and
non-conforming. Mr. deLong questioned whether Mr. Spada had
any other recourse. Mr. Annunziato answered, "None that I
know of. This process of the rezoning and land use element
is the recourse the applicant has." He continued that the
Board will make a recommendation to Council, and %he Council
will make a decision. If Mr. Spada is unhappy with the
Council's decision, he always has the recourse of the Courts.
Chairman Ryder commented that no doubt the Board will be
considering annexation for the area to the east along
Federal Highway. To make any change of this kind now did not
seem to make sense because it would impair what use the
City would want to put to the annexed area in the future.
He thought the Board should be careful in view of the fact
something will happen there on a larger scale.
Mr. Spada has taken rides through what they said were C-3
districts in this City. Now they were saying a concrete or
building contractor could not be in C-3, but all kinds of

contractors are in these areas with all kinds of trailers on
their property. Mr. Spada felt that he was not asking for
anything ridiculous, especially in the area where the

another contractor on the other side of Langston. Mr. Winter
advised that the swimming pool contractor is not in the
City limits. Chairman Ryder said the Board would not want to
do anything that would aggravate the situation.
It was apparent to Mr. deLong that the City was going to take
the initiative to clear up the problem there. Mr. Annunziato
felt certain the City would take the initiative to do some-
thing when they are in the planning process. Mr. deLong
thought spot zoning, which was what they were being requested
to do tonight, would be opposed to clearing up the problem
in the future.
Mr. Pagliarulo asked if it was because Mr. Spada would have
trucks parked there because it was apparent to him that
there was no manufacturing process. Mr. Annunziato answered
that contractors' yards are a permitted use in M-l, but they
are not permitted uses in C-3. C-3 is retail commercial.
Mr. Annunziato confirmed Mr. deLong's statement that there are
no parking classifications in C-3 except in conjunction with
an operation. He was not saying there are no contractors'
yards in C-3 but was saying if they are there, they are
probably grandfathered in.
Chairman Ryder asked if anyone else wished to ~peak in favor
or in opposition to the application. There was no response.
THE PUBLIC HEARING WAS CLOSED.
If they go ahead with this, Chairman Ryder said they would
be permitting an M-1 adjacent to a County pocket area. He
did not think it would be in the City's interest to move
in this direction when it affects just one piece of property
adjacent to a lot of other areas that possibly will have to
be reconsidered.
Mr. delong received applause from the audience when he said
the area looked like an aborted attempt at something, and
he felt it was unfortunate that there was not a conditional
use available to Mr. Spada in a C-3 or C-4 because he
thought what Mr. Spada had was more desirable than some of
the things that are there now. If they consider spot
zoning like this, Mr. deLong asked what they could do in the
future. He did not think it was conducive to going entirely
to M-1 in the area. Mr. deLong thought the Board had to
take a stand somewhere to clean up what you see there on the
way into Delray Beach every day and felt something had to be
done to start it.

Mr. deLong stated that he would have to vote against Mr.
Spada, and he regretted that there was not some way they
could let Mr. Spada park his trucks there on a conditional
use basis because apparently, all it will be is an outdoor
garage and Mr. Spada's office, which he did not find that
offensive.
Unfortunately, Chairman Ryder said this particular owner has
contributed to the shabby appearance the area has because he
did not make any attempt to pave the area. Vice Chairman
Trauger said Mr. Spada could not pave it if he was denied
the use.
Mr. Spada referred to Chairman Ryder's statement about what
the property lOoks like and told the Members the applicant
had to wait for the Planning Board to approve their plans.
They are going to put decorative concrete in front, trees,
a three foot hedge around the fence, lighting, and everything
else. They are painting the exterior of the building and
cleaning up the whole place.
Chairman Ryder asked what it was used for previously. Mr.
Spada answered that it was two residential houses, which
were not even fit to live in. It took about 16 to 18 hours
for a bulldozer to get all of the debris off of the property.
Junk cars and trucks and also tires were on the property.
Mr. Spada commented about the paint distributor, boxing
company, and a car repair down the street in C-3 with trucks
parked out front which they repair. He felt all of their
trucks are good looking trucks and said they are all kept
clean.
Once they put in the decorative concrete etc., Mr. Spada
thought it would be pleasant to the eye when people drive
by. He thought the building would be pleasant to the eye
because of the way they will decorate it.
Vice Chairman Trauger moved to accept the recommendation of
the City Planner and to deny the request, seconded by Mrs.
Huckle. Motion carried 7-0, and the request was DENIED.

Mr. Annunziato read his memorandum dated July 2, 1985, and
Mr. Cannon pointed out the driveways on the overlay. Mr.
Annunziato said the site is served by four driveways (two on
Congress Avenue and two on Boynton Beach Boulevard).
Vice Chairman Trauger asked how long the driveway is from
where the pump is to the end of the curb cut coming down
from Congress Avenue. Mr. Cannon replied that it was almost
the entire length, and you could pull in there almost any-
where. Vice Chairman Trauger looked at it today and it
looked like there was a "big long curb cut and a little short
one" on Congress Avenue. Mr. Annunziato presented a copy of
the survey for the Members to study, Chairman Ryder noted
the two curb cuts on Congress Avenue were close together.
Mr. Annunziato read from page 2 of his memo that "the TRB
recommended that a 45 foot wide driveway be allowed to
continue at each extremity of the property, but not closer
than 25 feet to the adjacent properties." He said this
means that the applicant should be permitted to have a drive-
way on Congress Avenue and a driveway on Boynton Beach Boule-
vard. A driveway will be located 25 feet south of the north
property line on Congress Avenue and 25 feet east of the
west property line on Boynton Beach Boulevard. The driveways
would extend 45 feet south on Congress Avenue and east on
Boynton Beach Boulevard.
Mr. deLong asked how far that would place them from the inter-
section. Mr. Annunziato replied, "About 140 feet on Boynton
Beach Boulevard and about 120 feet on Congress, more or less.
That would be the minimum that the Code would allow."
Mr. Charles W. De Santi, Agent, P. O. Box 024451, West Palm
Beach, Florida 33402, presented Mr. W. J. "Bill" Irwin, Shell
Oil Company, 100 South Pine Island Road, suite 130, Plantation,
Florida 33324, and informed Vice Chairman Trauger that he
does not operate the station but represents Mr. Irwin, who
is the responsible party for Shell Oil Company in this area.
Mr. De Santi showed the Members a plan and said the hatched
area would be landscaped by Shell Oil Company. They will
upgrade the property when it is important to do so.
With regard to the drainage, Mr. De Santi said the applicant
agrees to develop the calculations necessary to support the
fact that they can meet containing one inch of rainfall on
site, and they will landscape appropriately. He said they
would agree with the denial of that particular variance.
With regard to the turnout variances as requested, Mr.
De Santi said there are two turnouts on each main artery, and

the applicant has taken off the closer turnout to the inter-
section on Congress Avenue which creates a very disastrous
stacking situation as you pull out. The applicant agreed
that was extremely hazardous.
With due respect to everyone in the room, Mr. De Santi said
with the exit from the property going west along Boynton
Beach Boulevard, all traffic feeding out from that turnout
would be routed to the west. It would help in the flow of
the automobiles from the facility. Mr. De Santi understood
that ultimately they would be dealing with a fair amount of
right-of-way and laneage. He thought they were in the
situation where the owner has the desire and is absolutely
serious about beautifying the facility as it should be
because it is the entrance to the City.
Mr. De Santi requested that the turnout located closest to
the intersection along Boynton Beach Boulevard be included
in the variance for the reasons regarding th~ free flow of
automobiles exiting the facility. He took his car there
1-1/2 hours ago (about 6:30 P. M.) and as he attempted to
make the moves going from the gas pumps west inside the
property to the westerlymost turnout and come out, he found
it will be an impacting situation. Chairman Ryder asked if
Mr. De Santi meant traffic eastbound, as they come out, if
the curb cut closest to the intersection is closed and
they come out the one to the west. Mr. De Santi said that
was right and showed how traffic would have to move.
Chairman Ryder asked what was wrong with that. Mr. De Santi
called attention to the parking requirements and said they
have located parking stalls which are acceptable to everyone.
His point was this is a small parcel of land that has been
used for well over 20 years, and he wanted to discuss the
expansion of Boynton Beach Boulevard, which he thought was
important to this proceeding.
If this is done in the next 12 to 18 months, Mr. De Santi
felt his client would take a hard look at keeping that
particular turnout open. However, if the facility is
scheduled for gradual improvements along the Boulevard and
they hit the intersection in five to eight years, then he
would have to search hard to suggest to his client that his
client close the turnout. Chairman Ryder informed him that
predictions are that this will be the busiest intersection
in the City in years to come. He said Mr. De Santi was
wanting someone to come out there, when the traffic light
changes and traffic proceeds west, in the face of traffic.
The Mobil station was treated the same way for the same
reason. Their curb cuts were also too close to the inter-
section. Mr. De Santi agreed with Chairman Ryder that it
was a vital consideration.

Vice Chairman Trau~er pointed out that it will be six lanes
within the next 1-1/2 years. Chairman Ryder informed Mr.
De Santi that Vice Chairman Trauger is part of a Task Force
that has been working on the widening of the Boulevard from
Congress Avenue to Military Trail, so i% is in the works.
He emphasized that the Board has to be very careful.
Mr. De Santi wanted a moment to discuss with his client the
opportunity for closing that turnout in conjunction with the
widening of Boynton Beach Boulevard.
Mr. deLong understood Mr~ De Santi to indicate in his opening
remarks that the hatched area on his (Mr. De Santi's) plan
would be landscaped and wondered what kind of foliage would
be in there and what the height would be. Mr. De Santi
replied that the hatched area represented the on site
retention area and will coincide with the landscaping area.
Today, those areas are grassed. The Landscope Code requires
hedging and tree spacing. Mr. De Santi concluded by saying his
client will certainly meet the Landscape Code to the letter.
Mr. deLon~ was concerned about the height of any trees that
would be put there. Mr. De Santi assured him they would meet
a clear trunk of five feet with, he believe~ a mimimum crown
of 15 feet. Mr. Annunziato said it would be whatever the
Landscope Code requires. Mr. De Santi said a car will be
able to see under the canopy of the tree itself.
Mrs. Huckle asked Mr. De Santi what his thought was as to the
eastward movement of traffic as it comes out of the station.
Mr. De Santi explained that the reason for closing it was
because it created a very dangerous turning situation coming
out onto Congress Avenue. They pulled the turnout along
Congress Avenue as far back as they could to the property
line so that they could make the turn to get into the turn
lane on Congress Avenue to come back east. Mr. De Santi
agreed with Mrs. Huckle's statement that it was the main
area waiting for .eastern traffic.
Mrs. Huckle could not recall where the median is opposite
the most westerly exit. Mr. Annunziato advised that the
property is not served by a median cut on Boynton Beach
Boulevard. Some of the Members mentioned that there is a
cut. Mrs. Huckle recalled that it is "quite a deal back."
Vice Chairman Trauger was concerned about someone coming
back east. Mrs. Huckle was worried about someone trying to
swing all the way across. Mr. De Santi commented that it
could not happen. Mrs. Huckle determined that it would
leave the one northerly Congress Avenue exit as the only
opportunity for easterly movement. Mr. De Santi confirmed
this and guessed that had been the case for some time in
that location. Mrs. Huckle remarked that the mall is not
open yet.

Mr. Annunziato said they are now working on the plans for the
building of the intersection at Congress Avenue and Boynton
Beach Boulevard. It will not be six lanes but nine lanes
with two right turn lanes, three through lanes on each side,
and double left lanes on all approaches. As to the movement
mentioned to go east out of the gas station and make the
turn, Mr. Annunziato said one would have to traverse a turn
lane and three through lanes to get to the westernmost turn
lane, and that becomes part of the problem that the City has
with these close in driveways. It becomes tempting. Mr.
Annunziato advised that they were speaking specifically about
70,000 trips a day.
Vice Chairman Trauger asked where all the debris and water
would go from the car wash. When the car wash facility is
developed, Mr. De Santi said %here will be an appropriate
on site drainage program developed pursuant to the City's
Codes. Mr. Annunziato added that many car washes are self
contained, but a car wash was not a part of this presentation.
They would have to come back with a site plan. They cannot
build a car wash without first overcoming the variance
procedures.
Chairman Ryder advised that the car wash would go to Council,
but this variance will not go to the Council.
Chairman Ryder asked if anyone else wished to speak in
support of the application. There was no response. Chairman
Ryder asked if anyone wished to speak in opposition to the
application. There was no response. THE PUBLIC HEARING WAS
CLOSED.
Chairman Ryder informed the Members that they had two conclu-
sions from the Technical Review Board~. One was that the
curb cuts on both Congress Avenue and Boynton Beach Boule-
vard immediately adjacent to the corner be eliminated and
that-the remaining single curb cuts on each Avenue be moved
close to the extreme end of the property.. Secondly, with
regard to 5-141(e), the TRB recommended that the applicant
retain a certain amount of water on the property. (See
memo of July 2, 1985 from Carmen S. Annunziato, Planning
Director, which is attached to the original copy of these
minutes.)
Mr. deLong moved to go along with the recommendations
contained in the memorandum of the City Planner, dated
July 2, 1985, and that the two curb cuts be closed, the
curb cuts existing will be at the extremities of the
property, and that the recommendation with regard to drain-
age be approved. Mr. Pagliarulo seconded the motion, and
the motion carried 7-0.

Mr. Annunziato informed the Members that this is located
north of Lake worth Mariner Village. Staff recommended
that the plat be approved subject to the staff comments
from the Planning, Utilities, and Engineering Departments,
which Mr. Annunziato read.
Mr. Annunziato did not believe comment ~3 in the City
Engineer's memo of June 5, 1985 was necessary because there
is a current contract for the purchase of the property.
No one was present to represent the applicant. Chairman
Ryder said if the Board fel~ the staff comments ~e~e
necessary, they w0~Id be included in the motion. Mr.
Annunziato said the applicant provided the land value, so he
did not foresee any difficulties with the staff comments.
Mrs. Huckle asked if the private street had to conform to
the City's standards as to width. Mr. Annunziato replied
that the City would require that it be paved but would not
necessarily require right-of-way width. It seemed narrow
to Mrs. Huckle. Mr. Schultz informed Mr. Annunziato that
Lake Worth Mariner Village was built six years ago. Mr.
Annunziato advised Mrs. Huckle that the width of the road
serving this project is 22 feet of pavement. Mrs. Huckle
thought it was "a long shot without any other way of
getting out of there."
Mr. Schultz lives in a private home that almost adjoins the
property. He referred to the cul-de-sac and said when
the project is built, as cars swing around the cul-de-sac
they will be shining lights into a $220,000 home and other
homes there. Mr. Schultz was "dead set against the cul-de-
sac," but he felt the only way they could do it would be to
tear down the mangroves and fill it. Mr. Annunziato advised
that the cul-de-sac is where it has to be, and it does not
go all the way to where the houses front on the Intracoastal.
Mr. Schultz was not talking about on the Intracoastal.

~ere the cul-de-sac turns, Vice Chairman Trauger noticed
the land slopes down badly there. Mr. Annunziato suggested
to the Members, in answer to their comments, that .this was
drawn by an Engineer and was checked by Tom Clark, City
Engineer, so he presumed they could build it that way.
As the Members appeared to have questions they wanted
answered, Chairman Ryder suggested they table this. He
was surprised the applicant was not present.
Mr. Winter moved to TABLE the matter, seconded by Mr.
Schultz. The motion carried 5-2 with Messrs. deLong and
Pagliarulo voting against the motion.

and they dedicated land to the City in lieu of paying the
fee.
Vice Chairman Trauger moved to approve the preliminary plat,
subject to staff comments. Mrs,. Huckle seconded the motion,

Mr. Golden informed the Members that the proposed addition
to the existing structure will consist of a kitchen,
conference room, class rooms, and small offices. The pro-
posed use of the existing structure will consist of four
class rooms and a reception area. Mr. Golden indicated park-
ing which will be moved to the rear of the building and
expanded when the proposed addition is built.
The Technical Review Board recommended approval of the site
plan, subject to staff comments.
The property is located at the corner of N. E. 9th Avenue
and N. E. 3rd Street. To the west of the property is the
Public Works equipment storage area. To the north, across
N. E. 9th Avenue is a single family home. 'To the east,
across N. E. 3rd Street, is another single family home. Mr.
Golden pointed to a vacant parcel and said single families
are farther south.
Access to the site will occur on N. E. 9th Avenue. The
applicant also proposes a small driveway in front of the
existing building to provide for children being dropped off
and picked UP.
Mr. Golden read the staff comments from the Energy
Coordinator, City Forester, and the Building, Engineering, and
Public Works Departments.
City Manager Cheney informed the Members that this is the
building that was built 18 years ago with a lot of volunteer
labor. It is crowded and does not provide the opportunity
it should. Boynton Beach Child Care Center, Inc. has
attempted to raise some money to put an addition on the
building. The City Council became involved in the project
and agreed to put additional money into the project (around
$115,000) with $12,000 or $15,000 that the Day Care Center
has. They will build an addition on the south end and
renovate almost the entire building.
Two big class rooms that are there now will be cut into
four class rooms. The rest rooms will be arranged to serve
four class rooms. The existing kitchen will be moved into
the new building. Offices will be built in the new building
for counseling.
City Manager Cheney said it is patterned after a day care
center in-West Palm Beach that the Community Action Council
liked. One of the four class rooms will have a door that
will open up so it can be a meeting room. There will be
direct access to recreation out of each class room. City
Manager Cheney added that they will get the parking off of
the corner, as it is dangerous on N. E. 9th Avenue.

City Manager Cheney continued by saying there will be a
covered walkway around the building so children can go from
class to class. It is a whole new operation with the City's
support and City funding. It is still operated by the
Community Action Council. George Davis, Architect,
designed the original building and is working on the project.
Bob Norene is the Contractor. A mansard roof will be put on
the building.
Mrs. Huckle asked how many additional children the addition
will accommodate. City Manager Cheney replied that it is
not expected to accommodate many more, but he estimated
about 30. The problem is that the children are over?
crowded where they are now. Mrs. Huckle asked what the
current capacity is now. It seemed to City Manager Cheney
that it was something like 60, and they have 90 plus in
there now.
Vice Chairman Trauger moved to accept the site plan,
subject to staff comments. Mr. Pagliarulo seconded the
motion, and the motion carried 7-0.

Mr. Golden said the applicant requested approval for the
building to be located at the end of the cul-de-sac east
of the concession stand press box,~between the softball
field and the major league field. The Technical Review
Board recommended approval of the site plan, subject to
staff comments.
Mr. Golden said Caloosa Park is bordered on the north by
the L-28 Canal. South Tech Vocational Center is located
to the west, and industrial properties are further to the
west. No parking is provided for the structure. It is
a small maintenance building, and the intent is to access
the building by foot.
The plan does not propose water and sewer services.
According to the Utilities Director, water and sewer
service must be included to meet the City Building Codes,
as indicated in his memorandum of July 3.

Mr. Golden read the staff comments from the Building Depart-
ment, City Forester, and Utilities Department.
No one was present to represent the applicant. Chairman
Ryder referred to the comment by the Utilities Department
and asked if water and sewer was needed when it is just a
storage building. Mr. Annun~ato advised that it is a storage
building that will be utilized in the same architecture that
currently exists.
Chairman Ryder also noticed that the Building Department
wants additional information on truss details and wall
sections. He also noted reference was made to air condition-
ing by the Building Department. Mr. Golden informed the
Members that the building was discussed at the meeting of
the Technical Review Board. Both the Building and
Utilities Departments were made aware of the nature of the
building but still thought it needed to conform to Code
requirements.
Chairman Ryder asked if William F. Wilsher, Agent, had an
opportunity to go over the staff comments. Mr. Annunziato
did not know but did not think it was a significant problem.
Vice Chairman Trauger asked if it was not about the same as
a tin shed. Mr. Annunziato said it would serve the same
function but the architecture will be'~he~sa~eas is utilized
by the County and more expensive. Chairman Ryder thought it
was conceivable that they would not have air conditioning
and that no one would be living in it. Mr. Annunziato said
he would talk to Mr. Wilsher between now and next Tuesday.
He reiterated that he did not think there would be a problem
as they were dealing primarily with a Code interPretation
(Building Code).
Chairman Ryder asked if the Board had to go along with the
comments. Mr. Annunziato thought they should because it
was an interpretation of the Building Code, regardless of
what the Board said.
Mr. Winter moved, seconded by Mr. Schultz, to approve the
site plan, subject to staff comments. Motion carried 7-0.

Mr. Golden informed the Members that the applicant is request-
ing a site plan modification to increase the size of two
single family detached homes at Phase 3. One unit has a pool
with a screened enclosure. The Technical Review Board
recommended approval, subject to staff comments.
To the north of Tract'E is Tract F. To the west is Delray
Dunes Golf and Country Club in Palm Beach County. To the
north is the Village of Golf. The two units are located
on Northwoods Lane, which is provided access from Summit
Drive.
Mr. Golden read the staff comments from the Building and
Utilities Departments and the City Forester.

Chairman Ryder referred to the first comment in the memo

Department, dated May 3, 1985 and asked what it meant. The
comment was, "Plan shows Building 42 in setback."
After consulting with Mr. Culverhouse, Mr. Fleming said they
can move the building to meet the requirements. They were
aware of the other staff comments.
Mr. deLong moved to approve the site plans, subject to staff
comments. Mr. Pagliarulo seconded the motion, and the
motion carried 7-0.

Mr. Golden said the applicant was requesting site plan
approval for 56 one bedroom units and 328 two bedroom multi-
family attached units on a 52 acre parcel. They are intended
to be rental units.
A total of 3.5 acres has been provided for recreation facili-
ties. In addition, there are three lakes on site. The
applicant proposes a racquet ball court. There are four
tennis courts and two swimming pools. One pool has a

cabana and the other a clubhouse. Mr. Golden continued by
saying there is also a children's playground.
To the west of the development is a vacant parcel zoned
R1AAA. To the north is Stonehaven PUD; to the east, across
Congress Avenue, is Leisureville, and adjacent to the
south, across Congress Boulevard, is Lakes of Tara Planned
Unit Development. Ingress and egress will occur by way of
Congress Boulevard. There are two points of entry into the
site.
Mr. Golden read the staff comments from the Public Works and
Recreation Departments and the City Forester. With respect to
the City Forester's comment, he said the applicant does
intend to revise the landscape plan. Mr. Golden read the
memos from the Building, Engineering, and Planning Depart-
ments.
Enrico Rossi, P.E.., Rossi and Malavasi Engineers, Inc.,
1675 Palm Beach Lakes Boulevard, West Palm Beach, Florida
33409, appeared as Agent and said M. "Tom" Register was in
the audience. Mr. Rossi accepted the comments.
Chairman RYder drew attention to the 3rd comment in Mr.
Annunziato's memo of July 2, 1985 which said, "Pedestrian
access must be provided along both access roadS. "
Chairman Ryder asked if there would be a sidewalk along
Congress Avenue, running north and south. Mr. Rossi
replied that there was no provision on the plan to do that.
He added that he did not know, but engineering is going
forward with the four laning of Congress Avenue. Chairman
Ryder said the property goes to Congress Avenue, and he.again
asked when there would be a sidewalk on Congress Avenue.
Mr. Rossi was sure the Task Force would see to it. He
imagined it would be incorporated in with the widening.
Chairman Ryder commented that the sidewalk could go in now
and that Mr. Rossi knew where it should go. He asked if
it was not provided because they did not have access on
Congress Avenue. Mr. Rossi said it was not a requirem~ent of
the project to put a sidewalk along Congress Avenue. He
did not know where a particular section was going to show
it along Congress. Mr. Rossi added that it would have to be
determined by the alternate development of Congress Avenue.
Vice Chairman Trauger asked if the developer was contributing
to the improvement of Congress Avenue by a fee basis. Mr.
Rossi answered, "No'!. He thought this project, like every
other project in the County~ will have to pay an impact fee.
Mr. Annunziato informed Chairman Ryder that the sidewalk on
Congress Avenue will be built in connection with the Congress
Avenue reconstruction.

Mr. Annunziato advised that the construction of the cross
section for Congress will be the same cross section that
they can see north of Boynton Beach Boulevard. There will
be an eight foot bike path on the east side, and a six foot
sidewalk or bike path on the west side.
Mr. Rossi told Chairman Ryder Congress Boulevard is being
dedicated as a result of the work being done on the plat.
Chairman Ryder added that it serves the development to the
south too. Mr. Rossi said the streets in the project are
private. He explained that because this is a rental
project, this is a boundary plat that goes on record.
There are no condominiums or selling of individual parcels.
It is just for points of ingress and egress.
Mr. deLong asked what the rental rates would be. Mr.
Register believed they were in the low $400s but he was not
sure.
Mr. Pagliarulo moved to approve the site plan, subject to
staff comments. Vice Chairman Trauger seconded the motion,
and the motion carried 7-0. Mr. Schultz left at 9:10 P. M.

is one story.
To the west of the parcel is a structure which houses law
offices.. Further to the west is a strip commercial
center with Dino's. To the rear of the property is a 14
foot wide alley. Across the alley is a single family
residential home. To the east, across N. E. 1st Street,
is a continuation of the commercial district which fronts
on Boynton Beach Boulevard.
Access to the site occurs at three points. The first is a
two way drop from Boynton Beach Boulevard into the western
boundary, which is located 180 feet from the intersection
of Boynton Beach Boulevard and N. E. 1st Street. There are
also two points of access to the rear of the property.

Mr. Golden read the staff comments from the Fire, Engineering,
Utilities, Public Works, and Planning Departments and also
the City Forester.
Mr. Everardo R. Garcia, 290 East Fern Drive, Boca Raton,
Florida 33432, heard all of the comments and said he would
try to work them out. He said they should have been
advised of the comments before getting here. Mr. Annunziato
stated that he gave Mr. Anthony Mannino, Property Owner, a
copy of the staff comments.
Mr. Anthony Mannino, 1501 N. W. 2nd Avenue, Boca Raton,
Florida 33432, came forward. Mr. Annunziato advised that
these were comments that came out after a review of the
plans by the Technical Review Board. He wanted to bring
the memo from Kevin Hallahan, City Forester/Horticulturist,
dated July 2, 1985, to their attention. Mr. Annunziato
thought Mr. Hallahan's comments should be addressed in
connection with a modified landscape plan before the appli-
cant takes it before the Community Appearance Board next
Monday night (July 15, 1985).
Mr. Garcia referred to Mr. Annunziato's 2nd comment in his
memo of July 2, 1985 and exclaimed that he should have known
about the requirement for an additional handicapped space
before he came to the meeting. Mr. Annunziato explained
that it was simply a Code requirement. Mr. Garcia wanted
to know the Code requirement. Mr. Golden advised that it
is one for the first 20 spaces, two for 21 through 100
spaces, and 2% after that.
Mr. Mannino asked if they would be allowed to have compact
car parking. Mr. Annunziato replied, "No, Sir."
Chairman Ryder suggested that Mr. Garcia get a copy of the
staff comments. Mr. Garcia said he would get them tomorrow.
Mr. Annunziato clarified that except for the landscaping,
these were changes they would have to make in connection
with securing a permit. They were not changes they would
have to make before next Tuesday night (July 16, 1985) when
they go before the City Council. Mr. Annunziato confirmed
Mr. Garcia's statement that he thought the landscape plan
would be all they had to modify now.
Vice Chairman Trauger asked Mr. Garcia if any consideration
was given to making this all ~an office building rather
than part retail. Mr. Garcia answered that it was a matter
of economics. Vice Chairman Trauger commented that there
are very little economics in little strip shopping centers.
He said they are across from City Hall on Boynton Beach
Boulevard and when the bridge gets through, they will be on
the main thoroughfare of the City from the turnpike on in.

Vice Chairman Trauger said the City has several little strip
shopping centers and, frankly, he thought they looked
"pretty bad." He referred to absentee ownership and called
attention to Causeway Square. Although he knew it fell
within the category, Vice Chairman Trauger hated to see
another little strip shopping center and said the City is
trying to improve its image. He stressed that they have to
start somewhere to make Boynton Beach beautiful. Chairman
Ryder referred to a shopping center near Los Mangos that no
one is renting and asked if Mr. Garcia was aware of that.
Mr. Mannino thought this was a different situation, as this
is a small parcel.
Mrs. Huckle asked if the applicant had any commitments from
any possible renters. Mr. Mannino replied, "Not yet."
Mr. Winter moved to approve the site plan, subject to staff
comments, seconded by Mr. deLong. Motion carried 5-1. Vice
Chairman Trauger voted against the motion. Mr. Schultz was
not present, as he left the meeting at 9:10 P. M.
There was more discussion about the project and strip
shopping centers.

west, Golf Road and the L-27 Canal form the southern
boundary of the development. Across Golf Road to the south
is Cranbrook Estates. Phase II is immediately north of
Phase I. Access will be provided from the proposed S. W.
26th Street, which runs into Golf Road.
Mr. Golden read the staff comments from the Building and
Utilities ~epartments and from the City Forester.
Chairman Ryder said they had established S. W. 26th Street
will be a dedicated City street going all the way to Wool-
bright.

Robert C. Wade, Architect, Wade and Kreidt Associates, P. A.,
520 Brickell Key Drive, Miami, Florida 33131, reviewed the
staff comments and accepted them.
Vice Chairman Trauger asked what the marketing price of the
units is. Mr. Wade replied that they intend for them to be
around $80,000. They will range from $75,000 to $90,000,
and there will be four different unit sizes.
Mrs. Huckle heard comments on the news tonight that except
for Boynton Beach and a couple of areas in Delray Beach,
the average cost of a single family home in West Palm Beach
and Boca Raton is $160,000. Boynton Beach was mentioned as
being in the $80,000 bracket. Vice Chairman Trauger
remarked that the Marina called Boynton Beach a "blue
collar" city.
Mr. Winter moved that the site plans be approved, seconded
by Mrs. Huckle. Motion carried 6-0.

Mr. Golden said this will be a three story building with a

The Technical Review Board recommended approval of the site
plan, subject to staff comments.
The proposed site is located on the west side of Congress
Avenue, approximately 400 feet north of the intersection of
Old Boynton Road and Congress Avenue. To the east, across
Congress, is a large vacant tract which is single family
residential. There is also an undeveloped tract to the
south and west, which is still owned by the Lake Worth bank.
Access to the site will occur from the mall road at the
northwest corner of the property. A curb cut is to be
constructed through the median.
Mr. Golden read the staff comments from the Building, Fire,
Engineering, Utilities, and Planning Departments and also
the comments from the Energy Coordinator and City Forester.

Steve Boruff, Architect, Peacock & Lewis, Architects &
Planners, Inc., 501 South Flagler Drive, West Palm Beach,
Florida, was aware of the staff comments and had no problem.
It looked to Chairman Ryder like there was an out parcel.
He asked if this bordered directly on Congress Avenue and
if there was an intervening space between their plot and
Congress Avenue. Mr. Boroff said no space was there. If
you look at the overlay, Mr. Annunziato said Congress is
directly in front of the building. Mrs. HuCkle thought the
location map showed it differently and asked if this was to
replace the temporary. Mr. Boruff replied that it is. The
temporary is a little bit south. Mrs. Huckle remarked that
it is a long way from the corner of Old Boynton Road. There
was more discussion.
Mr. Golden advised that the landscaping will be approxi-
mately 400 feet north of the intersection between Old
Boynton Road and Congress Avenue. Mr. Annunziato indicated
the out parcel, which is at the southeast corner of the
mall. He said it is south of the first mall access road
that you come to as you go north of Old Boynton Road and
east of Mall Access Road B, which comes from Boynton Beach
Boulevard, across Old Boynton Road. The entire parcel is
now owned by First Federal Savings and Loan of Lake Worth.
They are keeping 1.3 acres plus or minus for this facility
and are marketing the remainder. There will be about 11
acres left after they cut out this piece.
vice Chairman Trauger moved, seconded by Mr. Pagliarulo, to
approve the site plans, subject to staff comments. Motion
carried 6-0.
COMMENTS BY MEMBERS
Future Growth of Boynton Beach - vice Chairman Trauqer
After discussion, Vice Chairman Trauger wished this to be on
the record. He frankly thought the Board should be taking a
look at what is being constructed in the way of the future
growth of Boynton Beach, from an appearance standpoint and a
use standpoint. Vice Chairman Trauger was concerned about
the vast condominiums they built and commented that
Condominium and Homeowners Associations are really the
"Devil's Advocate" after you have been in one.
vice Chairman Trauger asked if "a cheap economic City" was
going to be our image to everyone. He said most cities
everyone grew up in had nice residential areas with lovely,

big homes. Boynton Beach has Golfview Harbor, Chapel Hill,
and a few others. Chapel Hill is in its second ownership
and is starting to deteriorate. Golfview Harbor will do the
same. Lake Ida is practically filled up. He asked where
the Executives live. Although they may work here, Vice
Chairman Trauger said they live outside.
The city needs economics and affluent people as well as the
pick and shovel people. They are bringing in a long area of
workers in categories of medium income, vice Chairman
Trauger asked if we will be just a small medium income City
or will we have some affluent citizens within our boundaries
too. He asked where we would put them and thought there
was very little land use that would be conducive unless it
would be on the south, opposite the church, but it has no
water connection for houses in the neighborhood of $135,000
to $175,000. If $50,000 to $80,000 is the average here,
vice Chairman Trauger said it should be doubled.
Vice Chairman Trauger thought many people would like to
live in an individual house on their land and not be mixed
up with Condominium and Homeowners Associations and living
in "rabbit hutches". He thoughtl the Planning and Zoning
Board should be taking a good look at this down the road.
Chairman Ryder told Vice Chairman Trauger he overlooked
Hunters Run. He said the function the Board provides is to
check on whether the application conforms to the particular
zoning. Vice Chairman Trauger was implying that the
Planning and Zoning Board should be giving guidance to the
city Council for the future direction of this city. He
asked what the city will look like 15 or 20 years from now
and questioned whether it will be full of "rabbit hutches"
or nice big places all alone.
It was apparent to chairman Ryder that Vice Chairman Trauger
was talking about putting everything in R1AAA category.
vice Chairman Trauger thought they should provide as much
R1AAA that can be developed. Mr. Annunziato understood what
vice Chairman Trauger was saying but was not so sure that the
dye had already been cast. Mr. Winter agreed and said all
of the area west of Congress Avenue was residential, and now
they are having 7 and 8 units per acre put in there. Mr.
deLong pointed out that another problem is the cost of land
is so high, it encourages the development of multi-units.
vice Chairman Trauger argued that the cost of land always
has been high in proportion. If they did not allow such
high density development, Mr. Winter thought the cost of

land would go down. Across the United States, Vice Chairman
Trauger said to look at the small towns where lovely homes
were built. They were high priced even when he was a boy,
and it still is today. Mr. deLong advised that we have a
lot of that type of zoning.
vice Chairman Trauger referred to Quail Ridge and said they
did not even want the name of Boynton Beach. They wanted
the image of Delray Beach. Vice Chairman Trauger thought
they should lay the glove down at some place and see what
they could do or they will keep on perpetuating condominiums
and congregate living. Chairman Ryder said we are getting
R1AAA on Seacr~est, near Gulfstream Boulevard.
vice Chairman Trauger said there are lovely homes along the
Intracoastal, but how about five or six houses back. Mr.
Winter recalled approving land on the east side between
Swinton and Seacrest, but nobody ever built in there, vice
chairman Trauger said you have to be able to market it.
He said we market the $80,000, $90,000 "hutch type" house.
Now we are locked in also by a referendum to a straw ballot
that the city does not want to extend its boundary line any-
where; we still say we are half developed within the City.
vice Chairman Trauger asked who will run the City in 10 or
15 years. "Who will be sitting on the Boards and the
Council? All the Laborers in Town who work in all of the
fac%ories? I~t will take some brains and ability and people
that know how to handle money to run a city. Where are they
going to come from?" Mr. Annunziato thought they would be
here. Vice Chairman Trauger asked where they will live.
Mr. Annunziato thought they would be living in the same
places they live in now.
Mr. Annunziato thought you could find almost any price house
in Boynton Beach you would be willing to pay for. A plan was
presented today for houses that will probably be $250,000.
Mr. Pagliarulo advised that you have to establish the land
first. Mr. Annunziato did not think there was a direct
relationship in what you pay for the house and the kind of
construction you receive. He thought it was the same
construction, regardless of what you paid for the house.
Mr. deLong did not see a direct correlation between the
price of the house you live in and your intelligence.
Mr. deLong agreed there should probably be more R1AAA areas
and they should give the city direction, but he also thought
they should be sure to provide for everybody in Boynton
Beach. Mrs. Huckle recalled they created R1AAA in 1975.

Glass Buildings - Mrs. Huckle
Mrs. Huckle was concerned about all of the glass buildings
because of hurricanes, and she referred to the big one in
the Boynton Commerce Center at Woolbright. She wondered
if the Board should not be looking at that as far as the
debris that blows through when hurricanes hit. It is
becomming a real item of discussion in Pompano Beach and
Fort Lauderdale.
Mr. Annunziato said it has been discussed and that it came
up when First American Plaza's office building was presented
to Council. He thought the only comment made that they
could rely on was that it met the Southern Building Code.
Mr. Winter thought it required that the building have a
resistance to at least a 150 mile an hour wind. He asked
what happens if you have 175 m.p.h, winds.
Mrs. Huckle said we have a lot of citizens to think of and
should not let that get past the Board. Mr. Annunziato said
he would attempt to get an analysis from the Building
official regarding this.
Causeway Squar~
chairman Ryder said they have to do something about the
parking there because there is no direction. It is the
same way at Sunshine Square. Mr. deLong recalled that Sun-
shine Square was almost cancelled by their insurance company
because so many people were falling over the bumper stops,
and the parking lot had to be revamped and the bumper stops
taken out.
chairman Ryder referred to Woolbright Corporate Center,
which has islands and curb stops.
ADJOURNMENT
There being no further business to come before the Board,
vice chairman Trauger moved, seconded by Mr. winter, to
adjourn, and the meeting adjourned at 10:00 P. M.
