I. CALL TO ORDER
Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order
at 9:06 a.m. and explained the Magistrate's role and the procedures. Pursuant to Florida
Statute, all orders are appealable to the Circuit Court in Florida and the City Commission.
Also, that a fine will be imposed if the violation(s) are not corrected by the deadline.

died of Covid and new has been sought. Asking for an extension so new counsel can
give advice. Ms. Zalman will grant an extension to work with City.
Decision
Based on the evidence, Ms. Zalman ordered compliance date of February 20, 2021, or
$50 a day fines assessed and administrative fee of$384.12.

Officer Guim presented the case, which was a routine inspection. Initial inspection date
March 13, 2020. Not a repeat violator. Initial notice issued March 16, 2020. Thirty days
were given to comply. Date notice sent Certified Mail November 13, 2020, green card
not signed. Property was posted on Property and at City Hall on January 8, 2021.
Property last inspected January 18, 2021, fence permit violation still exists; permit
process has begun, but nothing since September 4, 2020. City recommended property
to be in compliance by March 1, 2021, or $50 a day assessed, plus administrative fee of
$384.12.
Sevenaire Jerome, owner, agreed that extension to March 31, 2021, should be sufficient
to work out delays with Building Department in getting the permit granted.

Officer Hart presented the case, which was a citizen complaint. Initial inspection date
April 15, 2020. Not a repeat violator. Initial notice issued April 22, 2020, via courtesy
notice. Thirty days were given to comply. Date notice sent Certified Mail was November
137 2020, signed green card dated November 23, 2020. All violations still exist. Current
pictures were submitted. City recommended property to be in compliance by March 1,
2021, or $100 a day assessed, plus administrative fee of$384.12.
Hanse Thelot, Owner, appeared and explained that he had been out of the country until
the first of the year. Officers Hart and Pierre explained what is needed to move forward
to compliance and offered to walk him through the process. Ms. Zalman granted an
extension and reduced fine to $50.
Decision
Based on the evidence, Ms. Zalman ordered compliance date of March 15, 2021, or $50
a day fines assessed and administrative fee of$384.12.
Case No. 20-2122 Gasbert Vibert & Viola Dubuisson
Property Address: 129 SW 7t" Ave
Type of Property: Single-family, homesteaded

Remove all inoperable vehicles on the property.
Officer Hart presented the case, which was a routine inspection. Initial inspection date
August 25, 2020. Not a repeat violator. Initial notice issued August 31, 2020, via courtesy
notice. Twenty days were given to comply. Date notice posted on property and at City
Hall was January 7, 2021. Property last inspection January 19, 2020, inoperable vehicles
still exist. Current pictures were submitted. City recommended property to be in
compliance by March 1, 2021, or abate by towing, or fine of $25 a day assessed, plus
administrative fee of$384.12.
Johnson Vibert, son of owner, did not have affidavit to speak on behalf of owner. Ms.
Zalman gave decision to relay to respondent.

Fine Certification Hearing
Case No. 19-3600 Mass Boynton 3060 LLC
Property Address: 3060 N Seacrest Blvd.

Officer Hart presented the case. Notice of violation January 3, 2020. Original Magistrate
Hearing October 21, 2020. Respondent did not appear. Compliance date November 20,
2020. Fine proposed was $25 per day plus $384.12 administrative fees. Property last
inspected December 4, 2020, property did comply. The total fine is $350, plus
administrative fee $384.12, for a total of$734.12.
Sharon Wagmon, owner, appeared and explained a chain of events and misunder-
standings with City and vendors to get water heater installed properly. Officer Hart
rebutted the testimony with what had been explained to cure violations on the plantings.
Respondent gave evidence of contacts to work with the City all along. City recommended
to waive the fees.
Decision
Based on testimony, Ms. Zalman waived all fees and costs.
Case No. 20-0820 David C Leary
Property Address: 29 Misty Meadow Dr
Type of Property: Single-family, homesteaded
Violation(s): As noted in the Notice of Violations.
Officer Guim presented the case. Notice of violation April 15, 2020. Original Magistrate
Hearing September 16, 2020. Respondent did appear. Compliance date October 31,
2020. Fine proposed was $100 per day plus $384.12 administrative fees. Property last
inspected December 4, 2020, violations still exist (the pool is still green, moldy porch) and
property is in the middle of a residential zone and neighbors are complaining. There are
78 days of non-compliance, fine continues to accrue at $100 a day. The total fine is
$7,800, plus administrative fee $384.12, for a total of$8,184.12.
Dave Leary, owner, appeared, stating that a lot has been done on the property; however,
Ms. Zalman suggested respondent finish the work and apply for a lien reduction and the

fine continues to accrue. Though some items have complied, there is a health hazard
with the mold and green water in pool. The lien reduction process was explained.
Decision
Based on testimony, Ms. Zalman certified the fine of $8,184.12, including administrative
fee, which fine continues to accrue.

Building permit applicability: resubmit building permit
application plans and obtain a fence permit.
Officer Daniels presented the case, which was a routine inspection. Initial inspection date
July 20, 2020. Not a repeat violator. Initial notice issued October 9, 2020. Ten days
were given to comply. Date notice sent Certified Mail November 12, 2020, green card
signed November 19, 2020. Building permit submitted, rejected with comments,
resubmitted and denied again. Last activity on this case November 14, 2020. City
recommended property to be in compliance by March 1, 2021, or $25 a day assessed,
plus administrative fee of$384.12.
Juliet Ciambrone, owner, gave history of submitting plans and being rejected; last date
submitted was November 14, 2020, uploaded digitally. However, City states that last
submittal was on October 24, 2020, it was reviewed and denied. Ms. Zalman will grant
extra time to resolve.
Decision
Based on the evidence, Ms. Zalman ordered compliance date of March 31, 2021, or $25
a day fines assessed and administrative fee of$384.12.
Lien Reduction Hearing

Officer Pierre presented the case. Notice of violation date November 17, 2017. The

was March 21, 2018, or $50 per day plus administrative fee. Date of compliance was
October 21, 2020. The property has 949 days of non-compliance with fines of $50 per
day in fines for $47,450.00 and administrative fee of $634.12, for a total of $48,084.12.
Owner of property has complied for lien reduction.
Angie Niebel, United American Properties dba Nautica Realty representative, stated
US Bank owns the property and gave it out to Hudson Homes Management LLC to
manage, which in turn assigned it to a local real estate company; and that the property
just went under contract for $320,000. The property was foreclosed in 2016, a history of
the chain of owners and managers was given. Current manager took custody in October
2020 as a vacant property, at which time City was contacted and property was brought
into compliance at a cost of$4,500; additional costs were discussed (HOA lien, etc.). City
recommended 50% reduction plus fees and costs.
Decision
Based on the testimony, Ms. Zalman ordered the lien reduced to $18,634.12,
administrative fee included.

Officer Karageorge presented the case, which was a routine inspection. Initial inspection
date August 30, 2018. Not a repeat violator. Initial notice issued September 11, 20187
via courtesy notice. Thirty days were given to comply. Date notice sent Certified Mail
November 4, 2020, green card date November 20, 2020. All items have been resolved
except for driveway; permit has been in Plan Check for one year since January 2020.
Permitting Department noted questions had been sent to application and no reply
received. City recommended property to be in compliance by March 1, 2021, or $50 a
day assessed, plus administrative fee of$384.12.

Theresa Hall Flynt, owner, appeared, stating the repairs to the driveway, basically a
rebuild, are a hardship on her fixed income. Other family members listed as owners have
passed away. Respondent was unaware of the questions pending from the Building
Department. Ms. Zalman instructed respondent to work with City to get the questions
answered and permit approval can be made.
Decision
Based on the evidence, Ms. Zalman tabled the case 90 days.
Case No. 20-1623 Boynton Beach Hawks Inc.
Property Address: 260 N Palm Dr

Officer Karageorge presented the case, which was a routine inspection. Initial inspection
date July 16, 2020. Not a repeat violator. Initial notice issued July 16, 2020, via door
hanger. Then days were given to comply on original items. Property was posted and at
City Hall on January 7, 2021. Date last inspected January 19, 2020. The grass has been
mowed, but stones and bags are still in yard which owner claims are to be used for a
pathway. Wood pallets and mattresses have been removed. BTR/COU has not been
obtained. City recommended property to be in compliance by March 15, 2021, or $50 a
day assessed, plus administrative fee of$384.12.
Guy Etienne, owner, appeared, stating there are plans to refinance the house which is
taking longer than expected due to Covid and unemployment, cannot afford taxes,
insurance, or fees to get the BTR/COU. No rental income is being earned on property.
Ms. Zalman tabled the matter to allow owner to continue working with lenders.
Decision
Based on the evidence, Ms. Zalman tabled the case 60 days.

Lien Reduction Hearing
Case No. 16-1127 S1 Capital Partners LLC
Property Address: 207 SE 25th Ave
Type of Property: Single-family, homesteaded
Violation(s): As noted in the Notice of Violations
Officer Pierre presented the case. Notice of violation date June 30, 2016. The Magistrate
hearing was on September 21, 2016, no one appeared. Compliance date given was
October 1, 2016, or$100 per day plus administrative fee. Date of compliance was March
9, 2017. The property has 220 days of non-compliance with fines of$100 per day in fines
for $22,000.00 and administrative fee of $634.12, for a total of $22,634.12. Owner of
property has complied for lien reduction. [see related Case No. 16-1431]
Jay Morrissette, new owner, stated intends to homestead the property, wants to clear
away the liens before moving in. Has taken a year to get the property cleared out, bought
the property with the liens on it. Ms. Zalman heard the related case before coming to a
decision. City recommended 5% reduction on this lien. Negotiations ensued,
consideration given because property is now homesteaded.
Decision
Based on the testimony, Ms. Zalman ordered the lien reduced to $2,000, administrative
fee included.
Case No. 16-1431 S1 Capital Partners LLC

Officer Pierre presented the case. Notice of violation date October 9, 2016. The
Magistrate hearing was on November 16, 2016, no one appeared. Compliance date
given was December 15, 2016, or $600 per day plus administrative fee. Date of
compliance was December 22, 2020. The property has 1,469 days of non-compliance
with fines of$600 per day in fines for $881,400.00 and administrative fee of$634.12, for
a total of $882,034.12. Owner of property has complied for lien reduction. [see related
Case No. 16-1127]
Jay Morrissett, new owner, stated intends to homestead the property, wants to clear
away the liens before moving in. A lender was used on purchase price of$185,000, knew
about liens but not that this second lien was so high. Improvements, undoing unlawful
work that was done, compounded by current contractors doing bad work that needed to
be redone, estimate of $92,000 to get property to pass inspections. Owner owns

restaurant in neighborhood and wants to live close to it. City suggested this lien could be
waived.
Decision
Based on the testimony, Ms. Zalman ordered the lien be reduced to $20,000,

Neighbors say that owners have both passed away and the owners' son turned it into a
squatters house. Law enforcement was called to vacate and board up the property as a
health and safety issue.
