Minutes 02-12-85MINUTES OF THE PLANNING AND ZONING BOARD MEETING HELD IN COUNCIL CHAMBERS, CITY HALL, BOYNTON BEACH, FLORIDA, ON TUESDAY, FEBRUARY 12, 1985 AT 7:30 P. M. Annunziato, Director of Planning Tim Cannon, Senior City Planner Chairman Ryder called the meeting to order at 7:30 P. M. and introduced the Members of the Board, Mr. Annunziato, Mr. Cannon, and the Recording Secretary. He acknowledged the presence in the audience of Mayor Carl Zimmerman, Councilman Nick Cassandra, Samuel Scheiner, Vice Chairman, and H. Peter Mooij, Member, of the Community Redevelopment Agency, Owen Anderson, Executive Director of the Greater Boynton Beach Chamber of Commerce, and Kipp Friedman of the Boynton Beach News Journal. Chairman Ryder read a memorandum stating that Mr. Linkous would not be able to attend the meeting, and he announced that Mr. Schultz was out of town. MINUTES OF JANUARY 8, 1985 Mr. Hester moved, seconded by Mr. Pagliarulo, to approve the minutes. Motion carried 5-0, with Mr. Mauti and Mr. Wandelt abstaining from voting as they were not present at the meet- ing of January 8. ANNOUNCEMENTS Special MeetinH Mr. Annunziato called attention to the announcement on the agenda saying a Special Meeting of the Planning and Zoning Board will be held on Thursday, February 14, 1985, at 7:30 P. M., in the Council Chambers to conduct a public hear- ing in reference to the Central Business District. The Board will be taking up a consistency review of the Central Business District zoning regulations and the attendant land development regulations. - 1 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Chairman Ryder commented that this follows a workshop meet- ing the Board had some time ago. COMMUNICATIONS Mr. Annunziato had a communication relating to "NEW BUSINESS, PUBLIC HEARINGS, Conditional Use," 91, "Leisure- ville Recreation and Maintenance Facility," which he said he would hand out when the matter comes before the Board. Chairman Ryder had a Memorandum dated January 24, 1985 from Peter L. Cheney, City Manager, addressed to City Boards and Commissions, and felt this Board had observed the procedure outlined in the memorandum. OLD BUSINESS Pre-Application (Tabled) Project Name: Agent: Owner: Location: Description: Lake Boynton Estates, Plat No. 5 Enrico Rossi, P.E. Riteco Development Corporation E-4 Canal at Woolbright Road Sixteen lot, R-lA Single Family Subdivision Mr. Gregory moved, seconded by Mr. Hester, to take this matter off of the table. Motion carried 7-0. Enrico Rossi, p. E., Rossi and Malavasi Engineers, Inc., Suite 407, Forum III, 1675 Palm Beach Lakes Boulevard, West Palm Beach, Florida 33401-2179, spoke on behalf of Riteco Development Corporation, and asked that the pre-application be withdrawn from the Board's agenda. At the present time, buyers are looking at the land, together with other parcels of land abutting it (namely, the Kislak piece), with the idea of coming forward with another plan. Mr. Rossi also understood the property of the First Baptist Church might be involved in a combination of parcels, which will include this one. In view of those ongoing circumstances, the Applicant asked that the pre-application be withdrawn. Chairman Ryder was not too happy with the fact that this was zoned Recreational and, on behalf of Mr. Rossi's principal, the Board and City Council finally went for R-lA. He hoped the Board would not set any precedent, whereby they change the zoning and then the ownership changes. Mr. Rossi was sure this Board and the Council would have a look at the overall picture of what comes forward and deem what is best for the City. - 2 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 As the applicant withdrew the pre-application, Mr. Annunziato advised that nothing else could be done about it. Redevelopment Area Moratorium Variance Request (Tabled) Project Name: Agent: Owner: Location: Description: Gustafson Commercial Building George Davis Thomas Gustafson 800 N. E. 3rd Street Request for a variance to Ordinance No. 83-40 as extended and site plan approval to con- struct a commercial/industrial building to house roofinig and painting supplies Mr. Pagliarulo moved, seconded by Mr. Mauti, to remove this from the table. Motion carried 7-0. At the last meeting, Chairman Ryder said this was discussed at some length. In accordance with the memo from the City Manager and the acquiescence of the Planning Director, it was thought to be in the interest of the City to have this matter tabled because more information was needed, particu- larly from the standpoint of environmental factors. Mr. Annunziato informed the Members that the applicant responded with modified site plans and additional informa- tion. All but one of the environmental factors were addressed in the application that was submitted. The Staff made a positive recommendation, subject to staff comments. George C. Davis, Architect, in his letter dated January 30, 1985 to Mr. Annunziato, responded to the questions raised by the City Manager. Perry A. Cessna, Director of Utilities, addressed the last of the environmental concerns Staff had in his memo of February 6, 1985, addressed to Mr. Annunziato, concerning floor drains and the proposed truck maintenance bay. Mr. Annunziato handed them out to the Members. The site is at N. E. 7th Avenue and N. E. 3rd Street. They are proposing to add a four bay storage facility to the existing storage building they have with offices. Parking spaces consistent with the Code requirements and a truck loading bay have been added. Concerning some of the environmental concerns with respect to the handling of petroleum products, Mr. Annunziato said the petroleum handling facilities have been redirected to areas where they are easily accessible, and construction of - 3 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 a concrete structure underneath the diesel and mineral spirits has been proposed. Existing gasoline pumps are pro- posed to be removed and new pumps installed. Floor drains are proposed to be added to where the trucks are to be washed and maintained. They will be directed to a grease trap first and then to a sewer system. The land- scaping has been approved. Mr. Annunziato told the Members to read the letter from Mr. Davis, dated January 30. Additional comments were made by the Building Department, which Mr. Annunziato read. He also read the comments from the Utility Department, which he handed out tonight, and comments from the Energy Coordinator, Public Works,and Planning Departments. Staff recommended that the plan be approved and that the Board make a recommendation of approval for a variance to the Moratorium Ordinance. George C. Davis, Architect, 1100 South Federal Highway, Boynton Beach, thought he was aware of the staff comments but asked Mr. Annunziato if there was anything new. Mr. Annunziato replied there were some minor things. The Utilities Department is asking that the maintenance facility within the building be connected to the grease trap for a drain system. The Building Department is requiring that sidewalks go through the drives, the dumpster be screened, and directional signs be put in the parking lot. Public Works wants to be notified when they pour their slab. Mr. Annunziato added that the applicant still must complete the Environmental Review and pay the fee, and the Energy Coordinator noted parking lot lighting details are required. Mr. Davis understood the comments and said the owner is willing to comply with them. Mr. Mauti moved to approve the site plan and recommend a variance, seconded by Mr. Wandelt. Motion carried 7-0. NEW BUSINESS PUBLIC HEARINGS Conditional Use Project Name: Agent: Leisureville Recreation and Maintenance Facility James Torbit, President Palm Beach Leisureville Community Association, Inc. - 4 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Owner: Location: Description: Romireo Andino, Trustee 1007 Ocean Drive Request for conditional use approval to secure an after-the-fact approval of a maintenance storage facility Chairman Ryder informed the Members that this facility is located in one of the three recreational areas in Leisure- ville. As a result of the Comprehensive Plan which was finally adopted, this area and other similar recreation areas were assigned the official category of Recreation. Because it is a recreational area, Chairman Ryder said the request is subject to a conditional use. Mr. Cannon said this came before the Board in the summer of 1983, and the City Council at that time agreed to disapprove it. Since then, the City's Attorney and the Applicant's Attorney have worked out an agreement as to what the use of this storage facility is going to be. Mr. Cannon showed a survey of the site plan, which differed somewhat from the site plan itself. The storage facility is located on the extreme western boundary of the recreation parcel. He indicated Ocean Drive on the south and the surrounding land uses and zoning, as outlined in Mr. Annunziato's memorandum of February 1, 1985 and read the memo o Included in the packets furnished to the Members was a letter from Mark B. Schorr, Attorney at Law, of the firm of Becker, Poliakoff & Streitfeld, p. A., Corporate Park at Cypress Creek, 6520 North Andrews Avenue, Fort Lauderdale, Florida 33310-9057, dated December 7, 1984, and addressed to the Planning Department. Mr. Cannon called attention to the last page, which detailed the exact items that can be put in the storage area. There was also the specification that these pieces of equipment are only to be those used and leased by the Palm Beach Leisureville Community Association. The Planning Department recommended approval of this as a conditional use, subject to its recommendation that the hedge be improved on the north and west sides and installed on the south side and that the uses be limited to the uses which the Applicant's Attorney stated in his letter. Sharon A. Weber, Attorney at Law, of the law firm of Becker, Poliakoff & Streitfeld, appeared instead of Mark Schorr to represent Palm Beach Leisureville Community and the appli- - 5 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 cant, James Torbit. She stated they were speaking of a con- ditional use, which was approved by the Board on July 12, 1983. They were back, seeking approval again, for the exact facility. The only difference is a tractorlike vehicle (mini sneaker) has been removed, and the shrubs have grown higher. Attorney Weber felt the report of the Planning Department was adequate to describe the criteria the Board was to consider in granting the conditional use. Attorney Weber introduced Members of the Palm Beach Leisure- ville Community, who would speak. Chairman Ryder asked her if she was aware of Mr. Annunziato's memorandum, and Attorney Weber replied affirmatively. James Torbit, President, Palm Beach Leisureville Community Association, Inc., 2399 S. W. llth Avenue, said the real reason they wanted the facility was because of an economic decision which made it necessary for them to take over their irrigation system. In 1980, he knew the irrigation system was in very poor condition, and Mr. Torbit told about the system. They have 19 pump houses and had Industrial Service Company give a report on them. They also have miles of plastic pipe, a lot of valves, and sprinkler heads there. Mr. Torbit read the report from Industrial Service Company in reference to the pump houses. Most of the pump installa- tions were generally poor, and some were dangerous. The maintenance ranged from none to poor, and the workmanship was poor regarding type, quality and places of equipment. Mr. Torbit said the system was poorly designed from the beginning. Mr. Torbit gave the estimates they received if a contractor would do this and the cost to the Asociation after they took over themselves. If they had not taken over the system, they would have been in serious budget trouble. Mr. Torbit itemized what taking over the system entailed. The third item was a secure storage area for the vehicles at night to prevent vandalism. Mr. Oliver Troup, General Manager of Palm Beach Leisureville, a paid employee, said the facility at issue was constructed in 1982. It is a fenced, concrete slab, well landscaped, as shown in the photographs he presented to the Members. Mr. Troup said the Association Members and employees of Leisureville are well aware of the sensitivity and rights of all of the Members of Leisureville. For the two years that they worked on this project, Mr. Troup said they have provided an off-site, rented facility for those items that are objectionable. - 6 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 What they were requesting tonight was the conditional use of the facility for the storage of rolling equipment only. Mr. Troup stated that they can and will abide by the recommenda- tions and will do what is necessary to make this a non- objectionable property. Lowell Bennett, one of the Directors of Palm Beach Leisure- ville Community Association, wanted to tell the Members about some of the problems the Directors face. In the documents they were issued at the time Leisureville was built, it states that the Directors are charged and legally bound to maintain the aesthetic standards of Leisureville, but they are restricted by the developer to 5% a year as the amount of money they can add to a monthly assessment. When they were faced with restoring the irrigation system and the fact they could not get more money from the residents, there was only one step they could take, which was cost reduction. Referring to the conditional use they were asking for, Mr. Bennett found it ironic if you considered that if Leisure- ville were being built today under the present Planned Unit Development regulations, the storage facility would be man- datory, and the Board probably would not approve a PUD without a storage facility. What they are trying to do is go back and correct the lack of a requirement at the time Leisureville was built. Mr. Bennett said the alternate is to discontinue certain functions within Leisureville because they must stay within their budget allotments. If they are not allowed to make effective cost reductions in this instance, which would require a storage facility for their vehicles, they must take another course. At this time, they know of no other course they can afford. Mr. Bennett referred to the Planning Department giving them approval with stipulations they will be glad to comply with, and asked the Planning and Zoning Board to support them and approve the conditional use. Attorney Weber requested that she be allowed to respond should the audience have any comments. Chairman Ryder asked if anyone else wished to speak in favor of the request. There was no response. Chairman Ryder asked if anyone wished to speak in opposition to the request. There was no response. THE PUBLIC HEARING WAS CLOSED. Chairman Ryder read a letter dated October 1, 1983, signed by 27 property owners of Leisure Lake Circle Community - 7 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Association, Inc., agreeing to the variance if they are pre- sented with a written agreement. Chairman Ryder pointed out that the letter from the Applicant's Attorney spelled out the type of equipment to be stored, and the analysis made by the Planning Director took into consideration that this will be adhered to. He said the agreement was up to them. Chairman Ryder said the development is about 15 years old and was probably the first PUD in the City. At that time, the primary concern was the inclusion of recreation facilities, and he stressed the importance of recreation facilities. Chairman Ryder noted there was some concern about the impact on the neighbors and said only two were within any appreciable proximity. Chairman Ryder knew the Board of Directors looked for alternatives. The all important one was the matter of the economics. In the absence of creditable opposition, as Mr. Annunziato noted, it would not impact unfavorably on the people in the immediate vicinity. Also, considering the fact that there are no common areas in the development which could be used for this purpose, Chairman Ryder felt the Board had to go that way. He informed Mr. Gregory that he was agree- ing with the recommendations of the Planning Department. Mr. Gregory moved to approve the request for conditional use, subject to staff comments. Mr. Mauti asked if any repairs to equipment (carts, lawn mowers, etc.) would be made on the premises. Mr. Troup replied that all minor repairs (changing and repairing of tires and equipment) would be made on the premises, but all major repairs would be made off of the premises. Mr. Mauti brought up the question because he does a lot of maintenance work for subdivisions and has found that most of the major developers in major developments such as Leisureville have disabled lawn mowers and golf carts that do not run and deteriorate on the premises. Before they know it, Mr. Mauti told Mr. Troup they will have one eye sore after another. Mr. Troup advised there is no shop at all. Because of the obligation of the Homeowners' Association to take care of the irrigation, lawns, and outside of the build- ings, Chairman Ryder said it is quite apparent as you go through Leisureville that the maintenance has been well kept. - 8 - MINUTES ' PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Mr. Mauti continued that he has seen developments where they have broken down lawn mowers that seem to mount up. This is done so they have spare parts, which may be proper in some cases, but it tends to put an eye sore on the premises. If there will be no major repairs, Mr. Mauti said he would be satisfied. Mr. Annunziato again called attention to the letter from the Applicant's Attorney to the Planning Depart- ment, which lists the vehicles which can be stored. Mr. Wandelt seconded Mr. Gregory's motion to approve the request for conditional use, subject to staff comments. Motion carried 7-0. W. 17th Avenue at 1-95 north side Request for conditional use approval to con- struct a permanent home for the Leroy Parker Post No. 288 American Legion Lodge Chairman Ryder commented that this project has R-3 zoning regulations, which allow clubs or lodges as a conditional use. Mr. Cannon said this property was part of a larger parcel of 19 acres which extends all the way to Seacrest Boulevard and then some distance northward. When the City Zoning Map was changed, the existing site of Post #288 was made a non- conforming use. Consequently, the City was willing to deed this property to the American Legion. Mr. Cannon indicated the surrounding land uses and zoning on the overlay. He read the Memorandum addressed to the Board, from Carmen S. Annunziato, Planning Director, dated February 1, 1985, which included the Planning Department's staff com- ments. One of the comments was that the applicant will have to construct a sidewalk along 17th Avenue in order to meet the Street and Sidewalk Ordinance and put in fire hydrants so that no part of the building is more than 200 feet from a fire hydrant. With reference to the second comment, Mr. Cannon contacted Post %288 and spoke to the Post Commander. Considering typical use, Mr. Cannon said the parking would be adequate in most cases. However, at certain times there probably would be overflow parking, but the overflow parking could be accommodated on N. W. 17th Avenue. To prevent tearing up -- 9' -- MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 of swales, Mr. Cannon suggested signs or other methods for keeping the cars parked on the pavement of N. W. 17th Avenue. Mr. Cannon called attention to the third comment. The facility has a small kitchen, so there probably will not be a great deal of food preparation there. Mr. Cannon read comment %4 where it said, "Sewer service is available from a manhole," and said the Members should note the memo from Perry A. Cessna, Director of Utilities, dated February 1. As to comment %8, Mr. Cannon told the Members that with the existing membership of the American Legion and what they anticipate as a membership, this use would be compatible with the residential neighborhood and would not change the character of the neighborhood. Mr. Cannon then read the staff comments from the Fire, Utility, Police, and Public Works Departments. He also read the comments from the Energy Coordinator and Urban Forester/Horticulturist. Mr. Cannon concluded by saying the Planning Department found this to be consistent with the Comprehensive Plan and recommended that, since it meets the conditional use criteria, that the conditional use be approved. Mr. Leroy Harris, Agent, 212 N. W. 12th Avenue, Boynton Beach asked the Board to consider this so the American Legion will have a permanent home. Chairman Ryder asked Mr. Harris if he was aware of the staff comments. Mr. Harris asked if the fire hydrants would be the American Legion's expense. Generally and almost exclu- sively, Mr. Annunziato said the installation of fire hydrants is the responsibility of the developer. Mr. Harris questioned the Police Department's second comment: "Lights mounted on poles with photo cells," and the Energy Coordinator, s comment about lighting. Mr. Annunziato advised that the Code requires that the designer submit some calculations with respect to the amount of lighting, wattage of the lights involved, etc. Mr. Harris sa~d they had dis- cussed the lighting and asked Mr. George Davis to give some comments on the proposed lighting. Mr. Davis was aware of them. Chairman Ryder asked if anyone else wished to speak in favor of the conditional use. There was no response. Chairman Ryder asked if anyone wished to speak in opposition to the conditional use. There was no response. THE PUBLIC HEARING WAS CLOSED. Mr. Mauti moved to approve the request for conditional use approval, subject to staff comments, seconded by Mr. Hester. MOtion carried 7-0. Parking Lot Variance Project Name: Agent: Owner: Location: Description: Mobil Oil Service Station Kieran Kilday & Associates Mobil Oil Corporation West Boynton Beach Boulevard at Congress Avenue, southeast corner Request for relief from Section 5-141(g)(3) of the Parking Lot Regulations to be permitted to continue using non-conforming driveways after reconstruction of the facility It was apparent to Chairman Ryder that the applicant proposed to raze the existing facilities and construct new pump islands, a car wash, and convenience store. Mr. Annunziato said this was a request for a variance to the parking lot regulations, specifically to the location of driveways as they relate to the intersection of the rights- of-way lines of the public rights-of-way (West Boynton Beach Boulevard and Congress Avenue, in this instance). The parking lot regulations require that the Technical Review Board (TRB) provide for the Planning and Zoning Board a written recommedation when variances are requested, which the Members had in their agenda packets. Mr. Annunziato said the recommendation was that the application be approved in part and denied in part. Specifically, the recommendation was that the two driveways in close proximity to the intersection of the rights-of-way lines should not be permitted to remain after the gas station is reconstructed and the two driveways furtherest away from the intersection be permitted, in that the TRB did not feel it would be right to deny the applicant access to his site. - 11 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Mr. Annunziato read the three reasons for their recommen- dations from the bottom of page 1 and the top of page 2 of his Memorandum of February 6, 1985, which was addressed to the Board. As an example for ~2, he said as one attempts to exit west out of the gas station and continue going west, he would be crossing five lanes of traffic to get into the furtherest left turn lane. It is anticipated that the drive- way which connects to the east of the parking center parking lot and the driveway which connects to the south of the parking center parking lot will continue. The TRB asked that the Applicant provide some additional information when his site plan is submitted. One is that the TRB is desirous of seeing an overall traffic plan, not only for the Applicant's property but the intersection and shopping center, so the TRB can make some comments for the Planning and Zoning Board when that is submitted. Also, a dedication of seven feet of right-of-way will be required for Boynton Beach Boulevard. Mr. Kieran J. Kilday, Landscape Architect, Kilday & Associates, Suite 300E, 1551 Forum Place, West Palm Beach, Florida 33401, representing Mobil Oil Corporation (the owner of all of the Sunoco stations in Florida), said since Mobil Oil purchased the Sunoco stations approximately a year ago, they have been critically visiting each of the stations to see what sort of improvements and upgrading can be made to the stations. Mr. Kilday expressed that "access" was probably the most critical issue regarding not only Mobil but all service sta- tions dealing with upgrading their sites. Because of that, the decision that will be reached regarding access will, in effect, be the corporate decision of whether or not an up- grade is the best use of the site. Mr. Kilday was not say- ing they would not upgrade the site but would weigh the advantages and disadvantages of traffic. Mr. Kilday read the TRB's report and has been corresponding with the staff and Mobil Oil to try and come up with some sort of a solution that would satisfy both parties. He brought a colored plan and wished to go over the traffic patterns and show where the turnouts are. Mr. Kilday pointed to Boynton Beach Boulevard, which was to the north, and Congress Avenue to the west of the site. He showed the four turnouts that currently exist on the site with the existing station. The existing station takes in the area in the middle of the site. Two gasoline pump - 12 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 islands are very close to Congress Avenue, and one existing pump island is located along the Boynton Beach Boulevard a rea. Mr. Kilday said the process by which people enter and leave the project today, even under this plan, is basically the same. Both roads are median divided roads, so they are only taking in traffic from one direction. People on Congress Avenue entering the site would be coming from the south and would most likely take the first turn in, pull up to the existing pump island, turn back out, head north, turn right, or cut across all the way into traffic to get into a left turn lane (Police Department's concern). Chairman Ryder asked him to suppose the only way you could go was right, which it is limited to right now. In making the right turn, there could be a matter of indecision. Chairman Ryder commented that it is a very active lane. Mr. Kilday admitted it is a safety ~hazard and said they all agreed to. that. On the Boynton Beach Boulevard side, Mr. Kilday said they are coming from the west, heading to the east. He indicated a median and where they would turn in, pull into the exist- ing pump island, and head again to the east. Again, Chairman Ryder said they would be cutting across. Mr. Kilday argued that there was no reason to cut across here. When they make the left turn and want to use the first entrance, Chairman Ryder pointed out that they would be cutting across people wanting to make the right turn. Mr. Kilday wanted to suggest a compromise position to the Board. Coming along Boynton Beach Boulevard, where it is essentially an entrance only, they feel it is very necessary for them to create traffic in a proper line. They also feel if it were closed, traffic coming up here would be forced into a situation of making a "U" turn and slow down that much more within the right-of-way line. Mr. Kilday requested that the two remain open. The situation of where the one closest to the intersection is an exit, and possible conflict and cutting off of other people in lanes is a problem was one Mr. Kilday said they would agree to having closed. In summary, Mr. Kilday was requesting that in lieu of the four openings they originally requested and in lieu of the two openings staff was recommending, they be allowed to have one on Congress and the two on Boynton Beach Boulevard with the knowledge that one is essentially an entrance and another is an exit. He said they would put signage to that effect. - 13- MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Chairman Ryder pointed out that they still have two others from the shopping complex itself. If you come down Congress Avenue and drive in to the pump, Mr. Mauti asked how you would exit, if they close that one. Mr. Kilday answered that the people will just have to turn around and come back out. He indicated the place and said they could live with that. Mr. Kilday showed the easements that would work against them. He emphasized that they would love to have the four openings but are trying to be reason- able. Chairman Ryder commented that this corner gets busier every day, and Mr. Kilday added that the Sunoco station is an existing problem. Mr. Kilday said they have a situation where they have four turnouts, a service station, two gas pumps located very close to the intersection, and an oppor- tunity to promote a rebuilding that is not going to only reduce the amount of conflicts on the site but will bring the site back to the Community Appearance Board so the land- scaping will be revised and upgraded, and the new facilities will be upgraded. Mr. Kilday stated that Mobil would like everything: a new facility and all of the turnouts the way they are. He indi- cated the one turnout Mobil will depend on. In exchange, they feel that they can proceed forward and do all of the other things that they think will happen down the road in the renovation. Mr. Gregory asked if there will be any new pumps on the south side of the building. Mr. Kilday replied that the new pumps will be underneath the canopy area, and he indicated the two on the north and two on the south. He showed how someone would come in and then go out into the shopping center, back around and out. There is just a building and no pumps in the center. There are only four pumps. Chairman Ryder called attention to the two curb cuts on Boynton Beach Boulevard. As you go east, immediately you have another one going into the shopping complex, and another one beyond that. Chairman Ryder remarked that there are just too many, and this is the opportunity to do something about it because the traffic is getting worse all of the time. He thought Mobil Oil was being unreasonable in trying to insist on two of them at critical locations, right at a corner. Because one was an "in" situation, Mr. Kilday thought it was significantly different than the other one in terms of possible conflict. - 14 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Mr. Annunziato said they would rather have the driver slow down as far from the intersection as possible. When he mentioned that in the future there will be potentially 70,000 trips per day going through the intersection, it is likely to happen, and they anticipate that this intersection will not break the service out. It looks like a Million Dollar solution to make it any better. Certainly, this is the most dangerous driveway on the site and does not help the City. Mr. Annunziato continued by saying any entrance within close proximity to an intersection like that causes problems. People will slow down to enter that driveway in a traffic lane within 30 feet of an intersection. Vice Chairman Winter asked how you would get back out if the one closest to the intersection was closed off and you would enter in the easterly one. Mr. Annunziato said they talked about that at the TRB, and it was a concern, but they would rather have people making those decisions outside of a six lane highway. Chairman Ryder thought the Board would be remiss to permit the continuance of something like this. Mr. Annunziato saw a gas station with two curb cuts function- ing quite well on Power Line, just north of Palmetto, and it does work. It is a decision Mobil Oil will have to make, but Mr. Annunziato did not think the Board should consider the economic issues that were raised. These are safety issues. Mr. Wandelt recalled that the Mobil station on Congress and Woolbright has two entrances and functions properly. He suggested that they could change the configura- tion of their building. If this was a brand new, vacant piece of property, Mr. Kilday said there would be no doubt that would be the way it would go. It is physically a service station that is oper- ating with four turnouts, and it is operating with minimum stacking distance, a lot of congestion, and a lot of other things. Mobil is responding and suggesting going halfway with the City. Mr. Gregory asked what the distance is between the inter- section and the entrance. Mr. Kilday replied 36 feet on both sides. Chairman Ryder could not overlook the fact that this is an opportunity to reduce a traffic hazard. He did not see how the Board could compromise. Mr. Gregory wondered if there was a limitation on the size of the entrance. Mr. Annunziato answered that you cannot go - 15 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 any smaller than a certain number of feet for a one-way driveway. Mr. Gregory asked if it would be of any help to have a larger entrance way at a greater distance from the intersection. Mr. Kilday replied that another thing that may be~of help would be if they were able to maintain this pattern, take the turnouts and move them both in that direction. They are 40 foot turnouts but they may be able to reduce the size and move one to a place he indicated on the overlay and the other to another place. They could move the whole facility in that direction. Chairman Ryder did not like that because almost a continuous curb cut would happen. Mr. Kilday pointed out that they would be smaller curb cuts. Chairman Ryder said the crux of the situation was they are adjlacent to the intersection. Mr. Mauti asked if it would not be more of an advantage to Mobil Oil not to have the drive-thru that is closest to the intersection. He referred to accidents that could occur and thought it would be an advantage more than a hindrance to Mobil Oil. If Mobil Oil had what it wanted, Mr. Kilday said it would be one continuous curb cut. Mr. Annunziato said the Members had to remember what is happening at that corner. From the north approach, they have the double left turn movement, so they will be occupy- ing two lanes coming into that intersection. From the south, they have a right turn movement, so you either have three lanes turning or three lanes coming at you on the left. Chairman Ryder said they had an occasion to consider also, on the other side of the road, the fact that it would be beneficial to cut out one of the curb cuts because it pro- vides for indecision on the part of the motorist. Mr. Kilday was in favor of cutting out one. Chairman Ryder asked if anyone else wished to speak in favor of the application. There was no response. Chairman Ryder asked if anyone wished to speak in opposition to the applica- tion. There was no response. THE PUBLIC HEARING WAS CLOSED. Mr. Mauti moved to approve the request, subject to all staff comments. Mr. Wandelt seconded the motion, and the motion carried 7-0. The Board took an intermission at 8:55 P. SUBDIVISIONS Master Plans - 16 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Project Name: Agent: Owner: Location: Description: Savannah Square Enrico Rossi, P.E. W. 22nd Avenue, north- east corner Request for master plan approval to construct a 20~ acres commercial subdivision At the meeting last month, Mr. Annunziato said the Board approved the pre-application for this request. This is just north of Motorola. Access to the site is proposed off of 22nd Avenue and would be somewhat just to the west of the site. There are two points of access on Congress (one south central and one north central). The north central is a public road right-of-way (a collector, which serves the Boynton Beach Park of Commerce as it continues eastward). The site is to be served by master utilities along the east/west entrance road and also along N. W. 22nd Avenue with the loop system for water through the property. There is a proposal for a sewage collection system consist- ing of a pumping station located just north of the proposed lake with the gravity sewer system to serve all of the par- cels proposed. A lake on the east side of the proposed sub- division, which will act for storm water retention purposes, is also proposed. Mr. Annunziato read the staff comments from the Engineering and Utility Departments and handed out to the Members a letter dated February 11, 1985, addressed to him, from Charles R. Walker, Jr., P.E., Director, Traffic Division, Department of Engineering and Public Works, Palm Beach County, which he read. Mr. Annunziato said the first exercise they went through with respect to this application was to determine whether the traffic impact for this proposal was included as back- ground traffic within the Boynton Beach Park of Commerce's development of regional impact application for development approval. It was and, therefore, the capacity on Congress Avenue does exist and was considered at the time of the approval of the DRI (development of regional impact). Mr. Annunziato told the Members they were again back to the intersection of Boynton Beach Boulevard and Congress Avenue, which seems to be the key to traffic movement in West Boynton Beach. The problem now was on the east and west approaches. In order to have the double lefts, east and west approach, Mr. Annunziato said the right-of-way has to be - 17 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 expanded from its current 108 feet to 120 feet, which means taking out rows of parking and potentially taking out some gasoline pumps, etc., so they were talking about a tremen- dously sizable public improvement. Riteco, through the Department of Commerce, has committed $141,000 to that project and is also paying for the design of the improved intersection and rights-of-way map. Mr. Annunziato said the road impact fees collected from this subdivision, which also critically impacts that inter- section, will be added to that so these two funding sources and what other funding sources that are available can be used to improve that intersection. Mr. Annunziato said staff recommended approval, subject to their comments and the comments noted in Mr. Walker's letter. Enrico Rossi, P.E., Rossi and Malavasi Engineers, Inc., Suite 407, Forum III, 1675 Palm Beach Lakes Boulevard, West Palm Beach, Florida 33401-2179, representing the owner, Sybar Corporation, stated they were in accord with the comments. Mr. Rossi recognized the computation in the letter from Mr. Walker and said it was based on the projected 26 + dollar figure per trip. However, he did not think it was formally adopted as yet. Mr. Rossi said he would discuss it with his client, and they will be willing to abide by the final adopted figure and apply it to the project. He said the $300,000 mentioned in the letter may not be the case. In connection with the turning lanes mentioned in the letter, Mr. Rossi said they had a meeting with Mr. Walker and his staff and are familiar with what Mr. Walker and his staff will be looking for when they send the drawings con- cerning the left turn movements from both 22nd Avenue and Congress Avenue and will abide by them. Mr. Hester moved to approve the master plan of Savannah Square, subject to staff comments and the comments contained in Mr. Walker's letter. Mr. Mauti seconded the motion, and the motion carried 7-0. W. 7th and 8th Streets, south side Request for site plan approval to con- struct a 27,200 square foot shopping center to include a bank with drive- through facilities Mr. Cannon showed the plan on the overlay and said it is part of the small C-2 zoning district, which is immediately west of the Interstate in the vicinity of Wendy's and the recently rebuilt Texaco station. Boynton Beach Boulevard is along the north property line. N.W. 8th Street is above the property on the west, and N. W. 7th Street abuts the property on the east. The site occupies the entire block with the exception of the existing 7-11 store. Access would be by means of one driveway on Boynton Beach Boulevard, one driveway on N. W. 7th Street, and one drive- way on N. W. 8th Street. Mr. Cannon informed the Members that the County will be signalizing the intersections at N. W. 8th Street and Boynton Beach Boulevard and aligning Old Boynton Road directly with N. W. 8th Street. Mr. Cannon pointed out the drive-through for the bank. A fire lane is around the front of the building, and a lane with service areas, dumpsters, and truck loading areas is along the rear. There will also be a six foot masonry wall along the rear of the entire site to block the rear of the store from the view of the single family houses that lie to the south. Mr. Cannon indicated N. W. 1st Avenue, along the entire southern property line, and said there will be no access from N. W. 1st Avenue. The building will be a one story, CBS building with stucco finish and a Spanish tile roof. A couple of towers will go above the one story level. Mr. Cannon read the staff comments from the Building and Planning Departments. With regard to the Planning Depart- ment's comment, the applicant has applied for an abandonment of a utility easement which runs along the entire property down the middle east and west, and that will be an item on the agenda for the Board's meeting in March. Finally, Mr. Cannon read the comment from the City Forester/Horticulturist. Jeff Sherman, of Richard Wensing, Architects & Planners, P.A., Suite #100, 1280 North Congress Avenue, West Palm Beach, Florida 33409, Agents for the Owner, said they have done extensive work with both Mr. Annunziato and Mr. Cannon - 19 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 on the project. They previously submitted it in December of 1984 but had to withdraw the application because of a title problem and a mistake in the survey. Mr. Sherman said they resubmitted it, and it was to be before the Board in January. Mr. Sherman showed a colored rendering and said they pro- vided more than the required landscaping, especially along the residential streets. They purposely did not take access off of 1st Avenue so they would not disrupt the flow of traffic on the quiet residential side. As far as they knew, everything was in complete compliance with all of the Boynton Beach Codes and regulations. As far as the staff comments, the applications have gone to Water Management and the Department of Transportation, and they have been in touch with Mr. Hallahan, Urban Forester, about the trees on site and will move any one of them if they have to. Mr. Sherman also said they will have to take down the Power gas station. Concerning the comments about the abandonment of the utility easement, Mr. Annunziato said the site is bisected, dividing the parcel into the north half and the south half by a utility easement. Basically, it involves removal of the utilities at the applicant's expense. At this time, Mr. Sherman said the utility companies they have made contact with have no objections. Chairman Ryder wondered why they were using built up roof beams, as it is a 60 foot span. Mr. Sherman explained that it allows them to expand from front to back with the frame members that slope the building to the rear. Chairman Ryder pointed out that they are shallower at the end. Mr. Gregory had a great deal of concern with regard to the entrance off of 7th Avenue onto 7th Street. 7th and 8th Streets are sub-standard roads, which can never be widened. The entire subdivision to the south of 7th Street has West Ocean Boulevard and 7th Street as its only means of egress and ingress off of Boynton Beach Boulevard to Congress Avenue. At the present time, coming from the west onto 7th Street off of 1-95, Mr. Gregory said there is already an inadequate stacking lane leading onto 7th Street. At this time, there is substantial waiting of people wanting to get out onto Boynton Beach Boulevard from 7th Street. It seemed more logical and practical to Mr. Gregory that if they were to have an ingress and egress from S. W. 1st Avenue onto the property, using 7th Street and 1st Avenue as a stacking lane into the property, it would probably make - 20 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 more sense, create a better climate for a traffic pattern, and a more convenient position for those people living in that subdivision. Mr. Gregory said there are over 200 units (300 or 400 people) in that subdivision now. Mr. Sherman referred to the signalization at 8th Street and Boynton Beach Boulevard and said there is a big problem with people from either side of the road making a left turn onto Boynton Beach Bouleard. Old Boynton Road is being redirect- ed to align with 8th Street, where traffic seems easier to process. Right now, plans are being drawn by the County. Mr. Sherman also said the existing median cut on Boynton Beach Boulevard is being closed up where Old Boynton Road is, so now it would be very easy to make a left turn from 7th Street by traveling one block to the west and going to 8th Street. Mr. Gregory expressed that was not exactly true. That would serve the people to the west but not all those families living to the east of 7th Street, and they depend on 7th Street as their sole source of ingress and egress to the entire area. What they were doing was creating a stacking lane for the convenience of the shopping center, using 7th Street, when they have an underutilized 1st Avenue that could be used. There was some discussion. Chairman Ryder recalled that recently, the Board had an applicant that wanted to put in a day care center to the east, and the people on 1st Avenue did not want any access. They wanted it on 7th Street. Mr. Gregory pointed out that the people to the east were not heard, and he had first hand knowledge that they had objections to this. He informed the Members that is a road that is no more than 20 feet wide and will never be more than 20 feet wide. Mr. Mauti asked if 1st Avenue would be any wider. He then asked why they should bring a commercial use into a resi- dential area if they bring the traffic into 1st Avenue. Mr. Gregory argued that they are bringing it into 7th Street and denying all of those people to the east. Mr. Mauti retorted that 7th is a commercial use. Mr. Gregory disagreed, saying 7th is not a commercial use but a substandard access to a very overly populated area. Mr. Sherman believed the 7th Street access would be a secondary access. The major emphasis will be off Boynton Beach Boulevard where they have complied with all of the regulations or off 8th Street, where the signal is. Mr. Gregory questioned whether they had ingress and egress on - 21 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 7th Street and said it was similar to the problem they had with the gas station. Mr. Sherman advised that they are well over 180 feet from Boynton Beach Boulevard and met with all of the Boynton Beach regulations. In Leisureville, Chairman Ryder said some of them going as far east as 7th Street take Leisureville Boulevard. He did not know where that would be that much of a problem for people in Leisureville wanting to go to this shopping center. Mr. Sherman said 8th Street is in the process now of being extended and improved from Boynton Beach Boulevard all the way down to Woolbright. He advised Mr. Gregory that they have an entrance on 7th and 8th Streets. Mr. Pagliarulo also thought they would have a problem on 7th Street because a lot of heavy, loud trucks are in there all of the time. He travels that street every day and said when- ever you get one truck over there, that is it. Everybody has to stop and wait to let the truck get by. With regard to the realignment of Old Boynton Road with 8th Street, Mr~ Annunziato commented that the problem with the entire area is the inability to easily access Boynton Beach Boulevard, whether you are coming from the north or south, because of the traffic, and he explained. With the signal- ized intersection at 8th Street, not only will the traffic improvement flow out of Lake Boynton Estates and out of Laurel Hills north, but Mr. Annunziato thought it would be easier for traffic to access in and out of 7th because of the break in traffic that will result from the light at 8th Street. Mr. Gregory asked if they will allow the 40 foot semis to go down off Boynton Beach Boulevard onto 8th and make a left on 1st. Mr. Pagliarulo added that is the problem you have there. The 40 foot semis come around the corner there, and that is it. Mr. Annunziato thought their comments were well taken and said the only access to the industrial area along the track is through 7th Street or 8th Street and in the future would be through 8th Street to Woolbright Road. Otherwise, Chairman Ryder said you are bringing traffic into 1st Avenue. By bringing it in there, Mr. Gregory said they would be allowing a flow of traffic and a stacking lane that would enhance the flow. As it is now, everything will be jammed up from Boynton Beach Boulevard. Anyone wanting to come in-or out going west, coming into 7th Street, is going to create a problem. Anybody who wants to get out of there even in an emergency situation going to Boynton Beach Boule- vard will have a problem because there will be a constant flow of traffic coming out of the shopping center. MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Mr. Sherman called attention to their traffic statement, and said the number of trips generated is not a major impact on Boynton Beach Boulevard or the surrounding city in and of itself. He tended to agree with Mr. Annunziato that because the light is there, people will be able to make a left turn onto 7th Street and have access to Boynton Beach Boulevard. If the situation, which is already very negative and the reason the County decided to put the light there, does not improve, Mr. Sherman said.they have the option to go to 8th Street where there will be a signal and they can turn in either direction with ultimate ease. Because they have three curb cuts, it lessens the load on any one of them. Mr. Sherman believed with 1-95, most people will take access from 8th Street and coming from the west, the traffic flow will be right off Boynton Beach Boulevard. He believed the traffic flow off of 7th Street would be very limited. Mr. Gregory still disagreed with Mr. Sherman and moved to postpone the site plan approval until the applicant comes back with a different drawing showing the access on 1st Avenue. Mr. Pagliarulo seconded the motion. As both the applicant and City Planner were present, Mr. Mauti asked why the applicant should have to come back to reapply. He thought they should be able to settle it now instead of having the applicant make two or three trips. Mr. Mauti asked if they could make that a part of their staff comments. He was talking about putting a big cut on 1st Avenue and omitting the one on 7th. Mr. Gregory said he would go along with an agreement. Mr. Annunziato commented that they have generally tried to discourage bringing commercial traffic into residential areas. He understood Mr. Gregory's comments and advised that the traffic on 7th Street is going to be heavy. It is not the best situation in the world but will be helped some- what by the dominance 8th Street will take. At the expense of putting a turn out on 1st Avenue, Mr. Annunziato was not sure that would gain more than it would lose. Mr. Gregory asked, "In what respect?" He pointed out that it would not depreciate the value of the area. They would increase what is now an underutilized street and use it for a stacking lane for the convenience of not only the shopping center but the people who live there. Mr. Annunziato reminded him that they have had applications to use 1st Avenue for uses with as little traffic as a day - 23 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 care center. He vividly recalled comments from the resi- dents on 1st Avenue who were vehemently opposed to any curb cuts on 1st Avenue. Chairman Ryder thought the Board should act on the recommen- dations of the Planning Director. If that does not go through, they could make another motion. Mr. Gregory advised that he would be willing to withdraw his motion to postpone if they had some positive feedback from the appli- cant. Mr. Sherman introduced Mr. Jeff Iravani, P.E., Weyant and Associates Inc., 1544 Donna Road, West Palm Beach, who pre- pared a traffic statement. Mr. Iravani understood Mr. Gregory's concern but said it would not be a stacking lane on 7th Street per se because people who would be using 7th Street would be using it for a right turn lane. If anyone wants to make a left onto Boynton Beach Boulevard, they will be using 8th Street because a traffic light will be there. There will not be any considerable stacking lane or right turn lane to Boynton Beach Boulevard. Mr. Gregory asked if Mr. Iravani was telling him that as those cars are coming out onto 7th Street, which is 20 feet wide, it will hold all of the traffic coming from the south to the north on 7th Street and not back all of that traffic up while all of the people come out onto 7th Street. Mr. Gregory said it is nothing wider than a driveway right now. There was discussion among the Members and applicants. It appeared to Mr. Annunziato that the right-of-way of 7th Street is 50 feet. He did not think there was any question the way it is currently constructed that it causes problems. It is a narrow right-of-way with an inadequate amount of pavement. Mr. Annunziato suggested that perhaps the answer is to increase the pavement of 7th Street and make it a three lane roadway. He said it could be done with 50 feet marginally. They could have a left turn on the south approach and a right turn one way south. Mr. Gregory asked if the 50 feet includes the sidewalks. If they have three twelve foot lanes (36 feet), Mr. Annunziato thought they could do it. Mr. Mauti suggested this be incorporated into the staff comments. Chairman Ryder suggested that the applicants come back before Council with a sketch of the plan. In the meantime, one could also be given to the Planning Director.- - 24- MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA FEBRUARY 12, 1985 Mr. Annunziato clarified that the applicant should reconstruct 7th Street with a three lane roadway. High Ridge Road runs along the west property line. To the east of the Water Management Tract, there lies the Seaboard kirline Railway and 1-95. To the north is the single family area of Cedar Ridge PUD, and to the south is High Ridge Commerce Park, a Planned Industrial Develop- ment. Cedar Ridge PUD and High Ridge Commerce Park PID have been platted, and water, sewer, and the roadways are in. There are 19 two story condominium units with a maximum height of 27 feet. They are two and three bedroom units, and there are 40 foot setbacks along the perimeter. The streets which access the site are Forest Road and a public street. The remainder of the access on the site and parking areas are private. The applicant is providing recreation facilities. There is a pool about 1750 square feet, meeting hall, and a jogging trail. Mr. Cannon read the staff comments from the Building, Engineering, Utilities, Public Works Departments, Recre- ation and Parks Director, and the City Forester/Horti- culturist. Mr. Cliff Leisinger, Landscape Architect, Leisinger and Company, 200 De Sota Road, West Palm Beach, Florida 33405, said of 19 buildings, they will have two configurations (a 90 foot long building and a 100 foot long building). They have 104 two bedrOom condominiums and 48 three bed- room condominiums. The buildings are concrete block and stucco with asphalt shingle roofS. The minimum distance between buildings is 25 feet. Mr. Leisinger said the parking per Code is 2.0 parking spaces per dwelling unit, and they provided 2.36. Instead of 304 required parking spaces, they have 358 (340 normal tenant and guest parking spaces, 16 handicap, and 2 staff). Mr. Leisinger said they meet all of the requirements for the trees and have landscaping throughout the site. They separated their multi-family site from the PUD with a six foot CBS wall across the southern boundary. Mr. Leisinger replied that the meeting hall is 1,320 square feet and will serve also as the restroom facilities for the swimming pool. Parking is in front of the meeting hall. Mr. Leisinger was aware of the staff comments, had no problems, and said they are trying to meet the comments now. Mr. Pagliarulo moved to approve the site plans, subject to staff comments. The applicant is showing a potential of 13 bays in the building, and the garage doors will face on both the east and the west sides of the building. There are two access driveways to the site. Both of them are on S. W. 30th Avenue, and circu- lation is along the rear of the site. Parking is along both the east and west parking lines. Mr. Cannon read the staff comments from the Building and Planning Departments and also those of the City Forester. Mr. Leonard Kaufman, Kaufman Construction Co., 1141 Calamondin Terrace, C.B.22, Delray Beach, Florida, said his son, Samuel Kaufman, and he are partners on this, are aware of the comments, and agreed to go along with them. Mr. Mauti asked if Mr. Kaufman understood that because of the mixed occupancy, more parking may be required. Mr. Kaufman understood that. In other words, when he gets a lessee, Mr. Kaufman said he will expect to talk to Mr. Annunziato to find out what the situation is. COMPREHENSIVE PLAN CONSISTENCY REVIEW Mr. Annunziato reminded the Members that the Board acts in its capacity as the Local Planning Agency, and land develop- ment regulations which are proposed for adoption by the Council must be reviewed by the Local Planning Agency for consistency with the Comprehensive Plan. Proposed amendment to Section 7E of Appendix A, Permitted Uses, Zoning Code The first of the two items was an amendment to the Planned Industrial ~Development (PI~) regulations concerning the "Uses Permitted." It was suggested by the Council that some uses in the PID be subjected to the same kind of environmental review as uses in the M-1 classification. Amendatory language was drafted, and the Attorneys put it in Ordinance form. Mr. Annunziato recommended that the Board find this consistent with the Comprehensive Plan as it is a Zoning Ordinance which implements the Comprehensive Plan. He informed Chairman Ryder the uses requiring environmental re- view are the same uses requiring environmental review that are in the M-lo Mr. Pagliarulo moved to find consistency with the Comprehen- sive Plan, seconded by Mr. Wandelt. Motion carried 7-0. Proposed adoption of new zoning map and corrections thereto, to replace existing zoning map which is in need of maintenance Eight months ago, Mr. Annunziato said they received a request from the Building Department to do something about the official zoning map. It has been about five years since the new zoning map has been adopted. In addition to the new zoning map which they drafted, they are suggesting that four corrections be made to the zoning map concerning errors they uncovered as a part of the drafting. Amendatory materials and text accompanied the comments of the Planning Department to explain the corrections. Chairman Ryder commented that this indicates diligent research. Mr. Annunziato said this is a continual program of making the maps reflect exactly what exists.
