1 ORDINANCE NO.21-017
2 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
3 FLORIDA,RELATING TO THE QUANTUM PARK OVERLAY
4 DEPENDENT DISTRICT; DISSOLVING THE QUANTUM
5 PARK OVERLAY DEPENDENT DISTRICT PURSUANT TO
6 SECTION 189.071(1), FLORIDA STATUTES; SPECIFYING
7 INTENT; PROVIDING FOR CONFLICTS, SEVERABILITY
8 AND AN EFFECTIVE DATE.

10 WHEREAS, the Florida Legislature has enacted and amended Chapter 189, Florida
11 Statutes to provide an alternative method to finance, deliver, and manage basic services for
12 community development; and
13 WHEREAS, on October 18, 2005, the City Commission adopted Ordinance No. 05-061
14 establishing the Quantum Park Overlay Dependent District (the "District") and amended on
15 August 20,2019 via Ordinance 19-026; and
16 WHEREAS,Section 189.071(1),Fla.Stat.provides that dissolution of a dependent special
17 district may be effectuated by ordinance of the local general-purpose governmental entity wherein
18 the geographical area of the district is located;
19 WHEREAS,the City Commission has conducted the requisite public hearing; and
20 WHEREAS, the City Commission finds that the termination and dissolution of the
21 Quantum Park Overlay Dependent District is in the best interests of the citizens and residents of
22 the City.
23 NOW THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
24 CITY OF BOYNTON BEACH,FLORIDA THAT:
25 SECTION 1. The foregoing "WHEREAS" clauses are hereby ratified and confirmed as
26 being true and correct and are hereby made a specific part of this Ordinance upon adoption hereof.
27 SECTION 2. This Ordinance is adopted pursuant to Section 189.071(1), Florida Statutes.
28 SECTION 3.Quantum Park Overlay Dependent District,as established by Ordinance No.
29 05-061 and amended by Ordinance 19-026, is hereby dissolved.

1 SECTION 4. That all functions and assets of the District become the functions, including
2 operation and maintenance responsibilities, and assets of the City upon dissolution.
3 SECTION 5. If any clause, section,or other part or application of this Ordinance shall be
4 held by any court of competent jurisdiction to be unconstitutional or invalid,such unconstitutional
5 or invalid part or application shall be considered as eliminated and so not affecting the remaining
6 portions or applications remaining in full force and effect.
7 SECTION 6. All Ordinances or parts of Ordinances, Resolutions or parts of Resolutions
8 in conflict herewith be and the same are hereby repealed to the extent of such conflict.
9 SECTION 7. This Ordinance shall become effective immediately upon its passage and
10 adoption.
