Minutes 10-09-84MINUTES OF THE PLANNING AND ZONING BOARD MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, OCTOBER 9, 1984 AT 7:30 P. M. PRESENT Simon Ryder, Chairman Garry Winter, Vice Chairman Norman Gregory Ezell Hester Ronald Linkous Caesar Mauti John Pagliarulo William Schultz, Alternate, and Robert Wandelt, Alternate, were in the audience. Mr. Schultz was excused and left the meeting. Carmen S. Annunziato, Planning Director Timothy p. Cannon, Senior City Planner Chairman Ryder called the meeting to order at 7:32 P. M. and introduced the Members of the Board, the Planning Director, Senior City Planner, and the Recording Secretary. He acknowledged the presence of Mayor Carl Zimmerman; Councilman Nick Cassandra; Councilman James R. Warnke; Peter L. Cheney, City Manager; Samuel Scheiner, Vice President of the Community Redevelopment Agency; and Owen A. Anderson, Executive Vice President, Greater Boynton Beach Chamber of Commerce. MINUTES OF SEPTEMBER 11, 1984 On page 20, 7th paragraph down, Mr. Mauti said the first sentence should be changed to read as follows: "Mr. Mauti recalled it was changed to commercial, and there is residential all around that area." Mr. Mauti moved to adopt the Minutes as corrected, seconded by Mr. Pagliarulo. Motion carried 7-0. ANNOUNCEMENTS Chairman Ryder announced that the annual Board Dinner will be Thursday, December 13, 1984, at Hunters Run Clubhouse. Individual invitations will be sent to Board Members. Special Meeting On October 23rd, Chairman Ryder said there will be a public hearing in the Council Chambers in regard to the application of development approval for the Boynton Beach Park of Commerce. The matter came before the Treasure Coast Regional Planning Council on September 24th. When they are faced with a problem of this magnitude, under Florida Statutes, - 1 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 Chairman Ryder said Treasure Coast Regional Planning Council is to review the project and point out negative or positive impacts they think may develop. At their meeting, the Treasure Coast Regional Planning Council came up with a report which was an approval of the proposed development. However, certain conditions were laid down which they requested this Board and the City Council to consider. Since there were a lot of people present at the meeting tonight, Chairman Ryder told them this is a huge development of 540 acres which will run from the Boynton Beach Canal, back of Motorola, all the way up to Miner Road on both sides of 22nd Avenue, and over to 1-95. The intent is to develop the area for light industrial and research, and it will be developed under the City's Planned Industrial Development. OLD BUSINESS None. NEW BUSINESS PUBLIC HEARINGS 1. Project Name: Agent: Owner: Location: Description: Norman J. & Elishka Norman Michael Rezoning Charles Putnam Norman j. Michael S. E. corner of intersection of Congress Avenue and Golf Road Request to rezone 4.9 acres from R-1AA single family residential to C-2 neighbor- hood commercial district Chairman Ryder was just informed of a letter dated October 9, from Mr. Charles Putnam, Charles Putman & Associates, Planners and Land Development Consultants, Suite 106, 4722 N. W. Second Avenue, Boca Raton, Florida 33431, which he read, as follows: "At the request of the owner, I would like to have this letter serve as my official request that the petition of Norman and Elishka Michael relative to the above project be withdrawn from consideration by the City. Please call if you have any questions." It was apparent to Chairman Ryder from the great number of people present at the meeting that a great many people were interested, and he pointed out this was a matter of complete - 2 MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 withdrawal. He referred to the expense the City goes to in having legal notices published, notifying adjacent owners, the people coming out, and the work the staff did in lng the input for this meeting. 2. Project Name: Agent-. Owner: Location: Description: prepar- LaNotte Parking Lot Variance Regis Moreau P.L. & G. Enterprises, Inc. 2280 N. Federal Highway Request for relief from Section 5-141(g) (3) of the Parking Lot regulations governing location of driveways. Chairman Ryder informed everyone LaNotte has a new name: "Shooters on the Water". Mr. Carmen Annunziato, Planning Director, explained that they were dealing with a situation where there are two existing driveways on the east side of U. S. 1, 130 feet south of Las Palmas. By the addition of square footage, which includes the addition of an atrium to the east of the building, the parking lot regulations were called into play. Mr. Annunziato referred to the recommendations by the Technical Review Board and said the issue is the location of the two driveways within 180 feet of the intersection. The Technical Review Board advised the Planning and Zoning Board to approve the variance request because the driveways are ~xisting and it would be impractical to redefine the exist- lng parking lot to make it work. Mr. Cannon showed the lo- cations of the driveways on the overlay. At the original time the plans were shown to the City and approved by the City, Mr. Linkous asked if they realized there was an infraction. Mr. Annunziato replied negatively because the parking lot regulations as we know them today, did not exist. ' William Leander Osborn, Architect, 724 Garden Court, Plantation, Florida 33317, stated he represents Shooters on the Water. Chairman Ryder asked if anyone wished to speak in favor of the proposed request. There was no response. Chairman Ryder asked if anyone wished to speak in opposition to the request. There was no response. THE PUBLIC HEARING WAS CLOSED. Mr. Gregory moved, seconded by Mr. Linkous, to approve the request for variance. Motion carried 7-0. - 3 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 SUBDIVISIONS MASTER PLANS Project Name: Agent: Owner: Location: Description. Rollingwood Subdivision Burl Gentry Swinton Development Corporation Between Seacrest Boulevard and Swinton Avenue south of St. Joseph's Church and School Proposed 52 unit single family R1AA subdivision Mr. Annunziato said access to the subdivision is from both Seacrest Boulevard and Swinton Avenue. He read the staff comments from the Engineering, Public Works, Recreation and Parks Departments, and also the Building Department. The Technical Review Board recommended that the plan be approved, subject to staff comments The applicant was not present. ' Mr. Linkous moved to approve the master plan, subject to staff comments. Mr. Hester seconded the motion, and the motion carried 7-0. Project Name: Agent: Owner: Location: Miner Ridge Estates John Fiorentino Paggey Investors Miner Road west of Rolling Green Elementary School Description: Proposed 18 unit, single family Ri subdivision Mr. Pagliarulo wished to abstain from voting and filed a Memorandum of Voting Conflict, which is with the original minutes in the City Clerk's office. At the last meeting, Mr. Annunziato said the Board approved the pre-application for this proposed subdivision. Access is from Miner Road. Mr. Annunziato said it comes with a positive recommendation from the Technical Review Board, subject to comments from the Building and Recreation and Parks Departments. No one was present to represent the applicant. Mr. Mauti moved, seconded by Mr. Hester, to approve the master Plan. Motion carried 6-0, with Mr. Pagliarulo abstaining from voting. - 4 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 PRELIMINARY PLATS Project Name: Agent: Owner: Location: Description: Quail Lake West Modification Alan Ciklin, Esq. Great Universal Development - Florida, Inc. West of Congress Avenue between Woolbright Road and Golf Road Request to change S. W. 26th Street from a public street to a private street Carmen Annunziato, City Planner, said S. W. 26th Street is shown on the plat of Quail Lake West. The site lies between Woolbright Road extended, which currently does not exist, and Golf Road. It is bordered on the west by Quail Ridge and on the east by the lake. The applicant is requesting to delete S.W. 26th Street, which runs through the project north/south, practically bisecting the parcel in eas= and west halves. Mr. Cannon traced the locations on the over- lay. At this point, Mr. Annunziato said S. W. 26th Street goes through from Golf Road to Woolbright Road on ap~. Mr. Annunziato read his Memorandum, addressed to the Board, dated October 3, 1984. With reference to paragraph 3 under the reasons for keeping S. W. 26th Street as a public right- of-way, he pointed out that one of the stronger features for having this as a public road is that the Knuth Road corridor has gained prominence with the construction of the Stone- haven and Cherry Walk projects. Knuth Road, which currently exists as a platted right-of-way between Woolbright Road and Old Boynton Road, will be constructed as an urban collector and will serve the mall from the south. Mr. Annunziato showed that Knuth Road intersects Woolbright Road at about the westerly limit of an appendage, and the result is an off center corridor system which leads to the southwest corner of the mall. The Members had with their agendas a copy of a letter dated September 21, 1984, from Charles R. Walker, Jr., p. E., Director, Traffic Division, Office of the County Engineer, Box 2429, West Palm Beach, Florida 33402, which Mr. Annunziato said states the public's point of view. On October 2nd, the Technical Review Board met and recommended that this road be deleted as a public right-of-way. Mr. Annunziato read paragraph 2, page 2, under "RECOMMENDATION,, from his Memorandum and said it was felt the public gains for having it as a public right-of-way were offset by the inconvenience which would result to the residents in the proposed Quail Lake West subdivision. - 5 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 Mx. Annunziato informed Chairman Ryder the proposed right- of-way is 60 feet, and there would be sidewalks. If it becomes a private road, Mr. Annunziato thought it was the intention of the applicant to keep the same configuration of roadway construction. Chairman Ryder thought we needed additional north/south roadways. Mr. Annunziato added that the recommendation which came to the Planning and Zoning Board was not unanimous. Mr. Linkous agreed with Chairman Ryder that Boynton Beach is going to need all of the streets it can get. In his estimation, the private road would serve for the benefit of a few, whereas, it could serve the rest of the City. Alan J. Ciklin, Attorney at Law, 515 North Flagler Drive, West Palm Beach, Florida 33401, representing the applicant, agreed there were some positive sides of having the road public, which were mainly to provide another corridor for people to traverse and to keep them off of Congress Avenue. However, if you balance that versus the detriments, Attorney Ciklin said you come to the conclusion of the Technical Review Board that it is better to leave it private. From a safety factor, Attorney Ciklin said the project was, and continues to be, designed as a private project. Almost all of the units are on one side of the street that traverses the project, and the recreational facilities are on the other side. The people would be able to walk freely back and forth the roadway and use the recreational facilities. Without the guard facility at the entrances and without it being a private road, from a security standpoint, Attorney Ciklin said the security would not be there. Attorney Ciklin reiterated that the feeling of the Technical Review Board and their feeling is that when you take the safety and security of the residents that will live there and balance that with the very few trips that would use the road as an alternative to Congress, the scale would weigh towards a private versus a public road. Although this Ks designed as an extension of Knuth Road, it has a jog in it, and it seemed unlikely to Attorney Ciklin that people would choose to drive through the project in order to get some place else. Mr. Jim Zook, Kimley Horn & Associates, Inc., 5800 Corporate Way, West Palm Beach, Florida 33409, did a traffic analysis, and the County Engineering Department also did one. Mr. Zook said they had some higher traffic volumes because they updated the year 2000 to include all through projects. He showed the route mentioned on an overlay. MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 Mr. Zook said if this road is to serve as a semi-connection to Knuth Road, you can see that it is obviously not a straight connection but has a significant long jog in it. If someone is on Congress and traffic is diverted to the Knuth corridor away from Congress, they could drive through the project and would be going through a residential area with a number of driveway connections. Mr. Zook said it does not have the character of a cOllector that Knuth has the ability to be designed for. Even though somebody may be coming up Congress, and you assume a certain number of trips will divert off of Congress to get to the mall, Mr. Zook said they will have to make that manuever to be on Knuth. He indicated the only section of Congress that would be helped by that and said it would not change any of the rest of the traffic volumes on Congress. The advantage that could exist would only be between Golf Road and Woolbright Road. Possibly, a more logical place to divert is at Woolbright Road, which is pro- jected to be a major arterial. Mr. Zook said there was no change in the level of service. Even with a minor percentage change, there might be a little less traffic, but the change would not be noticeable to the driver. Mr. Zook clarified that he was talking about the year 2000, and the advantage from a traffic point of view does not show up on this map or their analysis. From a character standpoint, Mr. Zook said they are supposed to look at the character of the street. If someone was supposed to divert that way, it would be because he could get there faster than by going straight up Congress. That means he will not want to travel residential streets with speeds of 25 and 30 m.p.h, because he would be able to main- tain that speed on a straight path on Congress. If it is a private street, Mr. Zook said there would be no through traffic on that road. People in the project would use Knuth Road. Mr. Zook indicated the people it might affect and said they were only talking about 700 trips a day. Mr. Gregory asked if Woolbright is supposed to come on line in late 1986. Mr. Zook was not sure it was presently programmed for funding. The requirements indicate it is in the five year plan. As far as coming on at this point, Mr. Zook thought that was a requirement of the project itself. As far as being out to the west, Mr. Zook said that was not a committed, funded project. Mr. Gregory asked if a great deal of traffic would not want to take that arterial and proceed westward on Woolbright, - 7 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 going off to Military Trail. If the road they propose as private road were public, it would serve all of the people in that area. Mr. Zook said the only people it would serve would be the people living in the project. The people any- where else would have arterials, and very few would need to use the road through the project. If on Golf, you can use Golf. If on Woolbright, you can use Woolbright. The only people who might use this road would be people wanting to go north who could take advantage of this short cut through the middle of the project to get to Knuth and areas there, which is 700 vehicles a day coming up Congress and making that manuever. It did not appear to be a manuever many people would make unless they could gain a lot of time. Mr. Linkous said to assume people living on Knuth Road have to go to the hospital. He felt it would be nice for them to cut through there in a direct route to the hospital. Mr. Linkous referred to High Point having a road that is blocked off and said if that is a private road, there will be a barricade. There was discussion about the hospital and emergency trips. Mr. Zook said you would want that trip on the arterial system. Mr. Linkous also referred to the people that live at Quail Ridge and the Country Club of Florida. Mr. Zook advised that the longer you make the corridor, the more you get away from it having the characteristic of a residential street and the more you turn it into a collector. If that is what the designer wants to do to the road, Mr. Zook said it should run straight through Quail Ridge, which he did not think was very feasible. Mr. Zook thought, from a transpor- tation planning point of view, it was better for it to end at Woolbright Road (a major arterial) as opposed to a minor arterial (Golf Road). There was more discussion° It seemed to Mr. Linkous that if the road was shifted directly west to the peripheral line that the most logical configuration would be to have a cul-de-sac. Actually, Mr. Zook said they would be getting into another traffic problem, and he explained. In other words, Mr. Zook said the farther apart major intersections are along an arterial, the better it is for moving traffic. Getting back to the overall analysis, Mr. Zook said with this as a public road, it does not serve a significant amount of traffic, improve the level of service on Congress (it only affects one link on Congress), and the improvement on Congress is not a change in level of service to the driver. Mr. Zook advised they could say there is a positive gain by - 8 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 making the traffic volume somewhat less, but it is not enough less when you are talking about 30,000 vehicles a day that the driver will even perceive the difference. General- ly, you do not want to carry much over 1,000 vehicles a day on a residential street. There it would be a significant change, because they were talking about more than doubling the traffic volume on a residential street. From Congress Avenue going east, Chairman Ryder said you have to go a mile to get a north/south road (Seacrest Boulevard). There is nOthing else in between. Going west, you have to go to Military Trail. With the development of Motorola, the Mall, and the park of commerce between Congress and 1-95, Chairman Ryder said all of the traffic will build up. He thought some relief from Congress Avenue would be needed and said circulation is a problem. There was more discussion about Woolbright Road. Chairman Ryder said Mr. Zook would minimize it by saying it was only between Woolbright and 23rd, but Chairman Ryder said every little bit would help. He pointed out that there will be a good deal of activity between Woolbright and 23rd. Mr. Zook argued that all of that means more traffic on a residential street, which is nothing more than more and more negatives. Arterials are designed, and their whole purpose is to carry long trips and to serve the motoring public. TO solve a problem that might exist on an arterial by putting traffic on a residential street is not considered good transportation planning. Attorney Ciklin stated that if Knuth Road extended straight down, it would serve a valuable purpose. In this case, they are going through a residential development that was designed and has always been designed to have a private road run through it. Attorney Ciklin reiterated that there would be a disadvantage to the residents, primarily in having people go at high rates of speed, and repeated his previous argu- ments. Mr. Mauti thought this came before the Board before on the master plan concept and asked why it was not considered at that time. Attorney Ciklin was not before the Board before but said when it was originally brought before the Board in the late 70s, it was as a private road. There was a change in developers and a change in ownership, and in 1982, the City requested that the previously designed private road be made a public road. In fact, the Engineer for the project noted it as a public road. When it came to the attention of the owners that this had been done, it became a problem. · - 9 MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 Attorney Ciklin stressed that the project was never designed with this as a public road because obviously, they would never have put all of the units on one side and the recreational facilities on the other. He said they are try- ing to rectify the error the Engineer made at the request of the City. Mr. Mauti recalled it was a public hearing at that time and it was asked if there would be a road going through. The answer to the question was "Yes." Attorney Ciklin was not at the public hearing but believed it was still a private road. He thought the point was whether it is better to have a private road or a public road, regardless of what was done before. Attorney Ciklin thought the safety of the people that will live there was the key element and felt that was more important than the few trips that would be routed through the development. Mr. Mauti expressed concern about streets being shut off and residents of the City not having the proper access to where they want to go. Chairman Ryder thought this was in a critical area and the City does not have adequate access to what is there now and to what is going to happen in the next few years. Mr. Gregory moved to deny the request of the petitioner for the deletion of a public right-of-way, seconded by Mr. Linkous. Motion carried 7-0. Mr. Gregory asked about the extension. Mr. Annunziato advised that will be addressed by the City Council. Project Name: Agent: Owner: Location: Description: Northwoods at Hunters Run Addition 91 Chuck Gilbert Summit Associates, Ltd. Tract E, Hunters Run Infrastructure improvements to provide for the construction of 18 single family detached homes on 9.79 acres consistent with a previously approved master plan Mr. Annunziato said this is in the extreme northern and westernmost corner of the property. He referred to the overlay and said the road is an extension of an existing road, which was previously platted and constructed. The plans came to the Board from the Technical Review Board with a positive recommendation, subject to a memo from the Engineering Department. MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 Mr. Chuck Gilbert, Summit Associates, Ltd., had no problem with the comments. Mr. Linkous moved to approve the preliminary plat, subject to staff comments. Mr. Pagliarulo seconded the motion, and the motion carried 7-0. SITE PLANS Project Name: Agent: Owner: Location: Description: Northwoods at Hunters Run Addition No. 1 Chuck Gilbert Summit Associates, Ltd. Tract E - Hunters Run Request to construct 18 single family detached dwelling units on 9.79 acres Mr. Cannon showed the site plan for the same area the Board just approved. He pointed out the loop road and said all of the single family homes have one story· Mr. Cannon said no recreation is on the site plan because the recreation facilities and the swimming pool for Tract E were in the 1st Phase. The only staff comments were from the Building Department. Mr. Charles Gilbert, Summit Associates, Ltd., 3500 dlubhouse Lane, Boynton Beach, Florida 33436, said the staff comments did not pose a problem. Mr. Linkous moved, seconded by Mr. Mauti, to approve the site plan, subject to staff comments. Motion carried 7-0. Project Name: Agent: Owner: Location: Description: LaNotte Site Plan Modification Regis Moreau PL&G Enterprises, Inc. 2280 N. Federal Highway Request to bring building into compliance with code requirements and to make improvements to the east side of the building Mr. Annunziato handed out two memorandums from Bob Donovan, Chief Plans Check Inspector, Building Department, dated October 8 and 9, 1984, which requested eleven modifications. Mr. Cannon read a letter from William Leander Osborn, Architect, 724 Garden Court, Plantation, Florida, dated September 26, 1984, listing the modifications, and pointed them out on the overlay. Mr. Annunziato thought the applicant wanted to add one more thing to the list, which was inadvertently deleted. There - 11 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 is currently a receiving antenna dish located on top of the building, which was installed without a permit. It was also the subject of a violation, and the applicant is desirous of adding that to the site plan for the Board's consideration. Mr. Annunziato explained to Chairman Ryder that if it is approved, it can become part of the modified site plan and can be permitted by the Building Department and become legal, if it is approved by the City Council. Mr. Mauti was informed the dish is well within the 45 feet. Mr. Osborn, Architect, reappeared before the Board, and said Mr. Gandolfo explained the violations to them. Mr. Osborn stated that the applicant is willing to take care of all of the violations. Mr. Annunziato again explained to the Board Members that the antenna is a compliance situation, but this action provides for the approval of the existence of the antenna at that location. Mr. Linkous thought it would be a waste of money to have the applicant remove the antenna if all it would take is a permit. Mr. Osborn informed the Members that.a contractor is going to take out a permit. Mr. Osborn said the applicant is willing to agree with all of the items on the memo. Mr. Linkous asked about the buffer wall between the buildings and LaNotte. Mr. Annunziato advised that the wall exists. Mr. Annunziato said there were two additional memos (Fire Department and Utilities Department). Mr. Osborn stated that he discussed the comments with Mr. Cavanaugh, Fire Department, and agreed to them. After discussion about the proposed modifications to the plan, Mr. Mauti was informed they are all designed to bring the property into conformance. Mr. Gregory moved to approve the site plan, subject to staff comments, and Chairman Ryder added that the Board would have no objection to the antenna dish if a permit is obtained. Mr. Hester seconded the motion, and the motion carried 7-0. 3. Project Name: St. Mark's Site Plan Modification Agent: Richard San Giovanni Owner: Edward McCarthy, Archbishop Location: 433 N. E. 4th Avenue Description: Modification to parking lot - paving area immediately in front of church entry Mr. Cannon informed the Members this is a request to approve a change to the site plan. He indicated locations on the - 12 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 overlay and said the modification is to put a driveway connecting the two parking areas to allow better access to and from the chuch. Mr. Cannon said the Building Official determined this would not require additional building permits, and it would not have to go through the downtown moratorium procedures. There were no staff comments. Mr. Linkous moved to grant the request for modification, seconded by Mr. Mauti. Motion carried 7-0. 4. Project Name: Agent: Owner: Location: Description: Boynton Commercenter Site Plan Modifica- tion Fred Popper Boynton Commerce Center 1600 - 2200 Corporate Drive Request to modify buildings D, E, and F at the Boynton Commercenter development Chairman Ryder commented this is the one at Woolbright and 1-95. Mr. Cannon told the Members this is a request to modify two of the three southernmost warehouse buildings. They are requesting to put garage doors on the east side of building E, where there are presently windows and walls, and also a truck loading garage door on the south side of build- ing F. Mr. Cannon said many of the staff comments addressed the problem of the pump that will be used and indicated the easement and City well this would affect. Mr. Cannon read the comments from the Building, Engineering, and Utilities Departments and explained what they refer to. He said there will be depressed truck wells and a pump which will pump water out of there to a collector. There is a problem of contamination to the well site. The City has requested that the applicant get the approval of the Department of Environ- mental Regulations prior to installing the sump because of the problems of contamination at the well site. If the DER does not approve it, they would possibly put it in the City's sanitary sewer. Mr. Linkous asked if there was more than one well. Mr. Cannon replied only one well is specified. The applicant was not present. Mr. Linkous moved to approve the modification, subject to staff comments. Mr. Pagliarulo seconded the motion, and the motion carried 7-0. MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 9, 1984 ADJOURNMENT There being no fUrther business to come before the meeting, Mr. Mauti moved, seconded by Mr. Linkous, to adjourn.
