Minutes 01-10-84MINUTES OF THE PLANNING AND ZONING BOARD MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, JANUARY 10, 1984 at 7:30 P.M. PRESENT Simon Ryder, Chairman Garry Winter, Vice Chairman Ezell Hester Ronald Linkous Caesar Mauti Robert Wandelt Walter Kies, Alternate Stormet Norem, Alternate Carmen S. Annunziato Director of Planning Tim Cannon, Senior City Planner ABSENT Lillian Bond ACKNOWLEDGEMENT OF MEMBERS AND VISITORS Chairman Ryder called the meeting to order at 7:30 P.M. He introduced the Members of the Board, the Director of Planning, Senior City Planner, Mayor Warnke, Vice Mayor Zimmerman, Councilman Joe deLong, Councilman Nick Cassandra, Sam Scheiner, Vice Chairman, Community Redevelopment Agency, and Recording Secretary, Barbara Schwertfager. READING AND APP.ROVALOF MINUTES Mr. Linkous made a motion to approve the minutes of the meeting held on Tuesday, December 13, 1983. The motion was seconded by Mr. Wandelt. The motion carried 7-0. ANNOUNCEMENTS Chairman Ryder, as a reminder to the Board, indicated that there would be a meeting on January 24, 1984 in the Council Chambers a% 7:30 P. M. that would be confined to the matter of Bethesda Hospital's application. Before the meeting went any further, because Mrs. Bond was absent, Mr. Stormet Norem was appointed as the alternate. COMMUNICATIONS Mr. Annunziato said that it was going to be necessary to discuss the Community Redevelopment Agency's Plan, however, he would address this at the time of regular business. OLD BUSINESS None. -1- MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA NEW BUSINESS PUBLIC HEARING Abandonment January 10, 1984 PROJECT NAME: AGENT: OWNER: LOCATION: DESCRIPTION: Pollock Easement Abandonment James Scott Pollock James H. Pollock, M.D. 520 Chapel Hill Boulevard Abandonment in part of a portion of a 12 foot special purpose easement'between lots 1 and 2, and 5 and 6, Block 8, Mission Hill Subdivision. LEGAL DESCRIPTION: A six foot (6') easement along the southern boundaries of Lots 1 and 2.~ An abutting ease- ment along the northern boundaries of Lots 5 and 6. Block 8. MISSION HILL. Recorded in Plat Book 24, Page 178, Palm Beach County Records. Mr. Annunziato explained that the applicant is looking to trunkate the easement on the east and the west in order to build over the four lots. Further, the appl. ication was reviewed by the technical staff and came back with a positive recommendation, provided that the applicant provide a unity of title over the four lots. The applicant came forward, and Chairman Ryder, in order to clarify the intentions of the~applicant said he understood that the applicant wanted to do some landscaping and 'further building or extensions. Chairman Ryder also wanted to make the point that as long as this land was going to be treated as one parcel, that there wouldn't be any problem. However, if this was not so, because the rear parcels face on the street _(Whi~pering~-Rines~ ~ in the event that the appli- cant was going to build out and eventually~the lots on Whispering Pines Road Were sold, there would be a problem with proper legal set backs. In order to be assured that the applicant understood the nature of the problem, Chairman Ryder merely reiteratedwhat Mr. Annunziato had requested of the applicant, that being the unity of title. There was some discussion between Mr. Annunziato and the applicant to make sure the applicant understood what was required of him, and Mr. Annunziato also indicated that this would have to be done by Friday of that week (January 13, 1984). MINUTES OF THE PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA January 10, 1984 After inviting.anyone who wanted to speak in favor or opposition to this application, and there was no response, Chairman Ryder closed the public hearing. Mr. Linkous made a motion to recommend apProval of the application, subject to the applicant obtaining the aforementioned unity of title, and the motion was seconded by Mr. Winter. The motion carried 7-0. DISCUSSION In explaining his memorandum to the Chairman and Members of the Planning and Zoning Board, in reference to the fact that the Community RedevelopmentAgency forwarded to the a copy of the proposed Community Redevelopment to the Local Planning Agency which is the Planl he indicated that statutorially-this Agency has to provide a "review and recommendation" of the consistency with the Comprehensive Plan within Indicating that the Local Planning Agency had u to complete its review, it was suggested that the Board set February 23, 1984 as the date to conduct.'its public review. In preparation of this public review, Mr. Annunziato suggested Wednesday, February 8, 1984 as the date for a workshop to commence-at 3:00 P.M. Chairman Ryder concurred with Mr. Annunziato that a workshop session was in order, and~it was-.generally, agreed 'that February 8th would be a satisfactory, date. It was also agreed that February 23rd would be the date set fOr the public review. Annunziato Director of Planning COMMUNITY REDEVELOPMENT PLAN The Boynton Beach Community Redevelopment Agency ha~ forwarded to the Planning Director, a copy of the proposed Comm~unity Redevelopment Plan for forwarding to the Local Planning Agency ~Planning and Zoning Board). The Local Planning Agency has statutor~i~l responsibility to provide a "review and recommendation as to its~ (Community Redevelop- ment Agency's Plan) conformity with the Comprehensive Plan for the development of the community". (See Chapter 163.360(3) attached) The Local Planning Agency has sixty (60) days in which to formulate a recommendation, and, if, as suggested by the Redevelopment Agency Chairman, January 2nd, 1984 is accepted as the date of~transmittal, the Local Planning Agency will have until March 2nd, 19~to comolete its review. ~ With these dates in mind, I would like to suggest to the Board that it set February 23, 1984 at 7:30 P.M. as the date and time to conduct its public review.
