90-XXXXRESOLUTION NO. 90-~~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE A CERTAIN AGREEMENT BETWEEN THE SCHOOL BOARD OF PALM BEACH COUNTY/SOUTH TECHNICAL EDUCATION CENTER AND THE CITY OF BOYNTON BEACH FIRE DEPARTMENT, FOR THE RENEWAL TO THE EXISTING CONTRACT; A COPY OF SAID AGREEMENT BEING ATTACHED HERETO AS EXHIBIT "1"; PROVIDING AN EFFECTIVE DATE; AND FOR OTHER PURPOSES. NOW, THEREFORE, BE ITRESOLVED by the City Commission of the City of Boynton Beach, Florida, that: Section 1. The Mayor and City Clerk are hereby authorized and directed to execute that certain Agreement a copy of which is attached hereto as Exhibit "1", which renews the contract between the City of Boynton Beach Fire Department and the School Board of Palm Beach County/South Technical Education Center regarding vocational education at South Technical Education Center. Section 2. This Resolution shall take effect immediately upon passage. PASSED AND ADOPTED this ~r~day of July· 1990. ATTEST: (Corporate Seal) CIT~ DN M/yor / Vice Mayor · FLORIDA ~,~/Co~fs s i o~er Commissioner BETWEEN THE SCHOOL BOARD OF PALM BEACH COUNTY AND CITY OF BOYNTON BEACH FIRE DEPARTMENT FOR VOCATIONAL EDUCATION PROGRAMS This agreement is entered into between the City of Bovnton B,~ch V~re Dept. hereinafter referred to as the "AGENCY--, and The School Board of Palm Beach County hereinafter referred to as the "PROVIDER" which are the parties hereto. For and in consideration of the mutual covenants contained herein, the sufficiency of which the parties acknowledge, the parties to this agreement agree as follows: Scope of Services The PROVIDER will provide vocational education programs for students of the AGENCY II. The PROVIDER Agrees to: De Ge Provide a liaison for all vocational education activities between the PROVIDER and the AGENCY. Provide qualified and certified vocational instructors for each course. Addendum A & B is hereby incorporated as part of the agreement. Whenever possible provide a qualified substitute instructor in the case of absence of the regularly assigned vocational instructor. Require instructor6'to assume instructional responsibility for students in their classes'. Share the achievement records of the assigned students in the courses with the AGENCY. Provide and prepare an instructional schedule for teachers and students which will conform to the needs of both the PROVIDER and the AGENCY. Not discriminate against any students or employees because of race, color, religion, sex, national origin, marital status, or handicap. Submit any vocational education reports as required by the Florida Department of Education. III. The AGENCY Agrees to: Am Ce Provide a liaison to coordinate and supervise vocational education activities between the PROVIDER and the AGENCY. Provide the minimum number of eligible students to achieve and maintain the required membership for each course as designated by the PROVIDER. Provide agency orientation for the PROVIDER'S vocational instructional staff. De Fo Provide proper and adequate facilities and standard utilities including water, lights, phones heating, and air conditioning for all classes. ' Provide needed A/V equipment, copier services, student materials, consumables, laboratory materials, and textbooks as requested by the PROVIDER. Provide janitorial and maintenance services for all AGENCY based classroom and shop/lab facilities. Provide staff and support services for timely, .appropriate and adequate screening, counseling, and follow-up services to students. Provide and maintain adequate library services and clerical support for the vocational education program staff. Provide for the safety of all instructors. Provide any vocational education reports needed by the PROVIDER and as required by law. Both Parties Aqree That: ae Be IV. De Responsibility for day-to-day coordination and supervision of the vocational education program shall be vested in the AGENCY'S liaison of education. The AGENCY'S liaison of education may participate with the PROVIDER in recommending instructional personnel. Through their designated representatives, both parties shall collaborate in the development of policies and operational procedures for the efficient management and operation of the vocational education programs. The performance of obligations hereunder shall be in accordance with all applicable laws, rules, and regulations now or hereinafter in effect. This agreement will Re governed and construed in accordance with the laws of the State of Florida. No amendment to this agreement shall be valid or enforceable unless submitted.in writing and executed by duly authorized representatives of both parties executing and entering into this agreement. PROVIDER is an agency or subdivision of the State. Notwith- standing anything to the contrary contained herein, the total liability of PROVIDER under this agreement for negligent acts or omissions of PROVIDER, its agents and employees shall be subject to the limitations and procedures set forth in Section 768.28, Florida Statutes. -2- William Gulbrandsen KS designated AGENCY liaison of education and is responsible for enforcing performance of this agreement's terms and Conditions and shall serve as a liaison with the specialist of the PROVIDER, and shall approve all invoices prior to payment. The AGENCY liaison of education will also be required to meet with the PROVIDER at least once during the agreement period to review the services rendered. This agreement shall be effective July 1~ , 1990 and shall remain in effect through June 30 1991 ' · Should one party fail to conform to all mateirial conditions provided herein, the other party may, at its option, cancel this agreement upon 30 days written notice.
