Minutes 10-27-81MINUTES OF THE REGULAR MEETING OF THE PLANNING AND ZONING BOARD HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, OCTOBER 27, 1981 PRESENT Simon Ryder, Chairman Gary Winter, Vice Chairman Lillian Bond Ronald Linkous Ezell Hester Robert Wandelt Simon Zive Carmen Annunziato, City Planner Chairman Ryder welcomed everyone and called the meeting to order at 7:30 P. M. He introduced the Membe~rs of the Board, the City Planner, and Recording. Secretary. Chairman Ryder acknowledged the presence of Councilman Joe deLong in the audience, MINUTES OF OCTOBER 13, 1'981 Chairman Ryder called attention to. the last paragraph on page 3 of the minutes and requested the following changes: The first sentence should read: "Chairman Ryder informed Mr. Rodriquez that the Ci'ty has had problems in connection with the regional (not refill) treatment plant," .Continuing on in the same paragraph, the third sentence should read: "The treatment plant was started before Pines of Delray North came in and-there has been a great deal of pressure exerted upon (not by both~'Delray Beach and Boynton Beach," Mrs. Bond moved, seconded by Mr. Linkous, that the minutes be approved as corrected. The motion carried 7-0. ANNO'UNCEMENTS None. COMMUNICATIONS Chairman Ryder announced that he had received two letters within the last two weeks from Edgar E. Howell, Building Official, in which he asked the Planning and Zoning Board to consider recommendations for certain changes in Ordinances. Chairman Ryder discussed it with the City Planner, Carmen Annunziato. He requested the Board Members to stay after the regular Agenda is dispensed with, so they could go over what Mr. Howell had in mind. Chairman Ryder did not contemplate any action-at this meeting. Subdivisions: Preliminary-Plat Project Name: Agent: Owner: Location: Description: Lake Eden Heights Subdivision Burl Gent~ry Summit Investment - Att: Peter B. Scott East side of Swinton Ave,,'between S. W, 34th and S. W. 35th Ave., Boynton Beach, Fla. 33435 12 single family lots on 3.5 acres Chairman Ryder asked the Board to recollect that this application had been presented to them with regard to submission of the master plan, which was approved by the Board and subsequently approved by Council. City Planner Carmen Annunziato informed the Board it was an applica- tion for a very small subdivision. In connection with the preliminary plat, construction plans were submitted to the City Staff for sewer, water and drainage. They were found to be acceptable. Mr. Annunziato said the only issues that remain to be resolved, are as follows: City Planner: Recreation Dept.: Submit land appraisal Fee in lieu of land The applicant submitted to the City on October 21, 1981 a real estate appraisal of the property which pegs the value of the land at $28,915.66 per acre. Based On that' submission, Mr, Annunziato recommended that ~the Planning and Zoning Board accept ~that as the land value for the Recreation and Parks' indication purposes. It was-the recommendation of staff that the plans be approved. Chairman Ryder questioned whether the appraisal was by a- qualified appraiser, Mr. Annunziato advised that the appraisal was performed by Salvatore J, Catalog, Real Estate Appraiser and Consultant. Mr. Linkous asked if the entrance was off of Seacrest. Chairman Ryder informed him it was off of Swinton, in back of the Episcopal Church. Mr. Annunziato advised Mr. Linkous there was no approach from the east. The access is from 34th Avenue, which will extend eastward to a new street, which will be southwest of 6th Street. Mr. Hester moved the approval of the preliminary plat, seconded by Mr. Winter. The motion carried 7-0. Mr~. Annunziato asked if the connotation was the Board accepted the land value as sUbmitted by the applicant. Seacrest Blvd,, Boynton Beach, Fla. 33435 474 seat Church plus modifications to existing building Chairman Ryder thought the Board knew ~the location,~ which he,said was on Seacrest, on the same side as the hospital, just a little south; and currently, there is an existing building, Chairman Ryder said the proposal was for a new sanctuary and modifications to the existing building. Mr. Annunziato-informed the Board that the apPlicant plans to construct a new sanctuary north of the existing building, or the Ascension Lutheran Church, and to construct modifications to the existing one story'building. Access to the site is proposed to be located at S. E. 28th Avenue. As a part of the construction, two existing curb cuts will be removed. The'southerly most access to the site will be at the intersection of .S.E. 28th Avenue, Mr. Annunzia%o said the applY'cation had received extensive review by the staff and comes to the Planning and Zoning Board with a positive recommendat-ion, with comments as follows: Building Dept.: "1. County Engineer turn-out approval. 2. Water Management approval. 3. Please see City Engineer's requirements for water run-off." Engineering Dept. "P' ,, avlng and drainage, with calculations. Police Dept. With respect to the North entrance exit, "1. Should be marked, 'No Deliveries", or in some way to alert drivers of trucks that clearance under the canopy is only 11 feet. 2. Security lighting on buildings. 3. Traffic control signs." Public Works Dept. "Dumpster in lieu of cans - See Public Works Dept. for pad size. Energy Coordinator: "Recommend Energy Efficient H.P. Sodium Vapor Lighting." Mr. Wandelt requested Mr. Annunziato to explain the comments from the Police Department. Mr. Annunziato explained that the northerly entrance of the building driveway goes under a covered walkway. The Police Department is saying that the driveway should be marked so delivery trucks will not be caught in a position where they cannot go under the covered walkway. - 3 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 27, 1981 Chairman Ryder inquired about the elevation of the building. Chair- man Ryder noted that it was in an R1AA district, and the height limitation is 25 feet. Since the plan called for something much greater, Chairman Rydered wondered What the~ status was. Mr. Annunziato said two issues were involved with respect to the height of the building. One involved a variance request by the Church to exceed the district height regulation of 25 feet for the height of the structure. The he±ght of the structure exceeded the height regulation by approximately 20 feet to the top of the structure, which peaks inside the architectural feature.. Secondly~ the applicant is requesting from the City Council an exception to the district height regulation for structures which are architectural in nature to exceed the district height regulations. There were two height actions in respect~to the buildings. The building is not very bulky once you get above the 25 feet, as it goes into a triangle, and then nothing much more than an architectural feature. Chairman Ryder thought the Board should make that distinction, that the Board's approval would have to'be qualified, based on Council's action on the matter of the height. Mr. Wandelt asked whether it had been approved by the Variance Board. Mr. Annunziato replied that it had gone to the Board. of Adjustment. An action has already occurred in favor of the applicant. Chairman Ryder asked if the Board of Adjustment approved it up to a 45 foot level, and Mr. Annunziato answered that it was the structure height. The Board commented that the structure was very unusual and attractive. All the water off the paved area will be caught in a curb' and it will be run into drains. - 4 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER. 27, 1981- Pastor Ken Ferguson added that the drainage problem referred to by Jim Ferguson, Architect, happens only during the deluge of the hurricane season, and he was not sure there were any answers when that happens. Chairman Ryder found the construction of the roof interesting. He asked about the outer surface. Architect Jim Ferguson. advised that if the budget would allow, the Church was hoping for a metal roof. Otherwise, it would be an asphalt shingle. Chairman Ryder said, "Asphalt shingle on top of all this timber wood.-" Mr. Ferguson explained there would be sheeting and probably an inch or two inches on top of that. It would probably be a bronze anodized aluminum, as he doubted that they Could afford copper. Mr. Ferguson said they were also toying with~the contraction and expansion of the bUilding and glare. He stated there were money factors. Chairman Ryder asked Architect Ferguson and Pastor Ferguson if they were aware of the staff comments, They replied, "Yes." They said they had no problems with the staff comments. Pastor Ferguson told the Board they are to go from four cans of refuse per week to a dumpster. Pastor Ferguson does not knowwhat the Church will do with a dumpster since the buildings they are contemplating will not have garbage. It will be pr. imarily worship service. Mr. Annunziato stated that the Sanitation Department felt servicewise, it would be easier for the City to accommodate a dumpster, in that it is a one person operation. Mr, Annunziato inf©rmed Pastor Ferguson that there are small dumpsters. Mr, Annunziato suggested that Pastor Ferguson meet with Mr. Richard Walke, Director Of Public Works, and Mr. Warren Shelhamer and discuss the issue, Mr. Winter moved that the site plans be approved~subject to Staff comments. Chairman Ryder added the excess, of height would be subject to approval of Council. He was informed it had already been approved. Mr. Wandelt seconded the motion. Mr. Linkous asked about the drainage. Mr. Annunziato explained that there would be a .series of catch basins in the lower end of the property, particularly along the curb. He pointed ~out the lo- cations. There will be no retaining wall. There is a curb. The ordinances require that they retain their water on site. Mr. Annunziato said they will have to prove by calculations, There is some calculation mechanism that the City Engineer is responsible for reviewing. The motion carried 7-0. Annunziato City of Boynton Beach Woolbright Rd., West of Congress Ave., Nor.th side Ground Storage. Tank and Booster Pumping Station - 5 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 2~, 1981 Chairman Ryder was sure the Members were aware that the City had a storage tank which was elevated and on the easterly end of Wool- bright Road, adjacent to the water treatment plant, The intent is to provide an auxiliary facility which the City is in need of due to the expansion that has taken place. On the westerly end of Woolbright Road, Woolbright Road will be extended west of Congress Avenue. The location is on the north side of Woolbright Road, west of Congress Avenue and just west of the new gas station going up. Chairman Ryder said it was a ground storage tank in contrast to the present one, which is elevated. In addition to the storage tank, which is about 85 feet in diameter and about 24 feet. high¥ there will also be buildings housing the~necessary pumping equipment. Mr. Annunziato said the staff reviewed the application, 'and the staff review was severe. Access to the site would be by-Woolbright Road, The tank itself will be located in the northwest corner of the one acre parcel. The site will be busy from time to time, but no permanent employees w±ll be stationed 'at the location. It is primarily a self-sufficient facility. The application comes to the Planning and Zoning Board with the following comments: Engineering Dept.: "Paving and Drainage Regulations" Police Dept: "Subject to Security Lighting, because area is fenced and unable to be patrolled." Mr. Annunziato explained that because the area is fenced, the Police Department is unable to patrol certain'.areas, so the areas not easily accessible to the Police Department should have security lighting. ~' Energy Coordinator: "Recommend Energy-Efficient H.P, Sodium Vapor Lighting," The overall staff recommendations were that the plans be approved, subject to staff comments. Mr. Winter asked if it had been planned for a tower~ Mr. Annunziato did not know. He said it had always been planned to be a water storage facility necessary at that location. Mr. Annunziato thought there had been some discussion that it not be a high structure. T. Clay Blanton, Chief Engineer, Russell & Axon, appeared before the Board. Chairman Ryder noted that the plans call for some kind of compaction, which would be adequate for the height and the weight. Mr. Blanton said they had specifications to secure the ground so it would not give under the weight of~ the tank and water column. Chairman Ryder asked if the tank would be made of steel. Mr. Blanton replied that was correct. The steel membrane is protected on the - 6 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 27, 1RS1 outside. It is reinforced with ~einforcing~ba~s, The roof is a poured concrete slab. The reinforcing on the outside of the tank is prestressed. Chairman Ryder wondered what the exterior would look like, Mr, Blanton said it would be colored in an .earth tone, sort of tan, so it would blend in wlththe site, Mr. Blanton said ~he building will be an amber color, He informed Chairman Ryder it was a single level building, Mr. Wandelt asked about the elevations, and Mr. Blanton answered there were blueprint elevations. Mr, Annunziato showed a plan~to the Board. He thought it would be similar in structure to the lift stations, and Mx. Blanton agreed. Mr. Blanton said it~would be Similar in design to the lift station on SecOnd Avenue Mr. Linkous moved that the plans be approved, subject to staff comments. Mrs. Bond seconded the motion, and the motion carried 7-0. Chairman Ryder informed the Board of two letters he received from Edgar E. Howell, Building Official for the City. The letters were addressed to him with copies to the City Manager, City Planner, Central Files, Chief~ Inspector, and Deputy Building Official. The first letter referred to overhangs, pointing out that presently, overhangs are allowed to encroach two feet into setbacks beyond the walls of the building. It points out that in commercial zones there is no allowance for overhangs as an encroachment and setback. Mr. Howell points out that in order to get credit, according to the Energy Code, overhangs~have to be at least three feet or more due to the shading factors over windows. Mr, Howell could see where they could comply with new construction presently but with existing buildings, there would be a .problem to conform with the Energy Codes. Mr. Howell asked the consideration of the Planning and Zoning Board with regard t~o any possible reconsideration of the overhang extensions. Mr. Howell mentioned that he had been in touch with the City Planner, but the City Planner would not be in favor of approach- ing this on a piece meal basis because there are other areas that will come under consideration for possible changes by the Board and the City Coundil. Mr. Howell thought it might be considered an emergency situation. Chairman Ryder told the'Board that the other letter deals with twelve foot setbacks of an accessory building from the principal building. In other words, if you had a building and wanted an accessory building like a sh~d added, Which is not a part of the main building or garage, it has to be not closer than twelve feet from the principal building. Mr. Howell feels the twelve foot requirement should be deleted. He does not propose any alternative so it is possible if it is deleted entirely, there may be an accessory building outside the main building and then there would be problems. - 7 - MINUTES - PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 27, 1981 With regard to accessory buildings, ~Chairman Ryder continued, present- ly the height is limited to seven (7) feet, and Mr. Howell would recommend changing this to eight (8) feet because the present seven foot maximum height creates a structural hardship on the installation of doors. Mr. Howell would appreciate the Board's consideration of those items. Chairman Ryder said Carmen Annunziato, City Planner, felt it would be advisable for the Board to wait until they have some of the other matters that are also urgent so they could all be considered as a whole rather than doing it in a piece~a~ basis~ Mr, Linkous asked about the others. Mr. Annu~ziato explained'that they were looking at the Zoning Code, as he had mentioned earlier, in the Spring. They are in the final stages Of a complete rewrite of the OffS%reet Parking Code Section. They intend to address all of the Sections in the Code. Al%hough Mr. A-nnunziato agreed that some of the comments made by Mr. Howell are good, it did not seem that anything was of an emergency nature. He felt it was a matter of piecemeal adjustment to the Code, ~which could go on for years or addressing large sections at one point and time. Mr. Annunziato preferred the latter approach. Mr. Linkous asked if there was any reason why Mr. Howell wanted those items acknowledged. Mr. Annunziato and Chairman Ryder agreed that it had to do with comments he is receiving from the applicants. Mr. Annunztato said some things make a lot of sense, but the Code will not permit them. With existing structures, you cannot move the buildings, but with new structures, you can. Mr. Linkous asked when the items suggested by Mr. Howell could be incorporated into the various changes to the Code. Mr, Annunziato hoped within the next six months. - Mr. Annunziato told the Board both he and Mr. Howell had other matters they wished to comment on and change. Chairman Ryder thought if Mr. Howell, particularly, had other matters which would stem from;the Building Department, he thought it would be advisable for the Board to get some of the others from Mr, Howell and Mr. Annunziato,.~and'possibly treat them apart from the overall changes they have mn mind. He asked Mr. Annunziato to address Mr. Howell with that in mind, so the Board could consider and address all of them. Mr. Annunziato commented that he and Mr. Howell had been working together on it for sometime. Mr. Wandelt thought the items should-be brought-up individually rather than in a whole package, as they can be understood more thoroughly. H~ could understand the comments contained in Mr, Howell's letters, but if six or seven were thrown at him at one time, his mind could only take two or three things. - 8 - MINUTES ~ PLANNING AND ZONING BOARD BOYNTON BEACH, FLORIDA OCTOBER 27, 1981 Mr. Annunziato informed the BOard that the Ordinance adoption procedure was lengthy and involves advertising and a great deal of money, and to address individual ±rems would be time-consuming and expensive. Mr. Wandelt said it should go o~ record that the Board either approves or disapproves the· concept. Mr. Annunziato agreed~.that the concept could be addressed'but actually putting the items in force would require a great deal of energy. Mr. Linkous felt it was better to ask stupid questions than to make stupid mistakes. Mr. Linkous asked if there was any variance whatsoever relative to the rules, for instance the eigh~ foot maximum height. Mr. Annunziato said there was a procedure. Chairman Ryder said they could appeal to the Board of Adjustment but it would cost them some money. Mr. Linkous thoUght the Board should wait for all of the suggestions. Chairman Ryder felt the Board should wait and see to what extent they have others, and %hen go ahead on that in spite of the fact that it will be expensive and take time, Apparently, Chairman Ryder, noted, it poses problems, and they should be addressed.
