Chairman Ryder welcomed everyone and called the meeting to order
at 7:30 P. M. He introduced the Members of the Board, City Planner,
and Recording Secretary.

Mr. Annunziato, City Planner, said he had two documents:
An addition to the Zoning Code, which is a result of the action
recently taken by Council to provide for private cable TV
systems.
Final copy of Neighborhood Strategy Area Study, which was
prepared under the auspices of the LPA.

Chairman Ryder said the location was at the southwest corner of
the Second Avenue overpass and 1-95, down in the hollow, on the
north side of Northwest First Avenue abutting the south side of
frontage on Second Avenue, between Sixth and Seventh Street.
This block happens to be a varigated type of zoning, which includes
R-2 and C-2. The request is to take one s~trip only 10 feet in width
for the full depth of the plot and rezone that strip, using that
additional 10 feet so that a residential unit (duplex) can be
accommodated.
Mr. Carmen Annunziato, City Planner, asked the Board to recall,
when sitting as a Planning Agency, one recommendation made by staff
was to change land use designation and the zoning on property which
lies as a result of and adjacent to the overpass for Second
Avenue. This was a result of their analysis that the property did
lack access and any use of the property for commercial purposes
would act to inhibit the ability of the property to be developed
properly for residential purposes. The property changed ownership.
A developer bought the property and proceeded to developthese lots
plus the remainder of Lots 1 through 9 in a duplex mode, starting
from east to west, As the property was divided out into 9,000
square foot lots., it became apparent that a portion of Lot 10 was
needed to be added to Lot 11 to provide for a zoned lot of
sufficient size.

Lots 8,9, i0 and 11, but basically is the median cut in Second
Avenue. Mr. Ryder asked whether the applicant was the owner of the
strip or adjacent lot. Mr. Annunziato replied that was right.
Mr. Constant came forward and said they had a ten fOot strip that
would allow them to build a duplex. .Mr. Ryder asked if the property
owner to the west was present at the meeting. He said the Board
would call on everyone who may be involved in it.
Mr. Annunziato said staf{ recommended it be approved. Mr. Linkous
asked what would happen to the balance of Lot 10. Mr. Annunziato
said Lot 10 was the one which would be divided. Mr. Linkous then
asked if it would be utilized in conjunction with 321 and the
answer was, !!Yes".

Chairman Ryder asked if anyone in the audience wanted to speak in
favor of this proposed rezon±ng and received no response. He
asked if anyone wanted to speak in opposition to this proposed
rezonlng and received no response,
Mr. Ryder said the Board would have to assume the owner of the
remaining property had been advised as to the proposed change and
asked Mr. Annunziato if there had been any communication. There
were no communications.
Chairman Ryder repeated the above as to whether anyone wished to
speak ±n opposition to the proposed rezoning and received no
response.
Chairman Ryder pointed out that the proposed change would have
no serious impact as the block has already been divided almost
equally between C-2 and R-2.
Mr. Linkous made a motion that it be rezoned from C-2 to R-2,
seconded by Mr. Z~ive. Chairman Ryder also noted that the proposed
rezoning had the endorsement of the City Staff Technical Review
Board. The motion carried 5-0.

Chairman Ryder said the property borders on the westerly side of
Congress Avenue. Chairman Ryder said the master plan had been
approved and in matters such as this, in the event the applicant
feels the changes he desires are not substantial, in lieu of
beginning again with a new application, he can appear before the
Council and attempt to satisfy the Council that the changes are
not of a major character. At the last meeting of the City Council,
the Council approved the request on the basis they did not find
the proposed changes were of' a substantial nature. The matter now
comes before the Planning and Zoning Board for consideration and
approval as well.
Mr. Annunziato, City Planner, said they recently went through two
exercises of master plan modifications. Mr. Annunziato read th~
following changes which were requested:

TO remove frc~ each development tract the previously approved
small parcel of land which was devoted to private recreation and
incorporate this acreage into the proposed lot layout for the
tract;
2. To consolidate all the private recreation into two parcels
formed from Tracts M and G;
To increase the density in Tract E frc~ 3.5 to 4 units per acre
and in Tract F from 4 to 5 units per acre to account for the
loss of units which resulted in placing the private recreation
in Tracts G and M only; and,
4. To increase the overall unit count by two (2) units."
As to paragraphs 1 and 2, Mr. Annunziato explained that the plan for
development was approved for zoning 2½ to three years ago, The
final plan is awaiting the response of the Plann±ng & Zoning Board.
It is located on the west side of Congress, North of Canal 20,
opposite Boynton Lakes development, and extends from Canal 20 to
Hypoluxo Road on the North. The original plans called for separate
recreation areas in each of the 14 tracts making'up the development,
The Board must consider the request to change the recreation by
combining the private recreatio~ which appeared in the development
tracts, into two larger recreational tracts which serve north and
south of Canal 19. One is in Tract M and the other in Tract G.
Both recreational tracts will have a clubhouse, barbeque area, play-
ground, parking lot, open space, and a tennis court.
As to paragraph 4, Mr. Annunziato said he thought it was a m~sunder-
standing on his part. Access to the si'te remains unchanged~with
a circular road intersect±ng Congress Avenue at two locations.
The southerly location lines up center line to center line with the
entrance road to Boynton Lakes and will be signalized. A north/
south road terminates at Hypoluxo Road. At the time of PUD approval,
improvements relating to traffic were imposed by Council and are
not requested to be Changed.
Concerning the issue of whether or not this was a substantial
change, Mr. Annunziato said City Council had determined this was
not a substantial change. Mr. Annunziato reco-mmended the Board
approve the changes subject to the following:

Mr. Julian T. Bryan, III, Agent for Meadows 300, explained to the
Board that in the preparation of the plat for parcels A, B, C and
D, they were able to put two more units than they had planned on
the parcel, still utilizing the minimun lot requirements. There
will be 1,394 dwelling units consisting of a mixture of single
family, cluster homes, and townhouses.
Mr. Bryan also stated the developers already have dedicated a 4
acre site and a 7 acre site to the city to be used for public
recreation and some of the ~nterior roads may also be public roads.
After discussion about the public recreation and determining there
were no substantial changes to %he plans, Mr~ H~ster moved to
accept the plans subject to staff comments and recommendations.
Mr. Linkous seconded the motion, and the motion carried 5-0.

Mr. Annunziato presented the plat which contains 93 acres, which
he said was somewhat complex in that there are a number of private
streets and a great number of easements. Lago Marissa is a part of
the lake which separates the property in an east/west manner. To
the north is the dedication of Miner Road. There will be 423 units
of single family, duplex, and garden apartments. Chairman Ryder
asked whether the entrance road is private and Mr. Annunziato replied
it is.

Mr. Annunziato advised that the plat documents were resubmitted and
reviewed by the Technical Review Board, which differ very little
from Mr. Annunziato's comments. Mr. Annunziato read the following:
"The subject plat and development plans have been reviewed by ~he T,R,B.
and approval is recc~mended subject to the stipulations as noted on
the attached print and as further stated as follows:
The plat document must 'be corrected because of technical
discrepancies. The revisions must also show Miner Road
extended as 108-ft. wide fnstead of t06-ft, as shown, The
deed description is to be corrected also. The Dedication
must provide for utilities in private roads."
Mr. Annunziato said the above items had been accomodated in the
plat which was reviewed by the Technical Review Board that morning
('July 14, 1981). He read further:
"2. Street lighting and traffic control devices are to be added
to the development plans."
Plans have been received for the street lights. However, the City
does not presently have plans for the traffic control devices.
"3.
The Developer must present information concerning the value
of the property so the Planning and Zoning Board can determine
the recreation fee."
Mr. Annunziato said there was some discrepancy here, Public recre-
ation has been accommodated by the buffer areas dedicated to the
City in easement form. Maintenance can be conducted by the Dos Lagos
Home Owners Association.
"4. A cost estimate for the required private recreation. Said cost
to be bonded."

Mr. Annunziato referred the technical aspects to Mr. Tom Clark,
City Engineer.
Mr. Clark said the last note, No. 5, originated with the Lake Worth
Drainage District. He informed the Board that on all new plats, the
Lake Worth Drainage District wants a separate documented dedication
of their right-of-way instead of just dedicating it on the plat
document.
Mr. Tracy Bennett, Senior ViCe President of Satter Companies said the
Lake Worth Drainage District basically, in 1900, reserved every
lateral. They filed maps of reservations with the County Engineer's

office and various cities and indicated what they would like to have.
Through the years, as developments were approved, the property was
dedicated through plats in much the same manner as road right-of-
ways. However, a few years ago, LWDD began asking for deeds. Mr.
Bennett stated he felt the dedications were very sufficient. He
said the Lake Worth Drainage District feels a deed in hand now is
much better than waiting 'for a plat dedication some time later in
case they have to go in and widen a section. Mr. Bennett said they
had no aversion to deeding if the Board wishes.
City Engineer Tom Clark pointed out that LWDD also wanted it shown
right on the instrument, "to be maintained by Lake Worth Drainage
District," so they can point it out and say, "This is ours," Mr,
Cl~k said he thought the point was that before the final plat
would be recorded, that the document should be recorded in the
County and a~copy be made available to the City before the final
plat. He felt the LWDD would be satisfied with that also.
Mr. Annunziato continued reading Staff Comments, as follows:

As to the City Planner's comments, Mr. Annunziato explained the Staff
is requesting that the easement be superimposed over the buffer area
for utility purposes.
He read further:

Mr. Annunziato said it was the overall recommendation that the
application of preliminary plat be approved subject to staff comments.
Chairman Ryder asked whether Miner Road was being improved and if
access to it was contemplated. Mr. Annunziato said the improvement of
Miner Road lies with Palm Beach County and no access was contemplated.
There was a lot of discussion about Miner Road.
Chairman Ryder noted that there were only 423 units and a lot of
acreage and water. Mr. Bennett said about 15% of the acreage will
consist of lakes in addition to large open spaces and recreation
areas. Mr. Bennett said they had been working with the County and,
as to the signal requirement, the County basically allocates it
signal requirements by warrant, because if there is a signal prior to
a warrant, it can be just as bad as having a signal with a warrant.
Mr. Annunziato explained that the recommendation referred more to
internal stop signs within the development, street signs, etc.
Chairman Ryder verified that Inter Lagos, the central road, was the
only means of access and egress.

Mr. Annunziato said this had come before the Planning and Zoning
Board as both the preliminary application nd the master plan, He
presented the preliminary plat. The location of the 25 acre indus-
trial subdivis±on is at the western northern terminus of West
Industrial Avenue. It is proposed that West Industrial Avenue will
extend into the property along the western side of the parcel,
terminating in a Culdesac. The site will be served by gravity
sewer and existing water systems. Water will be extended to the
site and tie into water at 7th Street,
Mr, Annunziato further stated the lots are approximately 1½ acres
in size. Adjacent to West Industrial Avenue is a proposed 50 foot
drainage easement, which will be privately owned and maintained.
It is proposed that a two foot limited access be platted between
West Industrial Avenue and'-the eastern lot l~nes~of. Royale Village
III and IV Additions. A wall is to be constructed within that
limited access right-of-way.
Mr. Annunziato said the application had been reviewed by the City
Staff, and offered the following comments:
Building Department:
The city ordinance requires sidewalks on
all new subdivided areas.
Barrier wall must be a minium of six feet
(~6') above grade.
Utility Dept.
Subject to offsite easements.
Mr. Annunziato explained that the easements were in two locations.
Approximately 400 feet to the south of the plat, there is an East,/
West gravity sewer line which runs from Industrial Avenue to West
Industrial Avenue. That easement has been secured by the applicant.
It is one of the easements that has been granted to the City for
utility purposes. Additionally, an easement has been secured for
a~ six inch water line which will connect the water which is in West
Industrial Avenue westard to Seventh Street and southward to tie
in with an existing ten inch water line.
Mr. Annunziato continued with the Staff Comments:

Mr. Annunziato said they have requested the applicant to submit
a more definitive plan indicating number, sizes, and locations of
tree species. As to paragraph (2), Mr. Annunziato said to assume
you have a wall in a two fHot easement, the footer itself would
consume the entire two feet. The problem could be in maintaining
the wall five to ten years from now. Mr. Annunziato said if you
have access to the wall from all sides, maintenance should be
less of an issue.
Mr. Annunziato read the following:

The T.R.B. met on June 26, 1981 to review the subject preliminary
plat and approval is recommended subject to the stipulations made
by members of the T.R.B. and further stated as follows:
A letter indicating conceptional approval from the Water

The memo from Bud Howell (Building Department- as on page 8)
Sidewalks as required by the Subdivision Ordinance must be
shown on plans and included in the cost estimates for the
bonded improvements.
The wall required on the west side of West Industrial Ave.
should be six feet (6') above finish ground level.

Ave. must be included in the bond.

Mr· Linkous asked about the access to the wall for maintenance, and
Mr. Annunziato said he believed this may be an item that may have
to be taken up before the City Council in the future to request
relief from that various aspect. Mr. Annunziato said our subdivision
regulations requ~ire sidewalks on both sides of a dedicated right-of-
way, which he said appeared to be unreasonable to require sidewalks
on the west side of Industrial Avenue. He said ±t may be an item
the applicant may take up before the City Council in variance form
in the near future.

Chairman Ryder was advised by Mr. Annunziato that curbs were not
required.
Tom Clark, City Engineer advised the revised plans show a road
cross section that is not acceptable at this point, so he wanted to
comment that the road section, as proposed, must be consistent with
the City's requirements and would have to be taken care of on the
detail sheet.
Mr. John W. Ewseychik, Jr., Agent, said they will review Mr. Clark's
comments regarding the road cross section with him tomorrow (July
15). Mr. Ewseychik said the easements had been secured, as
requested by the Public Utilities Department. Mr. Ewseychik referred
to Mr. ~C~ne~ Annunziato's letter of December 15, 1980 with regard
to the sidewalks, which said, under staff comments, "construct a
sidewalk or a bike path on the east side of Industrial Avenue."
~r. Ewseychik said the letter was a letter of approval of the
master plan and there had been sufficient discussion about the side-
walks in December, 1980. He said if it was necessary for them to
go through a further variance request, they will do so. Mr.
Annunziato said he would still make the recommendation that he did
not feel the sidewalk was necessary on both sides of the right-of-
way but he would .still recommend to have a sidewalk.
Mr. Ewseychik said their master plan had been approved by staff to
reflect a 1.5 strip of land to accommodate the wall. He said he
had the signed plans, and it would constitute a hardship to meet Mr.
Annunziato's request, as the entire plat would have to be recalculated.
This would mean an extreme expense to his client, and it was not
fair to approve something and then change it. The wall would have
a permanent P'~gmentation which wOuld take care of the maintenance
problem. Mr. Ewseychik also said it would be the Property Qwners'
Association's responsibility to maintain the wall.
Mr. Annunziato, City Planner, said he did not think there was any
previous approval which precludes any body of government from taking
another look. Mr. Annunziato said maintenance of the wall could be
a problem. Mr. Annunziato agreed 1.5 feet was approved but pointed
out that maintenance was not discussed at that time. When they dis-
cussed maintenance of the wall, it was determined 1½ feet would be
insufficient, but Mr. Annunziato said he did not think that would
preclude them from making further determinations .in the process.
There was discussion about the wall and the maintenance of it and
the cost of submitting a new plat. Mr. Ewseychik said the cost of
a new plat alone would be about $1,500..00, and that would not
include time wasted.
Mr. Annunziato said the main issue was maintenance of the wall.
Mr, Annunziato said if the applicant could offer sufficient proof
that their treatment of the surface of the wall will .preclude long
term maintenance, there would be no problem of two feet, and it
could be approved subject to staff comments. Mr. Annunziato

recommended the Board approve the preliminarY plat ±f the applicant
will provide detailed and technical information within next week
which can shrink the easement from five feet to two feet.

Chairman Ryder stated the master plan had been approved by the
Board.
Mr. Annunziato said this was a proposal to plat 2.8 acres into ten
single family lots, some of which front on the Intracoastal and
some of which front on the finger canal south of the development,
and there is one land lot.
The plat provides for termination of public Las Palmos Road into
a culdesac providing a driveway to turn the vehicles. A private
driveway will be extended from the culdesac to serve six lots.
It is proposed Lakeside Harbor Drive be extended to continue as a
private street, which terminates at the culdesac. Now there is a
means to bring vehicles off Lakeside Harbor Drive, which is a
private drive, and put them on a publicly designated right-of-way.
Mr. Annunziato read the memorandum dated July 2, 1981 from Tom
Clark, City Engineer. (See "Memorandum" attached hereto.)
Mr. Annunziato continued by reading the following memorandum from
Charles C. Frederick, Director, Recreation & Park Department:
"Based on subdivision requirements, ten residential units at .018 acres
per unit equals .18 acres of land dedication requirement. Recc~nend
fee in lieu of land. Developer should provide land value documents."
Mr. Annunziato said a copy of the sales agreement, which was
consummated on July 14, 1981, transferring ownership of the property,
sets the value of the land at $400,000.00. His calculations show
$139,370 per acre. It was Mr. Annunziato's recommendation the plat
be approved, subject~ to staff comments.
Tom Clark, City Engineer said a letter from the Water Management
District stated the drainage plan had been accepted, so he does not
anticipate any drainage problems.

Michael B. Schorah, Agent for Fisherman's Landing advised that the
new owner is Blenheim, a Florida corporation. He said there could
be some confusion, as the contract shows Lancastire, a sister
corporation, as the one that closed the deal.
Chairman Ryder asked how they could make certain, in a change of
ownership, that the new owner does what was done before. Carmen
Annunziato advised to make certain the owners put themselves on
record officially as being responsible. He suggested they notify
the City in writing of the change in ownership.
There was discussion about whether the Board could act when there
is a new owner.
Mr. Linkous moved that the preliminary plat be approved, subject
to comments of staff and subject to the question of the new owners
being clarified. Chairman Ryder added the recommendation of the
recreation fee which was also stipulated in staff comments. The
motion was seconded by Mr. Zive and carried 5-0.

Mr. Annunziato said it was the applicant's intent to relocate the
sales area,which currently exists in Tract A, to Tract J, which
lies to the north and east of the clubhouse in Tract J. The site
plan provides for construction of a sales center and various types
of units which will form the basis of continued sales at Hunters
Run.
Chairman Ryder asked if the buildings would be of a temporary
nature and Mr. Charles N. Gilbert, Agent, said they would remain
and be incorporated into the final scheme. Mr. Gilbert explained
there would be villas, a~.t%~s~ building containing four apart-
ments, and townhbuses~f_ which is exactly as the present sales
center. Mr. Gilbert said it has been done successfully before.
Mr. Linkous asked whether it would exceed the gross limit and it
was determined it would not.
Mr. Annunizato said the plan had been reviewed by the Technical
Review Board, and he read the following comments:

During the reading of the Staff Comments", Mayor Harmening, Council-
member Woolley, and Councilman deLong entered the meeting,
Mr. Gilbert asked about the security lighting and Mr. Annunziato
explained it meant a continuation of what has been done before.
Mr. Gilbert then asked about the grade elevations for paving, Mr.
Tom Clark answered that when ~unters Run gets its paving permit,
they will have to have it completely definitive.
Mr, Zive moved, seconded by Mr. Hester, to approve the site plans,
subject to staff comments. The motion carried 5-0.
ADJOURNMENT
The meeting was properly adjourned at 9:30 P. M., after motion made
by Mr. Zive, seconded by Mr. Linkous, which carried 5-0.

Forwarded herewith is a copy of a letter from Michael Schorah,
Po E., which is self explanatory.
The pl'at documents required for the preliminary plat are forwarded
herewith as follows:
1. Six copies of the Preliminary Plat Sheets 1 and 2.
2. Two cop~es of the ConStruction Plans.
3. A copy of the cost estimate for improvements in the
total amount of $57,437.
4. Two copies of:the approved Master Pian.
5. One copy of t~e Drainage Calculations and a copy of
the D.E.R. Permit.
The T.R.B. reviewed the subject preliminary plat and approval is
recommended subject to the following:
Street lighting to be added to plans.
Traffic control devices to be added to plan.
A bill of sale, a recent appraisal, or other infor-
mation concerning the value of the property should
be presented so the Planning and Zoning Board can
determine the dollar amount of the recreation fee
as recommended (see memo attached from Recreation
Director dated June 29, 1981)~ The Developer's
representative says he will have this information
and will be at the P&Z Board meeting of July 14, 1981.
Ail existing easements and/or rights of way should be
be added to the plat with the book and page number
as recorded in the County Clerk's public records.
The existing 15-ft. easement on the west side of Lot 10
(0R2911, Pg.590) should be shown although the Developer
intends to abandon this easement so he can utilize the
10-ft. set back.

at each change in direction of the plat boundary
(except where corners are under water).
