Minutes 03-25-80MINUTES OF THE REGULAR MEETING OF THE PLANNING & ZONING BOARD HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, MARCH 25, 1980 PRESENT Arnold Thompson, Chairman Fred DiSalle, Vice Chairman Lillian Bond Marilyn Huckle Simon Ryder Garry Winter Carmen Annunziato, City Planner Craig Grabeel, Asst. City Planner ABSENT Wayne Drew (Excused) Chairman Thompson welcomed everyone and called the meeting to order at 7:30 P. M. He introduced the members of the Board, City Planner, Assistant City Planner and Recording Secretary. He recognized the presence in the audience of Councilman Joe deLong and Councilman Marty Trauger. MINUTES OF MARCH 11, 1980 Mrs. Huckle moved that the minutes of the regular meeting of the Planning & Zoning Board for Tuesday, March 11, 1980, be accepted as submitted, seconded by Mrs. Bond. No discussion. Motion carried 6-0. ANNOUNCEMENTS Mr. Annunziato announced the City Council has set April 16th and April 30th, 1980 at 7:30 P. M. to conduct public hearings on the zoning map and ordinance amendments. Chairman Thompson requested any members if they have any topic they would like presented ~ a Citizens' Awareness Presentation to please let him know or Mr. Grabeel know. COMMUNICATIONS Mr. Annunziato read a letter from Mr. Robert Beane and Mr. Lucien Samyn requesting an amendment to the Comprehensive Land Use Plan elements. He informed the Board the proper procedure is being worked on to provide for review of amendments including a hearing before the Planning & Zoning Board and City Council and action to amend the plan and rezone. This procedure is being reviewed now by the City Manager, City Clerk and City Attorney. MINUTES - PLANNING & ZONING BOARD CITIZENS AWARENESS PRESENTATION MARCH 25, 1980 Mr. Grabeel introduced Mr. Dick Warefield, Executive Director of the Areawide Health Planning Council. Mr. Warefield distributed copies of the Council's annual report, showed a slide presentation depicting their functions and organization, and then explained their programs. A question and answer session followed. Mr. Grabeel announced that Mr. Ned Brooke of the Metropolitan Planning Organization will give a presentation on Urban Trans- portation Planning at the next meeting on April 8. NEW BUSINESS Preliminary Plats Applicant: Location: Legal Description: Project Description: Hunter's Run Golf & Racquet Club (C. Gilbert, Agent) Summit Boulevard Replat Housing Tract Bi, Summit Plat No. 1 Preliminary Plat provides for 140 multi-family units on 16.709 acres (Site Plan approved by Council on 1/7/80) Mr. Annunziato informed the Board the next two applications before the Board are preliminary plats for Tract B1 and part of Tract B2. He explained the location. The site plans have been approved by the Planning & Zoning Board and City Council. These are the tech- nical drawings. Tract B1 is for 140 multi-family units on 16 acres. These preliminary plats have been reviewed by the staff. Mr. Clark advises these preliminary plats have been reviewed and approved by the Technical Review Board subject to the following: 1. Cost estimates for improvements to B1 and B2 should be broken down and a schedule of quantities with unit prices submitted. 2. The Utility Department stipulated that water meters should not be indicated in paved areas and that water and sewer lines Should be ten feet from any buildings. 3. P.C.P.'s (Permanent Control Points) should be shown on the plat map for Tract B2 as indicated in the legend. Mr. Annunziato stated the staff recommendation is the preliminary plat for Tract B1 be approved subject to staff comments. He added that the Utility Department is incorporated in this memo. -2- MINUTES - PLANNING & ZONING BOARD MARCH 25, 1980 Mr. Ryder referred to the sewer easement and stated he assumes this is sanitary, but how is the storm water drainage handled and Mr. Annunziato pointed out the lines drawn through the plat are noted utility or drainage easement. He added that it is noted that lines cannot be closer than ten feet to any building and the water meters are to be in the grassed areas. He then explained how the lakes serve water quality and quantity func- tions. Mr. DiSalle made a motion that the preliminary plat for Hunter's Run Golf & Racquet Club, Tract B1, be approved subject to staff comments, seconded by Mr. Winter. No discussion. Motion carried 6-0. Applicant: LoCation: Legal Description: Project Description: Hunter's Run Golf & Racquet Club (C. Gilbert Agent) Summit Boulevard ' Plat of Stratford Phase II, being a replat of a portion of Housing Tract B2, Summit Plat No. 1 Preliminary Plat provides for 164 units (apartments and townhouses) with community building, lakes and pool on 40.2 acres (site plan approved by Council on 3/4/80) Mr. Annunziato pointed out this replat lies directly to the west of the preliminary plat just approved separated by the Lake Worth Drainage District Canal L-29. This will form one half of the condominiums with the remaining half of Tract B2 to be incorporated into this development. There is a utility ease- menu crossing from Tract B1 into this portion of Tract B2 to provide for a looped water system. The bond amount for both plats is estimated to be $400,000 and has been submitted to the City Engineer. This was calculated to take into account all the sewer, water and paving improvements for both plats. This application was reviewed by the Technical Review Board and the~same comment appears on this plat as for Tract B1, the memo from Mr. Clark incorporating Mr. Cessna's comments. Mr. Gilbert corrected that .these units will be on 21.28 acres instead of the 40.2 noted. Mr. Annunziato clarified that it provides for 164 multi-family units on 21.28 acres with com- munity building, lakes and pool. He added in both cases, the number of unius approved on the tracts are below what was approved in the development plan. Mr. Winter made a motion that the preliminary plat for Hunter's Run Golf & Racquet Club, Plat of Stratford Phase II, replat of a portion of Housing Tract B2; Summit Plat No. 1, be approved subject to comments. Mrs. Bond seconded the motion. No discus- sion. Motion carried 6-0. -3- MINUTES - PLANNING & ZONING BOARD MARCH 25, 1980 Other Applicant: Location: Project Description: Los Mangos Homeowners Association, Inc. (S. Scheiner, President) Los Mangos Development at S. E. 27th Terrace Approval of Entrance Sign Mr. Sam Scheiner, 528 S. E. 27th Terrace, showed a model of the proposed sign. Mr. Annunziato stated this comes to the Board as a result of a requirement of the sign ordinance which requires review by the Planning & Zoning Board and approval by the City Council. This was reviewed by the staff and the comments noted are the Building Official noted subject to the sign code and the Engineering Department noted this construction should be outside the easement. The recommendation is to approve this subject to staff comments. Mrs. Bond asked how tall the sign would be and Mr. Scheiner in- formed her it would be about 4' high and 3' wide. Mr. Ryder asked if he was aware of the easement location and Mr. Scheiner replied they will have to find this out from the Building Depart- ment. Mr. Ryder made a motion that the Board recommend approval of the application from the Los Mangos Homeowners Association for the installation of an entrance sign in accordance with staff com- ments, seconded by Mrs. Bond. No discussion. Motion carried 6-0. Request by Mr. Robert Hamilton, President of Mariner Village of Boynton Beach, to Consider Changing Marine Drive from Manor Drive North to N. E. 12th Terrace from a two-way private street to a one-way private street running south. Mr. Annunziato stated this comes to the Board as a 'result of a request by the developer of Mariner Village to make a part of Marine Drive one way to the south. There was some discussion what would be the best avenue to review this procedure and the City Manager determined because this is a land development issue of sorts, a recommendation by the Planning & Zoning Board after staff review should be forwarded to the City Council. The pro- perty owners on N. E. 12th Terrace, Marine Drive and Manor Drive have been notified. He pointed out the portion which was pro- posed to be changed to one way. He added that these three roads are private roads. Mr. Annunziato stated the staff did look at this and some recom- mendations were made. He read the memo from the Police Depart- ment noting after review, they can see no problem with southbound one way traffic flow from the south curb line of N. E. 12th Terrace to the north curb line of Manor Drive. -4- MINUTES - PLANNING & ZONING BOARD MARCH 25, 1980 Mr. Annunziato then read the comments from the City Engineer stating: "In my opinion, since a number of residents already living in the area served by Marine Road may have an interest in the change proposed by Mr. Hamilton, a public hearing may be desirable. The City Attorney should advise concerning any legal procedures. "I see no reason why the request should not be granted if the people served wish the street to be one way. The costs for the signs would be borne by the developer since streets in the area are private and are not maintained by the City." Mr. Annunziato then explained the traffic access and flow for this area if the change was made. Chairman Thompson clarified that just the portion between N. E. 12th Terrace and Manor Drive was being referred to. Chairman Thompson asked if anyone in the audience wished to speak in favor of this to please come forward. Mr. Ray Kubes, 660 Manor Drive, stated due to the structure and width of the road, he thinks it is pretty hazardous as it is now with a two way system. The road is not wide enough to control two way traffic. It should be one way for safety purposes. He thinks the BOard's approval would be well deserving. Mr. Ryder questioned the route he takes from his house at present to go north on Federal Highway and Mr. Kubes pointed out the route along 10th Avenue as access onto Federal Highway is easier with a traffic light. He added that there is a problem now on Marine Drive with two vehicles not being able to fit through. Mr. Ryder asked if he thought with Mariner Village there would be more congestion and Mr. Kubes replied affirmatively, that it is obvious with having more people moving into the area. Mr. Ryder asked if he saw any problem with making the street one way and Mr. Kubes replied not at all and added that he went to the residents on Manor Drive and they signed a petition in favor. Mr. Ryder asked if the petition had been submitted and Mr. Kubes replied that he gave it to Mr. Hamilton. Mr. Ryder asked how many signed the petition and Mr. Kubes replied that everyone living on Manor Drive did, which is six houses and an apartment complex; everyone feels it would be a benefit to have it one way going south. Mr. Ryder stated he would like to be sure just because this new development is coming in that the people living there aren't unnecessarily disturbed and have a means of access and Mr. Kubes replied there will still be a means of access. ~ -5- MINUTES - PLANNING & ZONING BOARD MARCH 25, 1980 Mr. DiSalle asked how wide the road is and Mr. Kubes replied about 12 to 13 feet in that area. Mr. Winter asked if the south section would also be hazardous and Mr. Kubes replied negatively and explained that it is wider. Mrs. Huckle clari- fied that N. E. 12th Terrace is t~oway and Mr. Kubes agreed and added that it should remain two way. Mrs. Huckle referred to N. E. 12th Terrace looking narrow from the print submitted and Mr. Annunziato clarified that it is a narrow private road, but it is two lanes and the right-of-way is 30 feet. Marine Drive is very narrow and awkwardly located. This occurred when the private roads were created many years ago. Chairman Thompson asked if anyone else in the audience cared to speak in favor and received no response. He asked if anyone cared to speak in opposition and received no response. He re- ferred to letters having been received and read a letter from Mr. Eugene J. Mahlmeister stating this request will prevent a traffic hazard. He then read a letter from Mrs. Evelyn Gesell, 650 Manor Drive, objecting to this proposal because it would make it illegal to enter Manor Drive from N. E. 10th Avenue making it necessary to drive the long way around. Mrs. Huckle stated that evidently Mrs. Gesell misunderstood the request and Mr. Winter agreed and pointed out that it actually would not affect her. Chairman Thompson read a letter from Marie L. Pfeffer, Manor Cove Apartments, granting permission for this one way street. Mr. DiSalle made a motion that the request to consider changing Marine Drive from Manor Drive north to N. E. 12th Terrace from a two way private street to a one way private street running south be granted noting staff comments. Mr. Winter seconded the motion. Mr. Annunziato clarified there were no staff com- ments, but the staff did review this. Under discussion, Mr. Ryder commented that apparently most of the people who are liv- ing there are in favor of this. Apparently the one letter in opposition might be due to a misunderstanding. In view of the fact there is really no opposition, he would be inclined to go along with this. Chairman Thompson asked if the Planning & Zoning Board was to just make a recommendation on this and Mr. Annunziato replied affirmatively. Motion carried 6-0. ADJOURNMENT Mr. Winter made a motion to adjourn, seconded by Mr. DiSatle. Motion carried 6-0 and the meeting was properly adjourned at 8:50 P. M.
