Chairman Thompson welcomed everyone and called the meeting
to order at 7:30 P. M. He introduced the members of the
Board, City Planner, and Recording Secretary.

Chairman Thompson referred to Page 8, 8th line down, where it
states the Police Department has noted a 50' radius at State
Road 7 and stated he believes this should be State Road 807.
Mr. Hester moved that the minutes be approved as corrected,
seconded by Mr. Johnson. Motion carried 7-0.
ANNOUNCEMENTS
Mr. Annunziato announced that. the City Council has forwarded
back to the Planning & Zoning Board for public hearing pur-
poses the package of zoning ordinance amendments and map
changes to implement the comprehensive plan. He is currently
working with the City Attorney and City Clerk to set the dates.
He suggests that the public hearings be held on a separate
night from the regular meeting. These will begin in early
January. Chairman Thompson ascertained the members were in
agreement. Mr. Annunziato asked if any night was particularly
bad for anyone and Mrs. Bond replied that she would not be able
to attend on Thursday, January 17. Mr. Annunziato stated he
will schedule the public hearings and notify the Board members
by mail.
CITIZENS AWARENESS PRESENTATION
Mr. Annunziato announced the citizens' awareness survey ques-
tionnaire is available in the back of the room and hopefully
the people will complete it after the discussion tonight.
Mr~ Annunziato then gave a presentation famil~iarizing~e
with the scope of Florida State Statutes Chapter 380, Develop-
ments of Regional Impact, and explained the purpose, respon-
sibility, role, etc.
Mr. Ryder referred to the public hearing tonight being a
matter of rezoning and questioned at what point does develop-
ment approval enter this application and Mr. Annunziato re-
plied that it was initially submitted to the Regional Planning

Council and they have 15 days in which to notify the developer
if the application is sufficient. The application for develop-
ment approval and all parts attached to it become the basis for
the impact assessment report. In the instance in which the
development order may be approved by the City Council, the
application for development approval and all attached materials
should be made part of the development order.
Mr. Ryder questioned just what a development order is and Mr.
Annunziato informed him a development order can be any granting
of right,ether it is zoning, building permit, variance permit-
ting development to go forward, etc. In this case the develop-
ment order, if adopted, will be part of the rezoning ordinance.
Mr. Ryder clarified that it would be the action on the rezoning.
Mr. Hester referred to receiving a book in the packet and one
tonight and asked if the 14 recommendations are those from the
Treasure Coast and Mr. Annunziato replied affirmatively and
added the ones in the book are the recommendations of the
staff and what was handed out tonight was adopted by the Trea-
sure Coast Regional Council.
Chairman Thompson referred to this development being in three
phases and asked if the approval encompasses the entire project?
He also asked if approval could be denied on any one phase?
Mr. Annunziato informed him the DRI addresses the entire build-
ing program proposed by the developer. Stipulations can be
placed within the development order to limit development in the
future. The development order is for the life of the project
and generally runs for 30 years.
Mr. Ryder referred to this being the first DRI for us and Mr.
Annunziato added that we have come close in the past.
Mr. Annunziato ascertained there were no further questions and
suggested proceeding to Item 2 on the. agenda since the public
hearing is advertised for 8:00 P. M.

Mr. Annunziato' informed the Board that this preliminary plat is
the first phase of the Via Lago Development. He referred to this
preliminary plat having appeared before the Board in several
other phases and stated in all instances, it has been approved.

Mr. Annunziato continued that this plat represents the potential
for 24 condominium units on 3.374 acres. In reference to staff
comments, the Utility Department noted additional Valving is
required on some of the water lines. In regards to recreation
requirements, the developer responded by providing a dollar
value for the land, which he thinks is sufficient and the Board
can fulfill the requirements for establishing a number and the
private recreational facilities to be constructed are part of
Phase I. The letter from the developer notes in Phase I there
will be: concrete gazeboes along footpaths, one-half of Vita
Course excer¢ise course and exercise stations and equipment,
foot paths winding through the botanical gardens, beach on Lake
Worth, sidewalk, and benches along footpaths to be used as quiet
areas. Phase II will pick up the remainder of the private
recreational facilities. Plat I contains 3.374 acres of land
and the appraised market value as of November 20, 1979, as per
independent appraiser was $324,000. Based on computation, the
total land recreation to be dedicated to the City would be .18
acres. The developer will donate a fee to the City of $17,285
for Phase I. The overall comment from the staff is this pre-
liminary plat be approved subject to staff comments.
Mr. Ryder asked if there would be other phases and Mr. Annun-
ziato replied affirmatively and advised this is approximately
1,/3 of the Via Lago Development.
Chairman Thompson referred to there being a road to the north-
east and asked if the dedication of this road had been accom-
plished and Mr. Annunziato replied affirmatively and pointed
out that Tract A appears as Lake Street on the plat
Mr. DiSalle made a motion that the preliminary plat for The
1700 Development Corporation located on Lake Street behind
Bernard's Restaurant be approved subject to staff comments
including acceptance of the appraised value for the recrea-
tion fee to the City of Boynton Beach for Phase I. Mr.
Johnson seconded the motion. No discussion. Motion carried

Mr. Annunziato referred to rezoning to PID being similar to
rezoning to PUD and stated this requires the adoption of a
master plan with the rezoning. He referred to this being part
of the Sandhill development zoned R-3 and C-1 and explained the
location. This application presents a combination of uses with
the potential of having 825,000 square feet of production and
office space as outlined in the text and plan. He then ex-
plained the breakdown proposed and pointed out the locations
of the buildings on the master plan. The land surrounding this
development is primarily zoned residential and he pointed out
the various zones. He explained this plan offers the protec-
tion of a PID with having the mandatory greenbelt areas to buf-
fer the residential areas to the east, south and north.
He then told about the projected employment for each phase.
He then explained the impact of the expected tax revenue.
Mr..Annunziato then summarized with telling about a few of
the many positive features of this development.
Mr. Annunziato referred to staff review and stated it must
be determined whether this is consistent with the proposed
comprehensive plan. He read the paragraph addressing this in
the comprehensive plan. Some of the problems encountered in
review concerned the impact on adjacent road rights-of-way.
This was addressed by the Treasure Coast Planning Staff and
it was determined several roads in the area at some time or
other will be over-burdened by this DRI. The language adopted
in the summary of recommendations provides for litigating the
question of these negative factors by the expenditure of
public dollars for road improvements. It has been proposed
by the Department of Commerce, State of Florida, that approxi-
mately $2,000,000 may be made available by the State to enhance
industrial development in the State of Florida. A representa-
tive appeared before the Treasure Coast and pledged support to
try to secure said funds. Palm Beach County pledged to match
funds with the State of Florida if they became available and
to provide funding for the design and construction of Congress
Avenue from Lake Ida Road to Lantana Road. The site will be
served by public sewer and water. Congress Avenue forms the
basis for the sewer and water service for the northern part
of the City and he explained the location and route of the
16" water mains and force mains. The City has applied for
expansion to its existing EPA grant to provide 75% funding
for that regional force main. The developers are working on
an agreement to provide for a master water looped system.
He then concluded by stating he has highlighted the obvious
things in this plan.
Chairman Thompson referred to roads and asked if there has
been any move by any group pertaining to access to 1-95 at
N. W. 22nd Avenue and Mr. Annunziato replied this has been
addressed by the staff, Motorola, and Regional Planning
Council and an intersection at N. W. 22nd Avenue is under
study but does not appear in the Year 2000 cost plan. As
an alternative, there is mention of six or eight laning
Congress Avenue.

Chairman Thompson requested the representative from Motorola
to comment. Mr. Bruno DeJulian, attorney representing Motorola,
came forward and referred to representing Motorola for ten years
and told about his involvement in the plant developed at Planta-
tion. He then introduced various representatives of the firm.
Mr. DeJulian referred to it being difficult to make a presenta-
tion because the staff has done an excellent job and stated for
him to try to be any more detailed about what is proposed would
simply be an effort to justify his existence. The materials
submitted Ho the members and the presentation given have all
the details and the items proposed for this particular PID.
He then told about Motorola making the decision to pursue the
DRI procedure instead of developing the project on a piecemeal
basis. He then suggested that the Board adopt the provisions
of Section 7'~t0 of the PID classification in the zoning code as
it relates to their application. He then advised that he is
prepared to answer any questions and the representatives and
consultants will be glad to also.
Chairman Thompson ascertained there were no questions from the
Board members at this time. He then asked if anyone in the
audience wished to speak in favor of this rezoning request and
received no response. He asked if anyone in the audience cared
to speak against this rezoning request and received no response.
Mr. Annunziato referred to the staff comments and stated one
concerns the driveways to the north onto N. W. 22nd Avenue and
the south driveway onto Congress Avenue. He explained the loca-
tion would be subject to the permit procedure of Palm Beach
County and may alter slightly. A memo was submitted from the
Police Department and there is the recommendation a security
fence be provided for the parking areas. He has commented
that this master plan and DRI is subject to approval of the
development order and rezoning by the City Council. It is
consistent with the adopted comprehensive plan. The Recrea-
tion Director has noted that easements be provided and bike
paths constructed on Congress Avenue and N. W. 22nd Avenue.
The overall staff comment is the recommendation this rezoning
and master plan be adopted taking into account the summary
recommendations presented by the Treasure Coast Regional Plan-
ning Council, the recommendation in Section7-10 and the staff
comments.
Chairman Thompson asked if Mr. DeJulian cared to address the
comments and Mr. DeJulian replied that he certainly concurs
that the location of the driveways will meet the permitting
requirements of Palm Beach County.
Mr. DeJulian stated in reference to the fencing of ths parking
lots, this matter just arose and they are not prepared to pre-
sent statistically the reaons why this would not be necessary.

He requests when the Board makes their recommendation for this
PID rezoning to the City Council that they take into considera-
tion that they are subject to a great deal of additional appro-
val and should be given the opportunity to convince the Chief
of Police and present the statistics from the Plantation Police
Department to show the construction of such a fence is not nec-
essary. It is not only the matter of considerable expense,
but one that may pose certain aesthetic problems. They recog-
nize this legitimate concern of the Police Department, but
were not aware of it. He requests that a recommendation be
made to the City Council that this be studied further.
Mr. DeJulian added that in regards to easements, they are
satisfied.
Mr. Mauti asked if any security was anticipated as far as the
parking lot is concerned and Mr. Fred Hilton explained what
was existing at Plantation with a 24 hour, seven day guard
station with closed circuit television monitoring the dock
areas and parking lots. At times when the plant is opened,
other entrances are manned by security people. During the
work day when most of the employees are there, they have a
roving security person driving around the parking lot contin-
uously.
Mr. Ryder referred to this being the second PID the City has
been confronted with and stated one of the prime considera-
tions with the first one was only little information was
submitted on how the land was going to be developed which
created a good deal of concern. With this submission, we
find it is helpful to have the master plan submitted with
the request for rezoning. This industry is something which
is definitely needed in Boynton Beach. It is a very happy
occasion at this time to be confronted with a proposal that
many people have dreamed of. He finds in the Treasure Coast
Planning Council report that they apparently feel most of the
impacts are positive and the only negative one is in reqards
to roads, which is important. He told about other develop-
ments in this area being involved in the roads plus the
County is considering a bond issue. On his own part, he
feels it is gratifying to come to this point with all the
plusses and it will be a great thing for Boynton Beach.
Chairman Thompson asked how the chemical or hazardous wastes
are to be handled and Mr. Hilton told about the waste at the
Plantation Plant being picked up by a licensed scavenger. Mr.
Annunziato added that concerniag the disposal of hazardous
wastes, there are two recommendations that were adopted by
the Regional Planning Council and he read Nos. 5 and 6 in the
recommendations. The Motorola staff has accepted these recom-
mendations.

Mr. Annunziato stated Section 7, Paragraph 10, of the PID regu-
lations should be addressed by the Board and Mr. Ryder read this
paragraph. Chairman Thompson stated from the information we
have been given there is no conflict to what has been presented
and what is addressed in this chapter. Mr. Annunziato concurred
and stated the materials are consistent with what is proposed
by Section 7, Paragraph 10.
Chairman Thompson asked about Mr. Cessna's memo pertaining to
dedication of the lift station sites and Mr. Annunziato replied
that Mr. Cessna's comments were made on the master plan which
preceeded this master plan submitted. On this plan, Mr.
Cessna has approved it with no comments since his original
comments were satisfied.
Mr. Ryder moved that this Board recommend approval to the City
Council of the rezoning request covering the Motorola. Tract
east of Congress Avenue and south of N. W. 22nd Avenue to be
rezoned from the current R-3 and C-1 to the category of Planned
Industrial Development and this recommendation also includes the
recommendations made by the City staff, Treasure Coast Regional
Planning Council staff and also referring to the applicability
of Section 7, Paragraph 10 of the PID zoning regulations. Mr.
Annunziato clarified the motion was to adopt the recommendations
of the Treasure Coast Regional Planning Council approved at
their meeting of December 7; the Board notes consistency with
the adopted comprehensive plan of the City and Section 7,
Paragraph 10 of our PID Zoning Ordinance; and subject to staff
comments except the subject of fences is to be studied further.
Mr. Ryder agreed and Mr. Mauti seconded the motion. No discus-
sion. Motion carried 7-0.

Mr. Grabe~l referred to this being part of what was originally
called POD B and pointed out the location on the map. This is
140 condominium housing units, one and two stories. This area
is about 16.7 acres with a density of 8.37. The parking has
been accommodated in accordance with the master plan. The
utilities are served by the access road. The drainage will
be accommodated by the lake and canal.
Mr. Gilbert, representing the applicant, came before the Board.
Mr. Ryder referred to these being multi-family units and Mr.
Gilbert explained they would be one and two story units with
the maximum being an eight unit building, two stories.

Mr. Ryder asked if all the parking would be in the open adjacent
to the particular unit and Mr. Gilbert replied affirmatively.
Mr. Grabeel referred to the staff comments and stated the Fire
Department noted the fire hydrants should not be more than 500'
apart. The Utility Dept. designated the water line sizes with
the line to have a complete loop. The Police Dept. noted it
is subject to traffic control signs. The City Planner indicates
this-is consistent with the master plan. The staff recommenda-
tion is approval subject to staff comments.
Mrs. Bond asked if Mr. Gilbert is in agreement with the staff
comments and Mr. Gilbert replied affirmatively. Mr. Ryder
asked if access from Summit Drive will be by private roads
and Mr. Gilbert replied affirmatively.
Chairman Thompson referred to the density possibly being
lowered for the remainder of Tract B and Mr. Gilbert replied
that the density allowed is 10 units per acre and this parcel
is 8.3 and the other will be below 10, but it has not been
finalized yet.
Mr. Mauti made a motion to approve this site plan for Tract
B-1 subject to staff comments, seconded by Mr. Hester. No
discussion. Motion carried 7-0.

Mr. Mauti made a motion to adjourn, seconded by Mr. DiSalle.
Motion carried 7-0 and the meeting was properly adjourned at
8:50 P. M.

This willl confirm my statement of this morning at the TRBmeeting.
The fire service line to serve Motorola should be connected to the
main line in at least two (2) points.
Secondly, the future 'connections to both water and sewer lin~ cov-
ering Present and future developmen~ will be installed as part of
the original connection to prevent jack and bore problems at a
later date.
Third, the lift station sites and attendant force mains will have
to be covered by a legal document to be worked out between the City
Attorney and Motorola's attorney. As stated, we normally require
dedication; but, in this case, it is possible that the City Attor-
ney and Motorola's attorney can work out a 99-year lease, or license,
or some sort of document, if Motorola does not want to dedicate the
site to the City.

As per our conversation, Deputy Chief William Hamilton and I
visited the Motorola Plant in Plantation on November 8, 1979.
While we were there, we spoke with the head of security, Hansel
Bailey and his boss, Ralph Perelli who is also the Director of
Personnel. Our discussion of approximately four hours duration
dealt with the interfacing'of their Security system with our
policing efforts in our city of Boynton Beach. The meeting con-
firmed what was brought to light at the TP~ meeting of October
31, 1979 by Mr. Tom McDougall of Motorola. The company does:~not
request or require patrol, as this function is done by its in-
house security. Their security guards are unarmed and do not have
the power of arrest. They can hold for local authority. This
department will be called to investigate violation of Florida State
Statutes, most frequently for accident investigations. In our in-
-' vestigation at Plantation, we were informed that their largest
problem was from pilferage from the employee parking lot and oc-
casional theft of motorcycles. The Security Chief felt as we do,
that security fencing of the parking area would be a strong deterrent
to the type of pilferage they are experiencing in Plantation and can
be'expe~ted'.~ here in Boynton Beach when the company becomes op-
erational. We were informed that the Plantation Police Department
provides traffic control officers during their factory peak traffic
periods. As I recall, the four laning of Congress and traffic
signalization is part of the package. At this juncture, I cannot
say whether traffic enforcement officers will be required for
similar use at the Boynton location.
