OR Bk 32710 PG 0824 RECORDED 07/21/2021 14:57:03 Palm Beach Counts, Florida Joseph Abru�zo,Glerk /,,r//,'.��1L:_l __r- AP ad %_ ii.71.1143 ORDINANCE NO. 21-019 Jos 0h24 r zzo, (Irks) 3 AN ORDINANCE OF THE CITY OF BOYNTON BEACH,FLORIDA, 4 RESCINDING ORDINANCE 20-041 AND APPROVING THE 5 ABANDONMENT OF AN APPROXIMATELY 76 FOOT LONG 6 SECTION OF THE FIVE (5) FOOT WIDE ALLEY ALONG THE 7 SOUTH SIDE OF LOT 1,MEEKS ADDITION TO BOYNTON PLAT; 8 AUTHORIZING THE CITY MANAGER TO EXECUTE A 9 DISCLAIMER, WHICH SHALL BE RECORDED WITH THIS 10 ORDINANCE IN THE PUBLIC RECORDS OF PALM BEACH 11 COUNTY,FLORIDA; AND PROVIDING AN EFFECTIVE DATE. 12 13 WHEREAS, as a condition of approval of the Wells Landing North project on MLK 14 Boulevard, east of Seacrest Boulevard, Elizabeth Roque of Wells Landing, LLC, requested 15 abandonment of a 436.5 foot segment of the 5 foot wide alley along the north side of their 16 project and adjoining parcels to the west; and 17 18 WHEREAS, this condition of approval required the establishment of an easement 19 along the entire 436.5 foot length; and 20 21 WHEREAS, the condition of approval of the abutting parcels has not been satisfied; 22 and 23 24 WHEREAS, Staff now recommends that the City instead only abandon that specific 25 76 foot long segment that falls within the Wells Landing project boundaries; and 26 27 WHEREAS,staff has determined that the requested abandonment would not adversely 28 impact traffic or other City functions, and would not adversely impact other adjacent property 29 owners; and 30 31 WHEREAS, comments have been solicited from the appropriate City Departments, 32 and public hearings have been held before the City Commission on the proposed abandonment; 33 and • 34 35 WHEREAS, staff has determined that the subject alleyway no longer serves a public 36 purpose and therefore recommends approval of the request, subject to the accompanying 37 conditions. 38 39 NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF 40 THE CITY OF BOYNTON BEACH,FLORIDA THAT: 41 42 Section 1.
