Minutes 09-25-79MINUTES OF THE REGULAR MEETING OF THE PLANNING $ ZONING BOARD HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, SEPTEMBER 25, 1979 PRESENT Arnold Thompson, Chairman Fred DiSalle, Vice Chairman Lillian Bond Ezell Hester Gene Johnson Caesar Mauti Simon Ryder Carmen Annunziato, City Planner Craig Grabeel, Asst. City Planner Chairman Thompson welcomed everyone and called the meeting to order at 7:30 P. M. He introduced the members of the Board, City Planner and Recording Secretary. MINUTES OF SEPTEMBER 11, 1979 Mrs. Bond made a motion to accept the minutes of the Planning Zoning Board meeting of September 11, seconded by Mr. Mauti. Motion carried unanimously. COMMUNICATIONS~ Chairman Thompson read the attached letter from Mr. Howell per- taining to boat houses on private lakes and waterways. He re- quested this item to be put on the agenda for the next meeting for discussion with any information pertaining to this to be sent to the members with the agenda for review. He also requested that a memo be sent to Mr. Howell asking him to be present at the meeting. Mr. Grabeel referred to the Citizens' Awareness Programs and ad- vised that he checked with the Area Planning Board, County, and other cities and there are no such programs. He has been receiv- ing responses to the letters he sent. NEW BHS!NESS Subdivision Regulation Pre-Application Applicant: Location: Project Description: Edgewood Heights (Danny O'Brien, Agent) North of N. W. 8th Court at Old Boynton Road 21 residential lots on 6.13 acres Mr. Annunziato explained the location and stated the Technical Review BOard reviewed this and many comments were forthcoming. Perhaps the applicant can make his presentation and then he will state the City's concerns. MIN-~TES - PLANNING g ZONING BOARD SEPTEMBER 25, 1979 Mr. Danny O'Brien stated this is a 6.13 acre subdivision lying in a R-1AA zone. It is unique property with having elevation differential. There were two comments made at the Technical Review Board meeting pertaining to additional road right-of-way on 8th Court and looping the water line and they have no pro- blems with these. Also, the question of a recreation fee is no problem. There was a question regarding the width of the right- of-way being 50 ft. or 60 ft. and they feel 50 ft. is adequate since that is what is required by code. Mr. O'Brien stated that two problems to be resolved are double frontage lots and drainage. Due to the topography of the area, this is the best design taking into consideration all factors. Limited access would be required for houses to front on N. W. 10th St. A water retention area is shown on Tract A. There will be a homeowners association for complete maintenance of this area. The major points are frontage on N. W. 10th Street and the retentionarea on Tract A. They would like to proceed with this subdivision. These questions are not within the sub- division, but ~uture maintenance. These can be resolved in dif- ferent ways. The City Engineer had no problem with this plan. They would like to get the Board's informal approval of this pre-application so they can proceed into the master plan phase. Mr. Johnson referred to R-tAA requiring 75 ft. frontage and pointed out that two lots only show 28 feet. Mr. Annunziato explained how lots on a cul-de-sac measure the frontage at the setback line. Mr. OTBrien i~formed him that these lots all meet the code as far as square footage, frontage, width and depth. Mr. Ryder referred to not having received a formal application and Mr. Annunziato informed him the general statement submitted by Mr. OTBrien pretty much constitutes the basic required infor- mation that is within the subdivision regulation~ If the Board wishes, they aah require additional information for their review. Mr. Ryder suggested possibly there should be something similar to the application with supplemental information. Mr. Annunziato informed him that there are no specific applications for anything occurring in the subdivision regulations but certain requirements must be met. He explained they do have a check list which out- lines the kinds of information to be submitted and a copy of this could be sent to the Board members and Mr. Mauti agreed this would be helpful. Mr. O~Brien referred to the procedure and stated actually the pre-application and master plan could be done as one and the preliminary plat'and final plat could be done as one -2- MINUTES PLANNING & ZONING BOARD SEPTEMBER 25, 1979 Chairman Thompson referred to the plan and stated because N. W. 10th Street will ultimately be a thru street, for safety pur- poses possibly there should be a cul-de-sac turn to come off N. W. 10th Street so the double faced lots would be on dead end streets in the project, He is against a lot facing two streets. Mr. Annunziato stated the staff has several comments concerning these particular areas. Several memos were submitted and this pre-application was the topic of much discussion at the Techni- cal Review Board meeting Many reservations were expressed by the Technical Review Board members. Concerning drainage, it is understood there are some topographical features making it a little more difficult to construct 60 ft. streets and provide drainage along the back lot lines and within swales. Parcel A is noted as a drainage and recreation area. After the April flood, it was brought to the CouncilTs attention how one of these areas did flood. The staff has deep reservations about construction of these with on-site retention ponds. Not only do they fall into disrepair, but they present a hazard to sur- rounding neighbors. With having 21 homes, all of which have to participate financially to support the maintenance of the retention pond, it is very easy for a small group to complain to the City Council and ask the City to maintain the area. This resulted in a strong objection from the Recreation Director since he realizes this will be a maintenance responsibility for the City. Regard- less of the topography, there are .ways to maintain drainage on site. Homeowners usually maintain swale areas without having an out parcel which becomes a burden. Mr. Annunziato referred to double faced lots and read the defini- tion from the subdivision regulations. He thinks it has not been defined thoroughly enough to d~termine if this subdivision could exist in a different configuration. Mr. Annunziato referred to staff comments and read the following comments from Mr. Howell: The engineer should show elevation of adjacent property bordering on the east side ~f the proposed development and he recommends that no retainage pond be allowed on this project. He read the following comments from the Engi- neering Department: 1. Valleycurbs are required for 50 ft. right-of-way. Swales inca 60 ft. right-of-way will accommodate storm water better. 2. Lot "A" if it is to be used for drainage without an emergency outfall should be centrally~located. Recreation requirements should be addressed. 4. A legal description~of the property should be included in the pre-application. 5. A topographical map should be submitted. 6. Adjacentpropertyshould be identified.. -3- MINUTES - PLANNING $ ZONING BOARD SEPTEMBER 25, 1979 Mr. Annunziato continued with advising the Utility Department noted the water line to be looped. The Police Department has noted street lights. His comment noted there are to be no double frontage lots. He does not think it has been demonstrated it is essential to have this design of lots. Mr. Annunziato then read the following comments from the Recreation Director: 1. Based on the subdivision ordinance requirements, the recreation and open space dedication require- ment is: 21 units ~ .018 acres equals .378 acres. Recommend fee in lieu of land equivalent to .378 seres. 2. Recommend that the developer provide other means of drainage accommodations other than the water reten- tion ponding area as indicated on the plan. These areas present maintenance, health and safety pro- blems for the City work forces and area residents. Mr. Annunziato stated the overall comment is that this pre-applica- tion for this subdivision could be addressed differently. Perhaps with the lots fronting on N. W. 10th Street, this street could be improved. Perhaps if going to a 60 ft. right-of-way instead of 50 ft., there could be swales accommodating the storm water runoff and the lots would be deep enough to accommodate water in the rear. Mr. Ryder referred to N. W. 10th Street being shown as 30 ft. in width and asked if this is to be a dedicated City street, shouldn't it be widened and Mr. Annunziato replied the pre-application does provide for this. The 30 ft. dedication was part of the oldpplat. It is proposed to dedicate an additional 10 ft. from each side. Mr. Ryder referred to walks and Mr. Annunziato informed him these would have to be within the 10 ft. Mr. Ryder stated that drainage is a critical point. Retention areas are great, but without positive means of directing the flow, it is questionable how ~ffective they can be. He thinks a centrally~located retention area would be more efficient. Chairman Thompson referred to there being no plans to improve N. W. 10th Street and Mr. O~Brien agreed and added they do not know where it is going. Mr. Annunziato stated he thinks it is incumbent upon this subdivider to improve N. W. 10th Street. He doesntt think it has been proven this is the only way this sub- division can be developed. Lots could front on N. W. 10th Street and N. W. 10th Street could be utilized for the proper purpose. Mr. O'Brien stated he did not think it was necessary to prove every statement at this time, but this should be done at the master plan. The question on retainage is philosophical and regards maintenance. The homeowners association will be respon- sible for taking care of the retention pond and can be cited by -4- MINUTES - PLANNING $ ZONING BOARD SEPTEMBER 25, 1979 the City by ordinance. Drainage is an engineering problem. The City Engineer insures that they must take care of a certain amount of drainage. The drainage question is an engineering question that they have not submitted full information on. It will be included with the master plan and preliminary sections of the code. He is not prepared to argue the question of double frontage and drainage. There are sections in the code dealing with double frontage lots. This will all be covered at the proper time at the master plan or preliminary plat level. Mr. Annunziato stated N. W. 10th Street will be a local street, Lots could front on N. W. 10th Street. He doesn't think there is anything which would preclude that from occurring. As far as drainage, there are other solutions to the drainage problems other than a retention pond. He feels there are better solutions than shown here. There is no objection to going forward to the master plan with the understanding there will be no double front- age lots and no retention ponds on site and consideration be given to redesign. Mr. Mauti suggested tabling this until Mr. O~Brien has the proper time to review the staff comments and when he comes back with full knowledge of the staff comments, we can proceed from there. Mr. Ryder agreed since some of these points are critical. He feels developing N~ W. 10th Street is an important factor and he would like that explored. N. W. 10th Street abuts this property for a considerable distance and they are excluding any provision for putting in this street. He thinks we must address the responsi- bility of this developer to contribute something to the future installation of this street. Mr. O~Brien stated that according to the code, a pre-application is to consult informally with the Technical Review Board and Plan- ning & Zoning Board prior to the preparation of the master plan and formal application. It does not state in the code this pre- application can be turned down. He considers the pre-application an informal meeting whereby he can present the plan, get staff comments, get the Board's comments, put these comments together and come back with the master plan. Mr. Annunziato replied that he is of the opinion that the Board has the right and opportunity to approve, approve with recommendations, not approve or table any action. If the Board is not ready to make a decision con- cerning any application, they can table. However, tabling might not be the answer. He would like direction if there is a tabling motion. Mr. Ryder has pointed out that N. W. 10th Street is im- portant and he concurs. The Board might want to discuss with Mr. O'Brien the topic of double frontage lots and drainage and he will have direction in which to modify the pre-application. Mr. Mauti stated he brought this up because Mr. O~Brien is the agent and not the owner. He thought tabling might possibly be the answer so Mr. O~Brien can read the staff comments, bring them to the owner's attention and come back. MINUTES - PLANNING $ ZONING BOARD SEPTEMBER 25, 1979 Mr. Hester stated he doesn't think this should be tabled. Mr. O'Brien has heard the comments from the Board. If the recom- mendations are not met, there is reason to turn down the plan when the master plan is presented. Mr. O'Brien agreed and added there will be master plan review and the Board will have more authority than on the pre-application plan. ~hairman Thompson stated there is also reasoning if these pro- blems are worked out at this time, the master plan would be easier to approve. Mr. Ryder added that we are talking about fundamental factors and the principal is not present. He does not think we can imply any approval until these things are developed. Mr. Ryder moved to table this matter in regard to installation of N. W. 10th Street, the matter of providing an acceptable drainage area, and no thrusstreets. Mr. Mauti added that he thinks Mr. Annunziato has commented on all the provisions which were made and Mr. O'Brien will receive a copy of those provi- sions. We have the authority to approve this subject to staff comments which means everything must be included. However, he doesn't think we should until we hear from the owners of the property. Mr. O'Brien stated he would like the Board to let him move forward to the master plan section taking all the comments made tonight and incorporating them into the subdivision. If he can't do it to the Board's satisfaction at the master plan, that is it. Mr. Mauti asked if he would like the Board to approve this plan subject to all staff comments and Mr. O'Brien replied negatively, not subject to staff comments but approval with the consideration of staff comments and at master plan~approval, he will come back. Mr. Mauti informed him the Board could not give a half approval. Chairman Thompsonclarified that there is a motion on the floor to table this due to the numerous reasons stated. Mrs. Bond seconded the motion. Motion carried 5-1 with Mr. Hester dis- · senting and Mr. Mauti abstaining. Mr. O'Brien questioned the time on this motion to table and ChairmanThompsoninformed him this will be reviewed at the next meeting on October 9. Preliminary Plats Applicant: Legal Description: Project Description: Hunter's Run Golf & Racque~tClub Replat Housing Tract M, SummitPlat No. 1 48 two $ three bedroom condominium homes plus pool and pavillion -6- MINUTES - PLANNING $ ZONING BOARD SEPTEMBER 25, 1979 Mr. Annunziato stated the Board has already recommended approval for the site plans for this villa home proposed on Tract M. The City Council approved the site plan. This preliminary plat covers the technical aspects. The staff reviewed this and two comments were made.by the Police Department to provide street lighting and traffic control signs per Florida State Statutes and the Public Works Department noted no underground garbage cans. The site plan showed the street lights; however, it was not keyed in to what the mark on the plan meant. The applicant has submitted proper documentation. The staff recommendation is to approve subject to staff comments. Chairman Thompson referred to this not changing any layout of the lots and Mr. Annunziato agreed and added that it is a condominium with common land. Mr. Mauti referred to the letter submitted regarding bonding figures and Mr. Annunziato informed him that each preliminary plat has to be accompanied by the developerts engineerts esti- mate of the cost of construction for public improvements. Mr. Mauti asked if this met the approval of Mr. Clark and Mr. Annunziato replied affirmatively. Mr. Hester moved to approve this preliminary plat for Hunter's Run, Tract M, Summit Plat No. 1, with staff comments. Mr. Johnson seconded the motion. No discussion. Motioncarried 7-0. Latino Subdivision 12 Duplex Lots (24 Units) Mr. Annunziato stated this preliminary plat f~llows the pre- applicationand master plan,approved by the BoaDd at the last Planning & Zoning Board meeting. This plat covers the techni- cal plans. These were reviewed by.the staff. The Building Department notes the sidewalks have to be constructed. The Police Department notes it is subject to streetlights, fire hydrants anda buffer on the rear lot. The Recreation Depart- ment notes the developer is to provide a copyof the contract of purchase to provide the Planning g Zoning Board necessary information~to determine the required fee for recreationand openspace dedication. He has computed the acreage for the benefit of the applicant. Based on.3.15 acres of land and 24 units, .438acres would have to be dedicated. The question arises as to the value of the land. The applicant has provided a letter with David L. Reidfs signature noting the appraised value of $44,780 which would be $14,217 per acre which he thinks is probably close to the fair market value. Also, a letter from Mr. James L. Hillard indicates the appraised value is correct and in compliance with State law. Mr. Annunziato continued that concerning the School Board, they recommend the Planning & Zoning Board accept .4 of 1% on the value of the unit or closing costs be transferred to the School Board for 8onstruction of schools in Boynton Beach. Mr. Of Brien clarified that the School Board is going with their standard clause and it will be .4 of 1% of ~alue, which is the selling price of the home. The plans have been corrected to show the sidewalks, street lights and buffer area and have been resub- mitted to the City Engineer. Mr. Mauti made a motion to approve subject to all staff comments, seconded by Mr. DiSalle. Motion carried 7-0. ADJOURNMENT Mr. Mauti made a motion to adjourn, seconded by Mr. Johnson. I would venture to. state that ninety-five percent (95%) of the individuals who purchase property bordering waterways do so with the-intent of instituting docks and in fifty-percent (50%) of the instances, a boat house in mind at the time of purchase. Hopefully you will be in agreement with me on this, along with possi- ble limitation as to size and heights. (Possibly the same type roof as the residence on that property, for aesthetic reasons.) The parcel containing 6.13 acres lies in an area classified as R-1AA Zoning within the city's corporate limits. Annunziato, City Planner Re: BdgewoodHeights - A Proposed Subdivision Dear Carmen; In regard to your letter in reference to the mentioned subject dated September 7,' 1979, the following comments are forwarded. It is the intent to construct the fifty foot right of ways in accord with the City's specifications. I see no need at this time to contact the S.F.W.M.D. for varied reasons, one of which'is that by Regulation we have to seek a General Permit from the District, however at this stage this permit is premature. It is my contention that until such time as the Master Plan is approved that the developer should not have to stand the expense of any thing more than conceptual engineering design due to the fact that any change in lot, unit or road configuration may cause a complete redesign of the engineering factors. Up to the point of preliminary plat approval these considerations could and should be conditional in nature. The Peripheral Drainage/Recreational Drainage tract is placed as shown due to the topographical nature of the lands involved and it is our contention, when considering all of the factors, involved, that this is its best location. Can not your concerns be alleviated if this tract were owned and maintained by a Property Owner's Association thereby causing an entity that the City's insPectors can site in accord with the City ordinances as they do presently with the private property owner? Attached are seven'copies of the Site Plan revised to indicate the size, location and connection points to the City's utilities.
