~hairman Thompson welcomed everyone and called the meeting to order
at 7:30 P. M. He introduced the members of the Board, City Planner
and Recording Secretary. Mr. Annunziato then introduced Mr. Peter
Cheney~ the new City Manager for the City of Boynton Beach.

Mr. Hester made a motion to approve the minutes, seconded by Mr.
Oberle. Motion carried 7-0.
ANNOUNCEMENTS
Mr. Annunziato announced at the past City Council meeting, the
Council by motion agreed to forward the Comprehensive Plan to the
state and regional planning agencies and adjacent mmnicipalities
for review. Now, we are in the 60 day waiting period for responses.
OLD BUSINESS
Mr. Annunziato referred to the open storage issue and advised he
is still working on an acceptable proposed ordinance and is coor-
dinating with the Building Department and reviewing the minutes.

Mr. Jim Tirhorst, General Manager of Gulfstream Lumber Company, ex-
plained the plan to increase their parking facilities for their
employees and retail customers. By using this proposed parking
area for employees, it will free the area in the front of the
store for customer parking. The back portion of this parking
area will be used for truck storage and parking.

Mr. Tirhorst referred to meeting with the Community Appearance
Board last night and stated they suggested adding foliage trees
consisting of approximately 27 trees to be located on this parking
site with nine along Federal Highway. From an appearance stand-
point, there will be a beautiful cover of trees within a few years.
There aIso will be hedge along Federal Highway and hedge along the
fence dividing the two parking areas. He feels this will be very
acceptable and will add to the overall general appearance of the
site fitting in with the surrounding area. They have tried to
maintain their store and property in the best condition possible.
The design has been engineered according to City specifications and
the drainage will be retained on site. He would be very happy to
answer any questions.
Mr. Ryder referred to there being an opening in the divider wall to
the north of the ramp to this property and asked if it permits U
turns and Mr. Tirhorst replied that it is not supposed to and ex-
plained there is a cut located parallel to the store entrance.
Mr. Annunziato informed the Board this parking lot was reviewed by
the staff. He referred to the zoning ordinance recently being
changed to permit lumber yards and their associated uses as a con-
ditional use in C-3 and stated following this, this request was
presented to the City. Regarding the staff comments, the Engineer-
ing Department has noted a membrane is required under the rock and
computations are required for 3" water storage. He has commented
this is per 11.2 of the Zoning Ordinance. The staff recommendation
is to approve subject to comments.
Chairman Thompson asked if anyone in the audience cared to speak
in favor of this at the present time.
Mr. Matthew Romano~ 1321 S.E. 3rd Street, stated he is probably the
one most directly involved since his property directly abuts the
lumber yard. He speaks in support of this proposal because basic-
ally during the six years he has lived here, Gulfstream Lumber
Company has consistently demonstrated they are concerned about the
residents. He told about the company moving a cutting machine
when the noise bothered the residents, installing a fence when
requested to by the neighbors, etc. He feels certain they will
do what they say they are going to do and it will be attractive
for the area.
Mrs. Hildegard Crockett, 1314 S.E. 3rd Street, referred to taming
to speak in favor of Gulfstream previously and stated she is very
much in favor of this improvement. She told how this lot previ-
ously had a dilapidated house on it with tramps living in it with
dangerous dogs. She is happy to see Gulfstream is making an im-
provement. She is sure this will definitely be an improvement
for the City.

Chairman Thompson asked if anyone wanted to speak against this
proposal and received no response. He ascertained there were no
questions from the Board members.
Mr. Mauti made a motion to approve this subject to staff comments,

Mr. Bill Vaughn, Architect, explained a small branch bank was pro-
posed on 1.4 acres of land on Woolbright Road iust east of Lindsley
Lumber. He has been given the information on the changes requested
by Mr. Annunziato and is in agreement with all the changes. He is
present to answer any questions.
Mr. Annunziato referred to this site previously being approved for
a small Food Fair Shopping Center and advised they are not part of
this application but have retained ownership of the parcel just
south of Lindsley Lumber. This property is now divided into three
parcels which does not require platting.
Mr. Annunziato referred to the staff comments and read the memo
from Mr. Howell requesting: the existing walk on Woolbright Road
to be shown on the site plan, the handicapped parking spaces to be
indicated, the handicapped ramp to be shown and designated for
access to the building, handicap signs at handicap spaces to be
shown, a catch basin is required to handle water at south end of
property in lieu of runoff into grass area, and the entire storm
water drainage to be designed according to the Water Management
specifications before entering canal~and must be approved by the
Water Management District. He explained the northern 2/3Ts of the
property will be served by positive drainage and it is felt the
southern portion will encroach beyond the landscaped area and it
is recommended catch basins be provided and tie into the drainage
system.
Mr. Annunziato advised that Mr. Law has commented that a septic
tank is okay if platting is not required. The General Services
Department has requested the dumpster to be relocated to the
southeast corner to provide direct access. He has commented the
additional 7' of right-of-way required for Woolbright Road be
provided for a full 120' section. It must meet the Water Manage-
ment requirements. Palm Beach County approval is required for a
turnout. The plan is recommended to be approved subfect to these
recommendations.

Mr. Ryder referred to 15th Avenue only having one lane in each
direction and asked if there were plans for adeceleration lane
into this area and Mr. Vaughn replied that a deceleration lane
could be designed and questioned how long it should be. Mr.
Ryder suggested that it could probably start at the Lindsley Lum-
ber property line. Mr. Annunziato added that it would be subject
to approval by the City Engineer.
Mr. DiSalle made a motion to accept this plan subject to staff com-
ments, seconded by Mr. Johnson. Motion carried 7-0. Mr. Annunziato
clarified the plan was approved subject to the staff comments and
the comments by Mr. Ryder regarding the deceleration lane and
Chairman Thompson agreed.

Mr. Bill Lhota came before the Board and advised the owners are
present and the engineer, Mr. Gerald Church, and if there are any
questions, they would be pleased to answer them.
Mr. Annunziato informed the Board this application is a request to
eliminate the masonry wall that was required in conjunction with
this plan. Subsequent to the approval of this plan, the zoning code
was altered to provide a hedge in lieu of a wall. The applicant
is desirous of building a retaining hedge in lieu of a wall. The
staff has reviewed this plan and the comment from the Engineering
Department is to extend the curb on the north and south property
line.
Mr. Ryder questioned the basis for making this request and Mr.
Lhota replied the landscaping plan was approved with a hedge and
that approval was re-affirmed by the Community Appearance Board
last night. Mr. Annunziato clarified there would be an 8" retain-
ing wall and hedge substituted for the 6' wall. Chairman Thompson
referred to the plan not showing shrubbery and Mr. Lhota informed
him there will be shrubbery in addition to the retaining wall. Mr.
DiSalle asked if the shrubbery will be 6' high and Mr. Lhota replied
affirmatively. Mr. DiSalle clarified the retaining wall will go
above grade and the shrubbery will go 6' high.
Mr. Mauti questioned if this is a matter for this Board since the
ordinance was changed and Mr. Annunziato replied this plan was ap-
proved subject to the ordinance which required a wall. The only
avenue for relief would be for the Council to alter their approval
based upon the recommendation of the Planning & Zoning Board and
Community Appearance Board and the plan was resubmitted with the
request not to construct a wall.

Mr. Mauti stated he attended the Community Appearance Board meet-
ing last night and understood the 6~ wall would be a water retain-
~'ge wall and Mr. Lhota replied it would serve a dual function with
retaining the water as well as holding the dirt back and keeping the
planters in order.
Mr. Ryder referred to the ground being pitched towards the rear of
the private homes and Mr. Lhota informed him the ground will be
level and the wall would project 8" above that. He also pointed
out there is a row of catch basins along the center of the parking
lot. Mr. Gerald Church explained the drainage in detail with it
pitching towards the facility and not draining across the private
property. He pointed out there are three catch basins and the size
of the perforated pipe has been increased and in addition, there is
a swale area between the curbing and the edge of the pavement. The
water will be retained on site. The retaining wall will project 8'T
above the finished grade~ The proposed grades have been circled.
He explained how they were trying to match the elevation along
Seacrest Blvd. with a transition into the properties to the east.
They are retaining the drainage on site and have put in a drain
field system at the rear of the property.
Mr. Ryder stated the current regulation provides an alternative
with stating a vegetative barrier may be substituted. Consider-
ation must be given to what extent it would have on the surround-
ing area. Apart from retaining water, there is the matter of
privacy and security. The alternative is given depending on the
particular location and situation and how it affects the adjacent
property owners. These are important factors in deviating from
the original factors. Chairman Thompson asked if the adjacent
property owners were notified of this change and Mr. Annunziato
replied that he has not notified any~ but understands several are
present to speak on this matter.
Mr. Loyal Rohrbaugh, 2857 S.E. 1st Place, stated the neighbors
want their privacy back. In reference to the property sloping
to the center, he put a level on it and there are places where
it slopes to the residences. With only the 3 to 4T' of rain yes-
terday, the shell rock was washing down and the northeast corner
drains into the parking lot of the other building and goes into
the house across the street. The neighbors want a 6' wall at
their grade line. They want a 6' concrete wall put up for privacy.
They will not have any privacy with a hedge. He has put up a fence
and hedge and still does not have any privacy from the medical
center on the other side of him. Trash from the dumpster blows
into his yard and bags are laid around the dumpster which are
broken open and needles scattered all over. He has nails in his
yard from the builder. They want privacy and the water problem
taken care of. A hedge will do no good. The neighbor's pool is
full of sand which ran off. They want a wall and would like to
get rid of the dumpsters in the corner. He does not think vacci-
nation needles should be scattered around where kids can get ahold
of them.

Mr. Steve Frazier, 2865 S.E. 1st Places stated he lives directly
behind the parking lot and there is still a problem with drainage.
He would like a 6~ concrete wall along his back yard for privacy.
The kids have a tendency to cut through for a short cut and a wall
would prevent this.
Mrs. Betty Downdy, 2876 S.E. 1st Court, asked if the wall would
just be on the east side and Mr. Annunziato replied the request
is for no wall at all except a small 8" retaining wall. Mrs.
Downdy stated she requests a 6' wall. Her pool is just 20~ from
the parking lot. She also agrees it would stop kids from cutting
through.
Mr. Arthur Haley, 2861 S.E. 1st Place, stated a 6" curbing would do
no good at all. The land is pT higher than the homes and every-
thing comes in. There should be a wall.
Dr. Waldner explained they wanted the Seacrest Professional Plaza
to be something nice like a landmark for the area. The Community
Appearance Board has recommended a good looking hedge and not a
wall. He wants safety for the people. Some of the statements made
by Mr. Rohrbaugh about levelling probably could be challenged. He
was there after the rain yesterday and saw no problem~ but actually
the problem was further down on Seacrest Blvd. A wall will look
unsight!y~ people will write on it, it will get dirty, will be a
hazard, etc. If he thought it would help the appearance or safety,
he would constrnet one. He thinks the people are a little over-
reactive in their comments. He would hope they could follow the
Community Appearance Board's suggestion. Mr. Ryder informed him
the wall could be screened on his side with vegetation and Dr.
Waldner replied that a wall will be marked up and unsightly.
They will plant heavy hedges and the building will not be seen.
The hedges will probably grow to l0T and will have a better appear-
ance than a wall.
Mr. Mauti referred to the safety aspect and questioned if the wall
was taken away~ how would the hedge compare and Dr. Waldner replied
the Community Appearance Board asked to have the wall replaced with
a hedge. Mr. Caskey added that the people want the water stopped
and want privacy and they are trying to give them both with the
best appearance. The 8~ retaining wall is buried 6~ in the ground
to provide a water barrier. Nobody could have stopped the water
last week. He thinks the problem has been rectified now since
the parking area has been blacktopped. By putting in the retaining
wall and filling up to grade level and planting a hedge, there is
a runoff area and water barrier 8'? higher than the area where the
planting is and the hedge would give privacy. He thinks a 6' wall
is an over-kill for water. A hedge, within six months, will give
everyone all the privacy they want. They will have a company clean
out the wom~n~s pool. As far as the dirt from the dumpster, that
is not their dumpster and their dumpster will be located in the
front of the building. They are trying to keep all the water on
their property.

Mr. Mauti asked if they appeared before the Community Appearance
Board when the plan was approved with the 6' wall and Mr. Caskey
replied it was not approved or disapproved. They submitted plans
to the City when the ordinance required a 6' wall. During the time
they went in and the building permit was issued, that ordinance
was changed. The detail for the wall was erased then by the
architect. When they went before the Community Appearance Board,
they advised they would go with anything recommended and the
Board requested a 6' hedge.
Mr. Annunziato stated since this plan was approved by the City
Council under the ordinance which required a wall, in his opinion,
the wall is still required. He has a recommendation which might
satisfy the Communi~ty Appearance Board and provide a good looking
wall and some security for the applicant and residents. The ini-
tial request was to construct a 6' high wall of wood and masonry, but
the ordinance required a 6T masonry wall. Perhaps there could be
a combination stucco masonry wall with wood dividers at intervals
which would make it decorative. The Community Appearance Board
and the applicants are concerned about appearance and there is
still room for a hedge inside the wall. The wood portion of the
wall could be placed on top of the barrier retaining wall project-
ing 8~ above the pavement.
Mr. Hester asked if the ordinance regarding the wall was passed
before this plan was approved and Mr. Annunziato replied this plan
was approved with the wall.
Mr. Mauti again questioned how this applicant got before this
Board this evening and Mr. Annunziato informed him the applicant
submitted a revised site plan requesting not to be required to
build the 6T masonry wall. He read Mr. Lhota's letter for clari-
fication.
Mr. Ryder clarified that after approval, a change is being requested.
We must decide if this is equal to what was there before. Does it
serve the purpose of water runoff, privacy and security? The Com-
munity Appearance Board cannot circumvent these requirements, but
may be pleased with vegetation inside the wall.
Mr. Mauti referred to access by children and stated he was concerned
about a child walking through a hedge and he could not walk through
a 6~ masonry wall. Mr. Hester pointed out the wall would not be
completely around it, so a child could still get into the parking
lot. Mr. Johnson added that it will be on the south and east,
adjacent to the residential area.
Mrs. Loyal Rohrbaugh stated the ordinance calls for a 6' masonry
wall when commercial abuts residential to afford privacy to the
residential area. It was the unanimous decision of all the pro-
perty owners, all of whom are present, that they will not accept
anything but a 6' masonry wall. They are not in favor of masonry
and wood. They all want a 6~ masonry wall next to their property.

Mr. Annunziato stated if the wall is determined to still be appro-
priate, perhaps some recommendation would be in order to hot --
construct the wall adjacent to the C-1 property. Mr. Mauti re-
ferred to there being a house on this C-! property and stated when
it was built, it was zoned residential and it does not mean it will
be ~acated.
Dr. Waldner referred to the various commercial buildings in this
area and stated none of them have a wall.
Mr. Hester stated Mrs. Rohrbaugh mentioned wanting a 6' wall and he
thinks a compromise is in order. Although they might not be in
favor of Mr. AnnunziatoTs suggestion, he thinks we should look into
it. It could be a m/xture of masonry and wood and would be a wall
and afford privacy.
Mr. DiSalle made a motion to accept the compromise position. Mr.
Mauti referred to the code requiring a solid decorative masonry
wall and asked if this could be altered by us and Mr. Annunziato
replied that C-1 uses were addressed differently. Mr. Caskey sug-
gested there be enough masonry to satisfy the water runoff with
wood on top for privacy. The masonry walls a few years old are a
disgrace with mildew, broken down, things written on them, etc.
and need continuous maintenance. He would suggest having a masonry
base 1~' high to hold water or sand runoff and having a good look-
ing wall above it. Also, children can get over a fence as well as
through a hedge. Mr. Mauti referred to a hedge deteriorating and
requiring maintenance and Mr. Caskey replied that a hedge can be
easily replaced whereas a wall cannot. He clarified that he does
not disagree with a wall, but what it should be made out of. He
does not think they are worried about the appearance as much as
privacy. A wood fence will give privacy and a retainer at the
bottom will keep water and sand from running off. Mr. Annunziato
clarified his recommendation is a 6T decorative masonry wall stuecoed
with intermediate wood panels placed on a retaining wall with a
hedge planted inside the wall required along the residential pro-
perty only. Mr. DiSalle asked if this would hold back the dirt
and Mr. Annunziato replied the wood sections would be placed on a
retaining wall 8" above the pavement. Mr. Rohrbaugh stated a
wood fence will not keep the dirt, dust and water out. Mr.
Annunziato suggested it could be 80% masonry. Mr. Rohrbaugh
stated the people will only be satisfied with a masonry wall, so
why should the Community Appearance Board object? They live
there and want a concrete wall. Mr. Ober!e explained that a
concrete wall will not keep out sound.
Mr. Mauti made a motion to go along with the wall as it was approved
by the City Council on the original plan, seconded by Mr. Johnson.
Chairman Thompson asked if he meant the entire perimeter as shown
on the plan and Mr. Mauti replied affirmatively. Chairman Thompson
clarified that it had been moved and seconded to keep the masonry
wall as approved previously showing a wall around the entire peri-
meter except on the north and side abutting Seacrest Blvd. Motion
carried 6-1 with Chairman Thompson dissenting.

Mr. Bill Vaughn explained this is a five acre site on which they
plan to construct a 5~000 square ft. branch facility as phase 1
and a ]0~000 square ft. service center in three stories as phase
2. It is bounded on the west by a fresh water lake which varies
from 600 to 800T wide. He will be glad to answer any questions.
Mr. Annunziato referred to this previously being the Kirsner-Cogen
PUD and explained this site plan is located on the plat of the com-
mercial tract. This tract of land would be located at the south-
west corner of Woolbright Road and Congress Avenue. Woolbright Road
will be extended westward by this developer. Access to this site
will be from Woolbright Road and from S.W. 19th Avenue extended.
This request is for approval of phase 1 which is a 5,000 sq. ft.
branch bank for First Federal of Broward.
Mr. Annunziato stated the plan has been reviewed for consistency
with the zoning codes and engineering requirements. He read Mr.
Howetl%s memo listing the following:
1. I am of the opinion that a buffer would be required between
the residential area and this property.
2. Walks required on Congress Avenue and Woolbright Road.
5. Indicate handicap parking according to state law.
4. Indicate handicap ramps with access to building.
5. Show handicap parking signs in front of handicap parking
spaces.
The Utility Director notes the water lines to be constructed 3T off
of paving. The Public Works and General Services Department notes
a dumpster must be located on this site. The recommendation is the
plan be approved subject to those comments.
Mr. Ryder stated he understood the additional right-of-way required
for the ultimate widening of Congress Avenue will be provided and
Mr. Vaughn agreed. Mr. Ryder asked if this would be deeded to the
County and Mr. Annunziato replied the plan dedicates the additional
right-of-way to Palm Beach County by plat.
Mr. Vaughn referred to the wall on the west parking line and stated
in view of the fact there is a 600 to 800~ wide lake, it is their
intention to build a 3~ high berm above the parking grade and plant
groundcover and Sea Grapes which will grow 8 to 10~. They make
this suggestion for safety reasons. The lake is about 30~ deep
and they do not want cars running into the lake and they could go
through a wall. He was not aware of a wall being required until

tonight. It is 12~' from the paving to the property line. The
water is approximately l0T west of the property line. Mr. Annun-
ziato informed him that a wall is not an option, but is a require-
ment. There is approximately 150 feet of residential land located
to the west of this property right along Woolbright Road. The lake
would start approximately ~ of the way south of Woolbright Road ex-
tended. Mr. Vaughn stated they would construct a wall to buffer
the residential and possibly discuss a berm for phase 2 between
their property and the lake. Mr. Annunziato informed him there is
no reason for a discussion concerning a berm as the wall is an ordi-
nance requirement.
Mr. Hester moved to approve the site plan for First Federal of
Broward with the staff comments, seconded by Mr. Johnson. Under
discussion, Mr. Johnson asked if the wall was included and Chair-
man Thompson replied affirmatively. Motion carried 7~ .

Mr. Dan Shalloway stated this is the plat of which First Federal of
Broward is a part. It is being divided into four tracts which are
to be sold to individual commercial ventures. The savings and loan
association has negotiated with the developers for their parcel and
they are being reviewed together since they want to open as soon as
possible. He explained the road and land dedications to the City
and County and stated they are also constructing the water main
along Woolbright Road to the water tower tract in order to provide
the ~ity utilities connection. Mr. Ryder asked if 19th Avenue is
to be dedicated and Mr. Shalloway replied affirmatively.
Chairman Thompson asked if Woolbright Road would be constructed as
four lanes and Mr. Shalloway replied this portion of the plat is
entirely four laned. Mr. Annunziato clarified that the construc-
tion drawings show Woolbright Road as a four lane divided highway
up to the water storage site with one lane accessing the property.
Mr. Annunziato explained the location and the traffic access and
how it would afford a safe traffic picture. Mr. Ryder asked if
the parallel road would be private and Mr. Shalloway replied that
it is on the easement and will be taken care of by the property
owners association.

Chairman Thompson clarified that they had no intention of four lan-
lng Congress Avenue, but will add an additional lane and Mr. Shaltoway
agreed. Chairman Thompson referred to the Comprehensive Plan calling
for four laning Congress Avenue and asked if it would be appropriate
to four lane it at this time and Mr. Annunziato explained how this
would be provided for by the developer with a monetary contribution.
He added that they do have some responsibility in reference to sig-
nalization.
Mr. Annunziato stated when Mr. Cogan sought annexation, he talked
about the dedication of a water tank or water storage site and he
has dedicated approximately one ac~e of land to the City. This is
noted as Tract E on the plat.
Mr. Annunziato referred to the staff comments and read the following
from the Acting Utility Director:
1. Supply a sewer service to the City water storage site.
2. Show valve on fire hydrant.
3. Where fire hydrants are more than one length of pipe
away from the main~ a valve on each end will be required.
4. Strike out the words, "by City", w~hen referring to the
16'~ ductile iron water main.
5. Ail water services should be ASTM 34069 Polyethylene

and will gladly modify the plans.
Chairman Thompson asked if S.W. 19th Avenue would be extended west-
ward and Mr. Annunziato replied it does not have to be extended
westward, but the intent is to serve the residential portion and
the commercial portion of this plat to get traffic off Congress Ave.
and to these uses, which he thinks has been accomplished.
Mr. DiSalle made a motion to accept this preliminary plat subject
to staff comments, seconded by Mr. Mauti. Motion carried 7-0.
