City Planner ABSENT Gene Johnson (Excused) Chairman Thompson welcomed everyone and called the meeting to order at 7:30 P. M. He introduced the members of the Board~and City Planner. He acknowledged the presence in the audience of Vice Mayor Betty Riscoe. MINUTES OF FEBRUARY 13, 1979 Mr. Ryder referred to having a problem with Mrs. Kruse feeling ill and having a gap in the recording; however, a digest of the matters considered during that period has been included and he would say by and large, this is a comprehensive review of what went on. Mr. Mauti made a motion to accept the minutes as written, seconded by Mr. Ryder. Motion carried 6-0. ANNOUNCEMENTS Mr. DiSalle announced that he called the County Attorney for a legal definition of spot zoning and received the following: "Spot zoning consists of exceptions or departures from the general provisions of zoning ordinances. When prescribed stan- dards for a variance have been established before the proper board~ experience has established after an over all zoning ordi- nance has been enacted these applications may resultsin practi- cal difficulty and unnecessary hardships. To avoid this~ such ordinances often provide for exceptions or departures of the general provisions when such prescribed standards for a variance have been established before the proper board or commission. This is often referred to as spot zoning. Spot zoning is a practice that is universally condemRed. Use of a portion of a building in a multiple family district for stores or other busi- ness enterprises would violate the integrity of the district and destroy the chamacter of the neighborhood and will be condemned as spot zoning." NEW BUSINESS - Site Plan Approval Applicant: Location: Legal Description: Project Description: (Revised) Boynton Industrial Development South Congress Ave. (Across from Charter World) Acreage 4 Buildings, Industrial Warehousing MINUTES - PLANNING $ ZONING BOARD FEBRUARY 27, 1979 Mr. Annunziato informed the members that this is a revised site plan which was previously approved by the Planning g Zoning Board and City Council. At the time it was approved, Building B was split into twod~ifferent buildings and some question was raised concerning the ability of trucks to turn around and there was also a question regarding utilities. The applicant has revised the site plan to conform. He then explained the location and read the breakdown of square footage for the buildings. Mr. Annunziato referred to the staff review and stated several items came to light centered around the primary location of the water and sewer lines. He referred to the utility plan and pointed out that south of Buildings C and Dj there ~s no water main and sewer force main emanating from the pump station. It is the staff recommendation to have the water line and force main located in the street to the south. Mr. Annunziato read that Mr. Howell noted: "I question the paving elevations. Further, I see no on-site water retainage, no legal description to check against zoning, and ! question the elevation of the grass areas.?' Mr. Annunziato stated the FireMarshall noted subject to the memo from the Utility Director. The Acting Utility Director, Mark Law, requested the following notes to be attached to the plans: Ail water lines with fire hydrants to be 6" l±nes and easement to be dedicated. 2. @n the south property line~ water line must be con- s~ructed withinthe public R.O.W. 3. Fire hydrant for same to be relocated to landscaped area. 4. Details for water and sewer plans. 5. Relocate sewer force main into public R.O.W. 6. D~dicate land for lift station site. 7. Lift station to be equipped with telemetry equipment per City specifications. Mr. Annunziato stated the City Engineer noted: "Computations required to show storage of first hour of three year storm, french drains are required for south parking area, water line is to be relocated in the street right-of-way, and 6" force main to connect with future 36" regional force main." Mr. Annunziato stated he has noted on the plan to dedicate a 5? right-of-way on the north side of the street and provide a 5' landscaped diVider every ten parking spaces. Mr. Annunziato stated the total staff recommendation is the plan be approved subject to comments. -2- MINUTES - PLANNING & ZONING BOARD FEBRUARY 27, 1979 Mr. Norman Thompson, partner on this project, appeared before the Board to answer any questions. Mr. DiSalle questioned the kind of industry planned for this site and Mr. Thompson told about plans to have an industrial warehouse park, but added they do not have any definite tenants at this time but have received a lot of in- quiries. Mr. DiSalle asked if he would permit under any circum- stances an industrial company emitting any obn6xious fumes, eta. and Mr. Thompson replied negatively and added they would not allow anything contrary to the rules and regulations.' Mr. Oberte questioned if possibly it would contain a terminal junc- tion for truck transfers and Mr. Thompson explained the first building was being built on speculation and they do not know what will be interested. Mr. Hester clarified that nothing could be included unless allowed by the ordinance and the City has control of this. Chairman Thompson referred to funds being requested from this developer to upgrade Congress Avenue and Mr. Annunziato replied this was not addressed in the initial plan. Chairman Thompson stated that an industrial park of this size will generate a lot of traffic and create a lot of traffic on Congress Avenue and he thinks this should be considered. Mr. Annunziato replied if the Board wishes, he will forward a copy of the plan to Mr. Walker in the Palm Beach County Traffic Engineers Office for his eom- ments. Mr. Mauti asked if Mr. Thompson had received a copy of the provi- sions which were just read required by the Utility Director and Mm. Thompson replied that he just discussed these with Mr. Annun- ziato and has no objections. Mr. DiSa!le questioned the maximum height of thebbuildings and Mr. Thompson replied they would be approximately 21 to 22 feet. They then reviewed ahd discussed the planssfurther. Mr. Hester moved that site plan approval be given to Boynton Industrial Development subject to the staff comments, seconded by Mr. Mauti. Mr. Annunziato requested clarification on for- warding the plan to Mr. Walker and asked if they wanted to make Mr. Walker's comments part of this plan and Chairman Thompson replied that Mr. Walker's comments should be part of this appro- val. Mr. Annunziato clarified this plan will not be forwarded to the City Council until hearing from Mr. Walker and the members replied affirmatively. Mr. Annunziato explained Mr. Walker's involvement regarding road impact. Mr. DiSalle made anmamend- ment to-.include Mr. Walker's comments, seconded by Mr, Mauti. Chairman T~ompson called for~.a vote on the motion and amendment and the vote was 6-0 in favor of both, -3- MINUTES - PLANNING & ZONING BOARD FEBRUARY 27, 1979 Applicant: Anthony Galante (Popeye's Restaurant) Location: 2007 S. Federal Highway Legal Description: Acreage Project Description: Popeye?s Famous Fr~ed Chicken Restaurant Mr. Anthony Galante came before the Board and introduced the builder, Mr. Bill Carpenter. Mr. Annunziato informed the Board that this is a site plan for Popeye's Famous Fr~d Chicken Res- taurant which will be located on South Federal Highway between Chicken Unlimited and Pizza Hut. Mr. Annunziato referred to the staff review and read Mr. Howell's memo: "I taunt 22 parking spaces, but there is no indication that I can determine as to the number of seats in this restaurant or how many employees. Further, no handicap parking signs are indicated. I question the paving elevations and the outside walk adjacent to the building shows no elevation but it cannot, however, be less than ~" lower than finish floor." Mr. Annunziato read Mr. Clark's comments: Pavement grades to be minimum 0.4% and computation required to show storage of first hour of three year storm. The Police Department note~ '~o Parking?T signs on State Road 5 and the structure not to block view of intersection. Mr. Annunziato stated his comments are that the number of parking spaces will determine the number of seats and employees. This will have to be shown on the plans submitted for a building permit. Mr. Thompson asked if this was going to be a restaurant for seating and Mr. Galante replied affirmatively and it would have 46 seats. Mr. Annunziato clarified that 15 parking spaces would be required and there would be 7 left for 14 employees. Mr. Galante advised there would be ten employees. Mr. Ryder referred to there being a curb cut leading into the private road and Mr. Galante explained this was existing and there would be another one onto Federal Highway exiting from the drive-thru window. Mr. Ryder clarified there was no cut in the median at the present time for an entrance and Mr. Galante agreed and explained there would be an exit for a right turn only and no cut will be requested in the median. Mr. Annunziato asked if there was a copy of the elevation of the building and Mr. Carpenter showed a sample of the feather rock to be used and told about the planned construction of the build- ing. Mr. Ryder asked if he had a rendering or colored photo of an existing store and Mr. Galante replied negatively. Mr. Ryder requested that one be submitted to Mr. Annunziato. Mr. Ryder questioned the limitations on the signs and Mr. Annunziato replied this was reviewed by the Building Department. They discussed further the actual construction. -4- MINUTES - PLANNING & ZONING BOARD FEBRUARY 9'7, 197 9 Chairman Thompson referred to there being a number of restaurants in this area and questioned whether this ~Duld be economically feasible and Mr. Galante explained that it was a tasty chiebJen and told aboutttheir successful marketing in the south. Mm. Mauti questioned the ladder leading to the roof line and Mr, Galante replied this has been installed for security purposes, but will be eliminated at this site. Mr. Mauti made a motion to approve this plan subject to staff comments, seconded by Mr. Oberle. Motion carried 6-0, Subdi vi sion Regulation Pre-Applications Applicant: Location: Legal Description: P~oject Description: Mariner Village of Boynton Beach, Ina. (Agent, Bob Hamilton) East End of N. E, 12th Avenue Acreage 7.9 Acres, 65 Units, Townhouses Mr. Annunziato read the pre-application document which is part of the subdivision regulation clarifying the procedure. Mr. Jim Gallo, representing the applicant, corrected the agenda, and advised that this application actually covers 32 units on 4.8 acres total which is inclusive of dry and wet land, The title to the property includes some submerged land which cannot be touched. It is a strip of land approximately 110 feet wide by approximately 1,000 feet deep entered from N, E, 12th Avenue. There are 32 townhouses proposed for this particular development. T~e plan complies with all City regulations. He then explained the concept with the individuals owning their property and a homeowners~ association taking care of maintenance for the road and canal. The developer will put in the road, sewer and water. Mr. Ryder asked if any seawal!s were being constructed and Mr. Gallo explained how the seawall proposed is not a true seawall because of D.E.R. requirements pertaining to preservation of the mangroves. Mr. Ryder questioned the first floor elevation and Mr. Gallo _ replied it has to be 8.5t above mean high and it will meet the minimum requirements. Mr. Ryder commented that he felt it should be more than the minimum here and Mr. Gallo replied that they could not go much higher because of the properties abutting it to the north and the drainage must be contained on this property. They discussed further the necessary elevation. Mr. Ryder asked if the units would have garages and Mr. Gallo replied negatively ~and explained how off-street parking would be provided with no parking allowed on the street which will be enforced by the homeownerst association. -5- MINUTES - PLANNING $ ZONING BOARD FEBRUARY 27, 1979 Chairman Thompson asked if there was any provision for recreation facilities and Mr. Gallo replied negatively. Chairman Thompson asked if it was required and Mr. Annunziato replied negatively, but explained that in lieu of providing private recreation, they probably would have to provide dollars. Chairman Thompson pointed out that 13 guest parking spaces were included on this plan which should preclude possible problems pointed out with the other plan. Mr. DiSatle questioned what provisions there were for street lighting and Mr, Annunziato replied this will have to be addressed at the time of the master plan. It is noted that street lighting will be required. Mr. Annunziato referred to the staff comments and read that the Engineering Department has noted the paving width must be a minimum of 22 feet and overflow and/or outfall pipes are re- quired for drainage with D.E.R. approval necesaary. The Recrea- tion Department has noted that the recreation ordinance must be met. The staff recommendation is the plan be approved subjeCtto comments. Mr. Mauti made a motion to approve this plan subject to staff comments, seconded by Mr. DiSalle. Motion carried 6-0. Appli cant: Location: Legal Description: Project Description: Reed & Malavasi, Agents S. W. 30th Avenue Acreage Lawson Industrial Park Mr. Malavasi~ agent for the owner of the property, ~equested Mr. Annunziato to read the staff comments and advised that he would then answer questions. Mr. Annunziato referred to this being located at the entrance to the South ~o-Teeh School and pointed out two out-parcels on Congress Avenue north'and south of this proposed plat. Mr. Annunziato then read the staff comments. The Fire Marshall notes subject to the Utility Director?s memo. The Utility Direc- tor noted the following to be attached to this plan: 1. 8" water main required looped back into Congress Ave. 2. Water and sewer detail sheets required together with lift station details. 3. Minimum distance required between fire hydrants to be 3001. Mr. Annunziato continued with reading Mr. Clark's notes: Ail property should be included in plat or Master Plan should show phases. How 30th Avenue will get four laned should be considered now~ ioe.~ prior to complete development since the school will not participate in off-site construction. -6- MINUTES - PLANNING L ZONING BOARD FEBRUARY 97, 1979 Mr. Annunziato stated he has noted to include the parcels along Congress Avenue as part of this plat. He added that according to the documents submitted, the utilities will serve this pro- petty along with the two out-parcels. Mr. Ryder asked if 3~0th Avenue was presently paved and Mr. Annunziato replied affirmatively, it is two lane. Chairman Thompson questioned who would be required to widen S. W. 30th Avenue to four lanes and Mr. Annunziato replied that he thinks the indication Mm. Clark is making is it should be a~dressed owing to the fact the School Board will not construct off-site i mpro vement s. Mr. Malavasi stated that he agrees with all the comments 100% except for the four laning of 30th Avenue. He then told how the City was in a bind six years ago when having to provide access to the school site and stated this owner gave an 80~ right-of- way throughhhis property for the road to be built to the school. He was told they would not be responsible for the four laning of the road, but should have had it included as a provision at that time. This industrial portion consists of 21 acres and according to the traffic impact submitted, the out-parcels and school will generate more traffic than this industrial area. Mr. Ryder asked if this road would also provide access to the 55 acre recreation site and Mr. Annunziato replied negatively, but it ~will be further south. Mr. Annunziato stated that Fir. Malavasi ?s statements are correct, but he would like to point out two things. Mr. Plunkett did dedicate an 80~ right-of-way and the City abandoned an easement along the canal. Secondly, althoughtnot part of this application, Bowman Transpomtation Co. and the ten acre mini-warehouse site were part of this land and were sold. Mr. Ryder clarified that the abandoned easement reverted back to Mr. Plunkett and in some degree a swap was made. Mr. Malavasi clarified that the ori- ~ginal plans for this development did not include a road going through the middle for the school, but the School Board's quest was accommodated. He thinks everyone should pay a fair share of four laning this road and not just this developer. They are applying for rezoning for the two out-parcels. His client will agree to four laning the road in the front, but not in this area. Chairman Thompson questioned who originally paid for paving this road and Mr. Plunketteclarified that when he bought the land, there was no school or plans for anything. There was a 40 ft. easement along the canal. After the school was under construe- tion~ the City planned to use the 40 ft. road along the canal, but the school would not accept it and it was requested that he dedicate the 80 ft. right-of-way in the middle of his propemty. -7- MINUTES - PLANNING & ZONING BOARD FEBRUARY 27, 197 9 This right-of-way equalled more than three acres of land. Heccer- tainly understood that he was not going to be asked to pave that road. The City paved the road initially. He had no use for it. No indication was given to him he would be asked to pave the other half of the road. This road goes back to the school and could also easily join the 55 acre park site. Mr. Ryder clarified that he was not assessed for theppaving and Mr. Plunkett replied nega- tively, but he dedicated the property. He did not plan the road there at all. He explained further about the City's acquisition of this right-of-way. He then told about his plans for a beauti-- ful industrial development with restrictions on the occupants. Mr. Oberle asked if this land transaction was covered in writing and Mr. Plunkett replied that 'there are documents, hut he does not think the matter of paving was included. Mr. DiSalle ques- tioned whose responsibility it was to pave the road and Mr. Plunkett ~replied tP~s was a good question and he was not pre- pared to answer it. Mr. Malavasi referred to the trips generated by an industrial park and they discussed fumther whether there was a need to widen S. W, ~0th Avenue.and whose responsibility this would be. Mr. Annunziato clarified that there was a swap involving half as much of right-of-way for twice as much. The cost of improve- ment probably encountered an .equal expenditure of the dollar value of land. The City provided the road and received back a half of right-of-way. The costs are probably closely aligned. Mr. Malavasi insisted that based on the traffic impact, this moad does not warrant to be four laned. Mr. Annunziato replied this may be correct, but-there is a need for a right ~urn lane with or without commercial rezoning. Perhaps the real issue would he to provide turning lanes. This might be a proper eom- promise. Mr. Plunkett replied he had no objection to this. Mr. DiSalle stated he did not think the Board should make the determination who should pave 30th Avenue. Mr. Annunziato stated it is not unusual for developers to pave City streets but possibly the solution he mentioned to provide turning lanes may alleviate 90% of the problem. Chairman Thompson asked if the traffic impact analysis made any recommendation pertaining to signalization and Mr. Annunziato replied this was amply covered in the approval of Hunter?s Run on Congress Avenue. They discussed and rev~d the plan.s further. Mr. DiSalle made a motion to accept the application for the Lawson Industrial Pamk subject to staff comments and the comment pertaining to the proper turning improvements, seconded by Mr. Hester. Motion carried 6-0. -8- MINI1TES - PLANqI~NG $ ZONING BOARD FEBRUARY 27, 197 9 Applicant: Reed g Malavasi, Agents Location: High Ridge Road (at Florida Pneumatic) Legal Description: Acreage Project Description: North Boynton Industrial Park Mr. Annunziato informed the Board this is a subdivision pre-appli- cation for an industrial subdivision located off High Ridge Road within the City of Boynton Beach. However, there is no dedicated access to this property from within the City. It is reached by Hypoluxo Road. It is the intent of the applicant to build an industrial park, Mr. Annunziato referred to the staff comments~and advised the Fire Marshall has noted subject to the Utility Director's memo. The Acting Utility Director notes: !. Minimum distance between fire hydrants to be 300'. 9. Off-site utilities must be approved by Russell $ Axon and in accordance with our master plan. 3. If off-site utilities are not in place before con- struction, a bond must be issued to the City to cover on-site utility work. Mr. Annunz~ato read that the Engineering Department has noted: 40 ft. right-of-way required for Miner Road along north property line, dry sanitary sewer system required including a lift station site and acceptable surety for future lift station, street lights are required, subgrade to be stabilized to P.B.I. of 50 p.s.i. The Police Department has noted for emergency purposes, connec- tion to N. W. 22nd Avenue is strongly advised. His comment is they must attempt to coordinate with the property owner to the south to provide access to 22nd Avenue if possible. The issue of High Ridge Road connecting to 'N.W. 22nd Avenue is vital for the provision of proper services. It would be up to the deve- loper to coordinate with the proper owner to the south to con- neet the road. Mr. Annunziato qu~estioned the form of the existing High Ridge Road in f~ont of Boynton Industrial Park and Mr. Malavasi re- plied that there is an 80' right-of-way and Mr. Annunziato plied that the remaining half would have to be dedicated. He stated the staff recommendation is the plans be approved subject to comments. Chairman Thompson questioned what provisions have been made for HSgh Ridge Road and Mr. Annunziato informed him this road would h~ve to be developed at least to the south limit of their pro- petty and hopefully to N. W. 22nd Avenue. Chairman Thompson asked if the City would take it upon themselves to make sure this coordination is done and Mr. Annunziato replied that given direc- tion from the Board, he can act to coordinate, but is sure the developer can. Mr. Ryder questioned the distance to the south line and Mr. Matavasi replied that it is approximately 1,500 ft. -9- MINUTES PLANNING ~ ZONING BOARD FEBRUARY' 27, 1979 Mr. Malavasi stated the developer will build the road in front of his property. He has tried to contact the owner to the south regarding the extension of 22nd Avenue, but was unable to. He agrees it should be incorporated on the master plan, ~ but would like to have a letter making this recommendation to present to the owner advising the City will cooperate to get the easements and right-of-way and the owner will pay'e for paving the moad. Mr. Annunziato stated he would prefer to have this developer coordi- nate with the property owner to the south, but if the Board wishe~ him to interject his feelings, he certainly will. Mr. Malavasi told about trying to purchase other property from this owner for a railroad spur and stated he thinks they will want a large sum for this right-of-way. Mr. DiSalle made a motion to accept the application for the North Boynton Industrial Park subject to staff commentS, seconded by Mm. Oberle. Motion carried 6-0. Phasing Plan Applicant: Faber &Kirsner Location: Northwest corner of Congress Avenue g Golf Rd. Legal Description: Acreage Project Description: PUD $ Commercial Mr. Annunziato informed the Board this development includes commercial and residential and has been approved by the City Council and is currently zoned. At the time of zoning, no phasing plan was submitted indicating it would be developed at one time with the commercial and PUD tied in together. The developer has requested to phase this with developing the commercial portion first. This was reviewed by the staff and the comment is to build all the roads and utilities first in their entirety for this project. Mr. Dan Shallow, representing the developer of the property, stated they will build the moads and utilities to serve the entire development and explained. Mr. Annunziato added that the intent is to be able to plat this commercial area first and construct the attendant master facilities. Mr. Ryder referred to Woolbright Road giving access to this area and Mr. Shallow agreed and pointed out there would only be two curb cuts onto Congress Avenue which would be at Woolbright Road and t9th Avenue. Chairman Thompson referred to there being plans for a commercial area to the north and questioned what provisions would there be pertaining to this plan and Mr. Annunziato explained that they would have to negotiate with Kirsner-Cogen for road right-of-way. He added this commercial would be deeper than thmcomme~cial shown on Mr. Reed~s property. MINUTES -PLANNING $ ZOLE[NG BOARD FEBRUARY 27, 1979 Mr. An~unziato stated his comments were to build all the roads, utilities, etc. in conformance with the master plan. Mr. DiSalle referred to the site for a future service station · and' Mr. Annunziato informed him that this site is zoned to accom- ~date a service station~ but no site plan has been approved yet. The proper plans must be submitted for meview. Mr. Hester moved to accept this phasing plan for Faber & Kirsner subject to staff comments, seconded by Mr. DiSalle. Motion car- tied 6-0. Discussion Major Modifications ~definition of); see Section 4, Paragraph L of the Zoning Regulations Mr. Annunziato informed the Board that last year, the buffer wall ordinance was revised to allow some relief, particularly for C-1 uses. Some verbiage was installed that 'a buffer wall would b~e required if a major modification oceured. The Build- ing Department has received some comments questioning the def-i- nition of major modifications. It is requested this Board estab- lish a policy to determine what major modification is and when a wall would be required. Mr. Annunziato stated he discussed this with Mr. Keehr and Mr. Holland and they have recommended: On 'all new construction, a wall is required. Ail changes in uses would require a wall. When 'the cost of improvement equals or exceeds 25% of the taxable valuation, this wo'uld constitute a major modifica- tion 'and a buffer wall would be required, Discussion followed how these recommendations would be applicable. Mr. Mauti referred to the remodeling taking place along S. E. 23r~ Avenue and Mr. Annunziato clarified that these recommendations w~uld exclude C-! uses. He explained how C-t was a separate issue. Chairman Thompson suggested that some requirement :also be in- eluded in the ordinance for upkeepof themasonry 'wall and discussion followed regarding the appearance and use of a wall opposed to a vegetative buffer. Mr. Annunziato advised that this could be addressed in the site plan ~approval procedure. Mr. Mauti made a motion to approve the recommendations as sub- mitted by Mr. Annu~ziato to the City o£ficia!s, seconded by Mr. Hester. Mr. Annunziato clarified the recommendation was to require a buffer wall for all changes in use except in the C-1 zone, for all new construction except in the C-1 zone, and for all modifications when the cost of improvement .exceeds 25% of the taxable valuation except in the C-1 zone.
