MINUTES OF THE REGULAR MEETING OF THE PLANNING & ZONING BOARD HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, SEPTEMBER 26, 1978 PRESENT Simon Ryder~ Chairman Col. Walter M. T~auger, Vice Chairman Ronald Arena Mrs. Marilyn Huckle Richard Lambert John Jameson Garry Winter Carmen Annunziato, City Planner Chairman Ryder welcomed everyone and called the meeting to order at 7:30 P. M. He introduced the members of the Board, City Planner and Recording Secretary. APPROVAL OF MINUTES Col. Trauger moved that the Minutes of the Regular Meeting of the Planning g Zoning Board of September 127 1978, be approved as pre- sented, seconded by Mr. Lambert. Motion carried 5-0 with Mr. Arena and Mrs. Huckle abstaining. ANNOUNCEMENTS Chairman Ryder referred to the disposition of matters referred to the City Council and told about the rezoning request for Boynton Lakes being discussed by the Council previously with the suggestion made that possibly a revision be considered containing a mixture of housing. He advised that the applicant did revise the plan and pre- sented it at the last Council meeting. He explained that the number of units had been reduced and a 26 acre area of single homes have now been included. The revised plan was approved by the City Council by a vote of 3-0 since two members were not present. He added that the commercial area at the southeast corner of Hypoluxo Road and Congress Road was also unanimously approved by the Council. Chairman Ryder referred to the site development plans and advised that the Council approved the two warehouse complexes. Chairman Ryder informed the Board that the Council also approved on first reading the ordinance for rezoning requested by Mr. Leemon for the Holiday Inn Type Motel and also a resolution was passed vacating and abandoning the portion of N. W. 4th Street as requested. OLD BUSINESS Mr. Annunziato referred to the Board's inquiry about who could sign the plans for approval and advised that the ordinance is very speci- fic and says the department head or his designated representatiVe on the Technical Review Board. Col. Trauger clarified that-a designated representative can be given this authority, but the department head is still responsible for it. MINUTES PLANNING & ZONING BOARD PAGE TWO SEPTEMBER 26, 1978 NEW BUSINESS Subdivision Regulation Preapplication Applicant: A.A.M. Builders, Inc., Burlison Gentry, Agent Location: S.W. 6th Street at S.W. 2Smd Avenue Legal Description: Acreage Project Description: Ridgewood Estates, a single family subdivision consisting of 35 homes Chairman Ryder explained that this was located on the south side of Golf Road, slightly south of 23rd Avenue bordering on 6th Street in the vicinity of the 1-95 crossing. He then requested input from Mr. Annunziato. Mr. Annunziato referred to the location and explained that the alignment of streets is determined by the existing streets, 24th and 25th Avenues and 5th and 6th Streets. Mr. Annunziato then read a letter from Mr. Burlison Gentry submitted with the application referring to the present condition of the site and elevation and advising that South Florida Water Management Dis- trict has been contacted for storm drainage approval. Mr. Annunziato asked if there were any questions regarding the loca- tion. Mr. Lambert clarified that the property is not immediately adjacent to 23rd Avenue and Mr. Annunziato agreed~and explained that the road was elevated at this location. Col. Trauger questioned where 4th Street ended and Mr. Annunziato replied that 4th Street does not project into 23rd Avenue physically. Discussion followed about the right-of-way for 23rd Avenue in this area. Mr. Annunziato pointed out that 4th and 5th Streets were not going to intersect physically with 2~rd Avenue. He has requested that an access bar- rier be constructed to limit access to the 23rd Avenue right-of-way. He told about review of the plansaand how revisions were made to correct the confusing situation at the intersection with orienting the western tier of lots in a north/south manner. Mr. Annunziato then read the staff comments. The Building Official requests the applicant to designate the frontage on the ten western lots. The Utility Department has noted that it is subject to the appropriate detailed water and sewer drawings being submitted. He has noted that an access barrier be installed on 2~rd Avenue and theme be no driveways on 23rd Avenue. Col. Trauger questioned access from the two western-lots and Mr. Annunziato explained how one would have access to the east on 5th Street and the other to the west on 6th Street. Col. Trauger told about this being a dan- gerous curve at present. Mr. Annunziato continued with the staff comments and read that the Recreation Director has requested a donation of money rather than land for recreation based on the number of persons and he explained. He then referred to the utilities and pointed out the locations of manholes and water and sewer lines. The staff recommendation is to approve with the provisions listed. MINUTES PLANNING & ZONING BOARD PAGE THREE SEPTEMBER 26, 1978 Chairman Ryder asked if the City Engineer had any objection to the street layout and Mr. Annunziato replied that he did not when the access road was eliminated. Mr. Lambert-referred to the R-1AA zone requiring 75' frontage and questioned the difference in which way the house fronts and Mr. Annunziato explained how the houses were being platted in groups of four. Mr. B~rlison Gentry, 261 N. E. 15th Street, Delray Beach, appeared be~re the Board and stated that he agreed with Mr. Annunziato's summary. Col. Trauger asked if A.A.M~oBuilders are local builders and Mr. Gentry replied affirmatively and added that they have been building in Boynton Beach for some time. Chairman Ryder asked if they own this land and Mr. Gentry replied affirmatively. Mr. Lambert asked if he was familiar with all the stipulations and conditions and Mr. Gentry replied affirmatively and they are in agreement. Mr. Lambert questioned the figure for the donation of money for recrea- tion and Mr. Annunziato replied that this has not been determined yet and explained how this would be discussed when the platting takes place. Col. Trauger referred to the square footage of the houses to be built and Mr. Gentry replied that they would average about 2,500 sq. ft. Col. Trauger referred to the selling price and Mr. Gentry informed him they would sell for $65,000 to $70,000. Mr. Winter referred to street lighting and Mr. Annunziato suggested that a recommendation be made consistent with the recommendations made in the past with the street lights to be provided by the deve- loper and turned over to the City for maintenance. Col. Trauger asked if additional fire hydrants were needed and Mr. Annunziato replied affirmatively and added that these would be designated on the master plan. Mrs. Huekle referred to sidewalks and Mr. Annun- ziato replied that they would be required and added that these would all be public streets. Mrs. Huckle referred to the northern boundary and Mr. Annunziato explained how this would require further consideration since there is a bike path on 23rd Avenue, sidewalks may not be required. He explained how bike paths may be appropriate to joint to the existing bike paths. The developer will be requested to make proposals. Chairman Ryder referred to the elevations being 15 to 18 feet and stated he assumed the City Engineer will establish the grades for the streets and Mr. Annunziato replied affirmatively in conjunction with the Water Management District. He added that with these ele- vations and the existing land, he does not believe there will be any problem with flooding, but on-site retention of drainage will be required. Mrs. Huckle referred to the Subdivision Regulations stating street lighting "may be" installed~and Mr. Annunziato agmeed that it 'was not addressednin the regulations as hard as it could have been, but we have established a policy with the other plans. Possibly the Boarddmay want to look into this closer. Mrs. Huckle added that possibly the requirement of house numbering should also be addressed. MINUTES PLANNING $ ZONING BOARD PAGE FOUR SEPTEMBER 26, 1978 Mr. Annunziato stated that a preapplication does not require Council approval, but requires approval from the Planning & Zoning Board to a!lowtthe developer to go onto a master plan. Mr. Lambert made a motion that the Planning & Zoning Board approve the preapplication for A.A.M. Builders, Inc. subject to staff comments and recommendations, seconded by Mr. Arena. Under discussion, Mr. Lambert clarified that it is understood that the donation of ~ney rather than land will be discussed further and Mr. Annunziato agreed and added that the Planning & Zoning Board will have to make an assess- ment and if the developer feels it-is not appropriate, he man have an appraisal made. Mr. Jameson asked if the developer would put the streets in and Mr. Annunziato replied affirmatively. Motion carried 7-0. DISCUSSION Mr. Lambert referred to the City of West Palm Beach having p~oblems in regard to the lack of employment in reference to hous~mg and ques- tioned if we were confronted with the same problem and should this be addressed by us or the Council? Mr. Annunziato explained how he felt there was going to be more enforcement involved with federal funds. Col. Trauger added that he attended part of the HUD meeting in Jacksonville and told how the cost of real estate caused the cost of housing to be high and there is very little housing for the young worker to buy. They are trying in the appropriation of federal funds to make the Planning & Zoning Boards and cities cognizant of the fact not to build to the upper income and something which,will not turn into a ghetto in another ten years and he explained. Mr. Lambert referred to the area west of 1-95 between 15th and Ocean Avenues being a moderately zoned classification and Chairman Ryder agreed and stated it is zoned R-1Aaand told about development taking place. Chairman Ryder further explained how there was a need to en- courage more reasonable housing with taking into consideration the compatibility of the surrounding area. Mr. Arena added that by re- questing the density of projects to be lowered, it actually caused the price of the units to rise and he explained. It is a delicate situation as everyone is in favor of low density and want moderately priced housing, but they cannot go hand in hand. Further discussion followed about the various developments approved recently. Chairman Ryder referred again to Bass Creek being developed and ex- plained since the area was platted years ago, plans will not have to be submitted for platting but the City is requiring the developer to adhere to present-day standards. Mr. Annunziato further explained how the current regulations and requirements must be met. Mr. Lambert questioned when these requirements would be made and Mr. Annunziato replied that it was being done now at staff 19vel~ it must conform to the subdivision regulations.
