Minutes 09-12-78MINUTES OF THE REGULAR MEETING OF THE PLANNING & ZONING BOARD HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, TUESDAY, SEPTEMBER 12, 1978 PRESENT Simon Ryder, Chairman Col. Walter M. Trauger, Vice Chairman Richard Lambert John Jameson Garry Winter Carmen Annunziato, City Planner ABSENT Ronald Arena (Excused) Mrs. Marilyn Huckle (Excused) Chairman Ryder welcomed everyone and called the meeting to order at 7:30 P. M. He introduced the members of the Board, City Planner, and Recording Secretary. He added that Mrs. Huckle was out of town and Mr. Arena had business to attend to and both were unable tobbe present. MINUTES OF AUGUST 22, 1978 Chairman Ryder referred to the preparation of the minutes being dif- ficult and commended Mrs. Frazier for her job of filling in for Mrs. Kruse. Mr. Lambert moved that the Minutes of the Regular Meeting of August ~ be approved as presented, seconded by Mr. Winter. Motion carried 5-0. ANNOUNCEMENTS Chairman Ryder referred to the action taken by the City Council at their last meeting and announced that a public hearing was held on the rezoning request for Boynton Lakes Estates, the development east of Congress Avenue and south of Hypoluxo Road. He told about there Ling a good deal of discussion by the Council regarding the size of the units, density, and the absence of a mixture of the types of units. The application was then tabled with the suggestion made that the applicant or representatives meet with the City Engineer and City Planner to see if some modification to the plans would be possi- ble. Chairman Ryder then referred to the application to permit the con- struction of a Holiday Inn type motel which was denied by this Board and the City Council; however, reconsideration was requested and a public hearing was advertised and held at the last Council meeting. After discussion, the rezoning was approved 3-2 with Councilman Caldwell's recommendation that the leg extending south be excluded, the abandonment of N.W. 1st Avenue not be granted, the north side of N. W. 1st Avenue in back of the present commercial zoning be C-i, the portion on 2nd Avenue to 4th St. be C-2 and the remaining portion to 1-85bb~ C-3. He is a little puzzled how this finally was determined and requested Mr. Annunziato to clarify it. Mr. Annunziato replied that he also found the motion to be confus- ing and is waiting to see the ordinance when it is prepared. MINUTES PLANNING $ ZONING BOARD PAGE TWO SEPTEMBER 12, 1978 Chairman Ryder stated that the Board recommended approval of the mini-warehouses on Congress Avenue near the Vo-Tech School and this plan was approved by the Council 5-0. Chairman Ryder added that there was also a request from the First Baptist Church to temporarily construct a tent at S.W. 23rd Avenue and Congress to be used for-meetings. He explained how this would ultimately be the site for their new church. After a good deal of discussion, this request was denied by the Council. OLD BUSINESS Site Plan Approval Applicant: Richard Wensing for J. Palermo Location: High Ridge Rd. (North of and adjacent to Fla. Pneumatic) Legal Description: Acreage Project Description: Storage/Warehouses Chairman Ryder referred to this being tabled at the last meeting because of a problem of the water supply and Mr. Annunziato clari- fied that it was tabled at our last meeting in order to determine what manner of fire protection would be provided at the site. Folt~r~ing the meeting, the architect met with the Fire Marshall. He read a letter from the Fire Marshall confirming the conversa- tion and listing the requirements. The staff recommendation is to approve this plan subject to staff comments and this letter. Mr. Richard Wensing, Architect representing Mr~ J. Palermo, appeared before the Board. Chairman Ryder referred to the Fire MarshallTs recommendation to have a well for use by the fire truck and explained how an installation of this type gets very little usage. Mr. Wensing agreed and statedtthat a two pump system would be installed. Chairman Ryder agreed this was highly recommended. Mr. Lambert referred to discussion of the reqommendations listed and Mr. Annunziato read that the Building Dept. noted that side- walks and fire walls are required. Col. Trauger questioned the location of the sidewalks and Mr. Annunziato pointed out that these should be installed on the west and north sides. Mr. Annunziato continued with reading the notations. The Fire Dept. approves per their letter. He read the memo from Mr. Tom Clark dated August 17, 1978, attached to the plan. Mr. Cessna has requested they connect to sewer and water when available and pay for the water and sewer lines in front of their property. He has noted that minimum parallel parking is to be 25 ft. and dedicated streets are to be to City specifications. Mr. Lambert asked if the applicant had any comments and Mr. Wensing replied that they are familiar with all of them. Palermo be approved subject to staff comments and the supplement letter dated September 8, 1978, seconded by Mr. Lambert. Motion carried 5-0. NEW BUSINESS Public Hearing - Rezoning Requests Applicant: C & H Properties Co. (Paul Wolfe, Agent) Location: Lying south of Hypoluxo~Rd~ & west o~ Congress Ave. Legal Description: Acreage Use: Planned Residential Community Request: Rezone from R-iAAA to Planned Unit Development (PUD) with LUI of 3.36 Chairman Ryder referred ~o a map being submitted indicating the mix proposed of the various type units and advised that the gross density would be 4.8. He added that f~ll information was submitted consist- ing of sets of descriptive documents. This generally complies with the provisions of the PUD code. He then requested input from the City Planner. Mr. Annunziato announced that he would like to review the staff comments aftertthe presentation. He explained the geographic location of the development. There are two applications in unison, but separate public hearings and motions will be required. He ex- plained the plans for a mixed unit type PUD with the intense uses adjacent-to Congress Avenue and the lower cluster type uses further west. He then explained the road and traffic pattern. This plan has had several reviews by the staff and there are very few comments listed as most have been incorporated into the plan itself. Upon completion of the presentation, he will address each comment individ- ually. Mr. Paul C. Wolfe, Attorney making application on behalf of C $ H Properties Company, appeared before the Board. He introduced Mr. Stanley Franks of C $ H Properties Company; Mr. Walt Keller, Traf- fic Engineer; and Mr. Julian Bryan, Land Development Consultant. He suggested discussing both applications together and explained how the planning, road layout, traffic analysis, etc. were in con- junction. He then requested Mr. Bryan to present the plan and explain the manner in which it is intended to be developed. Mr. Julian Bryan pointed out the location and added that it was the old Melear Dairy. He told about the existing vegetation and solid conditions of the property. He pointed out the various uses of the surrounding properties. He advised that the Palm Beach County Land Use Plan has been changed a number of times and the last time it was presented, a transitional zone was shown adja- cent to the estates along Lawrence Road with 2 to 2% units per acre and they propose the lowest density on the west side of the tract~and would increase the density as progressing to Congress Ave. $~ units would be close to the R-1AAA or R-1AAB zoning cate- gories. He added that it was designed for the 100 year storm requirements.~ Mr. Bryan referred to the utilities coming from the South along Congress Avenue and explained how the backbone line of the system would be in the 80 ft. right-of-way with everything served from that. He added that 'recommendations have been made by Mr. Cessna regarding this. He pointed out the locations of the major sanitary sewer pumping sites. He explained the six classifications of den- sities and pointed out the road pattern. He explained how the roads exiting onto Congress Avenue would align with the streets on the other side from Boynton Lakes. He pointed out that additional right-of-way was shown as required on Congress Avenue and Hypoluxo Road. He explained how there was discussion aboUt moving the canal along Hypoluxo Road, but pointed out that 80 ft. right-of-way had been provided. The latest information from the County Traffic Dept. is they will only need 68 ft. Mr. Lambert referred to drainage on the west side of Congress Ave. and Mr. Bryan replied that it would require in-street drainage which would be part of the agreement when constructing Congress Ave. As he understands, the final decision is two 24 ft. lanes plus a curbed median. He asked if a curb and gutter would be required and Mr. Annunziato replied that it 'is anticipated at this point there will be no curbs on the outside lanes but there would be on the median. Chairman Ryder referred to a homeowners association being conten~ plated for the maintenance of the lakes, recreations facilities, and asked if they would maintain the grounds for the unit owners and Mr. Wolfe informed him that it was not Contemplated that there would be general yard maintenance. The homeo~Rers association would be responsible for the major community entities. He ex- plained how developers would develop each parcel with sub-home- owners associations being probabl~ for each parcel. Chairman Ryder referred to there having been problems with apartments and homes being under the same homeowners association and Mr. Wolfe agreed and stated this was not contemplated here. Mr. Bryannreferred to the two major park sites and bicycle paths and explained how the balance for recreation would be equally dis- tributed over the parcels. He explained how there would be separate homeowners associations in each pod. The Parks Dept. agreed with their plan. Also, there is languaqein the ordinance to give dredit for the lakes as open sDaee, but it has not been determined how much credit they would be entitled to. MINUTES PLANNING & ZONING BOARD PAGE FIVE SEPTEMBER 12, 1978 Col. Trauger asked if C & H Properties Co. was going to develop and do the building in each pod and Mr. Bryan replied that he did not anticipate this as they would essentially put in the backbone im- provements but may sell pods to other builders and they would have to be developed according to the PUD. Chairman Ryder asked if they were aware of the fact that three major projects are underway in this area and Mr. Wolfe replied affirmative~fy andadded that they hoped to be able to share the cost of the sewer and water lines. Mr. Bryan added that this was the primary reason that diversified housing types were included. Mr. Lambert clarified that 'when each tract is developed, the plans must be submitted separately and all we are considering now is zon- ing. He is concerned about the park area being broken down. Mr. Annunziato informed him that a breakdown for the private recreation has not been shown, but the Recreation Director has noted that 5 of the 7 basic requirements must be met in each area. No problems are anticipated. Mr. Lambert questioned when this would be included and Mr. Annunziato replied at development and it will probably be required to be ~honded. Mr. Lambert questioned the bearing on the density and Mr. Bryan explained how it .would be very easy to pro- vide parks as required within the framework of the density. He added that al!~e~ ~he-~dehsi~ies on~ayy ~ven pod are sufficiently low for that housing type and park area can easily be set aside. Plans will be submitted of each pod with the recreation area delin- eated and can be compared to the PUD plan on file. Mr. Lambert referred to the 20~ft. easement on Congress Avenue for a buffer and biR~ p~h being unusual and Mr. Annunziato replied thatwe did employ a similar program in Sand Hill. What is antici- pated is that the use of the easement be dedicated for bikeway pur- poses to the ~ublic and maintained in private ownership and maintained by the homeowners association. Mr. Lambert asked if the bikeways would be built at City expense and Mr. Annunziato replied negatively and clarified that they would be for public use, but would be part of the improvements required of the developer. Mr. Annunziato questioned the minimum lot size in the single family pods and Mr. Bryan replied that based on 3~ units per acre, he would anticipate those lots would be in the range of 8,500 sq. ft. to 10,000 sq. ft. Therefore, the single family homes would be in the range of 1,700 to 1,750 sq. ft. under roof. In the 4 units per acre area, the lots would be slightly smaller, approximately 7,500 to 8,000 sq. ft. and the houses correspondingly reduced. He told about smaller lots and houses becoming more practical because of the price. Mr. Annunziato stated that these would about constitute the minimum floor areas in like zones. He suggests stating these as minimums, so they correspond to the zones we provide for. Mr. Bryan clarified that he was.suggesting a minimum on the two single family categories and Mr. Annunziato agreed. Mr. Br~an referred to the other pods and Mr. Annunziato informed him that the others are substantially multi-family and there is other criteria covering those. We do not have minimum criteria for single family in PUPs. MINUTES PLANNING & ZONING BOARD PAGE SIX SEPTEMBER 12, 1978 Mr. Annunziato read another notation that the southerly road forming access to the west will have to be shifted 30 ft. to the south so it forms a 90 degree intersection and Mr. Bryan agreed there would be no problem. Mr. Jameson referred to possible problems with extending the road and Mr. Annunziato replied that objections may arise, but from the planning and safety viewpoints, these connections are essen- tial. He explained how it ~would also eliminate the necessity for impacting County roads. He pointed out that the residents could travel the connecting ~oad without going out on Lawrence Road or Congress Avenue. Mr. Jameson referred go possibly the residents objecting to the traffic and Mr. Annunziato replied that these roads were needed for public utilities. He explained how the roads could be designed so as not to attract traffic. Mr. Bryanadded that it would not be made easier to drive through a residential street insteadof using Lawrence Road. Mr. Annunziato continued with reading the comments and advised the Building Dept. has noted thet density may be questioned and the setbacks must be determined at the time of site plan review. Mr. Cessna~s comments have been incorporated into the water and sewer phases and he is satisfied with the submission. The Police Dept. and Public W~mks have approved. Mr. Clark has noted subject to approval from the Water Management District. He read a letter received from the Water Management District stating that it appears enough water .management areas have been set aside. With this letter, we are pretty much satisfied the design which has been submitted will qualify for a permit. He has commented that it should be subject to agreements with the Palm Beach County Traffic Dept. and School Board. He read the tentative agreement with the Palm Beach County Traffic Dept. requiring a dollar contribution for the widening of Congress Avenue or the developer may construct Congress Avenue from the north side of Canal 19 to the south side of Canal 20, the developer will. be required to dedicate 10 ft. right-of-way for Congress Avenue and 68 ft. right-of-way ~r Hypoluxo Road~ turning lanes as noted to be prOvided~ and cost of traffic signali- zation to be borne by the developer When warranted by the County Engineer. Col. Trauger referred to the paving of Congress Avenue from Canal 19 to Hypoluxo Road and Mr. Annunziato explained that this would be done by Boynton Lakes and the two projects would be done in conjunc- tion with each o.t/aer. Mr. Bryan pointed out the area on Congress Avenue. Mr. Lambert referred to the comments from the Building Dept. and Mr. Annunziato explained that they were questioning whether 4.85 is the proper density for this area and explained how flexibility eguld probably be maintained to alter these pods. Mr. Lambert asked if this was within the range on the Comprehensive Land Use ~lan and Mr. Annunziato replied that it is right at the upper limit. MINUTES PLANNING $ ZONING BOARD PAGE SEVEN SEPTEMBER 12, 1978 Chairman Ryder referred to the traffic impact and asked if the mall, Sand Hill and Boynton Lakes were considered in the study and Mr. Keller replied affirmatively and explained how these were all taken into consideration. Mr. Annunziato informed the Board that a lengthy letter was received from the School Board similar to the requirements for the Boynton Lakes development requesting a contribution of .4 of 1% of the sales price of each dwelling unit. It also should be included that this contribution is to be used by the students in Boynton Beach and the Boynton Beach reserve area. The developer has indicated this would be acceptable. Chairman Ryder referred to the County being in the process of work- ing on an ordinance regarding the fair share contribution for roads and Mr. Jameson informed him that the Task Force has been given an additional 90 days to study this proposed ordinance. Mr. Annunziato announced that the staff recommendation is this zoning request be approved subject to staff comments and incorporating the agreements with the Palm Beach County Traffic Engineering Department and School Board. Chairman Ryder asked if anyone else in the audience wished to speak in favor of this rezoning request and received no response. He asked if anyone wished to speak in opposition to this rezoning re- quest 'and received no response. Chairman Ryder announzed that-a letter has been received from Mrs. Leila Foster, a property owner apparently adjacent to this site at the southwest corner within the County. In essence, she opposes the change in zoning, but does intend to stay in farming and indicates certain requirements and requests. Possibly, a satisfactory agreement can be reached. Col. Trauger questioned the basis for the opposition and Chairman Ryder replied that Mrs. Foster is concerned whether this development 'will hamper their farm operations. Mr. Jameson referred to the City Council questioning whether lakes are included in the open area and Chairman Ryder replied that it is open space even though you cannot walk on it. Mr. Jameson clarified that it is considered part-of the open area and Mr. Annu~nziato agreed. Mr. Lambert ~referred to the Council indicating that every unit should be 2~000 sq. ft.'with a cost of $70,000 and stated we must take care of the people in the medium and lower income range. Is there a good mix included for a different cost of house? Mr. Bryan replied that they have considered this and agree this must be addressed now. He explained how the cluster tracts provided for smaller size at reasonablecost. He thinks very definitely that this plan addresses the need. Mr. Lambert explained how exclu- .sionary zoning eliminated some of the population and added that ~whena municipality practices exclusionary zoning, the government isgoing to take a look at their revenue sharing. Withdecreasing the density, larger units will have to be built and this increases the price. MINUTES PLANNING & ZONING BOARD PAGE EIGHT SEPTEMBER 12, 1978 Chairman Ryder stated that in his own opinion, this is consistent with what we have been considering in the development of this parti- cular area. He feels the density is reasonable. The density is less tha~n ~what-was contemplated awhile back and there is a mix of housing units included which is advantageous. The applications comply with the requirements of the code. He has considered all the requirements and this is consistent. Mr. Lambert made a motion that the Planning & Zoning Board recommend to the City Council the approval of the C & H Propert~e§ Company application to rezone from R-/AAA to Planned Unit Development with LUI of 3.36 subject to the staff comments and recommendations from the Technical Review Board, County School Board, County Engineering Department, Lake Worth Drainage District and South Florida Water Management District. Mm. Winter seconded the motion. Under discus- sion, Mr. Jameson questioned if there should be a conditional state- ment of both areas being tied in with both to be developed. Mr. Lambemt-agreed and made the ad~tion to his motion that the rezoning on the PUD is subject also to the commercial property at the corner of Congress Ave. and Hypoluxo Road being approved. Mr. Winter seconded. Motion carried 5-0. Applicant: C & H Properties Co. (Paul Wolfe, Agent) Location: Southwest corner of Hypoluxo Road $ Congress Ave. Legal Description: Acreage Use: Community Commercial Center Request: Rezone from R-iAAA to Mr. Annunziato informed the Board that the traffic for this commer- cial site was included in the impact analysis. The driveway exi~g onto Congress Avenue will have to align with the roadway from Boynton Lakes. The staff recommendation is to approve contingent upon agree- ments with the Palm Beach County Traffic Engineering Department and contingent on PUD zoning. Mr. Lambert questioned the zoning in the existing County pocket on Hypoluxo Road and Mr. Annunziato informed him that it is agricul- tural. Mr. Lambert asked if any of the frontage was planned for commercial and Mr. Bryan replied negatively. Mr. Annunziato added that he feels this would negate the need for any further commercial zoning along Hypoluxo Road. Col. Trauger referred to signalization when required and Mr. Annun- ziato explained that it would be warranted as determined by the County Engineer and there is certain criteria ~n which to make this basis. Chairman Ryder asked if anyone else wished to speak on behalf of this application and received no response. He asked if anybody wished to speak in opposition to this application and received no mesponse. MINUTES PLANNING & ZONING BOARD PAGE NINE SEPTEMBER 12, 1978 Mr. Lambert made a motion that the rezoning request by C & H Pro- perties Company for the Southwest corner of Congress Avenue and Hypoluxo Road be rezoned from R-iAAA to C-3 subject to consumma- tion of an agreement with the County Traffic Engineers Office and approval of the PUD. Col. Trauger seconded the motion. Under discussion, Chairman Ryder commen~d how it should be tied together similar to Boynton Lakes. Motion carried 5-0. At this time, Chairman Ryder declared a break and then reconvened the meeting at 9:15 P. M. Site Plan Approval Applicant: Boynton Industrial Development Location: South Congress Avenue, North of LWDD Canal ~29 Legal Description: Acreage Project Description: Industrial Warehousing The members reviewed the plan and Mr. Annunziato referred to it being a rather major warehousing plan with approximately 317,000 sq. ft. under roof and advised that it is located on Congress Ave. adjacent to the entrance road to our 55 acre park. In fact, the developer is dedicating the right-of-way for the Cityts project. With respect to the plan, there are 601 parking spaces provided which equal 3.25 spaces per bay. The warehousing code is incom- plete regarding parking. Handicapped parking will be provided as required by code. He read the comments from the Building Depart- ment requiring the setbacks to be shown and handicapped parking spaces to be provided. He then read Mr. Cessna~s attached memo listing eight-recommendations. He has noted that 7 ft. of right- of-way be dedicated along Congress Avenue, 5 ft. of right-of-way be dedicated for a sidewalk along the entrance road, and the en- trance road be dedicated. Mr. Ken Carlson, architect representing the applicant,'appeared before the Board. They feel the changes Mr. Cessna requested are very fair and they will comply. As far as the dedications, they are included on the plans and will be accommodated. They will provide the handicapped parking as required. They have met sev- eral times with the staff and will comply~ith the recommendations. He then told about the construction of the building and landscaping planned. Further discussion followed regarding the actual construc- tion. Col. Trauger referred to the use and Mr. Carlson explained how they planned for these to be storage and distribution warehouses for the mal!! MINUTES PLANNING & ZONING BOARD PAGE TEN SEPTEMBER 12, 1978 Mr. Lambert referred to fire protection and questioned if the equip- ~ment could make the turns and Mr. Carlson informed him that it is 46 to 50 ft. and no cars will be parked near the bays. Chairman Ryder asked if there would be any prohibitions regarding type of materials stored and Mr.. Carlson replied that they must adhere to the requirements of the mode. They will install a sprinkler system for fire protection and will meet the requirements. Mr. Lambert explained how he questioned the area being large enough for the trucks to turn around and Mr. Annunziato replied thatthis plan was reviewed by the Fire Department and Sanitation Department and he is sure they took into account the turning distances. He explained how the driveways shown were greater in width than City streets. Mr. Carlson explained the traffic flow and parking layout. Mr. Lambert pointed out that it would not be possibl~ to back a truck to the door and Mr. Carlson agreed and advised that the trucks would be side loaded. Chairman Ryder .askedif he had laid out the turning radii andMr. Carlson replied that per graphic standards, it will accommodate trucks. Mr. Lambert asked if anything in the mode addressed truck loading and Mr. Annunziato read from Page 46 of the code and stated that they have complied~ but he thinks the off- street loading spaces should be marked on the plan. Mr. Lambert disagreed and stated he did not think what the mode says is incor- porated into this plan. Mr. ~nnunziato clarified that 601 parking spaces are shown which are not required because we do not have storage parking criteria and the loading spaces could easily be demarcated on the plan. Further discussion followed about the area for truck loading and maneuverability. Chairman Ryder clari- fied that 'this is actually an internal situation. Further discus- smon then followed about the construction. Col. Trauger made a motion to recommend approval for the Boynton Industrial Development on South Congress Avenue, North of LWDD Canal ~29, for Industrial Warehousing subject to staff comments, seconded by Mr. Jameson. Under'discussion, Mr. Annunziato asked if the loading and unloading spaces should be demarcated~ Mr. Lambert 'asked if it was required according to the mode and Mr. Annunziato replied that it is questionable, but he thinks they should. Col. T~auger then added to his motion ~hat approval be subject-to designation of loading areas being included. Motion carried 5-0. OTHER Discussion of signatures on site Plans Mr. Lambert-referred to some of the signatures on the plans not being those of the Department Heads and asked if it was permiss- able for the plans to be signed the way they are? He thinks the Department Heads should initial the plans rather than someone work- ing in the department. Mr. Annunziato explained how generally people were designated in each department for the review of the plans. Chairman Ryder suggested that if the Department Head desig- nates someone to do it, he thinks they should initial it also and the members agreed. Also, he thinks the Fire Chief and Police Chiefshould sign as they are the Department Heads and that is what the Technical Review Board is all about. After further dis- cussion, Chairman Ryder clarified that 'we want-an indication that the Department Head is aware of the conditions his representative makes and this is a valid concern. Cessna Director of Utilities DATE September 1, 1978 Billing & Thomson Warehouse Complex on Congress I have reviewed the plans on the above subject complex and the fol- lowing comments are pertinent: On the water lines -- both connections to the water main on Con- gress must be wet taps. There must be two (2) 6" gate valves placed immediately east of the two easternmost fire hydrants. There must be a 4x4x6" tee on the 4" line connected to the stub and 6" line running north past the pumping station. There must be easements for the 6" and 4" water lines and these water lines must be at least 10' from a building, and 10' from the sewer lines. Double strapped tapping saddle must be furnished with the proper corporation stop and appropriate sized Iines to the meter loca- tion ending with a Ford meter yoke of appropriate size. In addition, it is improper to stubout a water line under a build- ing as shown on the northeast portion of the building. Therefore, this should be located at the southeast corner and run to the street, with valves and capping as shown on the north section. The lift station site must be deeded to the City and must be equipped with monitoring equipment compatible with the new system being installed by the city. Details on this will be available in approximately 30 days. Force main must be cast or ductile iron pipe. All water and sewer lines must have a minimum of' 30" of cover.
