Minutes 11-29-77MINUTES OF~ THE SPECIAL MEETING OF THE PLANNING & ZONING BOARD HELD AT CITY HALL, BOYNTON BEACH, FLORIDA TUESDAY, NOVE~BER 29, 1977 AT 9:30 Ao M. PRESENT Simon Ryder, Chairman Col. Mary S c horr~ Garry Winter Carmen Annunziato, City Planner Chairman Ryder called the meeting to order at 9:30 A. M. and announced that all members were present. APPROVAL OF MINUTES Chairman Ryder referred to distributing, the minutes of the Regular Meeting just prior to the meeting and suggested deferring the approval of these minutes until the next meeting and the members agreed. OLD BUSINESS Discussion of Proposed Recreational Vehicle Parkin~ Ordinance Chairman Ryder anno~ced that as a followup of the last meet- ing, it was agreed the revised copy would he prepared by Me. Annunziatoo This was done and he personally distributed copies to all members of the Board. In comparing the re- vised copy to the work copy, it appears to be in accord with the conclusions reached on the various items to be changed. He then called on the Board members for comments and all responded they had no further changes, except Mrs. Euckle. Mrs. Huckle stated she had a few suggestions to offer. She referred to the first page under Recreational Vehicle and suggested changing the third line to: designed without "a" permanent "foundation". She then referred to Page 2, para- graphs 1, 2 and 3 in Section 4 under A and suggested using the words "may be" parked since these are optional condi- tions and ~not inclusive all the way through. She suggested this same change to paragraph 6. She then suggested wording paragraph 8 to read: Recreational Vehicle, boat and/or boat trailer be parked or stored entirely on the "owner's"~pro- perty in a safe and orderly manner, with deleting "will" and changing "his~'>own- to "owner's". She suggested deleting "will" two lines down. She then referred to Section C on the next page and suggested changing "applicable" to "applicably" zoned district. The members expressed agree- ment to these changes. Mr. Winter made a motion that the new proposed Recreational V~hicle Ordinance as amended by this Planning & Zoning Board at this meeting pn November ~9~ ~9~7. b~.forwarded to the City Co~uncil for tnei~ nex~ Scne~u±e~ mee~mng on MINUTES PLANNING & ZONING BOARD PAGE TWO NOVEMBER 2 9, 1 977 December 7 and we further recommend it be adopted by the City Council. Mr. Lambert seconded the motion° A roll call vote was taken and the motion carried 6-1 with Mrs. Huckle dissenting, ~T MEETING DATE Col. Mrs. Huckle advised they would not be able to attend next regularly scheduled meeting of the Board on December 13. Mr. Lambert and Mr. Winter advised that they would be out of town on December 27. Mr. Annunziato referred to ~ossibly not having a reason to meet, but stated he would be in contact with Chairman Ryder. Chairm man Ryder added that he would contact the members of the Board or send a communication. ADJOUR~ENT Mr. Winter moved to adjourn, seconded by Mr. Lambert. Kruse Recording Secretary (One Tape ~ CHAPTER 30 parking and Storage of Recreational Vehicles and Boats and/or Boat Trailers Section I Purpose The purpose of this ordinance is to regulate the parking and storage of recreational vehicles and boats and/or boat trailers. These regulations are intended for and in the best interest of the citzens of Boynton Beach to provide easy access to recreational vehicles while promoting the health, safety and welfare of all the citizens of Boynton Beach. Section II Scope These regulations are intended to be applicable in all residentially zoned areas within the City limits of Boynton Beach. Section III ae Definitions Recreation Vehicle Any travel trailer, motor home, slide-in camper, or Other unit built or mounted on a chassis, ex- cluding vans, designed without permanent foundations, which is used for temporary dWelling or sleeping p~rposes and which may legally be driven or towed on a highway, andwhich body length does not exceed 35 feet and total body width does not exceed 8 feet or any boat or boat trailer included in this def- inition and all other sport type recreational vehicles and the trailers used to store or transport all such recreational vehicles. B. Building Department Building department shall mean such department or any division thereof created or established by auth- ority of the City, and entrusted'with the regulation, control, and supervision of all matters pertaining to buildings and structures of any nature and their appurtenances, roadways, sidewalks, lighting, ventil- ation and zoning; and in the absence of such depart- ment, it shall refer to the governing authority of the City of Boynton Beach. C. Governing Authority Governing authority shall mean the City Council Which is elected and qualified by and for the City. Section IV Parking of Recreational Vehicles, Boats and/or ae Boat Trailer Permitted on Private Residentially Zoned Property Parking or 'storing of recreation vehicles, boats and/or boat trailers on private property may be permitted under the following conditions: 1. That the recreation vehicle, boat and/or boat trailer--by parked or stored in a carport. 2. That the. recreation vehicle, boat and/or boat trailer-be parked or stored on a driveway. 3. That the recreational_vehicle, s. boat and/or boat trailer be stored in the rear.yard, not closer than five (5) feet of the rear lot line or in the side yard - not projecting-beyond the front roof line. 4. That the recreation vehicle, boat and/or boat trailer must be owned and/or used by a resident of the premises. 5. That the recreation vehicle, boat and/or boat trailer be currently registered and licensed by State and Federal Law. 6. That no recreation vehicle, boat and/or boat trailer be parked between the right-of-way and the structure unless on a driveway or other hard surfaced area, such as asphalt, paving stones, shell rock or concrete. 7. That the total number of vehicles (other than passenger vehicles) so parked or stored shall be limited to 2 - not including those kept in a garage, only one recreational vehicle may be parked 'or stored between the right-of-way and the structure. 8.: That the 'recreational vehicle, boat and/or boat trailer will be parked or stored entirely on his_own property~in a safe and orderly manner and that vehicles parked or.stored-on a driveway will not bea hazard to People entering the-drive- way or to persons passing on the sidewalk. Section~-V- -Parking of Recreational Vehicles, Boats and/or Boat Trailers - Public Rights-Of-Way ae Section VI Public Rights-Of-Way- No recreational vehicle, boat and/or boat trailer shall be parked or stored on any public right~of-way for a period exceeding one (1) hour~- Parking and Storage of Recreational Vehicles, Boats and/or Boat Trailers - Uses Prohibited, Other Vehicles A. It shall be unlawful to occupy any recreational vehicle herein defined while said vehicle is parked or stored on private property unless such use is specifically permitted in the applicable zoning district. B. Construction trailers shall be permitted as outlined in Section 4 (H) of Appendix A of the Boynton Beach Code. C. Mobile Homes as defined in Section 1, General Def- initions, of Appendix A of the Boynton Beach Code shall be permitte~ in applicable zoned districts. Section VII More Stringent Regulations to Apply A. This section-is primarily for the purpose of protecting residential zoning. Therefore, any ordinances of this-City or laws of this State providing for the regulation of recreational vehic-tes,.boats and/or boat trailers or motor vehicles are in addition--~o this section and wherever any provision of some other ordinances or applicable statute, whether_primarily for-the Be regulation of recreational vehicles, boats and/or boat trailers or motor vehicles or for purposes of zoning, imposes.more stringent requirements or limitations than are imposed or required by the provisions of this section then ~the more stringent requirements or limitations shall apply. This section shall not be construed to limit any deed restrictions, condominium regulations or similar private limitation on land use imposing more stringent requirements or limitation than herein. Further this provision shall not be construed as creating an obligation on the City to enforce private limitations on land use. Section VIII Penalties for Non-Conformance or Violation of This Chapter
