Chairman Kelly called the meeting to order at 7:32 P. M. He
introduce~ the members of the Board; Mr. Howell, Building
Official; and Mrs. Eruse, Secretary. He announced they
would dispense with the regmlar order of business and pro-
coed with the public hearing.

Development Cor He ascertained that each mem-
ber of the Board received a copy of the application. He
noted it was filed on March 29 and was a very complete appli-
cation. Attached to the application were copiesof the deed
date~ June 13, 1972, and a legal description, He added that
some plats ware also available, which he believed the people
in the audience may find interesting to study. He also ad-
vised that six petitions had been received with approximately
300 names and each member of the Board had been furnished with
copies of them.

Mr. John Groves stated his name and his address as Box 115,
Orlando, and informed the Board that he was the Plan~ing
Consultant representing Riteco Development Corporation.
He showed the~members of the Board and audience a location

He added that directly abutting this property is Laurel Hills
5th Addition. The lots on N. W. 9th AvenUe at the present
time are platted at 60 ft. widths, which is basically what

Mr. Groves explained that the way the area was zoned was
not the basis for qUality. A man from the audience ques-
tioned~what was wrong with R-1AA? He added that they were
not interested ia the people, only mo~ey. They walk away
after building. The company representatives won't live
there. Another man asked why a representative from Riteco

added that the difference pricewise between this zoning and
R-IAA was about $15,000 on a house. A member of the audience
asked the approximate price of a 1000 sq. ft. house and Mr.
Howell replied approximately $29~,000 to $31,000. Chairmam
Kelly adde~ that they must consider the inflation on building

A member of the audience asked how long ago this area was
zoned~R-1AA and Chairman Kelly informed him it became effec-
tive June 13,1975. The man remarked that already they
wanted to change it and Chairman Kelly replied that at that
time, the Planning & Zoning Board and City Council felt it
shouldbe recommended for R-~AAzening. Mr. Lambert added
that at the time this deed was recorded i~.1972, this property
was zoned R-1. Also, Laurel Hills and Glen Arbor were zoned
R-1. They have to keep im mind that probably 75% of the
peoplesigaing these petitions live in homes built in the R-t

A member of the audience stated that the lots they have now
are too small and people living in LaUrel Hills bought addi-
tional property because their lots were too small. Another
person in the audience asked if a zoning ordinance was passe~
in 1962 upgradinE the lots from 50 ft. to 60 ft. and Chairman
Kelly informed him that the zoning ordinance prior to~'75-t9
was 62-9. Mr. Lambert stated that he was referring to Ordi-
nance 62-9.
A member of the audience asked if Riteco objected to the R-1AA
zoning when it was applied and Chairman Kelly replied that he
didn't~recall. He ~plained how public hearings were.held by
the Plaaning & Zoning Board and City Council and he didn't
recall Anybody from Riteco appearing to object at either hear-
ingo
Mr. Groves requested the opportunity to show everyone the
additional 900 acres owned by Riteco. He thinks it would
illustrate some of the concern for selecting this area for
development. He showed an aerial photo marked with a yellow
line indicating Riteco's property. He explained the location

and the zoning of the various portions. He also showed a
plan for the 900 acres, a t~pography explai~_ng the drain-
age, a soil plan showing the soil types of the surfaco soils,
a tree coverage drawing, and a master plan. Ne explained the
master plan pointing out the commercial, industrial, multi-

they used graduating land uses. He added that over 100 acres
would be designated for recreation. He stressed that in the
instance of the 57 acres, since it is single family, they are
making an effort to relate to what is existing. A member of
the audience remarked that they would be asking for more R-1

disputed the fact of a good design, but they were concerned
with'this R-1 area. He thinks it is strictly economical to
cram in houses and believes they will ask to continue R-1
further. Can't the company make as much money selling homes
in the R-1 zone? It was referred to that young people must
have a~ , but people able to afford R-1AA homes
must a place to live. Mr. Groves replied that a

Mr. Groves referred to his client being concerned by hiring
professional people to do the planning. He added that they
were also willing to reserve 100 acres for recreation, A
man replied that he had heard this before and asked if it
would be deeded to the City? Chairman Eelly stated that from
here on, he didn't think they were going to find a developer
saying he is going to do this or that unless he puts !~ ~
the plat and has it recorded. The final plat will be sub-
ject to that.
Mr. Howell explained that if this zoning went though, it is
a requirement of the City that any subdivisions.like this must
be platted, approved by engineering, approved by the utilities,
and approved by the Co~u~ity Appearance Board. He added that
he didn,~'~t think the area along North Seacrest~was a planned
development. It was Just a street with a piIe~of lots and
someone buil~ on them.
A man in the audience asked what the procedure was now and
Chairman.Kelly explaine~ how everyone was given the oppor-
tunity to. make their comments. The man asked if a vote
would be taken tonight and Chairman Kelly replied that they

hoped te make a recommendation to the City Council tonight.
A man stated that he didn't understand why the City spent all
the money for rezo~ing and just rezoned this area and now
they want to chamge it. Chairman Kelly informed him that
this Board is a voluntary Board. He clarified that the City
spent $28,000 for a master plan and he showed this book te
the audience amd laid it on the table for the audience to
consult.
A man in the audience referred to Mr. Groves' statement that
people were not seeking too much land any mere and questioned
what kind of people would be in this neighborhood$ He added
that people are looking for more property now, so they can
have recreation in their own back yard and this has Been
proven bymamy studies. Mr. Groves agreed this was true
sometimes, But there are many people looking for less respon-
sibility in terms of maintenance based on less time and less
money. The difference between a 60 ft. and 75 ft. lot does
not seem to be substantial. A man questioned why they wanted
to change it then and Mr. Groves replied for ecomomi¢~easens.
A member of the audience referred te the drawing presented
showing a 1000 sq. ft. house with 7~ ft. Between homes and
stated that there was no room in the back. He added that the
people in Laurel Hills have longer lots with room for a
screen room or pool in the back. There is no room for this
on the lots as planned. Mr. Howell clarified that Mr, Groves'
drawing showed the building line and there is room in the rear
for additions. In regard to a peel, it does not have to set
back as far as a Building. Mr. Groves agreed the line was
where the building would be and added that ~he lot would be
6000 sq. ft. and the house would only be 1000 sq. ft.
Mr. L. T. Brownlee stated his name and his address as 901
N. We 8th Avenue and questioned how close these houses would

a swamp area. Mr. Groves pointed out the location on the
map and added that this area was a marshy area, But mot
below 9 ft. Mr. Brownlee continued that the people were
concerned what this will do to the value of their property.

Mr. Harold Werger stated his name and his address as 719 N.W.
7th Co~rt. He informed the Board that when Laurel Hills was
platted, it was 50 ft. lots, but the depth was 139 to 140 ft.

In 1962, the zoning was passe~ changing it to 60 ft. lots.
In 1975, the zoning was raised to R-1AA and he spoke in favor
of this rezoning. Petitions were presented at that time from
80% of the people in Lamrel Hills. Everybody was in a~reement
to keep it R-1AA. They appeared before the Board and City
Co~u~cil and Both voted in favor. This man had his land be-
fore and did not appear then. They are against this.

They are bucking this before it is put into effect. It is
not fair to the DooDle there because they have voiced~ their

Mr. Ryder referred te making additions to the rear of the
house and explained how he was previously a member of the
Board of Adjustment aud encoun%ered many preblem~. Ne thinks
basically when talking about lot sizes and house sizes, they
want it ~uderStood they want to h~ld to these setbacks and
not say in the future, they can do something else. They
must consider only the 57 acres. When they get towards Con-
gress, there may be pressure to make changes. This 57. acres
is far from Congress Avenue. It is in the area of Laurel
Hills and Glen Arbor and co should be
built there. A lot of given to setting up
these areas. This is an ~unity to the area and
that im why it was set ~IAA. less than that
would be downgrading and not t~ng advantage of the fact it
is virgin area. He feels it is not a matter of economics.
He thinks there are other areas with z~ ~ories where
it would ~e mere suitable to build. They take the long
term view of the future growth and development. He really
sees no justification for any change at all in this particu-
lar area at this time°
At this time, Chairman Kelly requested those opposed to this
application to come forward o~e at a time.
Mr. John Verchicross stated his name and his address as 1210
West~Boynton Road. He first stated that he has been waiting
quite awhile for the Chair to call for people opposing. He
presented a petition te the Board with 45 signatures of
people living at Poinciana West. Ne read the petition re-
questing the denial of this request for rezon~?g. He con-
tinued that after listening to Mr. Groves, he still feels
the same way. He pointed out that only Mr. Groves had spoken
in favor of this application and the people present and the
petitions presented are in opposition. He requested~the
Board consider very carefully the removing from R-1A~.~.to R-1.
He added that they should be mindful of the requests~ of the
people in the adjacent areas.

Mr. Howell stated he didn't thimk Mr. Ryder meant the Build-
ing Department would let an addition beyond the setback line.
Ne also referred to-Mr, Werger's statement regarding the
people appearLug here, the Building Department does not like
this, but when a request is~made they ~mst honor it. Mr.
Werger agreed, bat added that there comes a time when the
peoples' patience wears thin. Once a ruling is made, the
Buildimg Department shomld say this is the. ruling. It should
be said the zoning is not going to ~e cha~ged. They Just

rezoning and questioned why they wanted to downgrade the
neighborhood and Chairman Kelly replied that the Board was
just hearing the case. Mr. Howell added that he thinks the

a big parcel of lamd and are trying to put houses on the

A woman in the audience asked how many building lots there
would be in this 57 acres and ChairmamKelly replied: 507.
Mr. Groves corrected him in that it would be 287, with the
density of 5.07 per acre. The woman a~ked if police protec-
tion, fire protection, sewers, water, schools, etc. would
be taken into consideration and Mr. Howell informed her the
plans~ould be submitted and would go to engineering who
will check water, elevation, lot gra~e, etc.; then to
public utilities and they work with the fire marshall as
far as~water supply, fire hydrants, etc.; and then to the
Community Appearance Board before a permit is issued. The
woman asked what the ho~ses would be built of and Mr. Groves
informed her that the drawing shown was basically a square
footage study. As far as the type of constrUction, it would
have to be i~ accordance with all the co~es of Boynton Beach.
He surmises the construction would be similar towhat is
there. .Mr. Howell agreed, but added that under $~ate law
if anybody brings factory ho~sing into Boynton Beach, he
cannot even inspect it. They can only inspect the tie-down
and foundation.

A woman in the audience referred to the traffic condition on
Old Boynton Road and Mr. Howell informed her that the site
plan must be approved by traffic control. He asked if there
was another access other than Boynton Road andMr. Groves
replied: no. The woman rema~ked that the road could not han-
dle all the traffic.
Mr. Lambert referred to the type of construction and pointed
out that regardless whether it was zoned R-1AA or R-l, the
type of construction has ~o bearing on this. Ne explained
this further. He added that there are rules on the construc-
tion and it must meet the codes. In reference to the traffic,
there is going to be confusion somewhere regardless of the
zoning. Mr. Werger stated that with lowering the amount of
houses, it would decrease the amount of traffic. ~. Lambert
replied there would be confusion somewhere when this land is
developed. The woman told about the traffic problem there
nOW.
Mrs. Louann Kline stated her name and her address as 1060
~est Boynton Road. She stated that mhe hopes the Board takes
into consideration the traffic not only being a mess during
the construction but after completion of the construction.
The traffic there now is a mess. It can only get worse.
There is a 20mph zone, which has never been observed. They
would only have to assume with more homes with more access
roads, the traffic would be even worse. She then told about
the wild life in the area and stated she would hate to see
them shoved out or killed. They need to preserve the wild
life. Chairman Kelly asked if the developer provided~ other
access~roads, would it relieve the condition and a member of
the audience replied: no.
An audience member questioned the price range of these homes
and Mr. Groves replied that he thought M~. Howell's estimates
were correct. The man replied that this would be at the low
end of what is being offered in that area. Mr. Groves replied
that he was not really familiar with the prices in that area
and a member of the audience informed him that two bedroom
homes Sold for $34,000. Mr. Howell explained tha~ basically
houses selling tod~v were priced at approximately $30 per
sq. ft~ including land and building. With 1000 sq. ft.,
they are talking approximately $30,000 not includimg a garage
or screen room. The builder's cost is over $22 per sq. ft.
A man in the ~udience stated.that ~his would flood an~area
immediately to the west of Laurel Hills with ahousing unit
that is at the low end of what is available in that area.
Mr. Howell clarified that according to the market and what
additions people want, he woul~ say they would probably run
from a low of $29,900 to possible $36,000. The People dis-

Mr. Brew~lee referred again to the houses along N. Seacrest.
Ne realizes that everYbody is interested in making money, but
every builder~only wants to change the code for his own good.
They don't want to pay his profit.
Mr. Frank Vero stated his name and his address as Old Boynton
Road. He informed the Board that he thinks everybody here is
concerned with R-lA& against R-1. If this gentleman wants to
build, they are mot going to stop him, but if he wants to
build in that area, let him build R-1AA. If he makes the
lots 8000 sq. ft., everybody will be satisfied. Leave it
R-1AA.
Mr. Ryder referred to there being a good deal of discussion
~egarding economics. He doesn't believe it is within their
province to base any discussion on this. Ne doesn't think
it is something they have to lean on in arriving at a deci-
siom. From what he has seen and heard, he does not see justi-
fication in undoing something which was done to upgrade this
particular area only a short while ago last year. He doesn't
see any justification to downgrade.
Mr. Ryder then made a motion to rece~end to the City Council
that the application from Riteco Development Corporatio~ t,
change~the present zonimg from R-1AA to R-1 be denied- Mr.
Winter seconded the motion. Motiom carried 4-0.
A man in the audience asked when the City Council would dis-
cuss this application and Chairman Kelly advised him on May

Chairman Kelly stated that he had no additions or comments,
but Mr. Kestner had called his attention to two corrections.
He referred to Page 10, paragraph on bottom, beginning with
Mr. KoStner asked Mr. Howell if the applicant was reverted
back etc. Applicant should be property.
He then referred to Page 18, middle of page, in the paragraph
where ~. Ryder refused to rescind his second to the motion.
Mr. Kostner advised that he requested a vote om the motion,
h±ch could~be passed or voted down. Mr. Ryder replied that
this wa~ not his recollection at all. He believes what is
stated in the minutes is the truth. Mr. Winter agreed that
the way ~it reads is exactly the way it was. Chairma~ Kelly
a~d Mr. Lambert also agreed. Mr. Ryder added that he~ did say
it could be voted up or down.
Mr. Lambert moved to accept the minutes of April 13 as cor-
rected, seconded by Mr. Winter. Motion carried 4-0.

does not mind approving R-1 if it upgrades the existing
zoning. He would be in favor if it was upgrading. He gave
the example of changing R-2 or R-3 to R-I. Mr. Lambert

Chairma~Kelly told about talking with ~yor DeLong abomt a
meeting Between this Board and the City Comncil. He stated
that he was inclined to agree with Mr. Lambert's remarks.
He then told about hearing the Co~cil members.remark that
they should leave the old City alone and try to improve
overall inthe western expansion. Perhaps, they could set
a time to meet with the Council. Mr. Ryder referred to the
City hiring a Planming Director and stated that these are
things he should clarify. He referred to the members of the
Board and Council not being permanent and he th~ the zoning
should be given a long look by someone who is going to stay
around°
Chairma~Kelly referred to the estimated price range of houses
in the R-1 zone being $29,000 to $31,000. They mast consider
the economical situation. Mr. Howell added that in looking
at this 900 acres, he believes some rezoning will have to be
done. ~He pointed~omt that Congress has R-1AAA zoning right
up to it. Chairman Kelly informed him that R-1AAAwas in-
tended to be a holding zone classification. Mr. Nowell con-
tinued that when they get into this, they will probably have
commercial along Congress. Ne referred to the planner's pre-
sentation tonight regarding graduate zoning. He also ex-
plained that he agreed with Mr. Lambert and they must be
careful with zoning. There is no planning in the west for
moderately priced homes for lower income people. He added
that subdivisions must be approved by the C.A.B. and sug-
gested recommending a certain amount of green areas, etc.
Chairman Kelly agreed a~d added that the minutes will co~-
rain all these comments by the Board members for the Council's
review.
Mr. Howell referred to Leisureville having some 1000 sq. ft.
homes and stated that it was a nice looking area. Ne state~
that R-1 can be a good looking area. Mr. Ryder agreed and
explained how it took control. Mr. Howell agreed and sug-
gested that this Board recommend ordinances for not allowing
the parking of beats, trucks, etc. in the ~riveways and ordi-
nances enforcing same. Mr. Lambert told about developers
having these controls in deed restrictions. Mr. Howell in-
formed him that the City could not honor deed restrictions.
Ne suggested that these restrictions be written in the zoning
regulations.
Mr. Winter referred to Palmland and Riteco and how it coul~
possibl~ downgrade. Mr. Howell replied that these companies
could h~ld the land or sell at a profit. They are in the
development business and are in marketing. They are inter-
ested in the trend. They see what is moving in the market.
Under the present zoning, it is 1500 sq. ft. and it means a
house will cost approximately $45,000. This is net taking
into consideration the streets, water lines, surveying, etc.

built selling for $50,000 to $60,000, they will only sell
a few. Mr. Winter 'explained how he thought the real estate
was priced unrealistically. Mr. Howell informed him that

Mr. Howell then stated he wanted to clarify the minutes from
the last meeting. He referred to them reflecting that when
they did not have the proper papers, it was the City Clerk's
fault. He woul~ like to clarify that he was speaking of his
own department with reference to a la~ck of communication.
He added that'hopefully they h~ve it straightened out now.
Adjournment
Mr. Winter made a motion to adjourn, seconded by Mr. Ryder.
Motion carried 4-0 and the meeting was properlY adjourned at
9:50 P. M.

MINUTES OF THE SPECIAL MEETING OF THE PLANNING & ZONING BOARD
HELD AT CITY HALL, BOYNTON BEACH, FLORIDA,
TUESDAY, APRIL 27, !976

Chairman~Kelly called the Special Meeting to order at 10:O6
P. M. ~He s~nnoune~d the meeting was called in regards to a
question made by builders to the Building Department. He
referred to Page 16 in the Blue Book under R-1AAA, Single
Family Residential, Paragraph A, stating side yard - 30 ft.
(one side must be at least 20 ft.) He advised that it had
come to the attention of the B~lding Official that this is
ambiguous and this special meeting was called to discuss the
change required. During the recess between meetings, this
matter was brought up and the Chair thought it advisable to
call a short special meeting. This subject is now open for
discussion.
Mr. Lambert suggested that Mr. Howell explain the problem
he has encountered. Mr. Howell stated that it was brought
to his attention that the way these two lines read, a builder
could take a 30 ft. setback from one side of the property
and build to the property line on the opposite side.
Mr. Winter made a motion to correct that minimum side yard
from 30 ft. to read 15 ft. each side to coincide with the
general pattern of zoning on the other classifications and
the parenthetical sentence to be deleted. Mr. Lambert
seconded the motion. Motion carried 4-0°
Mr. Ryder made a motion to adjourn, seconded by Mr. Winter.
Motion carried 4-0 and the meeting was properly adjourned at
10:1t P. M.
