Minutes 05-01-75MINUTES OF THE SPEC~ ~ETING OF THE ~ANNING & ZONING BOARD HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, THURSDAY, MAY 1, 1975 AT 7:30 P. M PRESENT Joseph T. Kelly, Chairman Col. Walter M. Trauger, Vice Chman. Mrs. Vicki Castello John !. Rogers Enrico Rossi Oris Walker Jack Barrett, Bldg. Official Warren Bushnell, Deputy Bldg. Official ABSENT Mrs. Marilyn Huckle (Excused) OhairmanKelly welcomed the ladies and gentlemen present to the Special Meeting of the Planning & Zoning Board of the City of Boynton Beach and called the meeting to order at 7:40 P. M. He announced this meeting was intended to give a last review of the latest correction to the book which they worked on and completed about 5:00 P. M. last Saturday. He stated for the record that publicity for this meeting was given in the Sum-Sentinel yesterday and the Palm Beach Post Times and Boyntom Beach News Journal today. He added there were several errors and the announcement om the door of City Hall clarified this meeting. Chairman Kelly then ascertained that each member had received notices from the City Clerk ammouncing a City Council meeting on May 8 and also public hearings by the City Council on May 13 and14. ChairmanKelly then ascertained that each member had received a new revised copy of the regulations. He added that he had the opportunity to get together with Mr. Bushnell and go over this latest copy. Chairman Kelly introduced the members of the Board, Building Official, Deputy Building Official and Recording Secretary. Chairman Kelly referred to the latest copy having numerous typographical errors. Mr. Barrett advised him that these errors would be corrected. Mr. Barrett suggested that in the interest of time, they proceed going along with these having been verified by M~. Bushnell and Chairman Kelly. H~ then referred to Section 10, which has been completely rewritten. He informed the Board that he met with the City Attorney and discussed this for 2½ to 3 hours. It is almost verbatim out of Chapter 163 State Statutes. Other than that, he thinks they will find everything in order. They plan to run s~ffi- cient xerox copies for the City ~&~e~r and City Council members, so they have correct copies to read. They will then proceed in producing the book in its entirety. Col. Trauger referred to this Section 10 and questioned whether they should have the concurrence of the Chairman of the Board of Adjustment? Chairman. Kelly advised him that the Planning & Zoning Board did not consider this chapter and the City Attorney, City Clerk and Building Official went over this. He pointed out that the bock had been reduced by five pages and 4½ pages were cut out of the Board of Adjustment section. Col. Trauger replied that he just wondered if the Chairman of the Board of Adjustment had been consulted just as a form of courtesy. Mr. Barrett informed him that a copy had been given to the Chairman of the Board of Adjustment. Mr. Bushnell then proceeded with making the following cor- rections~ He referred to the Introduction, the end of the first para- graph, where it states intervals of not more than three years and this should be changed to: ~not more than one year, as stipulated by Florida Statute 163.~' Mr. Rogers referred to the beginning of this same sentence where it states together with the other tools entitled, etc. and stated he believed "the other~ was superfluous. Mr. Bushnell agreed a~d read it as corrected: "the Official Zoning Map together With the,etc." Mr. Bushnell referred to the third paragraph and the sentence referring to districts and the indication that subsequent pages will give details. He then pointed out that several residential, commercial districts, etc. were included, but the City owned district was not. He pointed out that the statement was incorrect and they must delete or add a sen- tence stating what City owned means. After discussion, it was agreed to add at the bottom of Page 34~ "CO - City owned properties which are not designated by districts". Mr. Rogers pointed out that this would be Section 9 an~ the ethers would have to be renum~ered. Mr. Bushnell added that should state all other details are found in subsequent pages. Mr. Bushnell referred to Definition of Accessory ~se and stated it should be: "inCidental~. He referred to the last full line of this same~ paragraph and it should be: on the same premises "as" the principle use. MINUTES PLAh~ING & ZONING BOARD PAGE THEE MAY 1, 1975 Mr. Bushnell referred to B~ding and Rooming Houses and it should state: "a building other than a hotel or motel providing lodging and where mesas are or are not served for compensation." tn the definition under building in the last sentence, it should be "construed,~ instead of constructed. Page 4 Mr. Bushnell referred to contiguous and stated he preferred to see it written as: "lands are contiguous if they adjoin each other or if separated only by, etc." Under cul-de-sac, strike out street and add~ 'Ta circular turn-around on a minor street with one outlet." Mr. Bushnell referred to the last parsgraph, next to last sentence, which states accessory buildings shall not be counted as floor area and "if" should be added after area. Mr. Bushnell referred to the first paragraph, Setback, at end of first line and ~the" should be inserted. Under Storage, Open, insert ~ comma after space and insert a~other comma four words later after sky. Take "y,, off similar on last sentence. They should have a definition for yard, which will ~e taken ~rom 62-29 as defined in the old ordinance. Page 10 M_r. Bushnell referred to A, Scope, and pointed out that the entire paragraph was defined as one sentence, but it was not a sentence because it has no verso They decided to state: "this regulation "is", etc." ~. Bushnell referred to the last paragraph and stated that Official Zoning Regulations should be capitalized. MINUTES PLANNING & ZONING BOARD PAGE FOUR MAY 1 , 1975 Mr. iRogers referred to 0P and pointed out that they left the old designation of office park district and it should be: "industrial office park district". Also, M-1 should be: '~industrial district". Mr.~ Bushnell referred to (a) Use and stated that after the first word in the second sentence a comma is required. Under (d), it should be principle buildings (plural). After cluster, there should be a comma and not a semi-colon. Mr. Rogers questioned the capitalization of lots, areas, etc. and Mr. Bushnell agreed that they should 'be small letters. Under Section 4 (b), distmmce between buildings should read; accessory buildings (plural) an residential districts (plural). Page 14 Mr. Bushnell referred to (g) Cul-de-sac and stated that the ~'s" should be removed from setbacks. He referred to (h) Temporary Buildings, and the last word of the last full sentence should be "ceases" and not cases. Page 15 Mr~ Bushnell referred to the top of the page where it stated fences, hedges, etc. and '~wall'~ should be inserted before not. Mr. Bushnell referred to R-1AAA in the first sentence and it should state "population of not more than" instead of no more th~u. Under (b), in order to be consistent they should state: "and other places of worship~'~ after churches. Page Mr. B~shnell referred to 2, Building Site Regulations and the second line in (b) states F-1NT and it should be ~'R" instead of the dash. ?age 19 Mr. Bushnell referred to the bottom of the page, end of last sentence, and it should read ~duplexes together with single family dwellings" (strike A and add dwellings after family$. Page25 Mr. Bushnell referred to Confection:.ryS~p and (including · ou~tain) should be in parenthesis. He stated they should strike C-2 district ahead of Uses Pro- hibited. Mr. Bushnell referred to Paragraph C-3, Community Commercial District and it should be: ~accommodating~'. Page Mr. Bushnell referred to 3, Building Site Regulations and stated the maximum coverage is 40% since the copy didn't print. Mr. Rogers referred to the deficiencies in printing and questioned if the other copies would be more readable? Mr. Barrett informed him that the stencil machine required repair. He advised him that they would run one correct copy and xerox it for the City Council, but this is more expensive to do. Chairman Kelly added that the seven copies would be for the use of those who may read it at the City Council meet- ing. 2__8 Mr. Bushnell referred to D, C-4 General Commercial District, first sentence of second paragraph, and pointed out they had nothing to back up this statement. Paragraph three, end of first sentence should be t'mailing addresses" (plural). M~. Bushnell stated there should be a new Item 5 which was completely overlooked and should read: "applicants shall be required to file a proper form (supplied by the City Clerk) accompanied by a fee of One Hundred Dollars ($100)." Mr. Bushnell referred to Paragraph 5 and stated the last.word in the line was misspelled and should be ~concurring". Also, in the same paragraph, the next to last line, should be four members (plural). Mr. Bushnell referred to this same sentence and the reference of a 4-1 vote for and 4-1 vote against. He referred to Page 41, C, where it stated 4-1 is for reversal only. The differ- ence of these two statements was discussed and the meaning of a 3-2 vote. Mr. Bushnell also read Chapter 163 to verify the statement. After discussion, it was agreed to leave bot~ statements as printed. Chairman Kelly referred to (c) and stated it should be "by" and not be. Mr. Bushnell referred to PaEagraphF, next to last sentence, and Fifty Dollars should be capitalized. Mr. Bushnell stated these were all the corrections they had made and Chairman Kelly agreed. Mr. Rogers made a motion to pass this ordinance as corrected tonight and the map as corrected on previous occasions with recommendation to the City Council for approval. ~ Col. Trauger seconded the motion. Motio~ carried 6-0. At this time, Chairman Kelly requested that the record show Mrs. Huckle being excused for a ten day period. She will be back in the City on May 10.
