Minutes 02-11-75i~INUTES OF T~ REGULAR MEETING OF THE PLANNING & ZONING BOARD HELD AT C!~ H~L, BOYNTON BEn, CE, F~ORIDA, T~SDAY, FEBRUARY 11 , 1975 AT 7:30 P. M. PRESENT Joseph T. Official Chairman Kelly welcomed the ladies and gentlemen present to the first regular meeting in the month of February of the Planning & Zoning Board a~d called the meeting to order at 7~42 P. M. He recognized the attendance of Mrs. Jackson in the audience and announced that he would call on her later in the evening. He then read the agenda and introduced the mem- bers of the Board, Mr. Barrett and ~o Bushnell. N~# BUSINESS St. John's Methodist Church - Discuss Proposed Addition and New Steeple ~. Floyd Van Deusen stated his name and his address as 227 N. E. 22nd Avenue and he informed the Board that he is a mem- ber of St. John's Church and Chairman of the Building Committee and Board of Trustees. He advised that they were planning to build an addition to the present building. The church is located at 3215 North Seacrest Boulevard, about ~ block north on the west side of Arthur Court and south of Memorial Park and Pine Point Villas. It is located on more than three acres. The b~lding is 32'5~' high from the ground to the roof of the building; from the top of the building up to the steeple, it goes to 55'7" and with the cross on the top, it makes it a total of 65'3-. This is just a steeple. In going through the book, there is nothing that excludes building a church. It is zoned properly and the location is proper. The only question that has been raised is regarding the steeple in that it is over 45'. Of course, the church would like to have a steeple with a cross to make it look like a church. ~. Barrett agreed with ~. Van Deusen, but pointe~ut that the code states no structure shall exceed 45' and the steeple is a structure. There were provisions in the old code for considerations to be made by the City Council. When the code was amended, this unfortunately was not included. The only way that this Board can do anything about this particular situation is to recommend to City Council that an amendment be made to the existing ordinance in this matter. MINUTe,S PLANNING & ZONING BOARD PAGE T~O FEBRUARY 11, 1 975 Chairman Kelly questioned if they should look at the plans at this point and Mr. Barrett advised him that he had reviewed the plans and everything is correct, but there is no allowance for any structure over 45' and a steeple is a structure. He recommends that the Board considers recommending to City Coun- cil an amendment to the ordinance. Chairman Kelly asked what plans had been made for brea~ng Eround and Nm. Van Deusen informed him that they planned to put the shovel in the ground this~coming Sunday and have made arrangements. Then, it will take approximately three weeks to get the money. We have had two meetings with the bidders and building committee and it has been approved. His view- point is that he cannot u~derstand the ordinance as~it reads in that buildings going over 45' block the View, but a steeple could not block the view. Chairman Kelly agreed that he made a good point. ~. Rossi asked if this ~uestion came up after the plans were completed and Mr. Van Deusen replied: yes. I,~. Rossi then questioned what zone this was located in and ~. Barrett informed him it was R-lA and added that a church was allowed in any zoning. Mm. Barrett pointed out that this seemed to be a super structure which could be placed at any time. This is largely a framework which is superimposed on the church proper and if ~he Board recommends to the City Council that an~amendment be made, it would not hold up con- struction by the time they were ready. }~. Rossi questioned if provisions had been made for elevator shafts, etc. and Mr. Barrett advised him that this had been orovided for in the new Code. effect since informed him that they were within the 45' limit. Chairman Kelly stated that it seemed to him that Mm. Barrett has recommended an avenue of approach. Nm. Barrett stated the Board should recommend to City Council that the ordinance should be amended so steeples, radio t~wers, navigation bea- cons, etc. shall be reviewed by the City Council for approval. The 62-9 code was amended in 1972 or 1973. If the motion goes onto the floo=, he will research it. Col. Trauger ques- tioned if they needed an amendment even though, the proposed code was not in effect and ~. Barrett replied: yes. Huckle stated that the latest amendment to this ordinance was dated 12/7/71. She added that on the agenda it also mentioned an addition being made. ~m. Barrett informed her that the proposed addition will come later. ~. Van Deusen is just appealing to the Board to being able to go ahead with the steeple. }~. Rossi referred to the heights and questioned the height of the building the steeple would be located on and }~. Barrett informed him that it was 32'5~'. Rossi asked if they would get another look at the final wording of this new ordinance and Mr. Barrett replied: yes, after he drafts it, he will circulate it for the Board. ~s. Huckle qUestioned if this would mean a delay for the 8hurch and Mr. Barrett~ replied that he didn't think it would hold them back in any way. They can go ahead with their general structure, s~ thais is a superimposed structure. Motion carried 7-0. Mr. Van Deusen thanked the members. He stated they certai~y appreciate it and hoped when they get it built, the members will come and visit. They do need it very much. The ch%arch will hold 370 people and now they can only hold 150 people. Replat - Parcels H & I Leisurev~ille Section 10 - Preliminar~ Approval Mr. Rossi made the presentation since it was submitted by his firm. Boynton West wants to develop this~land into sin- gle family lots instead of multi-family as zoned. As a re- sult, they end up with a reduced density of about one half of what was previously planned. This will open up the visi- bility to the lake and will enhance the property. This lake is about centrally located in the plat. They previously looked at one located in the east end of the plat. Mrs. Huckle questioned if they planned to do the same thing here and Mr. Rossi replied: yes. Mrs. Huck_le asked if the lake was existing and ~. Rossi replied: yes. Col. Trauger asked what type of houses were planned and Mr. Rossi informed him that they would probably work from the five models they now have. ~. ~alker made a motion to recommend approval, seconded by ~. Rogers. Motion carried 6-0, with ~. Rossi abstaining. Review Site Pla~fo~..~6~.Uni. t~D~tments for Mr. Barrett explained where it was located and showed the plans to the members. Col. Trauger made a motion to recommend final approval to City Council of the plat for Y'achtsmen's Cove. Mr. ~alker seconded the motion. Motion carried 7-0. Dis_ c~ussion of Dates o~ Workshop Meetings Chairman Kelly announced that tentative arrangements had been made to hold word, hop meetings on Saturdays from 9:00 in the morning until 4:00 in the afternoon. One was planned for last Saturday, but was cancelled because of the inability to receive larger maps to consider requests and petitions. This is now open for a general discussion. Mr. Barrett informed the Board that he did not anticipate having the reproductions back before the 18th and it would take a couple days to run copies. He doesn't anticipate they will be available until possibly the 22nd. He is going to be out of town in Gainesville at the University of Florida from the 23rd to the 26th. He hesitates to put in all day Saturday prior to leaving early Sunday morning. ~. Rossi added that the maps would be ~ the size of the ones displayed on the board at the public hearings and possibly they could note the areas which were bmought up. Mr. Barrett stated he thought time was needed to study the areas and physically look at the areas. He stated this would bring the first Saturday meeting on Marcht and then they could study and look at the areas and have another meeting on March 15. Col. Trauger stated he thought it would be worthwhile for them to possibly look at them en masse, so they would have them in the same frame of reference. Chairman Kelly agreed. ~M. Barrett stated they could meet on March I and possibly he could, arrange it with the City Manager for them to have the 'bus on March 8 to look at the areas and they would have the bus trip between the two meetings. Col. Trauger remarked that he thought they should have the bus trip first. ~. Barrett suggested wor~uing with the areas they were sure of first and then going out on the bus and have a work session afterwards. ~so Huckle stated she agreed with Col. Trauger and they should take the toughest ones first. ~. Barrett remarked that he thought it should work the other way. Col. Trauger said that possibly while ~. Barrett was away they could get this done at the end of February. ~. Barrett suggested possibly setting up a bus trip for February 22. M~s. Trauger suggested M~rch I stating they could take the map and look at the sites. Mr. Barrett informed them that ~. Rossi has been able to get aerial photos of the area which should really be helpful. ~s. Castello pointed out that on a bus trip, they could consider traffic better. ~. Barrett pointed out that Saturday was a bad day for that. Col. Trauger stated that he was thinking of the areas along the intercoastal and by The Cellar. M~. Barrett stated they could take the aerials with them. ~. Rossi informed them that there were 29 aerial photos. He added that a red line should be put to show where districts fall, so they can move the line, etc. ~. Barrett questioned if he wanted the red line on the reproduction or the aerials and M~. Rossi replied that he thought it should be on the reproductions. Mr. Barrett stated that was the way they were coming. Mr. Rossi suggested that on the one showing the proposed zoning, they shomld possibly show the problem Chairman Kelly informed the members that he has done a little homework and has taken the minutes and the various paragraphs indicating the people appearing before the Board and he marked the minutes. He suggested having a discussion about this at a workshop meeting, ~. ~alker suggested waiting u~tii Feb- ruary 25. M~. Barrett agreed and stated they would also have the maps then and could mark out the problem areas in pencil. Chair~man Kelly added that his marking~are just suggestions for discussion. He then announced they would follow the regu- lar meeting on February 25 with a workshop meeting to have a discussion and start on this. Minutes of the Soecial W~ Meeting of January 27 ~975 Mrs. Huckle referred to Page 7, Paragraph 4, which starts with her ~ame and corrections she made to Page 30. should be eliminated and it should be: Uses Permitted.~, Also, quotation marks should be around Uses Permitted and Uses Prohibited. Also, on Page 7, almost to bottom of page, next to bottom paragraph, where she referred to Page ~6, should be: shall then (t~en added~. She then referred to Page 8, Paragraph 2, and the man's property at 4th & Sea- crest is~zoned R-2 and the property behind his back yard is R-3. She again referred to Page 8, middle of next paragraph, and questioned Col. Trauger ~larified that he was asking how they were going to improve Hoadley Road over what it currently is. Chair- man Kelly suggested inserting: with any better paving. Coll Trauger moved that the Minutes of the Special Workshop Meeting of January 27 be approved as corrected. ~s. Huckle seconded the motion. Motion carried 6-0, with Mr. Walker abstaining because of absence. Minutes of the Public Hearing Meetings of January 28 and 29, 197~ ~Ms. Huckle referred to Page 9, last paragraph, and stated the gentleman's name was M~. Curtis Weaver and not ~. Curtis Levy. Mr. Walker made a motion to approve the Minutes of the Meet- ings of January 28 and January 29 with the correction as noted. Col. Trauger seconded the motion. Motion carried 7-0. OTHER Chairman Kelly announced that ~Ms. Jackson has been kind enough to explain the financial disclosure statement re- quired to be filled out by Board members. M~s. Jackson appeared before the Board and informed them that there 'was two ways of doing this, they can file their whole income tax or complete Items I thru 6. You do it in a descending order. On the next page, if you own I0% or mere of any busi- ness or have $1,500 income, you name the business, address and principal activity. On the last page, you list the asset, location and address. There is ~no money to be listed at all. M~. Walker questioned about giving their income tax and Mrs. Jackson replied that this could be filed and just sign your name. She added that she didn't prefer to do this as she feels it is an invasion of her privacy and otherwise, you don't have to list any money. Col. Trauger questioned when this had to be filed and Chairman Kelly informed him on ~'&~Y 15. Mrs. Jackson added that it was a State law and is good for municipalities, counties, states, etc. Don't worry about it. She just wanted to clarify this. Mr. Rossi ques- tioned where it stated who had to file this and Chairman Kelly stated he thought there were some contradictions and Mayor Roberts is seeking a legal opinion. Mrs. Jackson stated that she just wanted to bring this up and point out there was nothing to it. Col. Trauger questioned where it was filed and ~.irs. Jackson advised him that it was~filed with the City Clerk and she sends them to the Clerk of Circuit Court. Mr. Barrett added that they may mail them to the Clerk of the Circuit Court themselves. Chairman Kelly' stated he would get copies for the members and would request that they be mailed to them. ADJOURNmeNT Mr. Walker moved to adjourn, seconded by Fn~s. Huckle.
