Minutes 11-05-73 The Chair calls to order a Special Meeting of the Plann~mg and Zoning
Board of the City of Boynton Beach a t 10:30 A.M.~ on this $-~onday mornings
November 5th for the purpose of reconsidering the action of this Board as
reflected ~u ou_~ minutes of October IO, 1973 iD_ relation to the reco~endation
to City Council relative to the application of Lehigh Portland Cement
Company request for Zoning approval.
The Chaims_u, M_r. Vast~ae, for~varded a letter to Ci~ C~mncit Under ~he
date of October 29, 1973 recommending a denial of the reques~ as approved
~n the Board meeting of October 10th. This letter was sent in compliance
with a letter sent to all Boards by the .~gayor on Jsmuary 9%h~. 1973 ~hat
Council should' receive, in addition to the minutes, necessary communications
concerning Board actions where recommendations were involved.
Chairman VastLue pointed out that this action wass through a m~ sunder-
standing, not in order (the October 10th meeting) because the City Attorney
had advised that a public hear~ug was required and since .none had been
advertised and held 'it would appear best that the Planning and Zoning Board
immediately communicate with the City Manager requesting that the reco~=~udation
of denial of the Lehigh Portls.ud Cement Company be wit~awn from ~e Agenda
of City Council of the November 6th Council Meeting.
The Chair entertained a~motion that,` ~the P'lmnning and Zoning Board
recommends to the City Cotmcil the deletion from the Agenda of the NOVember
6%h meeting the recommendation for denial as tran~mitted iu o-er letter of
October 29th because there has been no legally advertised notice and heariug
of the request of Lehigh Portland Cement company as required by City Ordinance o"
