I. CALL TO ORDER Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order at 9:04 a.m. and explained the Magistrate's role and the procedures. Pursuant to Florida Statute, all orders are appealable to the Circuit Court in Florida and the City Commission. Also, that a fine will be imposed if the violation(s) are not corrected by the deadline. II. INTRODUCTION AND SWEARING IN OF WITNESSES Officer Guim administered an oath to all those intending to testify. III. NEW BUSINESS Fine Certification Hearing Case No. 19-3441 Harbour Hall Inlet Club 11 Property Address: 689 NE 6t" Ct Type of Property: Single-family, non-homesteaded Violation(s): As noted in the Notice of Violations Officer Hart presented the case. Original Magistrate Hearing November 18, 2020. Property manager and attorney appeared. Compliance date May 1, 2021. Fine proposed was $100 per day plus $384.12 administrative fees. Property last inspected June 15, 2021, violations still exist. There are currently 45 days of non-compliance and the fine continues to accrue at $100 per day. The total fine is $4,500, plus administrative fee $384.12, for a total of$4,884.12. Guy Shir, attorney on behalf of Association, appeared and explained there is a new board and the Vice President of Association was introduced. Board has taken steps and worked with Officer Hart to repair the wall. Officer Hart stated a portion of the wall has been fixed, but old property manager didn't follow through and more needs to be done. Mr. Shir said there are complications with working with neighboring associations [lawsuit has been filed], getting an engineer and/or a loan to complete the entire project. An addition 30-45 days are requested to take the project to next stage, all while working with Officer Hart. Ms. Zalman explained the fine certification process and ultimate lien reduction. The case will be tabled for at least 45 days. Decision Based on testimony, Ms. Zalman tabled the case for two months and did not certify the accrued fine this day, but the daily fines will continue to accrue at $100 per day plus administrative costs. Case Hearing Case No. 20-2430 Kate B Silver Property Address: 35 Heather Cove Dr Type of Property: Single-family, non-homesteaded Violation(s): CO CH 10 SEC 10-56D Repair damaged facia board, permit may be required. Officer Daniels presented the case, which was a routine inspection. Initial inspection date September 23, 2020. Not a repeat violator. Initial written notice issued October 9, 2020. Thirty days were given to comply. Date notice posted on property and at City Hall June 30, 2021. Property last inspected June 15, 2021, violations still exist. Not a safety hazard. David Silver, brother of owner, presented Power of Attorney to speak on owner's behalf. Communication was spotty at the time of the notice of violation; neighbor took picture of posting on the door and sent it at some time to Mr. Silver. An account of how mail has been handled during pandemic was given. An extension of 60 days was requested to fix the fascia, soffit, and roof, and will continue to work with Officer Daniels. An updated address was given to ensure future communications. Decision Based on the evidence, Ms. Zalman ordered compliance date of August 15, 2021, or $25 a day fines assessed and administrative fee of$384.12. Case No. 19-3276 Fenel Elan & Salomon Holdine Property Address: 83 Magnolia Cir Type of Property: Single-family, non-homesteaded Violation(s): [not given] Repair or removed wooden fence, permits may be required. Officer Hart presented the case, which was a citizen complaint. Initial inspection date October 29, 2019. Not a repeat violator. Initial notice issued December 9, 2019, via courtesy notice. Thirty days were given to comply. Date notice sent Certified Mail was May 21, 2021, signed green card dated June 4, 2021. The fence has been replaced but without proper permitting. Permit application made, but expired. Property last inspected June 15, 2021, violation still exist. City recommended property to be in compliance by July 16, 2021, or $25 a day assessed, plus administrative fee of$384.12. Fenel Elan, owner, appeared with Jude Avril to assist with the process. The survey will be completed June 16 [this date] to satisfy the requirements to proceed for the proper permitting. Officer Hart noted that complaints have been received that there have been issues receiving easement consent forms through FP&L and recommends 60 days compliance. Ms. Zalman also reduced the administrative fees to $150 as respondent had honestly attempted to comply all along. Decision Based on the evidence, Ms. Zalman ordered compliance date of August 30, 2021, or $25 a day fines assessed and administrative fee of$150.00. Page 3 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 16, 2021 Case No. 21-0213 CAEV Holdings LLC Property Address: 602 NW 7t" St Type of Property: Single-family, non-homesteaded Violation(s): CO CH 15 SEC 120-D.1.A CO CH 15 SEC 120-D.1.E Mow, trim, and de-weed all overgrowth on property (complied). Remove all outside storage as well as trash and debris, wood blocks, building materials, etc. Officer Hart presented the case, which was a routine inspection. Initial inspection date January 25, 2021. Not a repeat violator. Initial notice issued January 29, 2021, via courtesy notice. Fifteen days were given to comply. Date notice sent Certified Mail was May 7, 2021, signed green card dated May 21, 2021. Property has been mowed again but the storage still exists. Property last inspected June 15, 2021. City recommended property to be in compliance by July 16, 2021, or$25 a day assessed, plus administrative fee of$384.12. Camilo Elizalde, managing member of CAEV Holding, appeared and stated there has been communication with Officer Hart, explaining the development of the land is in process; approval from County to split the lot has been received. Architect has given preliminary drawings and permit applications are being made. Storage space costs for materials to build two homes on the property is prohibitive; a discussion on putting up a fence for construction ensued; due to hurricane season, materials will have to be removed during the permitting process. If a named storm comes prior to July 5, Mr. Elizalde is on notice to remove the materials sooner. Decision Based on the evidence, Ms. Zalman ordered compliance date of July 5, 2021, or $25 a day fines assessed and administrative fee of$384.12. Fine Certification Hearing Case No. 20-2152 Popamar Investment LLC Property Address: 213 SE 1St Cir Type of Property: Single-family, non-homesteaded Violation(s): As noted in the Notice of Violations Officer Daniels presented the case. Original Magistrate Hearing March 17, 2021. Mr. Popa did appear. Compliance date April 29, 2021. Fine proposed was $50 per day plus $384.12 administrative fees. Violations still exist. There are currently 47 days of non- compliance and the fine continues to accrue at$50 per day. The total fine is $2,350, plus administrative fee $384.12, for a total of$2,784.12. Page 4 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 16, 2021 Florian Popa, owner, appeared and explained permit from City to redo the plan has been received and currently awaits verification of qualification for Homeowner Building Credit and reply from Building Department. Permits were applied for on March 17, 2021. Officer Daniels confirmed the applications for the credits and permits have all be done in a timely manner. Decision Based on testimony, Ms. Zalman tabled the case for 60 days and did not certify the accrued fine this day, daily fines will not continue to accrue nor any administrative costs. Case No. 17-2584 Michael Hanlon Property Address: 2385 SW 13th Way Type of Property: Single-family, non-homesteaded Violation(s): As noted in the Notice of Violations Officer Daniels presented the case. Original Magistrate Hearing February 17, 2021. Mr. Hanlon did appear. Compliance date April 30, 2021. Fine proposed was $100 per day plus $384.12 administrative fees. Property last inspection on June 15, 2021, violations still exist. There are currently 46 days of non-compliance and the fine continues to accrue at $100 per day. The total fine is $4,600, plus administrative fee $384.12, for a total of $4,984.12. Michael Hanlon, owner, appeared and submitted several supporting documents; there appears to be some confusion on respondent's part as to the processes and notifications. Officer Hart explained that the trusses in the house to support the roof were installed without permits; contractors cannot replace a roof with unpermitted trusses. Habitat for Humanity and other agencies were contacted, but these repairs are beyond their scope or no responses received at all. Mr. Hanlon presented proof of income and receipts for materials to date. A litany of attempted resolutions, including Officer Hart's attempts over the past four years for assistance for respondent, was given. Ms. Zalman took respondents age, disability, income, and frustrated attempts at resolving the violation into consideration. Mr. Pierre recommended that Habitat for Humanity and the City be approached again to see what can be done for Mr. Hanlon and an extension of two months. Decision Based on testimony, Ms. Zalman ordered the matter, including administrative fees, be held for two months to see if a resolution can be found for the owner. Page 5 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 16, 2021 Lien Reduction Hearing Case No. 11-1809 Targon IV LLC Property Address: 534 NW 5t" St Type of Property: Vacant Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date July 13, 2011; property at 534 NW 5t" Street must be properly maintained. The Magistrate hearing was on September 217 2011, no one appeared. Compliance date given was October 1, 2011, or $200 per day plus administrative fee. Date of compliance was July 7, 2012. The property has 291 days of non-compliance with fines of $200 per day in fines for $50,200.00 including administrative fee. Owner of property has complied for lien reduction. (see related case 13-1910) Tim Quinones, attorney, and Dan Lumbra, current owner, appeared and stated the property was purchased a couple of years ago for approximately $75,000 and it was a disaster. $150,000 has since been spent for new underground plumbing, new electrical service, overgrown with scrub pines that were cleared. A new house was built, a new roof on existing building and detached garage, fence, landscaping. The project took about a year. Original plan was to fix up and sell; however it is now a rental property. The owner was unaware of all the liens from other municipalities outside Boynton Beach, which was common way of doing business for previous owner. There are hopes to sell some day once all the liens are resolved. Another goal is to expose and shut down Targon IV LLC to prevent further dealings in Boynton Beach and surrounding municipalities. City recommended reduction to 2% plus administrative fee. Ms. Zalman settled for 1% less administrative fees. Decision Based on the testimony, Ms. Zalman ordered the lien reduced to $1,582. Case No. 13-1910 Targon IV LLC Property Address: 534 NW 5t" St Type of Property: Vacant Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date August 27, 2013. The Magistrate hearing was on October 16, 2013, no one appeared. Compliance date given was October 26, 2013, or $500 per day plus administrative fee. Date of compliance was January 24, 2019. The property has 1,915 days of non-compliance with fines of$500 per day in fines for$958,134.00 including administrative fee. Owner of property has complied for lien reduction. (see related case 11-1809) Page 6 Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida June 16, 2021 Tim Quinones, attorney, and Dan Lumbra, current owner, appeared and stated that this lien also involves similar municipalities. The property is possibly worth $250,000. Mr. Pierre stated that the lot mowing lien, which is not negotiable, had to be paid before the respondent could appear for lien reduction. Also paid were water bills and other costs. City recommended reduction to 2% plus administrative fee. Ms. Zalman settled for 1% less administrative fees. Decision Based on the testimony, Ms. Zalman ordered the lien reduced to $8,255.34. Case No. 19-1929 Sherrah Campbell Property Address: 8281 Bermuda Sound Way Type of Property: Single-family, non-homesteaded Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date July 29, 2010. The Magistrate hearing was on February 19, 2020, no one appeared. Compliance date given was February 26, 2021, or vehicle will be towed. Cost will be $384.12. Date of compliance was April 2, 2021. There were 107 days of non-compliance, cost to tow the vehicle $384.12. The total amount of fine is $2,675, including administrative fee. Owner of property has complied for lien reduction. Shirley and Sherrah Campbell, owners, appeared and stated this is a rental property since they moved away 14 years ago; real estate agency rents the property for them, some good, some bad. The last tenant was a difficult tenant who seldom lived in the house as he was a traveling consultant. There have been communication problems, notices were not received and/or forwarded to them. Once violations were discovered, violations were corrected. Costs for repairs were just under $1,000. Property has been prepared for sale. City recommended reduction to 7%, including administrative costs. Decision Based on the testimony, Ms. Zalman ordered the lien reduced to $117.25. Case No. 20-2819 Demetrius Bryant Property Address: 2371 NE 1St Lane Type of Property: Single-family, homesteaded Violation(s): As noted in the Notice of Violations Officer Pierre presented the case. Notice of violation date November 5, 2020. The Magistrate hearing was on January 20, 2021, no one appeared. Compliance date given was February 15, 2021, or vehicle will be towed. Cost will be $384.12. Date of compliance was May 7, 2021. Demetrius Bryant, owner, appeared and stated he was working on the truck and was going to sell it but contracted Covid-19 and was on temporary disability; decided to give it to his brother. Would just like to reduce the lien, if possible. City recommended reduction to 7%, including administrative costs. Decision Based on the testimony, Ms. Zalman ordered the lien reduced to $140.00. Case Hearing Case No. 21-0810 Sunny Side in Florida III LLC Property Address: 136 NE 12th Ave Type of Property: Single-family, non-homesteaded Violation(s): As noted in the Notice of Violation Officer Hill presented the case. This is a health and safety hazard because property next door was declared a chronic nuisance, vagrants are using hole in fence to go between properties. City recommended property to be in compliance by July 10, 2021, or $75 a day assessed, plus administrative fee of$384.12. Decision As no one was present to testify, Ms. Zalman ordered compliance date of July 10, 20217 or $75 a day fines assessed and administrative fee of$384.12. There was discussion on how to proceed with second and third violation fines as Owner had paid $100 fine for first violation for an oversized truck, but truck remains on lot.
