Minutes 04-05-73MINUTES OF THE SPECIAL MEETIN~ OF THE PLANNING & ZONING BOARD, HELD APRIL 5, 1973 at ?:30~P.M. CITY HALL, BOYNTON BEACH, FLORIDA PRESENT Col. Wehreil Br. F. Koetner mr. R. Olds 3ack Barrett, Building Official mrs. Go Huckle mr. O. Walker Mr. E. Simon meeting mas called to order by Mr. Olds, Chairman~ mt ?:30 P.M. Br. Olds then introduced members present. (See above.) Br. Olds then proceeded to read a letter addressed to the board pertmining to the rezoning of Charte~ World, from Harold Hopkins, acting City M~nager. This letter mas then referred to the City Attorney, Mr. Simon, for action. mr. Olds then r~ad the City Attorney~s response. (See attached letter.) Fenamore Cooper, ?20 Hmrtford Building, 200 East Robinson St., Orlando, ap- peared on behalf of the omner of the parcel. He stated that he felt that palm Land mas being rezoned. He also brought up changes that mere mmda since the notice oas published, and said these matters ~ould be brought before the coumto Br. Cooper then msked the board to declare that palm Land is already zoned, mhd table it ~ntil decided by the court. ~. Olds told mr. Cooper that the project mas 'not properly advertised and that mas the reason it mas being brought up. The rezoning mas then discussed betmeen Mr. Cooper mnd various members of the board. The question of a fire station and PUD zoning mas also brought up at this time. Mr. Vastine then asked fo~ a map to be brought out shoming the zoning in order to make it clearer for eve~yone present, mhich mas done. The map mas then explained, and questions ansmered from certain board members, ~ very important question concerning the semerage mas then brought up to the board by Mr. Coope~. He mentioned that the city did not have the capacity to- provide semer hookups for the project. He then stated ~t ~ras lmter added to parcel 13. Mr. Olds proceeded to explain that they did not knom mhat exactly mas going to take place ~s lam as the semerage mont. A motion mas then made by Mr. Kostner to consider al! the things that mere dis- cussed on this night at the morkshop meeting, and further move to adjourn this meeting. As this mas not seconded at this time~ Br. Olds asked the floor if they had any more questions, Mr. Webber of S.E. 27th Ave., and m~' Oohnston of 523 S.E. 19th ±~ Leisureville Special Meeting of the planning and Zoning Board 4-5-73 placed a few questions before the board. In response to this~ ~r. Olds then asked Mr. Simon to answer this from the book. Mr. Simon then read the ans$er to the zoning question asked, with favorable res- ponse from the floor. Mr. 8i9elow stated that in answer to M~o Oohnst°nts question, that they mould do everything in the best interest of the people affected. A new motion was then made by ~.Kostner to again consider all the things that mere discussed, and bring it up at the workshop meeting at an early date. This motion mas seconded by Mrs. Huckle. Mr. Blacketer and ~r. Vaetine asked Mr. Simon what mould happen if they do not have a recommendation to the city council by April l?th, as Mrs. Huckle had pointed out that they might delay. Mr. Simon stated that the public hearing would not serve any purpose if it was not recommended at that time~ am they mould not be able to proceed, Mr. Vastine then stated to the board that he considered the matter to important not to take a good deal of time with. He also wanted it on record that he was making this statement mithout predjudice. He wanted the board to have time to really think this thing through. All in favo~ of the motion were then asked to signify by saying "aye". Six out of the seven members agreedo ~r. Vastine abstained. ~r. Cooper then requested that someone from palm Land be info,ed of the work- shop meeting. ~r. Olds said this could be done. The motion for adjournment mas then made by Co. ~ehrell at 8:30 P.M, and sec- onded by ~r. Hopkins Interim City ~anager Ht~: sr cc: ' City Council City plem~aer City Engineer OPINION ri'O: From: Planning g Zoning Board Ernest Simon, City Attorney Subject: Necessary Action Re Charter World It would appear ghat the intention of the City Council, in referring the Charter World property to the Planning g Zoning Board, was as £oilows: (a) Subject property is to be zoned in accordance with Chapter 31, City of Boynton Beach Code o£ Ordinances; Subject property is to be zoned in accordance with provisions o£ the City of Boynton Beach Charter; (e) Notice of all zoning hearings shall be 9~iven~ in due course; specific designations o£ the nature of such zoning and legal descriptions of the property shall be included; (d) The Planning ~ Zoning Board shall make its recommendations to the City Council for final disPosition thereof.
