Minutes 07-24-72~NUTES OF THE PLANNING AND ZONING BOARD MEETING HELD AT CITY HALL, BOYNTON BEACH, FLORIDA, JULY 24~ 1972 AT 7:30 P. M. PRESENT: Robert Olds Stanley Weaver Charles Ayers Fred Kostner Ori~Walker Kent Ewing Jack W. Barrett, Acting Building Official Robert Largent, City Planner P~s. Paula Moore, Absent ¥~. Olds called the meeting to order at 7:40 P. M. OLD BUSINESS Minutes -~~~~, 197~ Mr. Kostner moved to accept the minutes with. the correction as asked for by M~s. Moore, seconded byMr. Ewing. Motion carried unanimously. Application for Rev. Wright - conditional use for church with less than one acre of ground. Mr. Olds explained the requirements for a church in the R-1 zone and he so stated that area did not meet the one acre requirement. Rev. Wright presented a sketch showing the location of the building on the proposed site and stated that there v~uldbe no playground, school building nor anything but a church and that he did have the required front footage. ~r. Olds stated that thi~ was correct but the total sq. footage was not there. Mr. Largent said that there is approximately30,OOO sq. ft. here or slightly more than two-thirds of an acre. General discussion followed as to the s~q. footage involved. ~fr. Olds asked if there w~s anyone else present that wished to speak in favor of this application. No one came forward. ~. Olds then asked for any Opposition. No one came forward. M~. Weaver made~a motion to forward application to Counc~without objection, seconded by I~. Kostner. Discussion: ~'~. Olds asked the Board if it w~s the d~sire to send this to Council without a decision. Rev. ~right stated that he first settled in Boynton Beach but then went elsewhere but it had always been his desire to return to Boynton Beach and start a church here and when the church saw the particular property and decided to build a church there he w~s not awa~e o£ the one -1- MIk~3TES PLANNING & ZONING BOARD I~ETING JULY 24, 1972 ~r. Walker asked the Board if they thought the motion that was on the floor was the right motion for the board to make. Discussion followed as to the legality of the motion. ~. Ewing asked if this could go before the Board of Adjustment. Mr. Barrett said this was not in the Board of Adjustment's jurisdiction and ~the Ordinance clearly states that this shall come before the Planning and Zoning Board. Also it is clearly spelled out that a one acre site is required for conditional use in this instance. Mr. Largent then asked the Rev. Wright how m any members there were in this congregation and how m~ny were driving or walking members. Rev. Wright stated that there were only about 8 driving members the balance being walking members. ~. Largent then stated that parking would not be a real problem. Rev. Wright stated that this is a neighborhood church and the congregation numbered only about 30 members and most would be walking or transported ~a small van type bus that the church would provide. ~. Olds then read a letter of objection from ~s. F. P. M~lls, asking the Board to consider a requirement for fencing this property and that other than that she had no objection. Mrs. Mills resides at 301 N.W. 6th Avenue and her property abutts the church property. Mr. Olds then stated that there was a motion on the floor and the Board was not taking any action and said that on a previous occasion the board had a similar situation submitted to Council returned to the Board for definate action. Mr. Kostner stated he thought the motion could probably be reworded. ~ir. ~eaver stated he felt vm needed legal advice and this was why he made the motion so that Council could ask for advice on this matter. ~. Barrett stated that he though Mr. Olds was right in asking for a definate decision. ~ k~eaver then withdrew his motion. Mr. Kostner withdrew the second. M~. Olds entertained a new motion. Discussion followed with regard to the proper manner of hand~ingthis matter. P~. Xostnermade a motion that the Board deny this application with a con~nent to Council that although there was a denial the Board felt it was worthy of Councils consideration, Mr. Ewing seconded the motion. Discussion on motion: ~. Walker feels that if the motion is made in this manner Council will feel that this Board is trying to influence Councils thinking. -2- PLANNING AND ZONING BOARD JULY 24, 1972 Motion corrected to read application denied based on requirement. of the ordinance, with no objection from the Board for Councils consideration. Motion carried unanimously. Suggestion made by the Board to Rev. Wright as to some of the things Council would like to know when he appears before them. Banks ,came forward and outlined his plan, saying that his church already existed and there was no room for expansion on the present lots so the church had purchased additional property within 300 feet of the present church and on this they proposed to expand and provide parking facilities. Rev. Bar, cs seem confused as to whether these lots were for parking or expansion. ~. Barrett explained that Rev. Banks had come in to the Building Department for expansion of the present ch%r~ch but vms told that there was not enough parking at the present site and any further expansion would require additional parking, and that such parking could be provided within 300 feet provided the church owned the property. Ms. Ayers then called to the Boards attention that this property is in a R-2 zone and as such would allow the construction as proposed. ~. Barrett said that in view of both applications coming in at the same time, that he had applied the same restrictions to each application and the R-1 zone requirements would not apply to Rev. Banks application and that approval would be in order. Mr. Ayers made the motion for approval, seconded by Mr. Ewingo Motion carried unanimously. Mr. Olds called the Boards attention to the fact that they seemed to be at a standsti~!l with regard to the new zoning. Mr. Weaver and Mr. Walker concurred.
