O70-03 AN EMERGENCY ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, PROVIDING FOR INSPECTION AND
APPROVAL BY CITY RELATIVE EXTENSION, REPLACEMENT
OR ADDITIDNS TO EXISTING MUNICIPAL UTILITIES SYSTEMS;
PROVIDING FURTHER FOR AUTHORITY TO CODIFY, SAVINGS
CLAUSE, REPEALING PROVISIONS, PENALTY PROVI'~IONS,
AN EFFECTIVE DATE AND FOR OTHER PURPOS~$'.
PREAMBLE
THIS ORDINANCE IS DEEMED TO BE AN EMERGENCY MEASURE
ENACTED FOR THE IMMEDIATE PRESERVATION OF THE pUBLIC
PEACE, PROPERTY, HEALTH AND SAFETY OF THE INHABITANT
OF THE CITY OF BOYNTON BEACH, FLORIDA, AND FOR THE
EFFICIENT DAILY OPERATION OF THE MUNICIPAL BUILDING
AND UTILITY DEPARTMENTS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: That in connection with the installation and construction
of any extension, replacement or addition to the existing municipal utility
~ systems, including but not limited to, sewer, water and drainage, whether
such extension, replacement or addition be within or outside the territorial
limits of the municipality, or whether such extension, rep la cement or
addition is to be publicly or privately owned and maintained, it shall be
mandatory thai prior to issuance of any building permit or other authorization
to proceed with such project or projects, that the plans and specifications
therefor be approved by the Florida State Board of Health and the Municipal
Engineering Department, and, in addition, where such extension, replacemen:
or addition is to be constructed and/or financed by a private developer, rather
than municipal forces or their supervised agents or contractors, that such
private developer shall coordinate such installation with the Municipal
Engineering Department, in order to enable complete supervision of such
installation by a duly authorized supervisor or supervisors designated by the
City Engineering Deparkr~nt, at all stages.~::of construction, in order to insure
that such installation is in full compliance with approved plans and speci-
fications. It shall be a further and additional requirement that, prior to
.... issuance of a building permit for any such project involving extension,
replacement or addition to any municipal utility system, that the :lot:~t cost
of supervision by the City be paid by the developer and thai a sum to cover
such cost, as estimated by the City Engineer, shall be deposited with the
City by the private developer prior to the issuance of building permit. Prior
fo final a~cepian~e of any project described hereinabove, the City shall be
furnished with satisfactory evidence that all bills for labor, services and
materials incurred in connection with such projects have been paid in full.
Section 2:Authority to Codify: Specific authority is hereby
granted to codify and incorporate this Ordinance in the City's existing Code.
Section 3: Separability: Each of the provisions of this Ordinance
are separable, including word, clause, phrase or sentence, and if any
portion hereof shall be declared invalid, the remaining portion shall not be
affected but shall remain in full force and effect.
Section 4: Repealing Provisions: All Ordinances or parts of
Ordinances in conflict herewith are hereby repealed.
Section 5: Penalty Provisions: Any person, firm or corporation
found guilty of violating the terms of this Ordinance shall, upon conviction,
be fined by a fine not existing $500.00 or imprisonmenl in the City Jail for
a period nol exceeding ninety (90) days, or by both such fine and imprison-
ment.
Section 6: Effective Date: This Ordinance shall become effective
immediately upon passage.
