AN ORDINANCE OF THE CITY OF BOYNTON BEACH, FLORIDA,
CREATING THE NON-CLASSIFIED POSITION OF CITY PROSECUTOR
OF SAID MUNICIPALITY, ESTABLISHING THE DUTIES OF SAID
OFFICE, PROVIDING FOR A SAVINGS CLAUSE, AUTHORITY TO
CODIFY, REPEALING PROVISIONS, AN EFFECTIVE DATE, AND
FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH,
FLORIDA:
SECTION 1: That pursuant to the provisions of Section 23 of
the Charter of the CITY OF BOYNTON BEACH, FLORIDA, there is hereby
created the unclassified position of City Prosecutor~ said position to
be filled by appointment by the City Council, with said officer to serve
at the pleasure of the City Council. Any person appointed to the
position of City Prosecutor shall be duly licensed and authorized to
practice law within the State of Florida.
SECTION 2: The duties and responsibilities of the City
Prosecutor shall be as follows:
(a) To prosecute all cases coming before the Municipal Court
of the City of Boynton Beach, Florida, when requested to do
so by any police official or officer, the Judge or Judge
Ad Litem of the Municipal Court, or the City Manager of the
City of Boynton Beach~ Florida.
(b) To instruct municipal police officials and officers in
matters of arrest, Court procedure and other necessary
practices relative legal execution of their duties.
(c) To perform any other duties required by the Municipal
Judge, Judge Ad Litem or City Manager, which will aid in
the effective administration of justice in matters coming
before the Municipal Court.
SECTION 3; Compensation for the office of City Prosecutor
s~ail be established by'resolutiDn of the City Council.
SECTION 4: Specific authority is hereby granted to codify
and incorporate this ordinance in the City's existing Code.
SECTION 5: Should any section or provision of this ordinance~
or any portion hereof be declared by a court of competent jurisdiction
to be invalid, such decision shall not affect the validity of the
remainder hereof as a whole or any part hereof, other than the part
declared to be invalid.
SECTION 6: Ail ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 7: This ordinance shall become effective in the
manner and at the time provided by the Charter and Ordinances of the
CITY OF BOYNTON BE~CH~ FLORIDA.
