AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, AMENDING ORDINANCE 62-9 OF SAID CITY
BY REZONING LOT 7 AND LOT 11 OF THE SUBDIVISION
OF SECTION 33, TOWNSHIP 45 SOUTH, RANGE 43 EAST,
BOYNTON BEACH, PALM BEACH COUNTY, FLORIDA,
FROM ZONE R-1AA TO ZONE R-$~PROVIDING FUR THER
FOR SAVINGS CLAUSE, REPEALING PROVISIONS, AN
EFFECTIVE D~T,E AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON
BEACH, FLORIDA:
Section 1: The following described parcels be and the same
are hereby rezoned from Zone R- 1AA to Zone R- 3~
Lot 7 and Lot 11 of the subdivision of Section 33, Township 45
South, Range 43 East, according to the plat thereof on file in
the office of the Clerk of the Circuit Court in and for Palm
Beach County, Florida, recorded in Plat Book 1, Page 4;
Subject, however, to the following restrict ions and provisions
which have been agreed to and accepted by the present owners and applicants
for subject zoning change:
(a) That owners shall maintain the same quality and type of
development that they are now constructing in High Point
Apartments #2.
(b) That owners shall immediately dedicate by aPpropriate quit
claim deed a 50 foot right of way to the public from Seacrest Blvd.
westerly to the easterly property line of High Point Condominium
Apartment #4, in conformity with sketch presented to Municipal
Planning Board on proposed plot plan.
(c) That owners shall, at their expense, pave in accordance with
City specifications S. W. 3rd Street from S. W. 15th Avenue to
S. W. 23rd Avenue.
(d) That owners will cause to be a part of any development of the
above described property an agreement which will provide for
joint maintenance by all present or future owners therein of
private road running from westerly terminus of publicly dedicated
r°~dreferred to in paragraph (b) hereinabove to S. W. 3rd Street, a~d
that all costs for the joint maintenance of said street shall~be
included in Condominium Declaration as a common cost of all
owners of apartments developed within the area hereinabove rezon~d.
The Official Zoning Map of the City shall be amended accordingly.
Section 2: Separability: Each of the provisions ~of this~Or~inance
are separable, including word, clause, phrase or sentence, and if any portio~
hereof shall be declared invalid, lhe remaining portion shall not be affected
bul shall remain in full f~orce and effecl.
Section 3: Repealing Provisions: All ordinnces or paris of
ordinances in conflict herewith are hereby repealed.
Seclion 4: Effeclive dale: This Ordinance shall become effective
in the manner and al the lime provided by the Charier and Ordinances of the
City of Boynton Beach, Florida.
