AN ORDINANCE OF THE CITY OF BOYNTON BEACH,
FLORIDA, E~fTENDING THE TERRITORIAL LIMITS OF
SAID MUNICIPALITY BY THE ANNEXATION OF A CERTAIN
UNINCORPORATED TRACT OF LAND CONTAINING LESS THAN
TEN REGISTERED VOTERS, LYING CONTIGUOUS THERETO
AND WITHIN THE SAME COUNTY; TO WIT: A PARCEL OF
LAND LOCATED IN SECTION 5, TOWNSHIP 46 SOUTH, RANGE
43 EAST, PALM BEACH COUNTY, MORE PARTICULARLY
DESCRIBED HEREINAFTER; REDEFINING THE MUNICIPAL
BOUNDARIES; REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES HEREWITH; PROVIDING FOR
AUTHORITY TO ZONING PROVISIONS; AN
EFFECTIVE DATE, AND FOR OTHER PURPOSES.
WHEREAS, the owner of the properly more particularly described
hereinafter have heretofore petitioned the City Council of the City of Boynlon
Beach, Florida, requesting the annexation of certain property lying adjacent
and contiguous to the territorial limits of said municipality and within the
same County, lo the municipal territorial limits of said City; and
WHEREAS, said tract of land contains less than ten regislered
voters; and
WHEREAS, all requiremenls of the charter and ordinances of the
Ciiy of Boynton Beach, Florida, relative annexalion of contiguous territory
have been complied with; and
WHEREAS, the City Council of the City of Boynton Beach, Florida,
deems lhe annexation of subject tract to be beneficial to the municipality and
to the owner of said'tract;
NOW, THEREFORE, be it ordained by the City Council of the City of
Boynton Beach, Florida:
Section 1: Thai the City of Boynion Beach, Florida, hereby annexes
the following-described tract of land to lhe territorial limits of the City of
Boynton Beach, Florida:
Thai portion of the North 1023.0 '.feet of that part of the Southwesl one
quarter (1/4) of Section 5~ Township~ 46 South, Range 43 East lying
West of lhe West righl of way line of the Seaboard Airline Railway.
and the South 330.0 feet of the Southwest one-quarter (1/4) of the
Northwest one-quarter {1/4) of Section 5, Township 46 South,
Range 43 East, consisting of 56 acres more or less, together
with that portion of the right of way of Congress Avenue
. · lying Westerly of said described parcels.
Section 2: That subject property, upon annexation, shall be zoned
to authorize Use for light industry purposes, pursuant to the provisions of
Omdinance No. 62-9 of the City of Boynton Beach, Florida, as amended,
constituting the maSter zoning code of said City.
Section 3: The territorial boundaries of the City of Boy-aton Beach,
Florida, are hereby redefined so as to include the above-described property.
Section 4: Separability: Each of the provisions of this ordinance are
separable and if any section, subsection, clause, phrase, or portion of this
ordinance is for any reason held invalid by any Court of competent juris-
diction, the remaining portions shall not be affected but shall remain in full
force and effect.
Secti~,5:, A-Ltthority to Codify: Specific authority is hereby granted
to codify and incorporate this ordinance to the City's existing code.
Section 6: Re. pealing. Provisions: All ordinances or parts of
ordinances of the City of Boynton Beach in conflict herewith are hereby
repealed.
Section 7: Effective D. ate: This Ordinance shall become effective
in the manner and at the time provided by the charter and ordinances of the
City of Boynton Beach, Florida.
