Introduced Board members to OLD BUSINESS Chairman called for motion for minutes of meeting held April 1, 1970. Mo~ion made by Dx. Manthey to approved minutes~ seconded by Mm. Livingston. Unanimously ear~ied. Minutes approved. Brief discussion was 5eld regarding the new master plan iu relation to zoning end possible restrictions and changes it would create. ~PEW BUSINESS Chaizman stated to the audience that decisions made by the zoning board on zoning requests were not final. He explained that the Zoning Board acted only as a recxmm~a ~ding board to the City Council, which had the final decision on the requests. Chairman then read requests to the audience and the Board, b~inging out the fact that three of the Pameels were on the same street. Parcel 1: Lots 7 and 8 Block 4 g Lake Boynton Estates Address: 728 - 730 N. W. 1 Avenue Request R-! to R-2 Parcel to be used for duplex and single family Applicant: Catherine D. To~g~7 Mrs. To~gc~ came' fo~w. zard to explain he~ request for rezoning was needed to enable her to build a duplex on the proper~y. She stated that there was only one other house ~n the Block, and that she had o%~ed the proper~y one yea~. Chairman called for objections from the audience. Pk~. Evelyn Howell, 647 S. W. 1 Court, Lake Boynton Estates, came forward to state he~ objections, being that this would be a spot zoning, lowering the value of the prope~, as well as T]~e dignity of the neighed. Mrs Howell stated she had the signatures of 75 residents of Lake Boynton Estates on a petition against the three zoning requests on N. E. 1 Avenue. Mps. Howell submitted ~he petition to the Board. Chairman called for ~e~ objections. None wer~ stated. Brief discussion followed regarding zoning of surrounding a~ea. Mrs;~ Frye suggested that this request be discussed after the other two parcels on the same street were considered. D~. Mmuthey made motion that this rezoning request be tabled for the being~ seoonded by Mrs. Frye. UnanL~ously carried. Request tabled. Parcel Lots 1-5 inc., Block 56A Lake Boynton Estates Address: 802 820 N. W. 1 Avenue ~aquest: R-1 to C-1 - Apar~nts in .~.~, at present for use to park equipment and tr~cks. (B) Lots 22- 26 incl. ~ Block 56A , Lake Boynton Estates Address: 801 819 West Ocean Avenue Request: R-1 to C-1 Apar~nmut in future, at present for use to park equipment and trucks. Applicant: Clifford E. Keatts Chairman cmlled for representation of Parcel. No one present at the time. Ch~man suggested the request be delayed for few minutes, due to _Mr. Keatts' absence. Parcel 3: (A) Lots 22,23, and 24, Block 4, Lake Boynton Estates Add~ess: 701 7~ West Ocean Avenue Request: R-1 to C-1 - Ap~ts and Imudscapiug Contr.actor operation. (b) Lots !,2,3,4,5~ Block ~ Lake Boynton Estates Address: 702 ??U N. W. 1 Avenue Request: R-1 to C-1 Apartn~nts and Landscaping Contractor operation Applicant: Benjamiu C. M~. Johnson came forward to explain his purpose for reqUesting a rezoning being primarily for his son's landscaping business equipment. He further explaiued he even~_ally desired to build apartments upon the subject proper~y. Chairman pointed out to ~. Johnson that C-1 was comme~al zoning, not required for apr~ments. M~. Jchnston stated he did not know this and that he had evidently requested the wrong zoning. B~ief discussion followed. Chairman called for objections from the audience. Mrs. Evelyn Howell camm forward restating her objections as submitted to the Board against Parcel ~1, adding that the streets in this area are not capable of handling the increase of traffic that would result from apartments built on the subject proper~y. Further objections were heard fr~m the audience. Brief discussion was held regarding the parking of the trucks and equipa~nt of the landscaping business. Cha~ called for ~ts or questions from the Board n~r~. M~s. Frye asked [~. Johnson if he was plmra~ing on opening a ~iness on the subject property. Mm. Johnston stated no -- that his son only parked his equipment there, temporarily. Dm. M~nthey ccmmented that he had physically looked over the lots and had seen piles of d?.r? on the propez~y and wondered how temporamy this would be'. He ~ated that th~s was in violation of the City Ordinance. M~. Livingston offered that perhaps ~. Johnston had asked for rezoning which he did not really need. Chairman stated that if Mm. Johnstor~as to use this property fora pamkiug tPm trucks and equipment and operating a business theme that he would need C-1 zcmiug. However, the proposed ap~.L~nts would not require C-1 Zoning. Chairmen fure_her explained that there was little eontmol, after property was rezoned C-l, as to what could be b~lt under C-1 zoning. Chairman ~en called for a motion on request. Mre. Frye made motion that zoning request be denied; seconded by Dm. Manthey. Dm. Manthey commented that he did not feel there should be any C-1 zoning in this area. I~. Johnston asked the Board if he could change his request for zoning at this time. Chairman informed him that he would have to apply, again. He ~-tated to Johnston that the Board could only vote on zonzng advertised. Board was reminded of motion standing on floor. Unanimously cazm~ed. Request denied. Chairman then recommended to Mm. Johnston that he re-applY for R-2 zoning. Manthey made motion that Mm. Keatts' request be denied also Livingston seconded. Unanimously ~:~z[ed. Request denied. The Board resined Parcel 1 request at this time for t~s. Tor~ow's request for rezoniug to build a duplex. Dm. Mauthey made re~dation that the request be tabled until the planning Board's reO0nl~endat~ons were completed, regarding ohanges in cemtain areas of the City, which might involve vamious zoning requirement changes in the City's new Master Plan. Reccmmr~ndation made into motion by D~. Manthey; seconded by Mm o Livingston~ unanimously carried. Request tabled. Parcel ~: Lots lS and l~, Block 5, Bc~ems Park Address: ~15 South Seacrest Blvd. Request: R-2 to R-~ to be used as real estate office Applicant: Donald C. Lambe~t Mm. Lambert Came fozwa~d to explain the reason fop his rezoning request, being that since this amea is zoned R 2 to his understanding, the zoning did not allow him to hire employees or an associate or to do any remodeling of the building. He desired to do both of these. He then offered that perhaps the Board would want to table his request as Parcel ~, until the Plauning Board revealed what would be done in this area of the City. Chainnmn called fop objections from audience. Mrs. Allen Castello, ~05 South Seacrest Blvd., came forward to submit a petition oontainiug ~5 signatures of residents to the subj_ect proper~y in opp6sition to the rezoning request, with the feeling that it would'be down~Lin~ the surrounding property. Further objeetic~s were heard. Brief discussion followed. Chai~ made motion that the Parcel be tabled at this time until the Board had heard the results from the Planning Board; seconded by Mrs. Frye. Unanimously carried. Request tabled. Motion made by Dm.
