Motion was made to approve the minutes of the meetings held March ~th, 8th, and 19th. Mr. Allen offered correction to the minutes of March ~ He was ma~ked absent, instead of late. Correction was made and motion to approve the minutes was passed. OLD BUSINESS Dispensed, due to the lengthy agenda of the evening. NEW BUSINESS Pareel A: A parcel of land in the ~,~ 1/~ of Section 32, Township qSS, Range 43 E, City of Boynton Beach, Palm Beach County, Florida, more pa~cularly described as follows: The South 605 feet of the North 951 feet of the East 700 feet of the West 750 feet less the North 200 feet of the West 200 feet of the herein described parcel of land, containing 8.804 acres of land, more o~ less, and being subject to any and all easements and/or Rights-of-way of record. Request: R-1AA to C-1 - for Neighborhood Shopping Center. Parcel A was pointed out on the plan. The floor was opened for ques- tions regalxling this area f~om the audience. -I- Minutes Planning s Zoning Board April 14, 1969 Mrs. Wilcox of S. W. 15th Avenue, Boyntc~, asked why the area proposed for the shopping center was needed. Mr. Echa~te came forward to explain that Caldos feels two shopping areas will be needed to compensate fop the entire area of Leisureville. Mr. Weaver suggested that the discussion of P~cel A be dropped to con- sider request for the property described as: The North ~ne-hmlf of Section 22, Township 45 South, Range 42 East, lying West of the westerly right-of-way liue of equalizing Canal less Parcels A, B' C, D, $ E, as outlined in Public Notice, R-1AA with Special exceptions as provided in Ordinance 68-19 of the City of Boynt~n Beach, Florida, for the construction of single family dwellings, planned unit development under a condc~um cc~cept. Mr. Weaver then read several letters in opposition to the zoniug of this area. He then opened the floor to objections and/or questions from the audience. Mr. David McKay came forward and stated he is a practicing attorney in Boynton Beach and he is representing the Golf View Harbou~ Civic Association, Inc., opposed to the zoning of this area. Mr. Md<ay described and explained the location of the area proposed for zoning in relation to the homes of Golf View Herbour. Mr. Md<ay stated his clients do not feel this is adequate or consideration given to the residents of Golf View Harbou~, and objection is that it is not to the best use of the proper%y. He then read City Ordinance 68-19 in reference to the basis of the Specisl Exception zoning, as in relationship to that requested by Caldos. The question was raised by Mr. M~ay as to whether Caldos owns the property or if it is under contract for purchase. He then read the requirements The citizens of Golf View Ha~bour request of Caldos: !. Increase of the buffer strip. 2. The homes will not degrade the property in Golf View Harboum. Some form of assurance from Caldos that there will not be any multiple story buildings in this area (such as the apartment buildings planned for the Lake area)~ ~. R-1AA regular restrictions to be 500' North of S. W. 23rd Avenue. Mr. McKay also read petitions from the individual proper~ owners in Golf View Harbou~ in objection to the rezoning of this area.. Mr. David White, a resident of Golf View Hambour came forward to express his objection to Caldos' request for zoning of this area. He stated that the fact that the density of Leisureville is being doubled is not in accordance to the present zoning of this area. The question once again was raised regarding whether the pr~ is actually owned by Caldos. Caldos stated that the properdry is now under contract to be purchased. Mr. McKay came forward to submit a formal objection to the zoning of this area for reasons that Caldos does not presently own the property. Mr. Weaver stated that it is not unusual for someone to request a zoning change without owning the property. He stated further that if the present owner of the property came forward with the proposed purchaser to request Special Exception, that the formal objection could be over- ridden. Mr. Weaver asked the Board if, since this was a legal tech- nicality, they would like to adjourn the hearing until advice from the City Attorney could be obtained. Mm. Sarmo requested a 5 minute recess for a conference. The meeting was recessed at 8:40 P.M. The meeting was called to order agm~n at 8:45 P.M. by the Chairnmn. Mr. Weaver stated that the Board did not feel competent enough to answer the questions raised. Invitation was made to Caldos to state their case at this time. Mr. Earl Owen, Engineer for Caldos, came forward and said they would like to think over mhd discuss the points made by the residents of Golf View Harbour. He stated that possibly a satisfactory compromise could be reached within l~ weeks. Mr. MeKay then came forward to renew the formal objection submitted by Golf View Harbour, Mr. Weave~ a~ked for a notion to move the discussion to the meeting of the Planning g Zoning Board in two weeks (April 28). The motion was made by Mr. Allen, seconded by Mr. Sarno and by Mm. MacAlpine. Unan- imous ly carried. Parcel 2: That pamt of the South half (S 1/2) of the S. W. Quarter (S.W. 1/4) of the S.W. Quarter (S.W.1/4) of Section 27, Township 45 South, Ramie 43 East, lying West of the Florida East Coast Canal right-of-way, Less the South 50 feet thereof for Road Right-of-way. -9- Minutes Planning g Zoning Board April 14, 1969 Request: R-1AAto C-1 - to be used as a shopping center Applicant: John H. Adams and John B. McKee, Jr. Location: 631 - 691 S, E. 15th Avenue. Mr. Adams came forward and stated that he is the attorney for the prospective ptmehasers of this property. He put plan of the pro- spective propert~ on the board. Mr. Adams described the location of the property~ giving the dimensions. Mr. Sarno asked for another way of access to the property other than the one shown on the plan. Mr. Adams said he felt the access could be moved further East, along 15th Avenue to avoid creating a traffic hazard. Mr. Sarno asked about the number of units to be in the proposed buildings, in relation to parking area. Mr. Adams stated any changes necessary would be made to comply with building and zoning regulaticns. Mr. Weaver opened the fn~oor for question~ from the audience. Various residents of Lee Manor Isles expressed their objections to the zoning, based upon the rezoning would spoil the area as strictly residential property. Protests were also submitted from residents of Ocean Ridge. Lengthy discussion was held concerning these points. Mr. Weaver called for a motion on tJmis subject. Mr. Sarno stated he did not think the Board could change the zoning completely, without clarification of the use of the property. Mr. Sarno made motion that the request be denied. E. llth Avenue Arlene Miller Mr, Ezell Hester spoke for Mrs, ~iiller, Mr. Hester explained the conditicas and location of the property in relation to the surround- ing properties.
