90-BBB RESOLUTION NO. 90-~~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, IMPLEMENTING THE "FLORIDA CLEAN INDOOR AIR~ ACT~!~,~r~ 'ADOPTING THE PROVISIONS THEREOF, DIRECTING CITY" ADMINISTRATION TO DEVELOP, IMPLEMENT, AND POST A POLICY REGARDING DESIGNATION OF SMOKING AND NON-SMOKING AREAS; PROVIDING FOR AN EFFECTIVE DATE, AND FOR OTHER PURPOSES. WHEREAS, the State of Florida has heretofore enacted the Florida Clean Indoor Air Act, Chapter 386.201, F.S.; and WHEREAS, the Act defines public place to include indoor areas used by the general public in governmental buildings; WHEREAS, the City Commission acknowledges the purpose of the Act is to protect the public health, comfort and the environment by creating areas in public places and at public meetings that are reasonably free from tobacco smoke; and WHEREAS, the Florida Clean Indoor Air Act provides for the designation of smoking areas providing a policy for implementation has been developed by the person in charge of the public place; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO~H~ISSION OF THE CITY OF BOYNTON BEACH, FLORIDA: Section 1. The City Commission of the City of Boynton Beach recognizes and supports the legislative intent which was the basis for the Florida Clean Indoor Air Act. Section 2. The City Administration is directed to develop, implement and post a policy regarding designation of smoking and non-smoking areas in accordance with the requirements of the Florida Clean Indoor Air Act. Section 3. It shall be the established policy of the City that no person may smoke in a public place or at a public meeting except in designated smoking areas. PASSED AND ADOPTED this / )90.
