Mr. Wertz opened the meeting, and advised the purpose of this meeting is to
consider so:e requirements for change in zoning covering four contiguous
parcels of land in the western area of Bolcnton Beach. (The August 6th
regular meeting of the Planning ~ Zoning Board will consider the proposed
Amendment to Ordinance 62-9, establishing D-1 to allow a special one family
condominium district in a project o~med by separate c~eners and recreation
areas held in comnon by all ovmers, on a lease basis.)
Mr. Earl Owen of Brock~my, Owen ~ Anderson, came forward with a layout to
show the members of the Board. He advised that while waiting for }~r. King
and ~r. Echarte to arrive, he w~uld explain the layout of the whole plan to
the Board.
Lengthy discussion held by the members of the Board and ~. Owen.
They plan to have 2,250 lots. Smaller lots 5%. Larger lots are in the
majority. Approximately 55% of the land area of the whole development will
be in homes. The layout is taken from "Leisureville'~ in Broward County.

The Comnunity A~sociation approves all trees and shrubbery that is installed.
Recreation areas are not deeded to anyone, they are ~,tu~ed by the developer
and they are leased. A person ~,muld obtain a lease to the recreation area
on a fractional interest. ~.~aintenance charge covers *fo. is particular fee
area. It does not include his own individual taxes, liability, insurance,
etc. on his house.
Nr. %~ertz: %~at is the length of the lease?
Mr. IMorrison: 99 years.
Mr. King: The larger homes, orthe most expensive homes, actually we are
selling more of these than the smaller homes; average price is $15,500..00.

Declaration of restrictions cover all lots. Cost of maintenance, such as
grass cutting, etc., control!ed by the Association and each person purchas-
ing a home beco~s a men~er of the Association. It has aboard of Direc-
tors elected ~ually. The Board is responsible to the owners. Deed
restrictions provide for the resale and leasing. No children under 16
years of age to live on the premises. Visits ar~ allowed.
Mr. Wertz: Mr. King, is there anything you or muyone else in your party
wish to discuss with us at this time?
Bit. King: I c~u tell youwe are going to make a beautiful development out
of it.
Mr. Wertz: The Plarming & Zoning Board has requested funds from the City for
the purpose of hiring professional advice. It is only through the present
Council that we have been granted the services of Mr. Dake for the future
plarming of the City. The contract is of such a nature that he will be taking
quite a bit of tim~ for his study. At our last meeting, Mr. Dake outlined
the steps he was going to take. He advised the Board that if it could
possibly be done, that any requests for changing .in zoning be deferred
until his land use study was completed. Mr. Weft';. advised he talked with
Mr. Dake on the telephone and discussed this request with him. ~4r. Dake
confirmed the 'phone conversation by letter - which Mr. Wertz read to those
present, Lu which Mr. Dake advised the Board to proceed with caution. It
· s very important that the subdivision be developed with the planner's help.
It would be to the best interest of the City for us to work with the develop-
ers and the Council, etc. His charge would be $150.00 per day plus
expenses ....
Mr. King: I believe you are at the end of your budget year now. We Would
like toworkwith the City on our plmnning and, if possible, our Company
would be only too happy to reimbu~zse the City for extra funds on this contract
and we would reimburse the City fora ny expenses by Mr. Dake.
Mr. Wertz: It would sound to me that something could be vorked out as you
suggest and tbmt the City might be able to extend its contract with Mr. Dake
to start this promptly.
}~. Ward: I think it is a good idea.
Col. ~ehrell: I think this could be a shot in the am ~hat Boynton Beach
could stand. It shouldn't be a matter of a long periodof time for ~5-. Dake
to see whether it is a good plan or not. I ~ink it could be done expedi-
tiously. If fl~e developer would foot the bill, it would be very good.
~r. Weaver: I have been on the Board for a long time and have been urging
that we get a Pl~nnerand revise the plan. I believe time is of the essence
in this type of thing. We should facilitate the study ofthis proposalwith
all possible speed, even to the point of having extra workshop day or night
with the Board to workon it and I think we all h~vehadenoughexp~erience
and knowledge to help on it, wit2~ just one or two conferences witth~.~. Dake.

We should ask the City to cooperate with these people and ask ;ir. Dake to
rush in a~d see what can be done as soon as possible.
Col. Wehrell: This, if approved, may be a fine thing and pretty well set,
in my opinion, the future development of Boy~.ton Beach as a community
depends on being able to annex...
Mr. King: Our time schedule, everything permitting, we hope to start with
the groundwork September Ist and that is what we are looking ahead for, so
if ~{r. Dake could be called in promptly, it would be greatly appreciated.
Yin. Wertz: Our next regular meeting is August 6th and before then, we
hope the City Father's will see fit to invite him to spend more time on
this particular project.
Mr. King: We will be glad to give the City a letter from_ the developer
setting forth the financial situation mentioned .tonight,
Mr. Mcklpine: We should consult ;~'~. Dake and as ~4r. }~eaver brought out, as
soon as possible, to formulate something and work in conjunction ~th t_he
Board, developer and Mr. Dake, to see if we can't proceed on this as soon as
possible, not only for ourselves, but for the developer.
}{r. Gallo: The Council is quite interested in tJ~.e development. I asked ~4r.
Dake be given a copy immediately, and prior to hearing from Mr. ~ake, he
should possibly complete his overall study of the land, etc. Mr. Courtney
contacted Mr. King prior to this meeting; they would agree to pay the extra
expenses to keep Mr. Drake on and expedite this, as we would like to move in
accordance with ~{r. Dake. Now it is just a matter of meeting together with
Mr. Dake, to see if we can meet your deadline, lhe Broward County Ordinance
will have to be studied.
B{r. Courtney: Mr. Dake indicated to me some time ago, this type of con-
struction would fit in. I think he wants to be in on the design to fit it
in with the surrounding area. He has given me the idea that if the design
is proper, he might approve this situation. If there was a question as to
his approving this type of zoning, he ~ould have some hesitancy, but there
is no question in his mind, from talking with him.
Mr. Wertz: Would the Council need a letter, or will these minutes be enough?
~4r. Courtney: ~{e would like to have a letter from the Board.
Mr. kreaver .moved we send the Council a letter, as to the recomnendation of
the Board, that }.ir. Drake be brought in to aid in the future planning of this
area, with possibility of a change in the zoning for the area. Seconded by
CoI. Wehrell. Unanimously carried.
