Chairman Olds opened the meeting. There was a quorum present.

Mr. Weaver moved that the minutes of the last meeting be accepted as

Mr, Claud Dean Hamby, Presiding Minister of Boynton Beach Congregation,
261 N.W. 28th Avenue came forward. He advised the property consists
of four (4) lots-. If request is granted they would like to get started
right away.

Each lot is 65' x 100' - 26,000 square feet,
Mr. Olds: Under the Ordinance there is supposed to be an acrea for a
church. On Page 6 of the Code it states ~'...educational building~
churches and accessory uses fo~ minimum site of one acre and said lot
shall have the width of 100~''.
Mr. Hamby: We don't need an acrea~ we have the plans for the building
and parking and if we had an ac~e it would be over what we would need.
Mr. Weaver: I have the feeling that this application has been made
before the wrong Board. It should be made before the Board of Adjust-
ment instead of this Board. We can't recommend something that is
contmary to the Ordinance.
Mr. Olds: I checked this out before the meeting. Mr. Olds read
further from the Code.
Mr. Weaver: There is some acreage East of this property, is there any
chance that your organization would be interested in that property?

Mr. Hamby: We had not thought of purchasing anything else as we have
enough for what we would need. We have checked for over a year trying
to build in a R-2 zone and there is none available that we could afford.
We figured this property would be suitable. 2500 sq. ft. - 70 x 35
with parking: place for 100 chairs in accordance with your requirements.
To buy an acre is going to run into considerable amount of money.
Mr. Weaver~ You should bring this before the Board of Adjustment re-
questing a variance on this property.
Mr. Olds: Anyone else in favor of this request? No one came forward.
Mr. Olds: Any objections to this request? No one came forward.
Mr. Weaver moved that we recommend that conditional use of this land
be granted subject to the hearing before the Board of Adjustment to see
whether or not a variance could be allowed in accordance with Paragraph
2 on Page 6 of the Ordinance. Seconded by Mr. Doughty. Unanimously
cart led.

Owner: Lottie Linton
Mr. Charles Rosier who contemplates building apartment for Mrs. Linton
came forward and advised this is the house that caught fire and we
are going to destroy it and build the new apartment on that property.
Col. Wehrelt: I have been up there and regardless of the fact that it
had been rezoned to R-1 the general situation up there is apartments.
I don't see how anyone can expect to build a single family house almost
completely surrounded by apartments. I feel that it is very hard on a
person to stick to the R-1 zone in that general vicinity as much as I
hate to change zoning at any time.
M~. Rosier: The lot is 50' x 150' - four apartments - it is not going
to have a flat roof; it will be a gable roof. Everything will be in
accordance with the City regulations and requirements.
~fr. Fuller: They will have to go before the Board of Adjustment on
the front width.

Col. Wehrell moved that this application be approved subject to the
contractor or petitioner complying by all ordinances in the City per-
raining to that particular subject. Seconded by ~. Doughty. Motion
carried by 3 to 1 vote, Mr o Weaver abstained from voting.
Mr. George Claeys speaking on behalf of the Kislak Agency in Miami~
came forward, Lots in front of these particular lots fronting on
NoW. 2nd Avenue are currently zoned C-1. Due to condemnation several
years ago the State of Florida acquired 7~ to 8' for future road use.
It is our intention to develop this property with sufficient off street
parking whereas ~ne front lots are 100' and with set back requirements
it would not allow sufficient land ~rea for the development in the
future. The Miami Herald indicated that the Bureau of Public Roads had
set aside certain monies and possibly start construction of 1-95 from
Okeechobee Road to ....
Col. Wehrell: Is there any immediate plan to do anything?
Mr. Claeys: Development will be based on the letting of the contract
of 1-95. One individual is interested in acquiring lots owned pre-
sently by Tobin g Tobin of Miami: Fla. One individual wishes to acquire
both parcels for development.
Mrs. Harriett Bouton, 121 S.W. 5rd Ct. came forward. What are they
going to build there before it is rezoned? If it is a condominium I
woUld object strenuously.
Mr. Claeys: We are attempting to acquire additional property and a
number of the lots involved are in estates and it requires a great deal
of work to acquire 600' on N,W. 2nd Avenue by approximately 200~ deep
less whatever rigllt of way that the State required several years ago.
Col. Wehre!l: Where is S.W. 3rd Court?
Mrs, Bouton: I own property on 6th Street and that is why I am here.
Discussion held.
Mr. Weaver moved that the petition be granted. Seconded by Col.Wehrel!.
9~, Doughty: Do you intend to go West and get the whole block?
Mr, Claeys: That is our intention - Yes.

Mr. Olds advised there was a telephone conversation to City Hall
April 24th with City Clerk requesting rezoning to R-SA.

Location: 624 N.E. 8th Avenue
O%~mer: Forest R. Hangge
Mr. Olds: Mr. Hangge it is the first lot East of your - and your plan
is to build more units - be considered for the use of motel only?
Mr. Hangge: We want to use it for 5 units. 4 units 15 x 30 and 1 unit
20 x 42~ actually 1 building. Lot size is 50 x 135 (67750 sq.ft)
building coverage 2~5~.0 - we would have credit of 755 sq. ft. we would
not be building on.
Mr. Olds: I might say that you are aware of spot zoning and that is
what this is.
Mr. Hangge: It wouldn't be going out of line any. In other words when
the building is completed the setbacks and everything else would con-
form with the present building. 25' front and we would go back 55' the
same as it is there now. We have 15 units at the present time and we
have never been short a parking space. We are asking for 5 units on
this lot and we would arrange for 5 spaces to cover this - all paved.
Col. Weh~ell: Has this ever come up before? When the original piece
was zoned R-5, I seem to remember some comment that this lot would be
left to provide a buffer zone between this house and the apartments.
Mr. Hangge: I think we have proved ourselves up to this time and we
don't have children or young people. We cater to elderly people only.
Mr. Olds: Anyone else in favor of this? No one came forward.
M~. Olds: Anyone opposed? Eleven (!t) people in the audience were
opposed. Mr. Olds read a lette~ opposed to the zoning change signed
by William S. Williams and Thelma Williams of 655 N.E. 8th Ave. He
also read a letter from Lillian J. Varcoe, RFD 5~ Midletown7 New York
owner of Lot 187 Block 5~ and she opposed ~he change. Also a petition
from Lake Addition Association stating R-lA is for one family only
and that they were opposed. It was signed by ten (10) residents and
most of the members were husbands and wives.
Mm. Alfred Bowen7 627 N.E. 8th Ave. came forward. The Lake Addition

Association objected to this befome and the City and the Zoning upheld
it~ We would have a lot of noise, believe me. A high-raise would not
be objectionable~ but we do have objections to any additions to the
Motel. We ~ as Lake Addition Association members have about 35 to 40
membems who live behind the Motel, opposite it and East of it.
Mms. Ada Shook~ 643 N.E. 8thAve. In 1964 when he asked to have this
changed the first time he assured us that he had no intention ever to
build on this. We all objected strenuously to any additions~ He ~ow
has 9 efficiency and 6 sleeping rooms. He doesn't even live in Boynton
Beach~ but we do and we %~uld like to keep it the way it is.
Discussion by the Board.
Mr. Weaver: As I said heroine, this is spot zoning and I am opposed
to it.
M~. Weaver moved that the request be denied. Seconded by Col. Wehme!l.

Mm. Olds: I think we now have a City Plannem (Mm. Dake) and I thought
we might know more about this tonight.
