OLD BUSINESS There was no old business. ~ BUSINESS Parcel 1: West 1/4 of S.W. 1/4 of N.B. 1/4 less W. 10' and also less B.180' of N.235' and less E.180' of S.210'; ac. sec. 28-45-45, Palm Beach County records. Request: Location: (~ner: R-L~ to R-2. Bounded on the south by S.I?. 6th Avenue on the north by S.~'t. 2nd Avenue, and on the west by extension of S.W. 1st Street. Duplex and multiple family ua. its. David J. ~olfe (Acadia Developers, Inc.) ~{r. Brophy came forward and advised that the owners plan duplex and hope- fully eight unit, high type, apartments. ~!e stated that today, throughout Palm Beach County, there is a demand for these nice type apartments, for retired people also for those who have not quite reached retirement age. He pointed out that the !~/olfe family have o~med this property for 44 years and paid taxes on it for that length of time. Due to t,.~r, t~folf's ill health, back in the 50's, he was not able to build on this property. Now that his health warrants, he would certainly like to build. }~. Olds asked and was told, that S. W. 1st Street would be extended when this parcel was platted. Mr. Brophy stated that the streets would be provided by the developer, and that the City would not do this. If this zoning is approved, the developer plans to appear before the City for replatting ofthis parcel. -]- ?Snutes of the Planning ~ Zoning Board ?~eeting April 2, ]968 Mr. Olds talked about R-2A zoning, which allows sJ3~gle family, dUPlex and multiple family dwellings (maximum 8 families per principal u/alt) amd thought that this higher zoning would incorporate their needs and would not be as objectionable to the residents. He asked if the developer would be willing to accept this zoning. Mr. Brophy said he would recommend this to ~r. ~'blfe and his family, and thought it worth while to think about. ~r. Ward Cunmings of 100 S. l~f. 2nd Avenue came forward with pictures of buildings that he has constructed and stated that the majority of them are very close to City Hall. He had presented a part layout of the Wolfe property to scale; lots lying on S.W. 5rd Avenue and running to S.W. 2nd Avenue. He stated that only three 8 unit buildings could be built on this layout and that 1st Street extension is planned. The apartments planned are actually higher zoned, because no children or pets are allowed. This also automatically elimdnates younger couples and the people who rent in this particular type of construction are o!der people and very much like you peopIe here tonight. Apartment buildings are mortgaged for 20 years and at the end of 20 years, there is a pretty good bet they will be kept up from then on. In the City of Boynton Beach, R-2 zone is practically exhausted. The demand of the times is for condominum apartment type dwellings; single family homes are not in need at present. .The plan was presented to the audience at this time, and explained in detail. Mr. Gil Brophy requested to reserve one witness for rebuttal. ~:~. Olds read one letter from a tJr. ~ Mrs. Gerald and Ethel Williams who were opposed to *abe R-2 zoning. Robert Benson of 156 S. ~L 6th Avenue came forward and asked the difference in zoning be~,een R-2 and R-2A, should the zoning be changed. Mr. Olds explained the difference. ~. Robert Benson presented a petition with 89 signatures and a notation from Rev. Douglas Smith, of the Presbyterian Church. He read the petition first and advised that there were 8 of the church members who were also opposed. Harry Themas of 212 S. W. 6th Avenue came for~mrd in opposition, stating that multiple dwellings would depreciate the properties. Cornelius Fisher of 129 S. W. 6th Avenue came forward, advising he purchased his property about 2 years ago, after checking on the zoning of his property and before purchase. He objected to the rezoning, stating that if ~_r. Wolfe wishes to build one family homes, he is sure he won't have any problem in selling them. They are in demand in this area. Oakley Smith, Sr., 208 S. W. 3rd Avenue came forward. He purchased his property about four years ago and had his home built there and he wants to see it kept that way mud objects strenuously to any apartments being built there. Jacob Himpelmamu of 111 S. W. Sth Avenue came forward, not objecting to duplexes etc., but the fact that once this sort of project is started, it gets out of control, therefore, he objects to this kind of construction. - 2 ~finutes o£ the Planning B Zoning Board ~eeting April 2, ]968 Bill Yates of 722 S. W. 27th ~ay came forward and advised that he had been in Boynton Beach about 10 years as a realtor and stated that this type of construction definitely is the only real solt~ion to this tract of land. If this was built, it would take care of t~he dead end streets and also the sku~.l? that?{r. Jacob Himp_elmann spoke about. The trend is heavy towards rentals in Boynton. They bring in more taxes than vacant preperty. It was zo~-~ed at one ~ime for smaller ~omes, and he is very much i~ f~avor of this rezon~ng as he thinks it would help the City and also the people living in the area. In all probability, retirees like yourselves, will occupy t~e aparments. ~,~r. Olds stated that R-lA was applied to this tract only as a "holding zone" and the property will have to be used in the very near future. .~. WehrelI asked ~. Cuumings if the apartments will be primarily rentals or condominums? ~. Cummings replied that on the h.Zorth side, they would be rentals. Condom- inures have been requested, but has no idea at this time when they will be built. Rebuttal Wiriness, ~rs. Rachael Bethea of 122 S. i~. 4th Avenue came forward and advised that she had prepared a written statement, which she read and signed, before presenting to the Board. Statement attached hereto and made part hereof. Mrs. Benson, who was mentioned in the above statement of ~rs. Bethea's,came forward and admitted she mentioned t~he things in the statement to ~rs. Bethea, but did not repeat them to anyone else. ~r. Charles Bethea came forward and advised that the statement submitted by his wife was true, and confirmed that P~rs. Benson did tell ~irs. Bethea just exactly what was in the written statement submitted. ~4r. Doughty asked I?!rs. Bethea if she was for or against the rezoning in question. Mrs. Bethea confirmed that she was in favor of the plan presented. ~.ir. Olds requested a motion from the Board. ~r. Weaver advised that in his opinion, this could not possibly be granted without assurance that these streets and utilities would be built. No building should be allowed until after all the streets and utilities are in and dedication is made. Only then, would he be in favor of granting this zoning. M~. Weaver moved that after the City is satisfied that the streets, water and se~er will' be installed and completed, then the R-2A zoning be granted, but not until 'then, Seconded by ~.tr. ~cAlpine. (~. ~.4cAlpine advised that the problem of children in the area, the problem of having dead end streets, the problem of skunks will pretty much be solved. B!r. Doughty advised he would like to have some of the rights of the people in the City considered and a line drawn somewhere. Property is bought in good faith and with spot zoning, what is there to protect these people? To consider a property owner is as important as to consider a developer. b~r. Wehrell asked that a plan of actual layout, construction, streets, utilities etc., be sub~rdtted to Board for better consideration. Discussion followed. ~,~,~. McAlpine withdrew his second to Mr. Weaver's last motion. B~r, Weaver withdrew his last motion. I~. Weaver moved that the R-2 zoning request be denied. Seconded by Mr. McAlpine. Unanimously carried. Request denied. Discussion held on possibility of the Board ruling tonight on the R-2A zoning. Mr. Olds advised that if the Council does not see fit to act on this, it could be brought back before the Board again. ~.~. Olds advised that the City has had an opportunity to talk to 2 different planners, and are seriously thinking of updating the master plan. Me believes the Board members have letters, one from Mr. Gerald Dake, and another from Mr. Brutt. ~r. Dake, he stated, will try to work within the City's budget, and also stated that he had originally worked with ~4r. Simon, the original plc~uner. Mr. Weaver confirmed that Gerald Dake would do a good job. ~. Wehrell agreed with ~-~. Weaver, that what Mr. Dake would provide, is what the City needs at present. gr. Olds brought the Board members up-to-date on the cen~ersation taking place between hLmself and ~'~. Brutt of Ta!lahassee, the 2nd planner. Mr. Weaver commented on the many accomplishments in the City since 1960-1961, stating that the City at present has problem of rebuilding certain streets, due to neglect on-contractors part sometime back. }~r. Weaver moved that the Board recommend the Cotu~cil consider Gerald Dake Associates to be hired as the ~;mster Planner. Seconded by ~r. Wehrell. bhanimously carried. ~r. Wehrell said that it was his understanding the Planning Board was to be considered in the I-9S access road problem planning, and suggested that the Road Board, the Council and Planning Board get together to see what can be done. ~4r. Weaver told the Board that the Dolray Council was in favor of the I-gS access by a vote of 5 to 2, and that Boca was planning to go to Washington on this subject. It was his feeling that the roads be supplied by the City, but th. at it would be asking too mud~. the construction of a bridge by the CiZy. ~&r. Doughty brought up the tax situation for Boca, Delray and Boynton Beach. Discussion held by the Board. ~r. Gallo advised that he wants to see the road completed. He suggested a joint meeting to see if bare necessities could be met. At one time, they were considering N.PL 17th Avenue and now there is talk about a switch to N.W. 22nd Avenue, extending to the Trail; probably should only go to Congress Avenue for the present. Discussion held bM the Board. ~r. Doughty told of hearing that }~.~. t.~,L 2nd Avenue would take the place of either N.~. 17th or 22nd Avenue. ~r. Weaver ~oved the meeting be adjourned.
