Federal Highway Owners: Joseph C. Lotto & Philomen~ Lotto N 110' of S~ of Sl~¼ of S~j¼ lying East of U.S. Highway #1 and ~est of Intraco~sta~ ~5S, Range ~3E -~aterway, Section 27, Township Request: R-1AA to R-3A Address: 1402 S. Federal Highway Owner: Edwin j. !~estphal & Lydia P~estpahl S. 208.5' of N. 318' of S~ of S~¼ of ~J¼ lying East of U.S. Highway #1 and ~est of Intracoastal Waterway, Section 27, Township 45, Range 43 Request: R-1AA to C-1 Address: 1412 S. Federal Highway Owner: Edv~Lu j. ~estphal & Lydia Westphal Mr- Wertz noted that this matter was tabled at the last meeting and will be reopened at this time for action. It was stated that ~r Simon had not been contacted for advice on this matter. · ~- ~Jeaver noted that it was suggested that if possible the two opposing sides discuss it among themselves and see if they could arrive at a satisfactory settlement as to making part of this change, but it appears that everyone opposed before is still opposed and everyone in favor is still in favor. ~- ~eaver noted ome change in the Plans, that is, the food store location h~s been changed. It has been moved to the area that is now C-1 rather than the area that is up for change. Mr. Tergeson came forward and explained further about the relocation of th~ food store. -1- Planning & ZonLug Board Meeting July 7, 1966 Mr,, ~Yemec, attorney for those property owners abutt~ug this area to the north, spoke and restated his objections as before and said that no one had changed their mind about opposing this rezoning. Mr. Nemec read a jectingletter frOmto this~J~r' rezoning.Harringt°n with a Statement signed by 34 persons ob- Mr. ~e~ver answered two of Mr , 15 day's notice is no~ --- . · .Nemec s legal objections. ~ ~'~qu~red for Plarming He stated that just for City Council meeti ~ ~ & Zoning Board meetings within the 3~O~~om~ ~ no~ ' ii'ication~ ngs, and~ also that the Lotto property is not ~{r. Paul Harrington came forward and stated he had received a call from ~r. I,o~y, who is in Michigan and is a property owner in this area, voicing an objection to this rezoning. Mr. ~ertz read letters of protest from Samuel and ~rene Duff, M. ~issel, A~ R. Leibenherger and Fred D. Boyd ~ud Mrs. Bo~d. A discussion followed. Mr. Patrick stated that there ~eems to be a large amount of Too commercial property still vacant in much commercially zoned oronew+~ ....... t.hat general area. the other hand, he did not p4~t~~.~thb.~ damagxng ~o a city. He said the llO' is not deep enough to do ~mythiug decent w~-th an R-3A zonLng in that area, altho it is conceivable that it could lend itself to a high-rise in the fairly near future. He stated that he f~lt that after the bridge is complete and 1-95 is in that this whole street ~*lll go commercial at least from the Zntracoastal to i-95. However, ~,~.
