Mr. Weaver moved to waive the reading of the regular minutes of January 6, 1966 and accept them as written. Mr. Olds seconded and it was unanimously carried. Mr. Wohlleb read the minutes of Special Meeting held January 20, 1966 at The First Bank of Boynton Beach. Mr. Olds moved that they be ac~cepted as read. Mr. P~eaver seconded and it was unani- mously carried. OLD BUSINESS Mr. Kain gave the Board some maps in connection with the proposed 1-95 and stated that Mr. Grootenboer and Mr. Blanchette could project on these maps the interchanges at 2nd Avenue and 15th Ave. Mr. Wohlleb stated that the business of 1-95 would be discussed further at the end of the meeting. NEW BUSINESS Parcel l: Lots 21 and 22 and a tract 260.04' ~1~3.96' lying south of Lots 21 and 22, Gay Mar Estates Subdivision as recorded in Plat Book 24, Page llO, Palm Beach County Records. Request: Approval for conditional use as a church Location: 138 S.E. 27th Avenue Owner: Florida Conference Association of Seventh Day Adventist Church No one spoke in favor of this request and no one spoke in opposition. Mr. Weaver stated that this site was intended for a church from the beginning, and moved that the request be granted. Mr. Olds seconded and it was unanimously carried. -1- Regular Meeting Planning & Zoning Board February 10, 1966 Parcel 2: Lots 7 and 8, Block 5, Palm Beach Country Club Estates as recorded in Plat Book ll, Page ~3, Palm Beach County Records Request: C-1 to C-2 Location: 126½ N.E. 10th ~venue Owner: Leon M. Weekes and Edward B. Cooper Mr. Wohlleb stated that applicant wants to use one room in the store known as 126½ for a pool room. Mr. Leon M. Weekes, 273 N.E. 6th Avenue, Delray Beach, came forward and spoke in favor of this request. He stated that they wanted to put a couple of pool tables in one room in this store and felt that this was in conformity with general business conditions in the area. He also stated that there would be no liquor sold and that it would be used strictly for a recreational facility. No one spoke in opposition~ Mr. Patrick stated that there are several pool rooms in the area being operated in C-1 zoning and that the intent of C-1 zoning on No E. 10th Avenue is to keep it upgraded. He felt the real problem is getting a variance in usage for a pool room, and that this could probably be done by a request to the Board of Adjustment which this Board could recommend approval. Mr. Weaver stated that he was ~uclined to agree with this recommendation. Mr. Patrick moved that the request be denied and that the Planning Board recommend to the Board of Adjustment that a request before it for a variance be approved for use as a pool room. Mr. Wertz seconded and it was unanimously carried. Parcel Lot 6 and Government Lot 9 less the N~O' thereof and Lot lO less State Road #9 right-of-way, Acreage Section 33, Township ~5 South, Range ~3 East as recorded in Plat Book l, Page ~, Palm Beach County Records. Request: R-iAA to R-3A Location: 1901 South Seacrest Boulevard Owner: Harbor Hills Inc. Mr. h~ohlleb stated that this is a request for rezoning to build a con- dominiumapartment complex. Mr. Jay Sarno, a builder in Boynton Beach, came forward to speak in favor of the request. He presented the Board with a plan for the pro- posed project and stated that it would be a great asset to Boynton Beach. He stated that buildings will cover only 17% of the land and that the rest can be landscaped and that there will be complete off- street parking. The buildings consist of eight units each and there will be pools and club houses throughtout the program. -2- Regular Meeting Planning & Zoning Board February 10, 1966 Mr. Patrick asked if Mr. Rose, the owner, had plans for a road between 15th and 23rd Avenues, and if they Will be private roads or public roads. He also asked if it is necessary for the entS~e area to be re- zoned R-3A. Mr. Weaver stated that he felt some through traffic should be provided so that the people who live on 23rd Ave. will not have to go on Seacrest. Mr. Sarno stated t~t he felt this would he no great problem to Mr. Rose to provide a north-south road through this area. Mr. Weaver thought they should have a proposal from Mr. Rose as to where this through road should go, or a proposal from the city, and that it would not have to be constructed until it is necessary for the development. Mr. Sarno stated that he would like to consult with Mr. Rose to see if R-2A zoning is all that is necessary. Mr. Wertz stated that it should be determined if all property owners withLn 300' of this property have been notified. Mr. Weaver moved that this be tabled until the next regular meeting so that the Board can get some understanding back from Mr. Rose and Mr. Sarno on the problem of a through street. Also Mri Sarno could check to see if R-2A zoning is as satiSfactory as R-3A zoning. Mr. Olds seconded and it was unanimously carried. To consider proposed amendments to master zoning map and plan as adopted by Ordinance 62-9, previously amended, relative to rezoning that particular area of Boynton Beach bounded on the South by N. E. 3rd Ave., on the East by the F.E.C. Railroad right-of-way, on the West by N. E. 3rd St. and on the North by appro×~mately 165' South of N. E. 10th Ave., more particularly described as: Lots 18 to 29, Lots 44 to 67, Lots 90 to 113, and Lots 145 to 150, all inclusive, Arden Park Subdivision as recorded in Plat Book 2, Page 96, Palm Beach County Records. Request: C-2 to M-1 Lots 151 to 153, both inclusive, Arden Park Subdivision as recorded in Plat Book 2, Page 96, Palm Beach County Records Request C-1 to M-1 ' Lots 154 to 156, both inclusive, Arden Park Subdivision as recorded in Plat Book 2, Page 96, Palm Beach County Records Request: R-1 to M-1 ' Mr. Wohlteb noted that this motion was passed at a special meeti~ held by the Planning and Zoning Board. Mr. Ed Duffy, l~O No W. 22nd Ave., came forward and stated that he was representing the Industrial~ Board and that they are fully in favor of this rezoning. -3- Regular Meeting Planning & Zoning Board February 10, 1966 Mr. Thomas Dean, 3&5 N. E. 9th Ave., came forward and spoke in opposi- tion to this request. He stated that he wanted lots 151 through 156 zoned for apartments. Mrs. Hartley, who owns lots 15& and 155, was in the audience and she was in accordance with Mr. Dean's objection. Mr. Weaver made a m6tiOn that the change be recommended, eliminating lots lying north of N. E. 9th Ave., that is, Lots 151 through 156. Mr. Olds seconded and it was unanimousl~ carried. Mr. Wohlleb told Mr. Dean if there is a~ need for rezoning these lots for apartments, that they would have to make the request on their own. Discussion oD I-9~5 Mr. Wohlleb brought the rest of the Board up to date on discussions had in Ft. Lauderdale with members of the State Road Department on 1-95. There was a discussion on the needs concerning 1-95, and Mr. ~ohlleb stated that the recommendation of the Board would be that a grade separation, which is presently on their maps, be made at S.W. 23rd Ave.; that the city should initiate it and if necessary go to the county to get a road budgeted for S. W. 15th Ave. to Congress Ave. That the recommendation be for a horsehoe interchange on the east side of N. E. 2nd Ave., and that the entrance enter onto Ocean Ave.; that the west entrance and egress be on 2nd Ave. That a road be com- pleted on N. W. 17th Ave. and request an interchange at that point; a grade separation at Miner Road, also a grade separation at 22nd Ave. Mr. Patrick summed up his discussion with Mr. Frost. He stated that when the Turnpike was being built that the county at that time took emergency measures and built four roads, just to get a road down which was necessary for an underpass. He agrees that something like this should be done now. The problem is the money at the county level. The first 3¢ of gas tax is applied to county commissioners for their use and is being used for the secondary road program. Their other source is from ad valorem taxation. They are authorized to levy up to ten mills for road purposes, but only have levied .272mills. Of this money that is collected, 50% is given in cash when collected in a municipality to the city. They only have one-half of that amount left for their use. 15th Avenue South is now considered a county road. It is possible that money could be budgeted and 'that road built. 17th Avenue North is not a county road, it is a city road. It is possible that the city could request the county to make it a county road from the railroad tracks west to Congress and ask them to con- struct a road. The engineering has been budgeted in the current budget and is now almost completed for Seacrest. Mr. Frost stated that logically the next money appropriated would be spent on Seacrest because this engineering is completed. Mr. Patrick stated that the proper request should be for the city commission to ask the county to Regular MeetinE Planning & Zoning Board February 10, 1966 delay these construction funds, fer .$eaures~i~ when %h~y are available, and to consider doing first 15th Avenue a~d 'then 17th Aven~e. Mr. Frost recommended that the city co~j~ prepare a request in writing of what is needed in Boyn~om B~h and get it te the county commission as soon as possible. He..~ui~ed as to the city's pro- fessional assistance and if there is a master plan and an engineer. He recommended that simultaneously in getting the request to the county comm4ssion, that the city have the master plan brought up to date so that we can show the need from a professional basis. We would then have much better chance of selling the county commissioners in ether districts on our needs. That recommendation should be added te the proposal to city council. Mr. Patrick also talked with Mr. Warren ar~ Mr. Warren explained that the entire amount of money needed to extend 17th out to Congress and to extend 15th out to Congress to get our interchanges, which are priority items, aud to try to get grade separations for 22nd and Miner Road and to tie in with High Ridge Read, wonld be in excess of the entire amount budgeted. Mr. Warren will need the assistance of the other county commissioners. Mr. Patrick stated that if we are to stop a catrastrophe in Boynton Beach that the county commissioners are going to have to find ways and means of getting these roads built He felt the city could not do it. ~ Mr. Wohlleb stated that if it is the wish of the Board, he will work up a rough draft of recommendation and mail it to bhe Board and prepare a final draft for the council. It was suggested that they ~have a special meeting when the final draft is completed. Mr. Boos was in the audience and stated that the council has been advised and alerted of this condition and asked the Board if the council could have this report by the 21st for their meeting at that t~me.
