Th~ meeting was called to order by the Chairman. Minutes of the meeting held March 5, 1984, were read by l~r. ~eaver. ~. 01ds moved the minutes be accepted as read. Er. Effron seconded. Motion carried unanimously. ~PLiCATiO~S ~i~e Public, He. aring for the following item was anuounced: To consider rezoning Of Lots ~, ~6 and BT, Block 4, Boynton Heights, Boo. ton Beach, Florida, according to the plat thereof re- corded in Plat Book 10, Page .64, Palm Beach County RecordS. Request: Fr~m R-~ to C-1 .&ddress: 101 N. W. First Avenue 0wne~: Willi~mH.~Yates. ~r. Tares was present and explained to the Board that all the lots on the block were zoned C-1 except these three; that the lots were ~ feet wide and were zoned commercial by old deed restrictions; that he wished to change the zoning so that he could build a carport to the line on the west. Dr. Raulston, Mr. ~eaver and the other Board members were concerned as to what would be built on the lots at some time in the future if the zoning were changed as requested, particularly, since these lots were just across the street from the Methodist Church. I~rs. Keatts, representing the ~Iethodist Church, said that Mr. Call, attorney for the Church, couldn't attend the hearing, but that the Church would be concerned as to what the next o~ers would build on the lots were the $~oning changed. No other ob- jections were received, either in person or written. -1- After discussion as to the possibility of getting a variance from the Board of Adjustment to allow ~r. ]fates to build, the carport to the line on the west side, Er. Elf ton moved that the matter be tabled until the next regular meeting so that the Board could have more time to look over the facts and study the variance aspects~ IvY. Heari~n~ for the following item was announced: To consider the abando~ument of that certain north-south 50 foot easement lying along the ~est boundary of Boynton Industrial Park, Boynton Beach, Florida, as recorded in plat book ~0, page ~3~, Palm Beach County records. Requested by: C. St~uley ~eaver, President, Boynton Industrial Park, !nc. Earl G. Brown, Seacrest 0il Co, B. W. Nutter, Custom ~Iaid Cabinet Compmuy. Mr. Weaver announced that since he had a Rersonal interest in the property he would disqualify himself. Mr. ~/~olleb took the chair. ~r. Weaver representing a majority o£ the property owners, read a petition for the abandonment of the utility easements along the rear o£ t~he lots. He also read letters from the Florida Power and Li~t mud Southern Bell Tel. & Tel. requesting retention of the east-west easements, and from Florida Public Utilities stating that they had no objection to absndoning all existing ~asements. General discussion followed asto the nec- essity of the easements now ~ud in the fUtUre. ~r. 01ds moved that the Board recommend to Council that they abandon the 12' easement on the South side of Lot 5 running east s~d west, but retain the 12' easement running east and west behind Lots I and 2; also abandon the 8~ easement running east and west on rear of Lots l, 2, 3, and 4 and abandon the V--~ easement running north and south on the West side of Lots 5 thru 12 and along parcel marked ~'not included~ lying between Lots 12 and 13, and 13 thru 2~.; subject~to the approval'of all utility companies. ~f.r.
