The Chairman caIled the meeting to order at V:80 p.m.
Minutes of November 7, 1~6~, and November ll, 1~6~, were read
and unanimously accepted, with no corrections.
The Chairman brought to the attention of the Board the
two requests for change in zoning to be heard, as follows:
.TRACT 1.
Blocks 21, 2~,2~ and Lots i thru V and 1~
thru 20, incl. Block 25, Boynton Ridge, to
be rezoned from R-1 to R-2 and to be used
for duplex dwellings. Application for re-
zoning by William Neinstock~
TRACT
Lot 8, Block ~, Palm Beach Country Club
Estates, from C-1 to R-Z to permit family
dwellio~. AppliCation for rezoning by
Sam and Eartha Kelly.
Regarding Tract 1, Mr. Phi!tip Schlissel, representing
~r. ~einstock, spoke to the Board and those present in the audience,
ms to what Nr. ~einstock planned for the property and strongly
urged the granting of the rezoning. He stated that the duplex
would sell for approximately $8,.000.00 each side; that they would
appear to be a single family residence from the outside; that they
would require a down payment of 10% and the balance under a first
mortgage; that no one person could buy both units as they would be
under condominium; homestead exemption would be $2000.00 on each
side; the application for change in zoning covered about 81 lots.
The Chairman asked that the record show the receipt of a
petition against the rezoning bearing approximately 43 signatures
of property owners in Royal Palm Village, and a letter from
Er. and Nfs. Charles Snyder registering their disapproval. Speak-
ing against the rezoning application were ~r. Charles ClaYPool,
N~o A. Hinniman, Nr. Alfred Denning. in addition to these, when
the Chairman asked all those present who opposed the zoning change
to stand, approximately 3§ people stood wp,
After discussion, Mr. Wohlleb moved that the recommendation
of the Board be that the application for rezoning by Mr. Weinstock
be rejected. N~ Ryd seconded tt~e motion w~ich carried unanimously.
Regarding Tract 2, the application of Sam and ~artha Kelly
for the rezoning o~ Lot 8, BIock 4, Palm Beach Country Club Estates,
from C-1 to R-3, it was broug~ht to the Board's attention that the
applicants wanted to build a three bedroom dwelling on a lot that
was zoned commercial, but that did, in fact, now have private
dwellings all along the bloCk in whieh the lot was located.
Dr. RaUlston moved that since this was a hardship case that the
Board recommend that a non-confoEaing use be allowed on this lot,
because of the location of the property, the surrounding~buitdings,
and the fact that it is an ~rading of the neighborhood.
N~. Keatts seconded ~he motion passed unanimously.
There being no f~rther business the meeting was adjourned
at 9:00 p.m.
