Minutes 02-11-22 Minutes of the Art Advisory Board Meeting Held on February 10, 2022, at 6:30 P.M. In the City Commission Chambers, City Hall 100 E. Ocean Avenue, Boynton Beach, Florida Present: Courtlandt McQuire, Chair Glenn Weiss, Public Art Manager Ace Tilton Ratcliff Marcia Levine Clovis Moodie Cynthia Alexis Hector Velasquez Ellen Jones, Alternate Gregory Hartmann, Alternate Absent: Kelli Drum I. Call to Order Chair McQuire called the meeting to order at 6:31 p.m. a. Roll Call Self-introductions were made. It was announced Kelli Drum would not be present as she was getting married. b. Excused Absence Requests c. Appointment of alternate(s) for absent member(s) d. Agenda Approval or Amendments Mr. Weiss advised he sent out the minutes earlier in the day, but the agenda is the same. Motion Dr. Jones moved to add to Old Business Budget Activities for February and March 2022. Ms. Levine seconded the motion. The motion passed unanimously. II. Approval of Minutes Motion: November 18, 2021 meeting minutes are approved as written or amended. (Ex. A). Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 Motion Dr. Jones noted the following change on page 11, "Mr. Weiss—,Ae noted there were funds for an assistant and there were four finalists. Motion Dr. Jones moved to approve the minutes as amended. Mr. Velasquez seconded the motion. The motion passed unanimously. Motion: December 9, 2021 meeting minutes are approved as written or amended. (Ex. B). Dr. Jones noted the grants manager was supposed to attend the January minutes. Mr. Weiss explained she was but she was not available to come to this meeting. It can be added to New Business. Ms. Levine noted on page 3, Item 4, regarding the Montoya and Ortiz Exhibit, the sentence should read, the pieces may not extend all the way down the Avenue of the Arts. . . . Currently, they are creating a brand new piece to ensure they have the needed scale for the exhibit. Motion Ms. Levine moved to approve minutes as amended. Dr. Jones seconded the motion The motion passed unanimously. II. Informational Items from the Board Mr. Hartmann had a friend in Leisureville who asked if the art center a place for quality venues to bring a show or musical acts and murals for Leisureville as the community is looking to submit a permit and bring an artist into the community to paint one. Mr. Weiss responded in terms of musical shows at the Arts and Cultural Center, they do not have the technology right now, meaning the sound equipment was not there typically found. If a band bought a monitor and speakers, it would fine. Mr. Weiss advised regarding Leisureville, he and Mr. Velasquez met with them and he was waiting to hear from them. He had suggested they wait until the City Commission approved a mural program, which would be addressed next week. Mr. Velazquez explained they hope to address murals and Leisureville would be having a meeting next week at the Beautification Committee and he would lay out what they City decided in terms of participation and guidelines. He already contacted four artists and two artists were interested in coming over to see it. They were looking forward to enhancing the city and their surroundings. They were are they looking to put the murals in four places. One 2 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 is a wall that identifies recreation area number three. They are redoing all their signage at all the entrances to the community. They wanted to improve the look of the clubhouses and some clubhouses have towers. R3 has a pool and a wall that identifies the building. They do not need the identification thee, so they are looking to put a mural there. It is on Congress Boulevard and they were looking forward to working with the City. Last month, Ms. Levine was asked to DJ the Florida Highwaymen show. She reported it looked well attended and she did not know the outcome as far as sales. The art was beautiful. Ms. Levine has been volunteering at all City Friday events and the MLK events and she explained it was a great opportunity to talk to parents and people about art. They are asking what is going on in the City. She did not know if they could put up a booth for them at the first Friday and every other Friday for the movie and/or concert. With one person she can't talk up everything. Last time she had her hands full with tee shirts and could not take names for the newsletter. She asked if they could have another representative there or have another booth that says Art Advisory Board. The Library had a table at pretty much every event. Mr. Weiss responded they could have a booth. Mr. Hartmann had received a tour of the Library by Assistant Library Director, Jeannie Taylor and he noted the Library is a beautiful facility and a great Library. New Board Member Cynthia Alexis introduced herself. She is a vascular stenographer and she dabbles in art and cultural art. Her family is of Haitian descent and her family love art culture, heritage and all they incorporate into their clothing, murals and pottery. She met Mr. Weiss last year and he explained what the Art Advisory Board does for the City how they are developing its concert. Her sister has a salon in Delray and is a board member thee with fashion. She wanted to try to do something here in addition to cultural art from different ethnicities. Dr. Ellen Jones stated she has to leave early for another meeting, but in cities with a fiscal budget that work on fiscal year the way the City does, the period between January and March is usually critical time and excited to hear what will be presented with tonight and how the Board could be proactive in forming the budget for next year and year's out. Mx. Tilton Ratcliff attended an event at the Armory who had their Artist in Residence Show last week, which was a spectacular show. She agreed the Library is beautiful. III. Announcements/Reports A. Actions of City Commission: Feb 2, 2022 a. Mural Ordinance 15t Reading Approved (Ex C) Mr. Weiss explained Exhibit C was not included in the packet. It is very similar to the existing ordinance they have today, but it was removed from the Sign Ordinance section and was given its own section. 3 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 Chair McQuire read the applicable section. Mr. Velasquez inquired what kind of advertising was being done since it appeared they were trying to get the community involved. Mr. Weiss referred the members to the Mural Initiative which requires the program to be advertised. Mx. Tilton Ratcliff queried what the Board does in reviewing and approving murals. Mr. Weiss responded It was in the AIPP Guidelines, under the Mural Initiative, which has three components. No one can put a mural up unless the Board agrees it is a work of art and meets community standards. The AAB supports mural projects like they do with public art. Murals are unique. Mr. Hartmann asked when does the work become a mural on a wall or if there were size requirements. Mr. Weiss responded there is no designation about the size. This does not apply to single-family homes, the State Legislature says there are no regulations on them. b. Pride Street Mural declared a Memorial (Ex D) Mr. Weiss reviewed this item was never declared a work of art and was included on the agenda for informational purposes. Chair McQuire thought declaring the Mural a memorial with a plaque was a tricky tightrope to walk. Once memorialized if a someone wipes out on their dirt bike, they could be prosecuted. He also noted murals are also typically vandalized and tagged as they speak to all walks of life He was apprehensive about it and thought it opened up a Pandora's Box. He supports the mural and its meaning, but dedicating it as a memorial makes an infraction a violation of a new State Law. It was for statutes of Presidents and prominent historical figures. He thought if you apply it to contemporary art it is different. A mural is not meant to be permanent. The City declared it a memorial. The Historic Resource Preservation Board was reviewing the text to be included on the plaque. If it does not have a plaque it does not qualify for the State Penalty. Dr. Jones recognized art to the highest standards, but did not understand the legal implications. She thought they should be educated on it, if the Board would play a role in it. It was noted this did not go through the AAB. As a Board, they could express their concern about creating contemporary mural art that will not last forever. It was never declared a work of art, so it does not fall under the purview of the Board. The Board could express they have concerns about the mural. Dr. Jones thought there would be legal implications memorializing art. Ms. Levine agreed and stated the Board was not involved. But as a group or individually, they have the right and can decide to go to the City Commission to say what they want, now that it was on the agenda, they can speak to the matter and say now that it was declared as a memorial, they have concerns. The AAB has a right to express feelings about it, but and they have no say as a Board because it was not within the Board's purview. Mx. Tilton Ratcliff commented combatting public disorder was conceived to stop people from rioting. There is a strong difference between damage as part of being public art, and art that is willfully and intentionally defaced. Maintenance as a mural will be handled via the General fund. The intersection installation was paid for by Public Works. Mx. Tilton Ratcliff thought there could be a compromise. There may be a location if the City Commission is worried about the intersection being damaged by vehicles because it would not be in an intersection. They can come up with a piece of art or a mural as part of the Mural Initiative because it is not in an intersection. Public art is frequently damaged. Ms. Moodie asked if the mural would fall under the AAB as they adopted the Mural Initiative. Mr. Weiss responded it is not a sign so it would be a mural, but there is no artist. Dr. Jones suggested inviting the City Attorney as the Board expressed concern about their role and legal ramifications the Ordinance. B. Boynton Beach Arts & Cultural Center Exhibitions a. Affordable Art Show Results. ( Ex E) Mr. Weiss reported 14 pieces of art was sold for about $11,000 in total as contained in the meeting backup. b. Black Creativity: til March 26. Artist Reception February 17, 6:30 PM ( Ex E) Mr. Weiss explained this Exhibit was extended to March and it is not invitation only. There is also another event that night for Black businesses on the second floor so they combined the two to celebrate Black artists and entrepreneurs within the City. c. Montoya & Ortiz, Avenue of the Arts: Opens on March 5. ( Ex E) Images of some of the works that will be shown on banners down the Avenue were viewed. The sculptures will be in City Hall and the Art and Cultural Center. There will be nine pieces installed and some in the lobby of City Hall. Chair McQuire requested someone from the Board craft suggestions for placement of the pieces. One is on Federal Highway and the traffic count is 25K trips per day. This is at Ocean Avenue and Federal Highway at the NE corner. There were two pedestals on Federal Highway and Boynton Beach Boulevard and Ocean Avenue used for the Kinetic art show as there was no downtown. Mr. Weiss stated the work is too valuable so they must stay in City Hall, but he would look at them for the future. Ms. Levine asked if Mr. Weiss could put together a small tour and learned the Exhibit will be up until September. (Dr. Jones left the meeting at 7:17 p.m.) Ms. Moodie was looking forward to giving another tour of the new art with one of her groups. Mr. Weiss will arrange for a time and thought al should see their studio in West Palm Beach. . d. Art and Autism Show: Opens April 4 5 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 Chair McQuire announced the above event held . The show is coordinated by the FAU Autism program. It will be on the first floor of the Art and Culture Center when they remove the Black Creativity Show. Mr. Velazquez works with autistic kids teaching them golf and they have a lot of talent. Mr. Weiss will send him the invitation and if any of them are artists, they can send their work to be exhibited. The exhibit will stay up for a month. e. Second Career Artists: Opens April 8 It was noted the two above events will remain for three months and they have different crowds. C. Grants a. NEA ARP ($50,000) Chair McQuire noted this grant was not awarded. b. NEA Visual Arts Grant. Application for Kinetic (Ex F) Mr. Weiss explained they are applying for a $50K Grant for kinetic to match the City's $50K The timing would be perfect s the NEA indicates they can start spending the funds 15 days before the kinetic event. He and the grants writer were reviewing how to couch the event, which involves rethinking it. They should combine gravity and kinetic. Mr. Weiss read from kinetic about the two kinds of energy, objects in motion and potential: Gravity. The kinetic'Biennial will present new art forms that depend on motion as an essential element of the artistic effect. If cannot just be motion for motions sake, it had to be part of the aesthetics. It would engage the Boynton community, its interconnectedness of art and technology through kinetic art and kinetic industrial design. He queried why not have a beautiful industry of kinetic objects that move in the wind that could be part of their thinking. He believed Ms. Coles-Dobay was moving towards this, to be a national resource for kinetic arts. There is no reason what they have done in the past should not be catalogued and clarified in terms of what happened, to be a presenter and documentarian of 20th Century development of kinetic art in sculpture and optical illusion, and build a public art collection. He sent, Under Present New Art Forms, Mr. Weiss sent Beijing Winter Olympic Opening and he spoke to a choreographer to see if they would work with the High School flag court to do a piece that was both visual and motion with the human body in part. Mr. Weiss will continue to speak to the Board in terms of going in new directions in terms of kinetic. Ms. Moodie liked the clarity that was presented to them in the five points as it will help inform them about what they are trying to accomplish. Ms. Levine was sending emails to Mr. Weiss about considering artists. All the members can send ideas and artists to him. Chair McQuire liked the wind turbines. People can buy small wind turbines that generate a fair amount of energy. Mr. Weiss was trying to determine what they can afford to do. They are reaching out to FPL and Next Era Resources and hoped they would fund cool turbines. 6 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 (Mr. Velazquez left the dais at 7:27p.m.) D. ARP Funding Proposal to City Commission: Grants to Artist/Fabricators. Mr. Weiss stated this did not make it into the ARP funding, hopefully Ms. Drum will help raise funds in the schools. E. Boynton Inlet Pump House with Greater Boynton Beach Foundation Chair McQuire commented they are still working on this project. F. AiPP and Private Development. (Ex G) a. Oakwood Square Seating: 35 Artists Applied Mr. Weiss explained things are moving ahead in Boynton Beach. This item was the former Pier One Imports location. They want to remove some parking spaces and create a location to relax in a small seating area, which can be used in part by a small restaurant, should one locate to the plaza. The old SteinMart would become Whole Foods, which was purchased by Amazon. (Mr. Velazquez returned to the dais at 7:30 p.m. and Mr. Hartmann left the dais at 7:39 P.M.) The budget is $20K, but they are spending $40K. Images of concepts and benches were viewed. They are reviewing the applications. There was agreement the location was fine. b. Broadstone Sculpture Locations on Federal Hwy This will be on Federal Highway. Mr. Weiss liked the idea of having a series of significant sculptures on Ocean and Federal Highway to make it a place for people to come to. Two locations were selected by Broadstone for artwork and sculptures. They have about $350K to spend for art. Images of the fagade were viewed and the locations of the art on the plan. They moved trees away from the location to have more visibility,. The locations were acceptable to the Board. C. Bo nton Beach Office Condo at Federal Hwy & MLK Blvd U date Mr. Weiss stated this item just came in and will be on the NE corner of MLK Jr. Boulevard and Federal Highway. It is a very small office building and they have a small budget for art. They proposed a mural. Mr. Weiss recommended the mural not be place high up and fill in the entire area with a mural and make sure there is strong up or down lighting on the property. Palm trees are not permitted and they will need real. Chair McQuire thought aesthetically it seemed like a tight fit and a bit forced. If there are shrubs in front of the mural, it would get lost. He preferred the second option for the corner as it has better pedestrian access, visibility and impact. He noted the budget was 7 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 $41K and he thought perhaps the Frank Hyder piece could go there as the Hyder piece was $3,500. Ms. Levine agreed visibility was an issue with the Taco Bell mural and she cannot see it. The trees would hide the mural there and she wished the trees could be removed or reduced a few feet. There was discussion trees are required, but Mr. Weiss explained he was trying to show these issues now so they do not repeat the mistake. Ms. Tilton Ratcliff liked the bigger piece and asked if the mural could be made bigger. If placing the mural higher, the Oak trees would obstruct it. It would be better to either it be a pedestrian mural, or ask them to do something with a sculpture. Mr. Hartmann thought a mural is the best bet for the funds. Ms. Moodie thought it might be easier to manage a sculpture on the corner. Mx. Tilton Ratcliff asked if they could we assist with other funds for a sculpture. Mr. Weiss thought they could with a legal agreement. Chair McQuire commented the Board favors a corner sculpture piece and potentially fund the artist. Mx. Tilton Ratcliff spoke to the proposed seating on Congress Avenue and thought, like public seating , it be constructed in a way to be hostile to prevent sleeping and would forward information. IV. Action Items Approval of Artist Team and Alternate to NB Hospital Mural (Ex H) Motion: Artist team Koco Collab is approved as the artist for the NB Hospital Mural with Natasha May Pratt is approved as the alternate artist. Mr. Weiss explained this location is the back door to Boynton Beach Community High School which is not the main entrance off Gateway. A high school student can see the mural. The main people to see the mural are patients, staff and the dispensary. Motion Ms. Moodie moved to approve the artist as written. Mr. Velazquez seconded the motion. The motion passed unanimously. Mr. Weiss explained, if possible, if the artist comes first with the seating, rather than the private owner signing an agreement with an artist that may not be appropriate for the City, they would then discuss the mural. Mr. Weiss would like to commission a work from the above artist. Approval of"Artist Wall" Section on Proposed Mural Guidelines (Ex 1) Motion: The Artist Wall and Boynton Beach Art District amendments to the recommended mural guidelines are approved for presentation to the City Commission Mr. Weiss stated he gave the Board's presentation to the City Commission on the 2nd. The Mayor and some other members thought the way the Boynton Art District operated for many years, was going fine. He wanted to see that take place without the artists 8 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 having to coming to the Art Advisory Board with a sketch first so Mr. Weiss created a new section in the guidelines called Artist Walls and they can designate locations as artist walls so artists are free to paint those walls and modify. If the mural violated community standards or laws, the Art Advisory Board can require it be fixed or painted out. Chair McQuire explained the Art District has been there and they paint their garage doors and work spaces. It is a good idea not to get into the nitty gritty of a program they are handling quite well and the idea to do that in another area is good. The guidelines state when someone asks to be designated, they inform the Board how the artist would be selected and how they will be controlling the circumstances. Mr. Hartmann commented when he hears about walls, he thinks about Wynwood and graffiti, which is inexpensive and impromptu. He wondered how well an Art Advisory Board recommendation would be with impromptu art style. He did not want to stifle creativity. Mr. Weiss explained right now, per Code, there are no artists walls approved in the City except through this, and this would say the Boynton Beach Art District is an artist wall and can continue to operate like it is now. Right now, if Public Works put up a wall at City Hall, the Board could say whether the location is good or is not. Chair McQuire commented the art in the Boynton Beach Art District is exceptional and the area is lighted. Mx. Tilton Ratcliff liked the idea. Ms. Levine noted there is a distinction, this is just for the Arts District and understood if anyone wanted to put up a mural anywhere, they could not. Now that the CRA is working with Rolando, would the CRA come to the Art Advisory Board for permission. Mr. Weiss noted that is part of their district, and it is mostly helping to promote the events. Ms. Moodie thought the City would need to designate where the artist wall would go. Mr. Weiss responded the Art Advisory Board would designate walls and other publicly visible surfaces as artist walls. Mr. Velazquez commented the City decides where things will go. On the other side of Industrial Avenue, there are other buildings that may want to enhance their walls. As a Board, any mural has to come before the Board. The area on Industrial Avenue has been doing murals for a long time, so rather than having them come to the City all the time, they will allow them to continue If another area expresses that type of interest, the Board can let that happen again. Ms. Moodie commented the definition does not mention art district and it is generalized. One sections have artist walls, and the second is declaring the Boynton Beach Arts District so they can continue as they are now. Motion Mr. Hartmann moved to approve as written. Ms. Alexis seconded the motion . The motion passed unanimously. Approve Tracy Guiteau for Sara Sims Amphitheater Mural (Ex J) Motion: Artist Tracy Guiteau is awarded the commission to design the Sara Sims Amphitheater Mural. 9 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 Mr. Weiss explained he presented Vice Chair Hay the two artists and he requested the above be commissioned for the work. She will create a panel for the Board to review and approve. Motion Ms. Moodie so moved as written. Ms. Levine seconded the motion. The motion passed unanimously. V. Old Business Fiscal Year 22-23 Budget (Ex K) This item was not discussed. Dr. Jones brought it up and it will be brought up at the March meeting. Mr. Weiss explained at the March meeting, the members have to determine priorities. He will not be present at the meeting, but Veronica Inberg, the new Public Art Coordinator will be present. Chair McQuire noted the Board Elections are coming due, but the City Clerk advised elections will be held in April. The members should think about who would be the Chair or Vice Chair. Chair McQuire requested he meet with Mr. Weiss to review the entire budgetary process. Their budget is $200K in debt, and the City recognizes the Board will pay the money back, so the year will be a lean hear, but the following year would be fully funded. Chair McQuire noted there is a giant apartment building has a $300K budget. He asked if the current Ordinance allow them to spend $200K on art and give the Art Advisory Board $100K. Mr. Weiss explained the project will receive 30% of 1% which is $100K. It was also possible for them to spend less and give the remainder to the AiPP program. VI. New Business None VII. Public Comments Ernest Mignoli, 710 NE 7th Street 407, Harbor Hall Inlet Cove One. Since the Surfside building collapsed, they are noticing similar signs in their 40-year old build. When they approach the City, they are referred to the advisory boards. When they go to the Advisory Board, they are told advisory boards have authority Every single board no matter what they vote, the Mayor and Commissioners do what they want. When they were revising the Sign Ordinance, they appeared and some individuals want to let people in the neighborhoods who have a business put a sign out front. If they are a contractor they want to let them bring their equipment and manufacturing into their house up to 50% of their home. The art as it pertains to the City Commission, is causing a lot of issues in the City. The intersection at Boynton Beach Boulevard and Federal Highway, where the is now in world news. There is as a Benjamin Crump lawsuit, and all the Boards say they have nothing to do with anything. He suggested the Board look at the stadium they just built and look at the colors, some were concerned when this Board was trying to declare this intersection a memorial. He questioned what would happen when kids put bicycle 10 Meeting Minutes Art Advisory Board Boynton Beach, Florida February 10, 2022 skid marks on it, do wheelies and scratch and spray paint it as it would be a federal offense, because Board Member Penserga brought in a team of lawyers to exert pressure on this Board to make the intersection a memorial. He submitted a public records request on the matter and all he got was a bill from the head of the recreation committee that spent $12K to paint it. He contended his request was how did they get the approval to paint over the handicapped and crosswalks. This went through by a Commissioner using his influence in terms of art and how art impacts the City. The thought it was interesting the one Commissioner behind all this art that is very particular and selective and some people believe is prejudiced, has one sign that says it is supported by the Police and now there is a big case that occurred on the 13th, and then the City makes its a memorial. He wanted to see when the first child gets charged with a federal crime. He commented the Commission does not listen to the advisory boards. He claimed the City Attorney and Commissioner want to turn art into politics and no one would stop it. VIII. Future Agenda Items A. Diversity in Public Art Program B.
