90-NRESOLUTION NO. 90- ~ A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA OPPOSING THE EXEMPTION OF THE PALM BEACH COUNTY HEALTH CARE DISTRICT FROM THE PAYMENT OF ANY FEES, TAXES, OR INCREMENT REVENUE TO COMMUNITY REDEVELOPMENT AGENCIES AS ESTABLISHED PURSUANT TO FLORIDA STATUTE 163, PART III, LOCATED IN PALM BEACH COUNTY. WHEREAS, it has been found and declared that there exist in counties and municipalities slum and blighted areas which constitute a serious and growing menace, injurious to the public health, safety, morals, and welfare of the residents of the same; that the existence of such areas contributes substantially and increasingly to the spread of disease and crime, constitutes an economic and social liability imposing onerous burdens which decrease the tax base and reduce tax revenues, substantially impairs or arrests sound growth, retards the provision of housing accommodations, and WHEREAS, that the prevention and elimination of slums and blight is a matter of state policy and state concern that counties and municipalities shall not continue to be endangered by areas of the same and consume an excessive proportion ~of the municipalities revenues because of the extra services required for police, fire, accident, hospitalization, and other forms of public protection, services and facilities; and that certain slum or blighted areas or portions thereof, may require acquisition, clearance, and rehabilitation to be eliminated, and WBRREAS, the Florida legislature permitted the creation of Community Redevelopment Agencies as contained in Chapter 163, Part III, Florida Statutes, and WHEREAS, the City of Boynton Beach, Florida, pursuant to the Florida Statutes, Section 163.387, in 1983 has established a Community Redevelopment Trust Fund for the upgrading and redevelopment of its slum and blighted areas; and WHEREAS, public monies may be expended in the public interest for the purpose of preservation and enhancing the public health and safety, and WHEREAS, the State legislature did not authorize or grant taxing powers to the Community Redevelopment Agencies but rather provided that taxing authorities as provided by law appropriate funds to the Community Redevelopment Agency Redevelopment Trust Fund in order to preserve and enhance the redevelopment of the Agency areas, and W~F. REAS, that without the finding of the trust fund with tax increment financing through the taxing authorities, the clearance and/or rehabilitation of deteriorated, slum and blighted conditions may continue to escalate and endanger the public health and safety. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF BOYNTON BEACH, FLORIDA, AS FOLLOWS: Section 1. The City of Boynton Beach opposes any act amending Section 3 of the Palm Beach County Health Care Act, Chapter 87-450 as amended by Chapter 88-460, Laws of Florida; providing for an exemption from the payment of taxes, fees or increment revenues to Community Redevelopment Agencies created pursuant to Florida Statute, ChaPter t63, Part III. ~e~tion 2.~ The City of Boynton Beach opposes any actio~ ~ the ~tate legislature to amend Florida Statute 163 to exempt the Palm Beach County Health Care District from the Payment of increment finances to Community Redevelopment Agencies.
