Minutes 03-16-22 MINUTES OF THE COMMUNITY STANDARDS SPECIAL MAGISTRATE CODE COMPLIANCE/LIEN REDUCTION HEARINGS HELD IN THE CITY HALL COMMISSION CHAMBERS, 100 E. OCEAN AVE. BOYNTON BEACH, FLORIDA, ON WEDNESDAY, MARCH 16, 2022, AT 9 A.M. PRESENT: Hilary Zalman, Esq., Community Standards Special Magistrate Vestiguerne Pierre, Community Standards Supervisor Candace Stone, Director, Community Standards Tanya Guim, Administrative Supervisor Community Standards Charnice Harrison, Community Standards Associate Jennifer Oh, Recording Secretary, Prototype, Inc. I. CALL TO ORDER Hilary Zalman, Community Standards Special Magistrate, called the Hearings to order at 9:011 a.m. and explained the Magistrate's role and the procedures. Pursuant to Chapter 162, Florida Statutes, all orders are appealable only to the Circuit Court in Palm Beach County and not to the City Commission. Also, a fine will be imposed if the violation(s) are not corrected by the deadline. II. INTRODUCTION AND SWEARING IN OF WITNESSES Administrative Supervisor Guim administered an oath to all those intending to testify. III. CHANGES TO THE AGENDA Item Case No. Status IV. NEW BUSINESS Lien Reduction Hearing Case No. 16-0829 Williams Doris E. EST Property Address: 221 NE 10th Avenue Property Violation(s): As stated below Supervisor Pierre presented this case. The Notice of Violation date was May 2, 2016. There was a Special Magistrate Hearing on July 20, 2016, and no one appeared. A compliance date was scheduled for July 30, 2016, or a fine of $200 per day. The Respondent complied on April 14, 2021. There are 1,718 days of non-compliance at$200 per day. The total amount of fines is $344,234.12. This property has a surplus in the Meeting Minutes Community Standards Special Magistrate Hearings Boynton Beach, Florida March 16, 2022 amount of$54,579.08, which was credited to the City. This is a CRA property. The City's recommendation is about 10% of the $54,579.08 surplus. Theresa Utterbach, with Boynton Beach CRA, was present. Ms. Zalman commented that the City's recommendation is for 10% of the surplus amount, which would be $5,457.91. Ms. Utterbach indicated they are fine with that amount. Ms. Zalman agreed to the evidence presented by both sides. An Order will be entered to reduce the lien to $5,457.91. This has to go through the City Commission for approval and the Order will be received in a few weeks. This amount must be paid within 90 days, or it reverts to the full amount. Decision Based on testimony, Ms. Zalman reduced the fine to $5,457.91, payable within 90 days or the fine reverts to the full amount. This item concluded at 9:57 a.m. V.
