87-BBBB ASSESSING THE COSTS OF ABATEMENT OF CERTAIN NUISANCES AGAINST THE OWNERS OF THE PROPERTY INVOLVED, AND FOR OTHER PURPOSES. WHEREAS, the City Manager or his designated representative of the City of Boynton Beach, Florida, acting on and in behalf of the City, has pursuant to Section 5-182 of the Code of the City of Boynton Beach, found and determined that the condition of certain property or parcels of land as hereinafter described violates Section 5-173 of said Code by reason of the existence of buildings or structures which by reason of fire, age, decay, deterioration, structural defects or unstable foundation create a menace to the public health, a fire hazard, or so unsafe as to endanger life or property or render the use of public streets dangerous, thereby constituting a nuisance; and W~RREAS, the owners of the parcel of property hereinafter described were duly notified in accordance with Section 5-183 of the City Code and were required to abate the nuisance; and WHEREAS, said nuisance was not abated as required; and WHEREAS, pursuant to and in accordance with Chapter 5 of the Code of the City of Boynton beach, the City abated said nuisance; and W~.REAS, the City Manager has made a report of costs actually incurred by the City and abatement of said nuisance as to the property involved, which is hereinafter described. NOW, THEREFORE, be and it is hereby resolved by the City Commission of the City of Boynton Beach, Florida-that: Section 1. That the amount of costs incurred by the City and the abatement of the above described nuisance as to the parcels of land, owned and indicated to wit: Name & Address John P. Chaikin, Trustee c/o W. Ward Aksonitas 1655 Palm Beach Lakes Blvd. West Palm Beach, FL 33401 Location 110-116 Martin Luther King, Jr. Blvd. PALM BEACH COUNTRY CLUB ESTATES, Block 5, Lots 3 & 4 Amount $12,750.00 732.46 6,920.55 $20,403.01 (Demolition) (fencing) (fire-fighting) TOTAL AMOUNT OF LIEN Subject amount is hereby assessed as a lien against said parcel of land as indicated, said lien as to said parcel of land shall be of equal dignity with the taxes therefrom for the year 1987 and shall be enforced and collected in like manner pursuant to applicable provisions of law. Section 2. That the City Clerk be and she is hereby directed to record a certified copy of this Resolution in the Office of the Clerk of the Circuit Court in and for Palm Beach County, Florida. Section 3. That such lien shall bear interest from six months after the date that they have been filed in the Official Records Books of Palm Beach County, Florida, at the rate of eight (8%) percent per annum until fully paid. Section 4. That the City Clerk be and she is further directed to notify, by certified mail, the registered owners of the parcels of land named hereinabove, of the assessments of the lien on their property. Section 5. That this Resolution shall take effect immediately upon its passage. PASSED AND , 1987.
