A. Call to Order - Mayor Ty Penserga
Mayor Penserga called the meeting to order at 6:00 P.M.
Roll Call
City Clerk Maylee De Jesus called the roll. A quorum was present.
Invocation by Commissioner Woodrow Hay
Invocation was given by Commissioner Hay
Pledge of Allegiance to the Flag led by Mayor Penserga
Mayor Penserga led the Pledge of Allegiance to the Flag.
B. Closed Door Session
As publicly requested at the November 14, 2022 City Commission Meeting and in
accordance with Section 286.011(8) Florida Statutes, the City Commission will hold
a closed-door, private attorney-client session on Thursday, December 15, 2022
beginning at 6:00 p.m. to discuss the following case:
CITY OF BOYNTON BEACH, a Florida municipal
corporation, Plaintiff, vs. JKM BTS CAPITAL, LLC,
Defendant - Palm Beach County Circuit Court
Case Number: 50-2020CA012780-XXXX-MB
In attendance will be the City Attorney Michael D. Cirullo, Jr., Special Litigation
Counsel Thomas Baird, Special Litigation Counsel Joanne O'Connor, City Manager
Daniel Dugger, a Court Reporter, the Mayor and City Commission. Some

Michael Cirullo, City Attorney, read the title of the case into the record.
Mayor Penserga called for a recess for the Closed-Door Session at 6:03 P.M.
C. Resume the Special Meeting
Mayor Penserga reconvened the meeting at 6:56 P.M.
Attorney Cirullo asked for a motion to place this item on the January 3, 2023
Commission Meeting.
Motion
Commissioner Hay moved to place the item on the January 3, 2023 Commission Meeting.
Commissioner Turkin seconded the motion. The motion passed unanimously.
Commissioner Turkin asked for all relevant resources for this meeting and that we
advertise this to the public.
Daniel Dugger, City Manager, asked if they would like it on social media.
Mayor Penserga responded that they should do whatever it is that we normally do to
communicate this to the public.
2. Adjournment
Motion
Commissioner Kelley moved to adjourn the meeting. Commissioner Hay seconded the
motion. The motion passed unanimously.
There being no further business to discuss, the meeting was adjourned at 6:58 P.M.
