A. Call to Order - Mayor Ty Penserga
Mayor Penserga called the meeting to order at 5:30 P.M.
Roll Call
City Clerk Maylee De Jesus called the roll. A quorum was present.
Invocation by Commissioner Woodrow Hay
Invocation was given by Commissioner Hay
Pledge of Allegiance to the Flag led by Vice Mayor Angela Cruz
Vice Mayor Cruz led the Pledge of Allegiance to the Flag.
B. Closed Door Session
As publicly requested at the November 1, 2022 City Commission Meeting and in
accordance with Section 286.011(8) Florida Statutes, the City Commission will hold
a closed-door, private attorney-client session on Tuesday, November 29, 2022
beginning at 5:30 p.m. to discuss the following case:
E2L REAL ESTATE SOLUTIONS, LLC., Plaintiff, vs, CITY OF BOYNTON BEACH;
JKM DEVELOPERS, LLC; JKM BTS CAPITAL, LLC; JKM BTS NORTH, LLC; JKM
BTS CENTRAL, LLC; JKM BTS SOUTH, LLC, Defendants — Palm Beach County
Circuit Court Case Number: 50-2022-CA-006010-XXXX-AA
In attendance will be the City Attorney Michael D. Cirullo, Jr., Special Litigation
Counsel Kathryn Rossmell, Special Litigation Counsel Amy Petrick, City Manager
Daniel Dugger, a Court Reporter, the Mayor and City Commission. Some
participants may attend telephonically or by communications media technology
(CMT). Approximately 60 minutes will be needed.

Mayor Penserga called for a recess for the Closed-Door Session at 5:37 P.M.
C. Resume the Special Meeting
Attorney Cirullo reconvened the meeting at 6:14 P.M.
2. Adjournment
Motion
Vice Mayor Cruz moved to adjourn the meeting. Commissioner Hay seconded the motion.
The motion passed unanimously.
There being no further business to discuss, the meeting was adjourned at 6:15 P.M.

Attorney Cirullo stated that they will contact Council and have the meeting added to the
next Commission Meeting.

Motion
Commissioner Kelley moved to adjourn the meeting. Commissioner Hay seconded the
motion. The motion passed unanimously.
There being no further business to discuss, the meeting was adjourned at 6:42 P.M.
