AN ORDINANCE OF THE CITY OF BOYNTON
BEACH, FLORIDA, AMENDING SECTION 12-1
OF THE CODIFIED ORDINANCES OF SAID CITY
PERTAINING TO FIRE PREVENTION; PROVIDING
FURTHER FOR AUTHORITY TO CODIFY, A SAVINGS
CLAUSE, REPEALING PROVISIONS, PENALTY
PROVISIONS, AN EFFECTIVE DATE AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BOYNTON BEACH
? LORIDA:
SECTION 1: That Section 12-1 of the Codified Ordinances of
~he City of Boynton Beach be, and the same is hereby amended to read:
"Sec. 12--1: ~Adoption of Fire Prevention Code - There is
hereby adopted by the City for the purpose of prescribing
regulations governing conditions hazardous to life and
property from fire or explosion, that certain code known
as the Fire Prevention Code recommended by the American
Insurance Association, including all revisions thereof made
from time to time, save and except such portions as are
hereinafter deleted, modified or amended, of which code
not tess than three copies have been and are now filed in
the office of the Clerk of the City and same are hereby
adopted and incorporated as fully as if the same were set
out at length herein, and from the date on which this
article shall take effect, the provisions thereof shall be
controlling within the limits of the City."
SECTION 2: Separability. Each of the provisions of this
)rdinance are separable including word, clause, phrase, or sentence, and if
~ny provision hereof shall be declared invalid, the remaining portion shall not
~e affected but shall remain in full force and effect.
SECTION 3: Repealin~ Provisions, All Ordinances or parts
~f Ordinances in conflict herewith are hereby repealed.
SECTION 4: Authority to Codify: Specific authority is hereby
ranted to Codify and incorporate this Ordinance inthe City's existing code.
SECTION 5: Penalty Provisions. Any person, firm or
orporation violating any of the provisions of this section shall, upon conviction
hereof, be fined in an amount not exceeding ninety (90) days, or by both such
'ine and imprisonment. Each day such violation is committed or permitted to
:ontinue shall constitute a separate offense and shall be punishable as such
lereunder.
SECTION 6: Effective Date. This Ordinance shall become
!effective at the time and in the manner prescribed in the Charter and
Ordinances

Memorandum on Publication of Standard~
The fire protection engineering standards heretofore
~adopted and published by the National Board of Fire Underwriters
with the designation "as recommended by the National Fire. Pro-
tection AssoCiation" will not be published by the American Insurance
A s sociat ion.
These standards are ~vailable from the NFPA and it is
considered that our continual publication of them would be an
· unnecessary duplication of effort. The NBFU standards now on hand
will be available until the supply is exhausted ·
The Fire Prevention Code and the National Building Code
activity of the National Board of Fire Underwriters is to be con-
tinued by A. '.I.A. We are pleased to note too that no change is
contemplated ~with respect to the other technical activities and
~publications carried on previously by the National Board of Fire
Underwriters and the Assoclat'lon of Casualty & ~urety Companies.

s~ock insurance business has used NFPA
standards for many years and the fact that the A.I.A. will not
~publish them does.not mean a change in this practice.

The attached reprint from the November issue of the
Fire Services Magazine will be of interest to you. In this
article, Warren Y. Kimball, Manager of the Fire SerVice Depart-
-meut of the National Fire Protection Association takes a searching
look at the Municipal Grading Schedule.
This may well be the last communication you will re-
ceive from us on the letterhead of the National Board of Fire
Underwriters. After January l, our letterhead will carry the
name of American Insurance Association, an association of in-
surance companies created from au amalgamation of the Association
of Casualty and Surety Companies, the National Board of Fire Under-
writers and the American Insurance Association. Under its new
name, this organization continues its interest lu municipal fire
protection and the many problems relating to fire and fire pro-
tec t ion engineer iug..
In the future, the National Board's Engineering
Department will operate as the Engineering and Safety Department
of the American Insurance Association. The staff continues as
before and the warm relationship which has existed in the past
between municipal authorities, the fire services and the euglueer-
lng staff of the National Board will continue uninter~uped as we
begin the new year under our new name.
