project entails improvements to existing site amenities, landscape, facade renovation to two

requested that at time of permitting, we shall submit a copy of waiver approval from the
Engineering Division for the loading zone or revise plans to include the required loading zone

Regarding the 15 royal palms in front of 1301 w Boynton Beach Blvd, FPL would like to pursue removal
of all the palms at no cost to the customer. Removal of the palms can be done within one month. These
palms have been identified as critical due to their proximity of both FPL distribution and transmission
facilities. Removing these palms would eliminate safety and reliability concerns that trimming cannot
provide on a long term basis. Furthermore, to answer the question regarding the possibility of
relocation, this will not be possible for the reason that it would require a scheduled outage to more than
1,000 customers in order to safely operate a crane near the facilities.
Replacement of the removed vegetation is not FPL's responsibility. The customer should work with the
city to satisfy their requirements. If the customer is required to replace the removed palms please
forward them to FPL's Right Tree Right Place
website http://www.fpl.com/residential/trees/right tree right place.shtml. Here, they will find FPL
approved guidelines for tree planting near power lines.
In review, FPL will remove the 15 royal palms in front of 1301 w Boynton Beach Blvd, at no cost to
the customer. The customer's cooperation is much appreciated in helping FPL achieve a more safe
and reliable power delivery to the community.

IMPORTANT NOTICE - IMMEDIATE ACTION REQUIRED
At FPL we are committed to providing safe, reliable electric service to all of our customers. A single tree
condition that interferes with FPL power lines has the potential to disrupt service to many customers.
A Vegetation Management Specialist has identified a tree or palm conflict that cannot be effectively maintained
by pruning. The immediate removal of this condition is necessary to ensure safe and reliable electric service to
our:customers, as mandated by the National Electric Safety Code and defined by the Florida Public Service
Commission.
Due to the location and aggressive growth rate of this tree, removal is the only, effective option to ensure the
highest quality of energy delivery. Pruning will not remedy the threat of service interruption and the potential to
impact public safety or property. FPL is providing this notification to arrange for the removal of this vegetation
conflict.
Please sign and promptly return this form to FPL's Vegetation Management Department so a Specialist can
contact you to schedule the removal of the tree(s) or palm(s) described below. This work will include the clean
up and disposal of all debris and is performed at no cost to the customer. Please do not attempt to maintain any

Please find herein our response to comments from the Permit Drawing Submittal Revision (#14-
0173). Our review has been formatted to include your comments, which are immediately
followed with our response.
Engineering/Public Works/Forestry/Utilities
Comment: I —At time of permitting,correct the western access drive from
Boynton Beach Boulevard on all civil, tree disposition, and
landscape plan sheets to indicate one (1) right-in lane and one(1)
right-out lane(no left tum due to median). Align proposed striped
median and inbound and outbound traffic drive aisles accordingly.
Response: Revised, the western access drive has been revised.
Comment: 2 - At time of permitting,revise Sheet TS-3 to tabulate the total
number or diameter inches of existing trees on the site proposed
to be preserved in place, relocated, or removed and replaced
diameter inchesi on the site, and indicate all replacement trees
with a separate symbol on the landscape plan.
Response: As per meeting with Kevin Hallahan on 06//10/20/5, he is in agreement
with the following response: Please see revised Sheet TS-3 showing
tabulation with the number of diameter inches existing, removed,
remaining and proposed palms and trees. Please see landscape plans
LP-I thru LP-4 indicating the trees used for mitigation as requested by

Comment: 4 -At time of permitting, revise landscape plans and tree
disposition plans as follows:

Response: As per meeting with Kevin Hallahan on 06//10/2015, he is in agreement
with the following responses:
a. Royal Palms 1111 and 12 have been removed in coordination with the
City of Boynton Beach due to the conditions for relocation becoming a
hazard. Mitigation has been proposed with palms and trees shown on LP
sheets attached
b. Mitigation for all trees is shown on sheet TS-3 and plant list on sheet
LP-4
c. Trees 51-59 are shown to be removed and mitigation has been
provided in the proposed landscape plans. Please see mitigation table on
sheet TS-3
d-e Coordination with the City of Boynton Beach, FPL and the client
has been done for the removal of the Royal palms along Boynton Beach
Blvd. Please refer to attached Narrative regarding the existing Royal
Palms.
f Trees 85-86 are shown as remaining in tree disposition table on sheet
TS-3
g. Trees 101-113 are shown as remaining on landscape plan and as
remaining in tree disposition table on sheet TS-3
Comment: 5- At time of permitting, revise landscape plans to indicate where
the 15 Royal Palms are to be relocated on the site.
Response: 15 Royal Palms are being removed per coordination with the Landscape
Department at the City of Boynton Beach and FPL. Please see attached
letter from FPL.
Comment: 6- At time of permitting,revise landscape plan to include a 25 foot
safe sight triangle and provide mature plant/tree size for all plant
material within the 25 foot safe sight triangle,verifying that all will
be within the guidelines for plantings within the 25 foot safe sight
triangle,especially cross visibility at maturity.(Ch. 4, Art. II Sec.
4.A.14.a. of the LDR)
Response: 25 foot sight triangles are shown at both entry driveways. Proposed
planting Complies with guidelines and cross visibility at maturity with
Ch. 4, Art. II Sec. 4.A.14.a. of the LDR
Comment: 7- At time of permitting, submit an Irrigation Plan that follows the
Florida Friendly-Waterwise principles using water saving
components.
Response: Existing Irrigation system to be patched and repaired to work with the
updated landscape areas as required
Police
Comment: 8— Prior to issuance of the building permit, the applicant shall
prepare a construction site security and management plan for
approval by the City's Police Department CPTED Official.
Response: As per meeting with Officer Rachel Loy from the Crime Prevention Unit
of the Boynton Beach Police Department on June 17,2015, we have
added notes to sheet 5100 to address her comments.See attached
construction site security plan, sheet S-/00 for location of barricades
and lockable gates, and notes as per meeting. Also, please refer to sheet
A100 for scope of site work
Comment: 9 — Security measures at a construction site are determined
after a security survey is conducted using the following
procedures: a staging area to store equipment and park
machinery must be fenced. The staging area must be visible
from an accessible roadway to allow effective police patrol.
Lighting must be provided to allow complete visibility to the area.
Approved padlock for all storage trailers and equipment trailers
and park within staging area.
Response: Contractor intends to use plastic jersey barriers to barricade off west
driveway entrance and barricade east side entrances/boundaries of
intended scope of work. Existing site lighting is to be maintained which
will provide a well-lit area during night hours. All equipment/machinery
will be stored within barricaded areas. Storage containers should not be
required for this scope of work however if one is used the approved
padlock will be utilized.
Comment: 10 — At time of permitting, revise plans to ensure there is no
conflict with outdoor lighting and long-term tree canopy growth.
Timer clock or photocell lighting for nighttime use shall be above
or near entryways.
Response: Long-Term tree canopy growth is reflected on the Landscape plans to
ensure there is no conflict with outdoor lighting.
All site lighting shall be controlled via photocell. See note 3 on E-200
regarding photocell option (no change to drawing).
Comment: 11 —At time of permitting, revise plans to indicate
pedestrian scale lighting shall be used for all street and
pedestrian walkways, with interactive or lighting on demand used
in sensitive areas.
Response: Lights will be on at all times at night, controlled by photocelL All areas
have been lit per code. Rear of building has existing lighting not in the
scope of this work, existing to remain. There are no sensitive areas that
do not have light at all times during the night. No changes have been
made to drawing regarding this comment.
As per conversation with Steven Bender from Delta G and Kathy Zeitler
on June 15, 20/5; the above response satisfies the Conditions of
Approval.
Planning& Zoning
Comment: 12—At time of permitting, submit a copy of waiver approval
from the Engineering Division for the loading zone or revise plans
to include the required loading zone for proposed Building"C".
Response: As per meeting with Franz LaFontant on 6/10/2015; the city will accept
to have the loading zone in the lane used as drive-thru; however,
deliveries must be done prior to any other tenant hours of operation.
Owner will be submitting a letter from the tenant and a signed and
sealed letter from the tenant architect explaining how deliveries will be
accomplished.
Comment: 13—At time of permitting note on plans that all rooftop
equipment must be completely screened from view at a minimum
distance of 600 feet(per Ch 4,Art Ill, Sec.A.9.a.)
Response: Revised Please refer to sheet A-WO for note. Refer to sheet A-204 and
A-205 for partial roof plans showing mechanical equipment location,
existing roofframe with proposed screen mesh. Refer to section 2 on
sheet A-204 for sight line section showing location of existing roof top
mechanical equipment and existing roofframe with proposed screen
mesh. Existing equipment at Building A is located at the ground level
rear of the building.
Comment: 14—At time of permitting, revise plan sheets for proposed
Building "C" building elevations to identify added decorative
features such as medallions,including color and materials.
Response: To be submitted as a separate construction permit by tenant architect.

Comment: 15—At time of permitting revise landscape plan to note that
existing landscape buffer wall shall be maintained with a neutral
color that is consistent with the new color palette for the shopping
center.

buffer wall shall be maintained with a neutral color that is consistent
with the new color palette for the shopping center. Refer to elevations for
building "A", A300 and A30I: and building "B"A300 for revised color
elevation legend to include metal canopies colors and awnings colors.

Comment: 16—At time of permitting revise site plan and landscape plan to
indicate and label the existing monument sign near the eastern access
drive.
Response: See landscape plan indicating and labeling sir exLsting monument sign near
the eastern access drive. Note has been added on sheet A-I00.
Comment: 17—Prior to permitting,submit a revised Master Sign Program
to Planning& Zoning for approval that integrates the new facades
and color palette for the shopping center, and the new tenant
for proposed building(including menu board).
Response: To be submitted as a separate construction permit by tenant architect.
Building "C"color palette and menu board will be submitted for review
and approval.
Comment: 18—Prior to permitting, provide details of proposed mufti-tenant
wall signage,including sign dimensions, font,colors, and sign face
area per sign. Per the Community Design Plan requirements of the

LDR,only one(1) type of sign and (1)font/fettering style is
permitted.
Response: Has been submitted and reviewed by zoning.
Comment: 19—Any signage for proposed Building "C" that is visible from
adjacent property to the north shall be non-illuminated so as to
minimize impacts to adjacent residential properties.
Response: To be submitted as a separate construction permit by tenant architect.

Comment: 20—The Florida Royal Palms along Boynton Beach Boulevard are
very close to FPL power fines. At time of permitting, revise
landscape plans to indicate all existing and proposed Royal Palms
along Boynton Beach Boulevard shall be relocated elsewhere on site
and replaced with a native species of canopy tree(with a minimum 4-
• inch caliper) that complies with the FPL "Right Tree, Right
Place" guide and City landscape standards.
Response: Royal Palms along Boynton Beach Blvd are being 'removed per
coordination with the Landscape Department at the City of Boynton
Beach and FPL. Please see attached letter from FPL.
Comment: '21—At time of permitting,revise landscape plan to include a canopy
tree in between each existing tree that is no longer Florida No. 1
quality to screen adjacent residential properties from view above
the 6 foot buffer wall.
Response: Please see Landscape plan for new trees between existing trees that are
no longer Florida No. 1
Comment: 22—At time of permitting, revise landscape plan to provide
required foundation landscaping for proposed Building "C" by
adding trees or palms (proportional to building height) and
shrubs along the west side,and a planter(a minimum of 5 feet
wide) in paver area on the east side of the building.
Response: To be submitted as a separate construction permit by tenant architect.
Building "C"landscape plan will be revise to comply.
Comment: 23—At time of permitting,revise landscape plans to propose trees
and colorful shrubs for all planters in paver areas on south and
east building elevations of proposed Building "C"to comply with
foundation landscaping requirements.
Response: To be submitted as a separate construction permit by tenant architect.
Building "C"landscape plan will be revise to comply.
Comment: 24—At time of permitting revise landscape plan to propose a 12-14
foot Traveler's Palm or White Bird of Paradise Palm midway on
north side of proposed Building"C"to break up the large expanse
of blank wall and continuous hedge.
Response: 6 Solitaire palms are being proposed instead per DRC coordination with
the City of Boynton Beach. to break up the large expanse of blank wall
and continuous hedge.
Comment: 25—At time of permitting revise landscape plan to relocate the
proposed trash receptacle to the east facade of proposed Building
"C" near the side door to reduce conflict with handicap
accessibility and outdoor seating.
Response: To be submitted as a separate construction permit by tenant architect.
Building "C"landscape plan will be revise to relocate the proposed trash
receptacle.
Comment: 26—At time of permitting, revise photometric plan site layout to
match new parking and landscape island designs indicated on other
plan sheets.
Response: Photometric plan has been revised to match site plan layout. See revised
drawings E-100.
Comment: 27—Staff recommends that the audio component of the menu board
related to the drive-through facility project sound to the east,
rather than north,in order to mitigate any potential negative
impact to the residential neighborhood to the north. Sound levels
shall be monitored and if sound levels are found to exceed sound
limitations of the code, the owner or operator shall either reduce
the amplification level to comply with city sound limits,or apply
additional sound mitigation measures to accomplish same.
Response: To be submitted as a separate construction permit by tenant architect.
Building "C"landscape plan will be revise to comply.
Comment: 28. At time of permitting,revise plans to indicate all existing
dumpsters for the shopping center shall be completely screened in
compliance with City requirements,and all dumpster enclosures
shall be painted to match a neutral color used on the new color
palette for the buildings.
Response: Revised, color note has been added on sheet A-201 Trash enclosure
Elevations/Details on the Site permit. Also, refer to sheet LP-1 for
landscape screen of trash enclosure.
Comment: 29. At time of permitting,revise plans to extend the pavered
walkway in front of Building "B" to include the area designated
for parallel parking on each side of the striped pedestrian
walkway, thereby eliminating two (2) parallel parking spaces and
providing additional safety for pedestrians.
Response: Revised,please refer to site plan.

pedestrian scale lighting shall be used for all street and
pedestrian walkways, with interactive or lighting on demand used
in sensitive areas.
Response: Lights will be on at all limes at night, controlled by photocell. All areas
have been lit per code. Rear of building has existing lighting not in the
scope of this work, existing to remain. There are no sensitive areas that
do not have light at all times during the night. No changes have been
made to drawing regarding this comment.

Comment: 12—At time of permitting, submit a copy of waiver approval
from the Engineering Division for the loading zone or revise plans
to include the required loading zone for proposed Building"C".

limitations of the code, the owner or operator shall either reduce
the amplification level to comply with city sound limits,or apply
additional sound mitigation measures to accomplish same.

The owner of the property has attempted to engage several companies who
might be interested in removing and relocating the existing Royal Palms to
other properties. Various "Plant Finders" or specimen tree finding
companies are all of the same opinion. The Royal Palms are too tall, as
well as being in poor condition to be moved safely. The combination of poor
tree condition, age of the palms, and close proximity to the power lines all
create a situation which does not justify the relocation of these palms. We
feel this creates an un-safe condition for the tree movers as well as for
residents or pedestrians in the area of the trees re-location spot, due to the
inability of an aged palm of this height and condition to adequately develop
a new root structure to support the height and weight of the trunk of the
palm.
Please see the attached letter from Mr. Richard Wilson, one of the
foremost plant specimen source individuals in South Florida:
We request that these palms be removed and that we mitigate them with new
material on the site.

All Interested Parties:
Concerning the Royal Palms at 1301 through 1303 Cross Creek Plaza.
I have inspected the Royal Palms at this property for the last two years.
Florida Power and Light is requiring these trees to be removed due to proximity of
main power lines. I have attempted to give these trees away with no response.
The Royals on this property are at near maximum height. To move these trees
would be dangerous due to their proximity to major power lines and the
necessary movement with a crane to free the root ball. Transportation of these
trees would be extremely expensive, because they exceed the length limit on the
highway. It is my opinion that the palms are at near life end and not worth the
cost of moving.
Florida Power and Light wants the trees removed due to their proximity to power
lines and damage they may cause in a high wind. The same rational applies to any
future sight on the property, near any buildings. The trees will most likely never
develop a root system capable of supporting these tall trees when moved. This
will produce a hazard to the real property at the sight.

• Art Commission must approve public artist selected for project art or Public Art Administrator
will assist to create and publish a "Call to Artists" for the project's public art component.
• Approval from Arts Commission required prior to City,Commission approval of site plan.
• Payment of 30% of the 1% fee is required at time of permit issuance.
• Evaluation for the 70% of the 1% fee at time of Certificate of Occupancy that includes the Public
Art, per Ordinance 07-002.
• 70% of the 1% will be collected if 50% or less completion of Public Art, as approval by Arts
Commission. Temporary Certificate of Occupancy will be granted and completion date
