Section 2. The Mayor and City Clerk are hereby authorized and directed
to execute and deliver the attached Disclaimer and cause the same to be filed in
the Public Records of Palm Beach County, Florida.
Section 1. The City Commission of the City of Boynton Beach, Florida
by and through its City Commission, does hereby abandon the following two
street rights-of-way: (1) a right-of-way segment dedicated to the City by the
plat of Subdivision of Section 19, as in Plat Book 7, Page 19 of the Public
Records of Palm Beach County, Florida; and (2) a street right-of-way segment
dedicated to the City by the plat of Palm Beach Farms Company No.8, as
recorded in Plat Book 5, Page 73, Public Records of Palm Beach County, Florida,
and more particularly described in Exhibit "A" attached hereto.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION
OF THE CITY OF BOYNTON BEACH, FLORIDA THAT:
WHEREAS, based on the foregoing information, the said rights-of-way
no longer serve any useful purpose.
WHEREAS, comments have been solicited from the appropriate City
Departments, and public hearings have been held before the City's Planning and
Development Board and the City Commission on the proposed abandonment;
and
WHEREAS, J. Robert Bray of Wal Mart Stores East, Inc., is requesting the
abandonment of the following two street rights-of-way: (1) a right-of-way
segment dedicated to the City by the plat of Subdivision of Section 19, as in Plat

Chairman Wische polled the Board and there was a consensus to request that
Wah~i"Mart be asked to add fountains to their project. Mr. Myott said that there is
an impact fee on building permits, that is a fee for art in public places. Mr.
Rosenstock said these fees go to other places in the County and not to the cities.
Mr. Myott said that the City of Boca Raton has a median improvement surcharge.
